Sellout of territory seen as ‘greed without moderation’

The United Opposition yesterday asked the Senate to act on a resolution filed by detained Sen. Antonio Trillanes IV calling for an inquiry into the “Spratly Deal” allegedly entered into by the Arroyo administration with China “in exchange for dirty loans.”

Makati Mayor Jejomar Binay, UNO president, said if Arroyo has indeed signed the deal allowing China to explore Philippine territorial waters, “she has given away our sovereignty to a foreign power in exchange for loans that are the source of multi-million-peso kickbacks and a campaign war chest for the 2010 elections.”

The opposition call came as the Department of Foreign Affairs said a Joint Marine Seismic Undertaking (JMSU) signed on Sept. 1, 2004 with China “does not impinge on the sovereignty and territorial integrity of the Philippines.”

The DFA called the JMSU “a landmark agreement that affirms the political commitment of three claimant states (the Philippines, China and Vietnam which later signed up) to approach their disputes in the South China Sea in a peaceful and constructive manner.”

“It is a confidence-building measure and is aimed towards the transformation of the South China Sea from a region of conflict to a region of peace and cooperation,” the DFA added.

The JMSU is said to be the precursor of the secret Spratly Deal. The Arroyo administration has rejected calls for the disclosure of the text of the JMSU and its annexes.

Binay said if the Spratly Deal is true, then this shows a regime whose “greed is beyond moderation.”

“If such a deal had been signed, it becomes clear to everyone that the Arroyo administration is willing to surrender our sovereignty for the chance to get kickbacks and build a formidable war chest for whoever will be the anointed candidate in 2010,” he said.

Binay said a Senate probe would put the ZTE-NBN scandal, and the North rail and South rail projects – both said to be tainted by irregularities involving Arroyo, her husband and their cronies – in proper perspective.

“The Senate would no longer need to hold separate probes into the statement of Jun Lozada that the North and South rail deals were also tainted by corruption since these could be investigated as part of a probe into the so-called Spratly Deal,” he said.

Trillanes asked the Senate to investigate the Spratly Deal after it was first exposed by Malaya publisher Amado Macasaet.

Quoting Macasaet, Trillanes said Arroyo might have committed treason if she signed the deal which would allow China to explore territorial waters. The supposed deal also includes exploitation of the country’s exclusive economic zones, which are already contained in a memorandum of agreement signed between the Department of Trade and Industry and ZTE International in January 2007, in exchange for four projects that would cost around $4 billion.

The Chinese were also tying up the Spratly Deal with other loans to the Philippine government, refusing to sign the North Rail agreement unless it is signed along with the Spratly Deal.

China is also financing the $329-million NBN deal with ZTE, the $500-million North railway and the $932-million South railway projects. The CyberEd project of the Department of Education, costing $465 million, was supposed to be financed by Chinese loans.

The DFA statement on the JMSU was in reaction to a recent Far Eastern Economic Review report which said a portion of the JMSU’s coverage is well within the undisputed territory of the Philippines.

According to the DFA, “Vietnam, the People’s Republic of China and the Philippines entered into the JMSU in 2004.”

But according to the website of the Philippine embassy in China, the JMSU between Manila and Beijing was signed on Sept. 1, 2004.

Vietnam joined JMSU only on March 14, 2005.

In the FEER report, former Wall Street Journal Asia editor Barry Wain said the DFA protested the JMSU deal with China because of the absence of consultation with other Asean member-states as required by the Asean-China Declaration on the Conduct of Parties in the South China Sea adopted in 2002, but it was overruled by Malacañang. – Anthony Ian Cruz

    A leadership of liars revisited

    The Department of Foreign Affairs yesterday finally deigned to respond to reports that Gloria Arroyo committed a treasonous act in selling Philippine territory to Beijing in exchange for $4 billion in dirty loans.

    The DFA said the Joint Marine Seismic Undertaking (JMSU) “does not impinge on the sovereignty and territorial integrity of the Philippines” and described the agreement as “a landmark agreement that affirms the political commitment of the three claimant states (Philippines, China and Vietnam) to approach their disputes in the South China Sea in a peaceful and constructive manner.”

    Here’s our take on that agreement almost four years ago, titled “A leadership of liars”:

    “There they go again, Malacañang blandly claiming there are no irregularities in two agreements signed during President Arroyo’s visit to China two weeks ago.

    “One of the agreements calls for joint ‘seismic study’ in the disputed Spratlys. The other is for a $400 million loan to rehabilitate the northern portion of the Luzon railway.

    “Let’s put aside the NorthRail project for the moment. “We have not seen any independent costing so we have no opinion one way or the other about its alleged overprice.

    “But on the joint seismic study, Malacañang is again clearly lying about the project.

    “Palace officials say no secrecy surrounds the agreement. Ellen Tordesillas of this paper has alleged that there is, the reason mediamen seeking a copy of the agreement were being given the runaround. “Settling the issue is straightforward. Malacañang only has to release the full text of the agreement, including all annexes, and that’s it. We bet it won’t because it would open up a can of worms.

    “Then Justice Secretary Merceditas Gutierrez, according to Tordesillas, objected to the agreement because it runs against the constitutional provision on the country’s 200 mile exclusive economic zone which provides that ‘the exploration, development and utilization of natural resources shall be under the full control and supervision of the State.’

    “To skirt the constitutional mandate, the agreement was worded in such a way that ‘exploration’ does not appear in the text. It was replaced with the term ‘seismic study.’

    “Now what is a ‘seismic study?’ It has nothing to with earthquakes. It involves firing a series of explosives on the seabed, with the shock waves recorded at distant points. How the waves are propagated enable geologists to map the underground structures.

    “And what is the use of mapping of such structures? “There’s only one that comes to mind. It’s to identify potential oil-bearing structures.

    “There are no ifs and buts about that agreement. The Philippines and China have agreed to conduct joint exploration in the disputed portions of the South China Sea. Whether the joint project falls under ‘marine scientific research’ which is allowed under the Manila declaration on the preservation of the status quo is open to question.

    “But Vietnam is already objecting. Taiwan, Malaysia and Brunei which also claim the Spratlys in whole or in part are expected to follow suit.

    “The Philippines and China have raised the temperature in the disputed territories with this venture. The misadventure could lead into an outbreak of hostilities.

    “China, the recognized military power in the region, can very well take care of itself. But how about us?

    “The leadership has embarked on a perilous course, made worse by its lying to the people who will bear the brunt if war breaks out in the Spratlys.”

    The fault in that four-year-old editorial is that it failed to see early on the link between the “sellout” and the thieving. Gloria was inviting trouble in the disputed area not because Beijing put one over her negotiators, but because she was apparently already counting the “commissions” from the Chinese loans.

    Does anybody here are tired of unending investigation or Senate inquiry? It seemed just a waste of time, going through the motion, nothing really being accomplished to remove Gloria. Gloria is just keep smirking at everybody and going about her corrupt ways, since every paid dogs are lying and covering up for her. It’s not a well kept secret any longer, Gloria is corrupt and guilty, an indisputable charges. Absolutely, lots of strong evidences to convict Gloria are available. But, who will convict Gloria, certainly not any legal court in the Philippines that has the ball to do it. Just can’t happen for the love of justice, Gloria to go free without being punished. Gloria must suffered the consequences, she must be accountable for all she did.

I won’t say the Senate hearings are useless especially when you have witnesses like Lozada, who must have been moved by the Spirit of God to stick to the truth and stand by what he has already said in public so far. Kahit na hawak sa leeg, yagbols, etc. ang mga taong dapat na umaresto kay Gloria the Evil Bitch, at least, everybody knows what the Evil Bitch has done that she cannot escape legal responsibility for as they are written on the wall.

    Now it is up to them to decide on whether or not they want her out and for good by locking her up in jail, or allow her to continue oppressing them even beyond 2010. They have no other options as a matter of fact.

    Sa mga pandinig sa Senado, lumabas ang testigo katulad ni Jun Lozada na mas marami ang naniniwala sa kanyang kredibilidad. At kung nagpapatuloy ang pandinig, nabisto naman natin ang mga totoong kulay ng ibang Senador na pinagkatiwalaan ng boto ng bayan. Kung magkakaroon muli ng halalan na siya nating minimithi, kilala na natin sila, kung saang panig sila noon at ngayon. May bukas na huhusga sa kanila.

    Had it not for the Senate continuing inquiry of ZTE-NBN scandal, we will not hear much of the North rail and South rail projects being tainted as divulged by Jun Lozada. Had Senate heeded the pro-administration senators in the likes of Joker, Miriam and Enrile, to stopped the inquiry of the ZTE-NBN, with the diversionary tactic of gloria arroyo letting the Ombudsman do the investigaion, we may not reach to this point of knowing that there’s this Secret Spratly Deal. All because of expected commissions out of loans to finance the projects. Due to greed, there’s no more regard to selling out our territory. Indeed, a greed beyond moderation.

    In every contract or deal that Gloria entered into, there’s only one common denominator; it’s all about money. Yes, it’s money that served as inspiration for her and her goons on their non-stop quest and exploring ways on how to make more and more money and their imaginative minds formed a vision of Spratly that is full of Dollars. Her incomprehensible greed made her do what any other previous presidents did not dare or even thought about it; a sell-off of the still disputed Spratlys to the Chinese, which of course are well aware of the weakness of gloria and her fatso for money and they have lots of it.

    Like in the Greek mythology, everything that King Midas touches, turns into gold; while everything that evil queen gloria touches and involves in produces dirty money.

    First, I shouldn’t be misunderstood. I believe Mr. Jun Lozada was very credible and told the truths, I’m glad he came forward. For many years I have been following almost all the Senate investigation, and I have yet seen anyone prosecuted or even recommended for prosecution for any wrong doing. Numerous witnesses called to testify in the Senate, as you all well aware, and most of the time the supposedly witnesses they just completely ignored the invitation of the Senate or refused to say anything. And those that attended the Senate inquiry, in particular, Gloria’s boys, needless to say those boys told lies and made mockery of the investigation. If I may add also, Gloria’s boys has been lying for years and have not seen anyone goes to jail or even fine for lying under oath. As we all know, the Senate did nothing to recommend to prosecute those liars. It seemed any witness could say anything even an obvious lies and get away without any consequences in the Senate. Thats in my opinion a travesty of justice. Recently, Mr. Lozada put his life to risk to bring about truths, and I’m appreciative of his determination to expose corruption. In respond to Mr lozada’s effort, a very succesful rally on the street, I suppose. But, what lesson have we learn here, if any? Again, no one will be prosecuted, Gloria will still remain in Malacanang, Generals will go golfing and corruption will continue. Then, the Senate will start another hearing, I imagine. All I’m asking the Senators is to walk softly and carry a big stick. Not to let Gloria’s boys to spit on them. That’s not too much to ask from the Senators. And, they should be acting like real Senators, and not bunch of wimpy. I guess, I said my peace.
