‘I know nothing about $41M bribes’

New NBN witness called a liar

New witness Leo San Miguel yesterday said he had no direct knowledge about the alleged $41 million in advances made by China’s ZTE Corp. to the “Greedy Group” of Benjamin Abalos Sr. in exchange for the approval of the national broadband project.

“I’m not aware of any kickbacks or ‘lagayan’,” San Miguel told the Senate tri-committee of blue ribbon, defense and trade, which is investigating the overpriced project.

Previous witnesses Jose “Joey” de Venecia III, Rodolfo Lozada Jr. and Dante Madriaga, who were present at the hearing, said San Miguel was lying.

Sen. Panfilo Lacson, who had talked with San Miguel a number of times before the latter’s appearance at the Senate, also said San Miguel was lying, an assessment echoed by a number of senators.

San Miguel, an engineer, said his involvement in the NBN-ZTE contract was purely technical and his knowledge about the contract did not go beyond “technical matters.”

San Miguel said he is the technical consultant of ZTE, not Madriaga.

Madriaga earlier testified that the “Greedy Group” of Abalos, received from ZTE advances amounting to $41 million, half of which allegedly went to President Arroyo and her husband Mike.

He said he learned all this from San Miguel, who was his superior and the one who recommended him to ZTE as technical consultant.

Madriaga said the other members of the Greedy Group are San Miguel, Ruben Reyes and retired Gen. Quirino de la Torre.

But San Miguel said Madriaga was only tapped to provide technical inputs on the NBN framework that was submitted by losing US-based bidder Arescom, where Madriaga was the consultant.

“It’s not true. He’s not the consultant (because) I’m the one paying him. I cannot accept that,” San Miguel said.

He also denied signing a document supposedly showing the engagement by ZTE of his and Madriaga’s services.

San Miguel showed his signature on his credit card to the Senate tri-panel to prove that the signature in the document was not his.

He also denied authoring an electronic mail that he sent to Madriaga in July 2006 which described the “tongpats” (“patong”) or overprice in the NBN-ZTE deal.

San Miguel said commissions were a “standard” arrangement and that he heard the advances being discussed “among themselves.”

Pressed by senators who he was referring to, San Miguel retracted his statement, saying that he never heard this being discussed by Abalos, Reyes and De la Torre.

San Miguel, however, said it was possible that “commissions” awaited those involved in the NBN project.

“You know, no person would work for something without getting compensation. And there are people who have roles to play,” he said.

He said Reyes’ role was to help facilitate and expedite the project on the government side.

“It appears like he’s the local guy,” he said.

He said Reyes told him that money could be made out of the deal.

“Pare may konting kita rito,” San Miguel said, quoting Reyes.

San Miguel admitted seeing then Planning Secretary Romulo Neri to present the ZTE proposal. He said Neri initially expressed reservations on the ZTE proposal.

He said he did not meet Mike Arroyo.

San Miguel said he stood to get a “success fee” of 1.5 percent or $1.6 million of the $329 million NBN deal won by ZTE.

He said on top of it, he would be refunded by the ZTE of the expenses that he incurred in the course of packaging the project.

San Miguel said so far the ZTE has refunded him P4 million.

He said he is not aware of the extent of Abalos’ involvement in the project but stressed that “he’s helping.”

He said he had five to six meetings with Abalos, which at the Wack Wack Golf and Country Club in Mandaluyong. One meeting took place in the Makati residence of former Speaker Jose de Venecia.

“I don’t know the relationship of Ruben Reyes and Abalos,” he said.

He refused to say if Abalos was indeed brokering for ZTE but noted that Abalos was frequently talking to ZTE officials.

San Miguel said the perception was that it was ZTE which approached Abalos for help.

San Miguel denied being present in Wack Wack sometime December 2006 when Mike Arroyo had a verbal tussle with the younger De Venecia III, where the former told the latter to “back off” from the deal.

But De Venecia said San Miguel was in the same room with Abalos, Jaime Paz, de la Torre and Transport Secretary Leandro Mendoza when he met the First Gentleman.

OBVIOUSLY LYING

Lacson said he was surprised by the denials made by San Miguel.

Lacson stressed before the Senate hearing that he never described San Miguel as his “surprise witness.”

“I never said he’s the surprise witness. There’s a subpoena,” he said. “I’m more surprised than disappointed.” he later told reporters.

“At the outset, pwede kong sabihing hindi totoo ang sinabi niya. . .Tthat much I can say, hindi totoo ang sinasabi niya. Ibang tine-testify niya.”

Lacson said during his meetings with San Miguel, the new witness talked about “kickbacks” and “irregularities” in the NBN-ZTE deal, which were even backed with “materials” that were handed to him.

He did not elaborate what the materials were.

Lacson said something might have happened between 11 p.m. Monday to morning of Tuesday, which prompted San Miguel to change his mind.

He said he met with San Miguel on the eve of the resumption of the Senate hearings. Before that he met San Miguel three times.

He said a common friend called up San Miguel in the morning of Tuesday and said over the phone that he was under “intense pressure.”

Lacson said the “pressure” could only come from Malacañang or Abalos.

BUM STEER

Lacson took exception to remarks of Sen. Juan Ponce Enrile before Senate media that he was given a bum steer.

“No, I don’t feel I’ve been had, he’s a real witness,” he said.

In the hearing, Lacson declined to refute the testimony of San Miguel.

“For purposes of this committee hearing, I will neither confirm nor deny (what he has said). I want to preserve the goodwill or what ever is left between Mr. Leo San Miguel and myself,” he said.

Lacson nonetheless willing to divulge his discussions with San Miguel in a closed-door meeting with his fellow senators.

San Miguel told the Senate joint committee that his first meeting with Lacson was by accident in a hotel in Mandaluyong where they were both attending separate meetings.

San Miguel said he knew Lacson way back when he was still PNP chief and when De la Torre was comptroller.

“O kumusta ka na? Halika mag-usap muna tayo,” San Miguel recalled Lacson saying.

San Miguel said they ended the conversation with Lacson asking him to produce De la Torre and “see how he’s doing.”

He said he brought with him De la Torre to their second meeting evening of March 3, where Lacson and De la Torre talked about the latter’s health and going to the Senate to testify.

“We told him (Lacson), we don’t have invitations, why should we go (to the Senate)? Essentially that ended the meeting,” he said.

San Miguel said the third meeting took place March 9, a Sunday but without De la Torre in attendance because “he was not feeling too well.”

He said the fourth time was evening of Monday.

The new Senate witness said he did not talk about irregularities in the NBN-ZTE deal.

SURPRISED SENATOR

Senate majority leader Francis Pangilinan said it strains credibility that San Miguel did not divulge information on the NBN-ZTE deal during his four meetings with Lacson.

“I’m a surprised senator,” Pangilinan said during a break in the hearing.

“I’m the one surprised here,” Escudero said.

Sen. Manuel Roxas II, trade committee chair, said San Miguel appeared not to be telling the truth.

“Hindi kapani-paniwala ang sinasabi niya,” he said.

Blue Ribbon chair Sen. Alan Peter Cayetano, said the hearing nevertheless proved that San Miguel was indeed a consultant of ZTE and his testimony was relevant to the probe.

Lozada said that in meetings where San Miguel was present, “lahat napag-usapan, except for technical” to belie San Miguel’s assertion that he was purely a technical person.

De Venecia said he was disappointed but said San Miguel is “a member of Gang of 4.”

LIE DETECTOR

Before the hearing closed late evening, San Miguel accepted the challenge of the other witnesses in the NBN-ZTE probe to undergo a lie detector test.

“On the challenge of lie detector test, absolutely, anytime,” San Miguel told the Senate tri-panel on the query of Sen. Mar Roxas.

Roxas said San Miguel controverted all the testimonies given by the three other witnesses led by Lozada.

He said a lie detector test would put to rest who among the witnesses were feeding “lies” to the Senate joint panel.

Roxas also said he would tap an international lie detector company to undertake the test.

Lozada and Madriaga said they are willing to take the lie detector test.

De Venecia kept mum on the challenge.

Lozada said he found it incredible that San Miguel could describe his relationship with Abalos as “only casual.”

“Sabi niya 2 to 3 meetings sila ni Abalos at hi, hello at goodbye lang. Pero ng tanungin siya ni Sen. Enrile ay 5-6 times (sila nag-meet ni Abalos),” he said.

Lozada said “commissions,” “kickbacks,” “bukol” were discussed during his meetings with San Miguel and.

“Ang pinag-uusapan po doon, komisyon. Andun po si Mr. San Miguel,” he said.

He said San Miguel was always “within hearing distance” during those meetings.

Cayetano said San Miguel was being selective in remembering his dealings with Abalos.

“Nung isa pong senador ang nagtatanong, halos hindi nyo alam kung ano involvement ni Mr. Abalos, pero nung si Sen. Enrile, ay malinaw niyong naalala ang ginawa ni Commissioner Abalos,” Cayetano said.

PHONE RECORDS

Sen. Jamby Madrigal also proposed that San Miguel authorize the release of his phone records by mobile companies just like what Lozada has agreed to.

Cayetano said also asked San Miguel to agree to the release of his phone records from 11 p.m. of Monday to morning of Tuesday.

Lacson said that someone reached San Miguel between this period, which prompted him to change his mind.

Lacson opposed the proposal, stressing that it would be useless since SIM cards could be easily replaced or tampered.

San Miguel said he was willing to authorize the release of his phone records but on a limited basis only.

Executive Secretary Eduardo Ermita and Press Secretary Ignacio Bunye dismissed the Senate appearance of San Miguel which they said did not actually come as a surprise.

Deputy presidential spokesman Anthony Golez lamented the Senate’s “allegation by installment,” cautioning them against being “burned” if they continue to present witnesses without requiring them to back up their claims with evidence. – Dennis Gadil and Jocelyn Montemayor

    Succees fee of $1.6 million is Leo San Miguel’s commission. Not bad for just staying with Abalos, Dela Torre and Reyes. Of course, after meeting several times with golfing (commission) buddies, each one can issue a denial as having no knowledge of whatever they had been talking about – hole in one.

    Parang international players din ang mga pinoy sa dating ng commission. In major corporations, big projects are decided over golf and not anymore in boardrooms.

    Leo San Miguel like provide snippets, like Reyes’ “pare may konting kita rito” and at the same time denial king on any irregularities.

    Oo nga naman, commission is not anymore irregularities but it is a standard rule.

Believe it or not, this is unusual for a big corporation to hire a contractor without formal agreement and paid cold cash for his reimbursements and services. No paper trails or issued checks to pin them down. It seems that Leo San Miguel is working with Mafia-like operations.

    One of the things this witness San Miguel proved or confirmed was that Abalaos was there everywhere where NBN-ZTE dealing was concerned. What was he taking the trouble to be there for? Common sense says it was all about commissions for him but ‘konsumisyon’ for the filipino people.

    Well, the anticipated bombshell from San Miguel was a dud. Maybe the opposition should not talk of surprise witnesses next time, just let those witnesses do the talking.

    He may claim that he has no first hand knowledge, i.e., didn’t see the money pass hands or the paper trail but the man must have second hand knowledge; he could always tell the marines that he knows nothing!

    As a technical consultant, he is aware of the costs of the project; no way he can say he doesn’t — if he’s dumb, he should try adding one plus one or subtract, i.e., two minus one (original cost vs final cost.)

    So this guy is lying if he says he doesn’t know or is not aware!

    The Philippine Senate should file perjury case against Leo San Miguel and other Gloria Arroyo officials who perjured themselves during the Senate Committee hearing on NBN-ZTE broadband scam. I don’t know the number of actual prosecution for perjury. The Sandiganbayan acquitted President Erap on perjury charges. Dapat sampolan para may leksyon ang mga sinungaling under oath.

    Art. 184. Offering false testimony in evidence. — Any person who shall knowingly offer in evidence a false witness or testimony in any judicial or official proceeding, shall be punished as guilty of false testimony and shall suffer the respective penalties provided in this section.

    Mr. Leo San Miguel is a liar. The file attached to his email to Mr. Madriaga cannot be forged unless it is downloaded, edited and emailed back to Mr. Madriaga.

    It is not true that one can edit the attachment on the fly as claimed by Mr. San Miguel. I’ve tested this in the past and it’s not possible.

    After all is said and done, San Miguel CORROBORATED the testimonies of the 3 other witnesses (and Neri’s) that Abalos was involved in the ZTE meetings/discussions. Even if San Miguel says that he does not know if actual bribery took place, I think that this is a very important piece of information that people are not giving the proper attention…the attention is on the that fact that the surprise witness was a dud, etc. which plays into Malacanang’s “telenovela” spin.

    whistle-blower Jun Lozada, then a consultant to the NEDA and privy first-hand to the negotiations allowed us, the public, to understand in graphic details, how the original cost of 100 million dollar levels ballooned (more than) twice over.

    thus, i believe the guy, Leo San Miguel, in this particular regard— a lone unadulterated truth, among heaps of lies.

  36. They were talking of the pakipkip which is customary among Asians as a matter of fact. Over in Japan, the gratuity is 15%, and it can be legal based on some unwritten law “para walang utang na loob” so to speak.

    I don’t know how much is the supposed gratuity in China, but what the crooks must have thought of doing was convince the Chinese to pay the hiked up price and then ask for the desired commission that would be the legally allowable hiked price that the Chinese government would be willing to lend the Philippines to pay the ZTE based on the price the crooks had dictated to the Chinese, who are now silent on this crooked deal because they actually lose nothing!!!

    What’s done is done! A few highlights….

    1) This San Miguel guy indirectly implicated Abalos in the form of “helping”. His involvement is now established!

    2) In the end, he was able to collect his dues from the criminal enterprises and the “perks” w/o familial endangerment!

    3) Lacson’s judgment was clouded by his momentary exhilaration without due diligence. San Miguel while lacking in many aspects look very composed under scrutiny!

    4) When San Miguel became a hostile witness early on, the focus on the hearing should had shifted instead of allowing him all the air time to cast more doubts & poked holes on other testimonies!

    5) When he claimed his expectation of a 1.5 Mil in fee, the Senate should have pursued this line of questioning by asking on fees for other members of the group hopeful he might volunteer information.

    6) If Lacson were fooled into believing otherwise, indeed, he was outwitted by guns, goons and gold.

    Finally, the only means to bring this evil empire to its knees lies with Neri, the girly man.

    He must be willing to do it truthfully on his/her own term w/o outside interference or otherwise, we will be faced with the “real” trojan horse!

    San Miguel may claim that he has no first hand knowledge, i.e., didn’t see the money pass hands or the paper trail but the man must have second hand knowledge; he could always tell the marines that he knows nothing!

    As a technical consultant, he is obliged to be aware of the costs of the project; no way he can say he doesn’t and by putting one and one together, makes two.

    I know what I’m saying because I’ve been involved in making proposals to govt — based on company engineers’ inputs, we drafted the overall proposals including top-ups, i.e., cost paddings and of course, engineers (or technical consultants) are always aware of the difference because at the end of the day, they are the ones who either evaluate or present the specifications! They also have a very strong idea of who on the local side are involved (they have to!!!)

    So this guy is lying if he says he doesn’t know or is not aware!

    The question should not be direct, i.e., “Are you aware of the 41 million dollar bribe, etc?” But, “Explain the costing of the package, costs and all….” The Senators have to be more creative with their questions!

    I’m glad you asked the question. I hope Ellen will allow this lengthy retort.

    I may not have the same length of experience as San Miguel, mas bata akong malayo, but in any government project, especially those unsolicited, supplier-driven deals, the technical consultant does not only have control over the technical aspect of the project. His role includes site surveying, estimating completion targets of manufacturing/installation schedules, manpower requirements, logistics, quantity survey of deliverables, organizational planning, quality assurance, real-time completion assessment, re-planning for adjustments and contingencies, commissioning, and turn-over. And many more.

    Each activity carries a unit price which is then multiplied with the quantities as estimated. San Miguel is definitely lying that he does not know how much bribes, if any, were built-in into the proposed price.

    He definitely knows the total project COST even if he does not know the PRICE. The mark-up or PROFIT is simply deducting the COST from the PRICE which everyone knows, (except San Miguel, hahaha!) to be $329M. PROFIT is therefore ZTE INCOME plus LOCAL KICKBACK. It does not need an engineer of San Miguel’s “caliber” to determine that.

    Why is it not BOT like JDV3’s proposal?

    Because in BOT, there is the so-called “Swiss Challenge” where any interested party can match or exceed JDV3’s proposal and capture the prized project. The “Swiss Challenge” somewhat ensures that no single proposal gets an undue advantage by giving bigger bribes. It is actually designed to “moderate the greed”. Had JDV3 allowed Abalos his $130M commission, this NBN project will definitely be BOT.

    Back to San Miguel, the commercial aspect of any proposal must at all times comply with the profit requirements of the proponent and to be able to satisfy the client, the technical consultant must at all times be appraised of the cost variables, kickbacks, included. With this info, he can adjust the specs and quantity which falls squarely under the technical realm where he has to have total control of.

    San Miguel’s lame excuse is total bullshit.

Pero siya na rin ang nag-contradict sa sarili niya when he affirmed na siya nga ang nag-email kay Madraiga na may Excel attachment for Madriaga to refine the hi-level costing per phase nung project nila. Ito yung sinabi nya na dinuktor daw yung columns na “tong-pats” at “consortium” margins and amount. Dito pa lang pwede na syang i-contempt ng Senado.

    Nung nagtetestify si San Miguel, naalala ko si Jeff Schilling na dating presidente ng Enron while he was being grilled by the US Congress.. kahit na ang galing ng presentation and communication skills ni Schilling, lumabas pa rin ang mga contradictions sa testimonies niya.

Actually ang technical term sa so-called “decent and professional” work na ginawa niya sa ZTE is systems and solutions architecture.

    At san ka naman nakakita ng technical consulting engagement na walang “service agreement” or contract for his professional services? “Word of honor” lang daw ang usapan nila? Susmaryosep, $1.6M ang fee niya from a publicly-listed company tapos verbal agreement lang? SINUNGALING!! Insulto talaga sa mga nasa engineering and technical profession ang ginawa ni San Miguel na testimony sa Senate.

    Gusto ko na nga sanang maawa sa kanya nung umpisa ng pagtestigo niya kasi halata ang dinadala niyang pressure. Pero ang tipping point ko e nung naalala niya in detail ang meeting nila at JDV’s house, pero tila may selective amnesia pag ang meeting e sina Burjer at mga ka-partners niya ang kausap niya.     actually, power and energy ang forte ko. Malapit-lapit na rin sa telecoms dahil ang peripheral electrical equipment ngayon communications-enabled at computerized na halos lahat.

    Kagaguhan talaga yung pinagsasabi ni San Miguel. While I may somewhat believe him when he said he did not have appointment papers or hard contracts with ZTE, but if you consider ZTE is a publicly-listed in Hong-Kong, it’s almost impossible. I have experiences with the Chinese, their word of honor is worth more than the P.O. or contract.

    One big electrical contractor (Chinese) who ordered his equipment with us does not issue Purchase Orders. For him the downpayment is enough proof that he is serious. Our Finance Dept. refused to receive the order unless he issues a P.O. or signs a contract. He was offended! Just to prove his word of honor, he went to the office, prepaid the whole P42M order that will take some 2 years to complete. My Finance Manager was red in the face and asked him out to lunch to apologize. The guy even paid for the lunch, hahaha.

    But this happens only in single proprietorships not with public corporations.

    Leo San Miguel did not settle the score with Lacson that day. He dug a deeper hole for him inside that shit!
