Prayers and lessons in English in court martial

It is clear to those who have closely followed the court martial of 28 officers allegedly involved in the February 2006 alleged withdrawal of support from Gloria Arroyo that the panel headed by Maj. Gen. Jogy Fojas is following the prosecution’s script that Maj. Gen. Renato Miranda and his fellow accused officers be arraigned, by hook or by crook, before Feb. 26, 2008.

That’s because if the accused are not arraigned by Tuesday next week, two years from the commission of the alleged offense, the charge of “Conduct Unbecoming of an Officer and Gentleman” (violation of Articles of War 96) would prescribe and the case would be automatically dropped.

The remaining major charge would be mutiny which was recommended to be dismissed by the team from the Judge Advocate Office the investigated the February 26 incident “for lack of factual and legal bases.”

Last Wednesday, no arraignment took place in the eight-hour hearing despite the fact that when it opened at 10:00 in the morning, Fojas declared:” Proceed with the arraignment.”

The defense lawyers’ good command of the English language saved the day for the accused.

Lawyers Trixie Angeles, counsel for Capt. Ruben Guinolbay, and Teddy Rigoroso, counsel for Marine Maj. Francisco Fernandez and Lt.. Belinda Ferrer complained about defects in the charge sheet, which would be read to the officers in the arraignment. Atty. Dante Atienza got the panel to agree that, “The reading of a defective charge sheet will result in a defective arraignment.”

Rigoroso pointed out that while his clients are charged with “attempted to create or begin, excite, cause or join a mutiny”, there are also words like “consummated.” He said the punishment for having caused a “mutiny” is heavier that “attempting” a mutiny..

There was a lot of discussion on the meaning of the word “upon” after Angeles motioned to strike out “irrelevant and redundant allegations… that may tend to confuse the accused and prevent him from making a proper plea.”

The Manual for Courts martial states that ordinarily, the motion to strike out should be made “upon arraignment”. Law member Col. Marian Aleido ruled, without consulting other members of the court, to proceed with the reading of the charges and for the striking out of irrelevant and confusing allegations be done after.

When asked if after the reading of charges, the arraignment stage is not yet completed, Aleido could not answer. The defense lawyers then insisted that the charge sheet be corrected before the reading of the charges because the word “upon” means “during” not “after.”

I did my own checking. Webster says, “upon” is a preposition, “to indicate a course of action or an action or condition that is beginning.” The online Encarta dictionary says the word “upon” is used to indicate, “that an event is imminent.”

It was already past 5 p.m. and throughout the day, all that the accused officers and the defense lawyers got from the panel were “Denied” and “If you have any complaint about the decision of the court, you are free to bring it to the Supreme Court.”

Angeles expressed alarm over this “dangerous” attitude by court. She told members of the panel: “You are given the rare opportunity to do the right thing at the first instance. We have told you what is in the law and by insisting your way and by referring the execution to a higher court, it speaks of bad faith. You know it is wrong and yet you are doing it.”

While Angeles and other defense lawyers were taking turns pointing out to the panel what is in the law, Medal of Valor awardee Col. Custodio Parcon asked his fellow accused to pray. Minutes earlier, Ifugao Mumbaki Marcos Guinolbay, father of Capt. Guinolbay, informed Angeles that he was fasting and offering prayers for justice for his son and the other officers.

Panel member Gen. Bernard de Luna called for a break so they could confer. When they came back, even members of media, used to hearing the panel declare “Denied” was surprised by the order of Fojas to the prosecution to make the necessary corrections in the charge sheet.

But here’s a catch. It had to be done on the spot. Obviously, there was an order to execute the arraignment that day and they had to do it by hook or by crook.

After a long break, the hearing resumed and the prosecution panel said they have made the corrections. However, the defense lawyers pointed out that the proper procedure is for each and every accused to be served the corrected charge sheet. It also has to be signed by the accuser.

That’s a problem for the prosecution because the accuser in this case, Capt. Armando Paredes, has resigned from the military. A new accuser may sign the corrected charge sheet, of course. But the manual for courts martial also states that the accuser has to be someone who has full knowledge of the charges. The prosecution has to look for a new accuser.

At 7 p.m., Fojas had to adjourn the hearing. He said next hearing on Feb 19, they will immediately go to arraignment.

Every small victory under a military leadership that has no qualms about disregarding due process, is a renewal of faith. Capt. Dante Langkit, attributes the non-arraignment last Wednesday to the power of prayer.

    Just a few questions: Feb. 19 is just a week away from Feb. 26..DDay for them to be arraigned..and if not, charges will be dropped. The accuser has to sign the corrected charge sheet..the accuser has resigned..thus he can not officially sign..right Ellen? can he be recalled for active duty to serve, simply to sign the corrected charge sheet? He was not officially part of the prosecution when all these things were done. Nor was he physically present to hear what was said at the trial. On the new accuser if they can produce one and they certainly will (an order from the Chief). He should be one who has full knowledge of the charges..mayroon ba? and kung mayroon man susunod ba siya? a thorough questioning will be necessary. I have no doubt the defense lawyers will.. pero,can this be done and decided in a week’s time to meet the deadline? At kung hindi will the charges be dropped because of default? Kailangan ang todo dasal..for the truth..at sabay, sabay ang panalangin for Lozada and the 28 officers detained for truth and justice.. God will take care of the Philippines..

Sabi nga ni Lozada, tanong daw ng mga anak niya bakit siya na nagsasabi ng totoo ang kailangang magtago pa. Itong mga sundalong magigiting naman, bakit sila ang nakakulong at hindi iyong mga kurakot na sinusuhulan ng isang kriminal na dapat nang matagal na nakakulong?

Mahaba pa ang kalbaryo ni Lozada. Pero nararapat na samahan natin siya at bigyan ng suporta para ilahad ang katotohanan. Yun lang namang mga kampon ng Demonyo ang takot sa liwanag at katotohanan eh.     I was just shaking my head when I heard that the panel took a “white out” and corrected the charge sheet on the spot. Ganoon na lang ba yun? Di ba any changes to any document should be approved by whoever filed it? I need not be a lwayer to know this. I hope that the brilliant lawyers for the 28 brave officers will pursue this case victorious to the end. They have done an excellent job so far to question all the illegalities in the proceedings.

    On Tuesday, let us all pray to the Holy Spirit so the court may be enlightened to really follow the truth-not the Kagaroo court rules!

    These 28 men of honor protested the illegitimacy of the DOROBO’s presidency and these men have first hand information on how asspweron had a big role in her election rigging. Look at how the DOROBO and her lapdog asspweron demonized them and jailed them in detention cells worse than the cells of hardened criminals. Thanks to the efforts of concerned friends and relatives, they were able to make the detention cell habitable.

    Recently they were moved into small cells without any windows for ventilation. Talagang pinaparusahan sila ni asspweron until they would break and change their tune. But NO WAY will these men ever respect an illegal president and a DIRTY CRIMINAL LIKE ASSPWERON! Ngayon pa na kaliwa at kanan na naman ang ginagawang pagmamaniobra niya para pagtakpan niya ang pandurukot nila kay Lozada! Ang mga kriminal ay gagawa palagi ng krimen. It is in their system!

    Ash Wednesday? I’m no longer a practicing Catholic so I no longer follow such ritual. Please don’t get offended if I ask what biblical basis is Ash Wednesday. Wala akong mabasa sa Biblia na lalagyan ng uling ang noo. In fact, hindi magandang turo ang nakasulat sa Book of Revelation tungkol sa ganitong tradition. Anyway, I wonder if Gen. Asperon has the conscience to observe Lenten. Kay Assperon dapat “Ass Wednesday” hindi “Ash”.

    BNG: wala nga literally sa Bible ang Ash Wednesday..ang pagkaalam at pagkaintindi ko..the 40 days of lent which begins on Ash Wed. is for us to re live the event when Jesus went up the mountain to fast and to pray for 40 days and after which Satan tempted Him..remember that story? the ashes which is by the way (the palms blessed which were not used sa Palm Sunday-sinusunog at ito ang ginagamit) to remind us that “dust thou art and to dust thou shalt return” and also to remind us that during the 40 days.. we should repent..The rites of the Catholic are full of symbols to make us see as best we can what happened many years ago..water, oil, bread, wine. etc..

    Salamat Rose. Iniiwasan ko ang tungkol sa religion. Diyan nagkakaroon ng di pagkakaunawaan. Para sa akin, hindi symbols ang dapat sundin ng isang tunay na Kristiyano kundi kung ano ang tamang aral at utos na nakasulat sa biblia. Para nga sa akin, hindi biblical ang Penitence o pagsasakit ng katawan during the Holy Week. If our body is the temple of God, why do we have to hurt it and disfigure it? Ang katawan natin ay dapat ialay ng buong-buo na walang kapintasan sa Panginoon. Kung sa bagay, mga nagisnan na natin iyan mga tradition at ritual. Mula pa sa ninuno at hanggang ngayon. Pero hindi porke nagisnan natin ang mga bagay na iyan ay tama at ayon sa turo ng Diyos na nakasulat sa biblia. Dahil imbes na akala natin eh nakakalugod sa Panginoon ang ating ginagawa baka iyan pa ang ikapapahamak ng mga kaluluwa natin.

    I teach CCD to 7th graders and one of the things we do is to read the scriptures..No I don’t interpret..I just ask them to think and reflect on the words they read..the Saturday after 9/11 I asked them to look for Luke 6:27.. “Love your enemies do good to those who hate you.”

I simply said pray for him..pero ngayon sa totoo lang hirap na hirap ako magdasal para kay GMA so I ask the Holy Spirit to help me..at sa pagdasal ng Our Father..kung puede lang I would like to skip “forgive us our trespasses as we forgive those who trespass us..” ang hirap ano? Mas mahirap seguro ang nararanasan ni Jun Lozada..but he prayed to be the spark to lead the way..he is a true witness to what it would take and one has to give to be a true follower of Christ..ang hirap nga..kaya seguro doon hirap na hirap si GMA..BTW hindi pa rin tumayo si Velarde..mabigat nga seguro ang bulsa..at ginto ang laman hindi lang 500,000 pesos for shopping.. Prayers talaga ang kailangan..

    Bng: you are right we should live the gospel..symbols are just to help us in understanding and living the gospel..na mention mo “our body is the temple of Holy Spirit” we talked about that..and naintindan nila na ang mga diet to a point of anoxeria is bad..with regard to the practices during Lent..I don’t think it is sanctioned by the Church..at sa atin lang yon..and in certain regions lang..once I spent a Holy Week sa Zambales and on our way nakita ko yong mga flagellantes..grabe..and naka witness ako ng nagpapako..sa Western Visayas kung mayroon man hindi masiadong ginagawa..I think it is in how we were taught and how we understood it..but tama ka..we have to live the gospel..kaya lang sa mga Catolico hindi masiado tinuturo ang bible..Sa STC we were encouraged to read the bible and I make it a part of my daily routine to read the bible..it is all up to the individual..

    Rose, I thought that when the Fatso was on his death bed in St Luke’s, he saw the light. Yun pala, that was when the DOROBO went to China “like a thief in the night” to sign the ZTE deal. I do not know if these criminals will ever see the light. To them money and power seem to be their God! I always see the DOROBO in church praying along side her cabinet members, only to commit another crime again and again!

Selective amnesia, half-truth, cover-up, kidnapping, intimidation, suppression, bribery, deceit and fraud are part of your so-called due process. The Hello Garci political scam and NBN-ZTE scam and its subsequent cover-ops are best example of manipulated due process. Law enforcers become law breakers.

    Ah, the wisdom of the admonition of the leaders of our church to keep a journal especially when you are dealing with people with whom you may one day find yourself in trouble. In fact, I realized that when I started working as intepreter for the police in Japan.

    I was handling a case on drugs, and the police was actually trying to squeeze information from the suspect through memory even things that had happened a decade before that. Before magaling mag-imbestiga at magtali-tali ng ebidensya ang mga pulis and they were able to track down the suspects’ move, and even made a chart of the chronological sequence of events leading to the commission of the crime. Hindi makaisip ng alibi ang pobre.

    I realized then the importance of keeping a daily journal. Isip ko noon, what if something like that happened to me and I became a suspect for something I had not committed. At least, if I keep a journal, I will always be able to tell where I was at what place and time.

    In the case of Lozada, at least, nakuha siya agad, and there are a lot many people who can verify his every move even the time when he got embroiled in this racket. Salamat din sa media who has been fast in trying to track him down. Medyo natakot ang mga duwag!

    I bet you, right now, nagtatapang-tapangan lang ang anak ni Pandak, mobilizing her brigade to invade and try to create havoc especially in blogs critical of her “evil” mother, quote and unquote the binabae!!!

    In a few hours, these 28 men will be be arraigned by the kangaroo court. LET US ALL PRAY TO THE HOLY SPIRIT THAT REAL JUSTICE MAY PREVAIL. May the Holy Spirit work on those with wicked ends in their minds. Let us pray for the strength of the lawyers who have so far done excellent jobs of protecting the rights of these incarcerated men.

    Let us light a candle and offer our prayers for today’s hearing that our 28 men will be spared from the injustice this kangaroo court has cooked up for them since day one! Please LORD shield our GALLANT men from all the evil forces! Also, grant O Lord the continued dedication and support of their families in these men’s undying love for their country!

    re: the two meanings of the word “supot”…its true .that it depends on how the word is used…the first meaning pertains to the word “bag” as in bag carrying money…the second meaning pertains to a person (male) who is “not circumcised”.Yun lang po.

    Morena50: thanks for the explanation..and I am just wondering magkano kaya ang laman ng supot (bag money) naibibigay..I saw the bundles of money that they gave to Lozada..ang kapal..ganoon seguro ka kapal ang inabot ni Medy to the Congressmen and Governors last year..ang sabi ng anak niyang si Lul-eh hindi magnanakaw ang nanay niya..ang sabi naman ng anak niyang si miki,,hindi daw evil ang nanay niya..walastik! lahi ng Makapal-gal..

    I can’t get over sa hitsura ni Neri..salamat hindi ako pintor..kasi di ko mawari kung bakit ganyan..hindi ma drawing..Pero there are many cases na kahit pangit ang tao kung malinis ang conscience it reflects on his face..and there is an inner beauty..pero sa kanya kahit nakatawa maasim pa rin..compare that with the smile of his Lozada iba ang mukha his face shines..contrast talaga..
