Nine former Magdalo officers plead guilty to coup d’etat

The nine have long been expelled from the Magdalo group. Their plea of guilty smells of a deal. Let’s watch in the following days or weeks.

In a move that caught the defense lawyers by surprise, nine Magdalo junior officers including two of the group’s core leaders changed their plea to guilty on the charge of coup d’etat for their participation in the 2003 Oakwood mutiny.

The nine, all Army officers, were Captains Gerardo Gambala, Milo Maestrecampo, Albert Baloloy, John Andres and Alvin Ebreo and Lieutenants Lawrence Luis Somera, Florentino Somera, Christopher Brian Yasay and Cleo Dongga-as.

Five other Army officers, Lieutenants Lawrence San Juan, Warren Lee Dagupon, Rex Bolo, Audie Tocloy and Nathaniel Rabonza did not change their plea. Last year, San Juan tried to enter a guilty plea for the lesser offense of conspiracy to commit a coup d’etat but Judge Oscar Pimentel junked his motion.

Gambala and Maestrecampo, former Navy Ltsg. and now senator Antonio Trillanes IV, James Layug and Marine Capt. Gary Alejano were considered the leaders of the group which seized Oakwood Hotel in Makati’s central business district on July 27, 2003 and denounced alleged corruption in the government and the military. All were PMA Batch 1995 graduates.

Gambala and Maestrecampo had earlier severed their ties with the group by pledging allegiance to the chain of command while Trillanes’ group maintained its critical stance against the Arroyo administration.

Another Magdalo leader, Marine Capt. Nicanor Faeldon is still at large after escaping anew during the standoff at the Manila Peninsula last November.

Defense lawyer Ernesto Francisco Jr. said the guilty plea was “very unusual” and expressed suspicion that the nine may have entered into a deal with Malacañang that guarantees them a lower sentence or even an executive clemency. “Mali ang akala nila makakalaya kaagad sila. In fact, with their plea, masesentensyahan pa sila unless may usapan na sila with the government.”

Francisco said the prosecution was apparently prepared for the change of plea as assistant chief state prosecutor Richard Anthony Fadullon immediately recommended prison terms of 17-20 years for Gambala and Maestrecampo and 10-12 for the seven others.

Fadullon denied this. He said the change of heart could be due to the Magdalos’ recognition of the part they played in the Oakwood incident and the delays in their trial.

Pimentel set the promulgation of sentence for the nine officers on April 8. Fadullon said computation of sentence will credit the five years they have already spent under detention.

Fadullon said the change of plea will help their case against Trillanes but Francisco and Trillanes’ lawyer Reynaldo Robles said this will have no effect on the rest of the accused since the prosecution has not been able to establish conspiracy or that there was a coup d’etat.

“Personally I do not begrudge them. I understand gusto na nila matapos ang kaso since medyo matagal na ito at makapiling ang kanilang pamilya but we will go on with the presentation of evidence for our clients,” Robles said, adding that Gambala and company might be sorry if the rest of the Magdalos win their case after they have pleaded guilty.

The witnesses scheduled to take the stand yesterday – former Social Welfare secretary Corazon Soliman and NEDA director general Augusto Santos – both did not show up. Santos sent a representative while Soliman said she will attend the next hearing.

    Nothing surprises me anymore in this whore Gloria’s enchanted kingdom. If those nine former Magdalo group pleaded guilty of coup d’etat, if it was a coup d’etat, yet unsuccesful overthrow of illegitimate gov’t, why then Angelo Reyes is not being charged? Surely if anyone is guilty of coup, treason Angelo would be the one first to be prosecuted. Furthermore, why is it whore Gloria as veep and the pig husband Mike which were undoubtedly both the ring leader of mobs, including many others are not being charged of overthrowing a legitimate gov’t? Afterall, whore Gloria set a precedent in overthrowing a legitimate gov’t in 2001 and with the help of SC, legitimize coup d’etat as another way acceptable of replacing the head of the State. So why is it illegal now? Of course, it is double standard. As whore Gloria would say, don’t do what I do, just do what I tell you. It is in whore Gloria’s rule of law, which is now the only law being recognized since the SC has surrendered there equal power or sovereignty to whore Gloria in exchange for brown bags. Once again, it is the power of the haves that did it. Never mind principles, in the whore Gloria’s enchanted kingdom, no such thing. Are you getting it yet or what would it take to wake up to reality to what really to be under whore Gloria’s rule of law?

    5 years detention is a long time. When subjected to isolation, continous overt and subliminal messages of loss of friends, desertion of brothers, apparent lack of concern of the people you fought for, the situation of family, topped with deplorable living conditions – the desired end result would be an acceptance of futility, of helplessness against an all powerful force…first you start to feel sorry for yourself and then just give up…

Kung yong ginawa nilang change of heart ay mapapadali ang labas nila o maiiksihan ang sentencya nila, sana ganon nga ang mangyari. Hindi natin sila masisisi dahil hindi lang sira ang naghihirap kundi ang pamilya nila. Saludo pa rin ako sa kanila dahil kahit papano nagawa nila ipaglaban ang karapan ng mamamayang pilipino, yon nga lang at talagang wala na tayong magagawa pa dahil lahat na alagad ni arroyo ay parehas nyang humahakot ng salapi kaya kahit ano mangyari, makikipagpatayan sila. Kagaya nga ng sinabi ni Jun Lozada na narinig daw nya na sinabi ng isang taga cabinete na “hindi natin ibibigay ang gobyernong ito na walang patayan”. Ano pa ang pwede natin gawin sa gobyernong ito. Marami ng nagsawa sa pag punta sa mga rally. Kulang ang 100,000 na tao sa kalsada, ang kailangan kahit 1milyon lang man sana. Dahil ang sinasabi lagi ng malacanang ay hindi sinisigaw ng lahat na 90milyon na tao ang isinisigaw ng mga tao na nasa rally na gustong magpatalsik ky arroyo….
    Ganon pa man sana makamit nong 9 na sundalo kung meron man deal sa kanila ng malacanang….

    Ayon sa aking bubuwit…..The 9 Magdalos struck up a deal with GloriaEsperon for them to plead guilty. They were promised to be given either a pardon or executive clemency immediately (or within 15 days) and were further promised that they will be reinstated back to the service. May bubuwit doesn’t know what is in exchange for this.

Kung si Osama Bin Laden nga nasa kaloob looban na ng cave eh, nakakapag padala pa sya ng mga tapes nya para pagbantaan ang US.     Ang iba dito ay sinisisi agad ang mga sundalo na nag bago ang desisyon. Ilang taon sila nag tiis at lumaban para sa atin tapos ay ganito ang sasabihin ng iba kesa nasusuka sila. May pamilya sila at kailangan sila ng mga anak nila rin. Unawain natin sila at hindi basta basta mag bigay ng panget na salita. Hirap na sila sa kulungan at wala naman tayong magawa para sa kanila. Nag bago ang desisyon nila dahil nakita nila pati sa Supreme Court ay nabaliktad na at kaya siguro wala ng makikitang liwanag. Matagal na rin silang nag buno sa kulungan at pahirap. Kaya huwag na natin silang sisihin. Iyung ibang nag bigay ng panget na comments sa mga sundalo ay kayo kaya ang malagay sa kalagayan nila ano ang gagawin ninyo.     These officers are very young and they have a life ahead of them! Their intentions were good for the country but knowing how corrupt the evil bitches’ regime is, they probably know by now that it is futile to go through the legal system because it has been bastardized since the day the bitch took over in 2001! Two more years of incarceration (that is if the bitch does not go through the charter change before 2010) may have completely destroyed the spirits of these men and their families.

    I do not want to pre-judge their decisions and I certainly like to acknowlege their five years of jail time. Not everyone is built with Nelson Mandella’s passion for his country! Nelson is a rare breed that is why he became a president after 27 years of harsh incarceration!

    Whatever the motive is for surrendering, it was a choice they have to live with. My initial reaction was, could they not have just stayed for another two years and took a chance on the changed administration? Maybe by then, the leadership will be willing to really sit down with them and listen to their issues instead of outrightly incarcerating them! These officers are PMAers. They were chosen from thousands of applicants and they went through the rigorous military schooling. They are supposed to be toughened by the time they become captains! By then they may have seen cut off heads in Mindanao and had been through several tough operations.

    Yes, we need to understand these men. Put yourselves in their shoes. Just by visiting the incarcerated Tanay Boys in Tanay a few times, seeing their sacrifices and that of their families pained me so much! Tanay, I heard has good weather and better cells, unlike the bartolina cells in the camps where the Magdalos are housed in now, similar to the cells of the Tanay boys as well. This is why a few of them are in the hospitals every now and then. The tiny rooms are not even ventilated! HORRIBLE!

    Bilib ako sa kanila kahit papaano dahil nakulong na rin ako at apat na araw lang ako sa kulungan ay parang nabaliw na ako. Nagmamadali akong umalis sa selda noon dahil hirap huminga at wala kang makikita kundi semento. Kaya naunawaan ko sila. Nag hirap na sila para sa bayan at ang taong bayan naman ang dapat kumilos (tayo). Kahit anong deal ang makuha nila ay napag isipan nila siguro mabuti iyun dahil nga walang liwanag sa batas natin. I hope those detained military men who pleaded guilty shall be given presidential pardon after their conviction para makauwi to their families.     How many times will I repeat how the Americans invaded our country in the 1900s to abort the birth of our nation after we became independent from Spain. We Filipinos resisted but more than half a million of us died. Our resistance weakened which facilitated for the invaders the transmition into our system the Institutionalization of Replication of American Colonization Virus. They weakened the secondary invasion by the Chinese to control our economy. This made us unable to control our economy enough for us to utilize our own raw materials. What has been happening is that our raw materials went straight into the hands of these foreigners.

    Are we not convinced that this colonization did not end with their formal granting of independence to us after World War II? How can it end when this the colonization virus is continuing to replicate until now? How could it have ended with all these foreigners controlling our economy, defense and foreign affairs?

    If it is clear to us that Greatest Malignant disease in All history is a puppet government of foreign invaders, then it would have been natural for soldiers among us to remove her having defense against foreign threat to national integrity and sovereignty as reason for existence. This is basic reason for existence of a soldier.

    If it is not clear yet, then let us unite to make this issue clear and become a strong force for us to reach our natural destiny.

They knew we were not ready; but still went on to grant it to us so that they could easily control our country. Indeed, their plan worked out because until this day, we’re still under their control and dictate. The US doesn’t want to see a Philippine that progresses.     Trillanes’ group failed in that alleged coup because the promise or promises never came. Had it not for the media, he and his group’s lives would have been at great risk.
