The offers

In the past weeks, Maj. Gen. Renato Miranda and his fellow detainees at the ISAFP compound in Camp Aguinaldo have been visited by officers with a message from someone “at the top”.

A source said there were two proposals. The first was for the officers to plead guilty to conduct unbecoming of an officer in exchange for the dismissal of the charge of mutiny. Punishment for conduct unbecoming of an officer and a gentleman (Articles of War 96) is dismissal from service while mutiny is life imprisonment.

In the second offer, 22 officers would be released while six remain in detention and face trial. The six are Miranda, Brig. Gen. Danilo Lim, Col Ariel Querubin, Col. Orlando de Leon, Major Jason Aquino, and Capt. Dante Langkit.

Both proposals were rejected by the detained officers.

The first one was preposterous. Why would the officers plead guilty to a charge that had prescribed? The charge of conduct unbecoming has a two-year prescription period. If the accused is not arraigned within two years, the charge is dropped.

The charges against the 28 officers stemmed from the alleged plan to withdraw support from Gloria Arroyo in February 2006 following the discovery of the “Hello Garci” tapes that exposed her to be a fake president.

In the pre-trial investigation report, there were several dates that the different officers committed the offense. But the latest was the Fort Bonifacio standoff which was Feb. 26, 2006.

Prior to last Wednesday’s hearing which was adjourned due to lack of quorum, the last hearing was Feb. 22, 2008. No arraignment took place on that date. Therefore, the charge of conduct unbecoming of an officer and gentleman has prescribed and is considered dropped. So, why would the officers plead guilty to it?

As to the mutiny charge, the judge advocate office that conducted a pre-trial investigation recommended that it be dismissed for “lack of legal and factual bases”. Although a Pre-trial Advice was issued by Col. Pedro Davila reversing the recommendation in the PTIR, the PTA was not signed by AFP Chief of Staff Hermogenes Esperon.

With the prescription of the charge of conduct unbecoming of an officer and a gentleman, the defense is expected to file a motion to quash the charge of mutiny.

The second offer was classic divide-and-conquer strategy perfected by Arroyo and Esperon. It worked with the Magdalo. The February ’06 detainees found it offensive.

A source said the officers told the emissary that they just follow the rule of law and abide by the process the court has established.

We are intrigued by these feelers from Esperon to the detainees (Miranda is his ‘mistah’) . Has he realized that he cannot easily get away with railroading the trial? Or does it have something to do with the need for this case to be resolved before he retires on May 9 to assume the position of secretary of national defense?

In what seemed to be a counter-proposal, Gen. Miranda last Wednesday reiterated his earlier offer to be the only one to face trial and to have the 27 other officers released.

Miranda said it pains him so much to see the younger officers and their families suffer. He said the officers are assets to the military and “they still love the service.”

He said he still has faith in the court martial:”We are still members of the armed forces of the Philippines and we should be towards the preservation of what we call professionalism in the service. The court martial is part of the professionalism.”

“I am willing to face the court martial so that they can hear my side,” he said.

May we hear from Esperon?

    Ang laro ngayon ni GloriaAsspweron ay executive clemency/dismissal of charges kasi ay wala naman talagang silang kaso laban sa Men of Honor.

    Marami na rin silang nagoyo sa “one sided deal” na ito, ang mga sundalong hindi tulad nina Gen. Miranda at Lim ang paninindigan at pagkatao.

    I saw Gen. Miranda’s photo (gmanews) talking to his lawyer through metal bars.

    Ganyan pala sila tratuhin ni GlueAsspweron. Hindi man lang payagang magkaharap ang dalawa na walang barikada at nang hindi kandahaba ang leeg ng Heneral sa hirap pagbasa sa dokumentos.

    Of course, the General or anyone of the Men of Honor will not complain pero ako ang nagrereklamo! Putragis na GlueAsspweron na yan!

    I just read the development of the last hearing. The accused officers asked the panel to review the case and come up with a decision by the 18th of April. This is a welcomed development considering that in all the hearings all the panel could say was “denied”. Even if the decision will be favourable to the incarcerated, the pain has gotten so deep in the lives of the incarcerated that asspweron will be a hated cheat of staff for a looonnng time!

    The evil bitch continues to reward asspweron for keeping her in power. If indeed he will be appointed as the DND secretary, this is against the study that had recommended that the DND secretary should not be a military man, not even a retiree at that. The evil bitch still wants to control the AFP by just moving this “Hitler” to another position of power!

    Toungue, who among the cabinet members were confirmed by the CA anyway? I do not think that even half of them made the cut. But the evil bitch does not care. Those who were not even confirmed are the real mouthpieces of the evil bitch! In first world countries, no unconfirmed official will be allowed to assume office. This is why we are still considered a third world country because the laws are not followed at all. Whatever the corrupt leader mandates, that is the law. Very sad indeed!

    A visit from Gen Lim’s comrade at the West Point is certainly a morale booster not just for Gen Lim but for the group of the incarcerated as well. For all we know, this is Uncle Sam’s way of saying, enough is enough with this kangaroo court! Release these men!

    Truth of the matter is, Hermogenes Esperon, if whore Gloria has something to do with it, will be Secretary of National Defense when he relinquish his position as Chief of Staff in May. Whore Gloria need esperon desperately to remain in power which is why his tour of duty was extended. Esperon need not be confirmed by defense secretary. It’s the way it is, and it’s always going to be as prescribed by whore Gloria. Angelo Reyes wasn’t confirm neither Hilario Davide, yet both are being paid healthy with extra bonus in the position they’re now holding without CA confirmation. This is Philippines.

    You can be stubborned and not to give in whore Gloria’s wishes and rot in jail. Or surrender to whore Gloria’s demands and be a free man. Being a free man on the outside, I would think can do more help to the cause than being incarcerated. I guess it all depend of one look at it, I suppose. Imagine, the double face Gringo Honasan, was once a wanted man until he made a deal with the devil, now a Gentleman and Senator with a position in the society. And how many more were like the Gringo? Again, Honasan is for Honasan, not about the country. So, he’s now sleeping with the devil and he has the conscience to do it. Shameless, integrity, honesty, etc, who really cares, whore Gloria doesn’t care, This is Philippines.

    Trillanes, Miranda, Lim, Querubin, and others might be professional soldiers and hold a traditional military values, but I don’t think they’re playing their cards right which is why they’re still in jail. They’ll remain in jail for as long as whore Gloria is in Malacanang, since they’re threat to whore Gloria’s well being. If those gentlemen and officers are waiting for the 1 million people to free them, they can forget it. However, they’d decided to escape and join the people’s revolution. Is it possible? This is Philippines, anything is possible.

    One inevitable good news, whore Gloria is not superwoman, her death will one day come. One can only wish, sooner than later. Then we can pick on some else corrupting the Pilipinos.

    The only event these incarcerated officers are waiting for would be the retirement of asspweron. Hopefully Yano will be a much better AFP chief. These incarcerated officers will probably listen to Yano more than this “Garci general” asspweron. But if indeed asspweron becomes the next DND chief, he still can pull the strings to make Yano implement his wishes otherwise Yano’s projects may not get funded. Tuloy pa rin ang ligaya ng kadiliman!

    These 28 officers should not compromise with these devils at all! The year 2010 is just around the corner. If I were them, just ask for better cells( not in the same cells they are in now) and wait until these evil dou are gone! Delay the trials because these hearings will not result into anything beneficial to them anyway! Even if Yano is the AFP CS if asspweron is still the DND chief wala pa ring mangyayari! LULUTUIN pa rin nila ang resulta ng kangaroo court!

If they succeed in killing these men by making their living conditions harder, their blood is in their hands. How long can these two deny their conscience? When they’re old and weak, and in the mercy of the caregiver, they will still remember what they did and remind them we shall.

When you are out of your powerful position, and the evil bitch is out of her stolen position, the real witnesses will come out of the woodwork. Right now, they know that if they will come out, they either face death by the motorcycle bandits or be incarcerated with the Tanay and Magdalo Boys. Kaya asspweron, enjoy ka muna sa mga perks mo! Darating din ang araw na magbabayad ka sa mga kasalanan mo sa bayan!

    If I’ve to advice Trillanes, Miranda, Lee, Querubin and the others, I’d tell them to forget the rule of law and play the same rule of law as whore Gloria, her kind of law. I’d tell them to forget being a gentlemen and officers for a moment, escape, then build an army enough to make counter “Offers” to whore Gloria, something she couldn’t able to refuse. Personally, I won’t do it, but with those professional soldiers what they got to look forward to or their future being incarcerated while the whore Gloria is destroying the nation and them. If they’re lucky they might be able to get out of jail someday, but when would that be? No one can tell about the future, but the future of those professional soldiers at on their hands, it’s only them who can dictate, if they’ve the courage. Surely, Philippines can use them now, only because of the political crisis the Philippines now is facing. I don’t prescribe violence or advocate such, but there is the time one must consider it. Whore Gloria an illegitimate head has stayed too long. It’s time to someone cut it short. Those Gentlemen and Officers might be the one the country need.

  21. Practically there are only two windows, on the cells located on each side of the building, the cells in the middle so not have any.
    This is not the way to treat officers.

    I wonder if the people really do care about those officers? Or, if the majority of the people really understand why those officers are being incarcerated. Instead of having an interfaith rally in which I’m not in agreement, why not the people come out this time, where ever those officers are being held, demanded that they be released, pronto. Forget the judicial system, this time let the people exercise their own power, power of the People, for the people and by the people.   28. The best we can do for now is to strengthen their spirit. We can offer prayers, send letters, cards, notes of encouragement – anything that will shoe them that we still care and believe in them.
    This administration’s weapon against them because of isolation is the continous bombardment that the people have turned their back on them, that they are alone in their fight.

These things they can share with their families when they come to visit..games that they can play with their children, like scrabble, monopoly, etc. or DVD films that they can watch with their children..let us wish list of things they need..and let us do the best we can to send them things they would like..books, whatever..puede ba magpadala ng balikbayan boxes sa kanila?

    Toys for the kids are great, Rose. You know one of the officer’s children loved trucks. Maybe Ellen can get the list of the kids’ ages so the bloggers would know what would be needed.

    But more than anything else, Rose, these officers need legal assistance. The lawyers’ fees have eaten up the money for the food and education of the family. So far these families are surviving day to day from the help of family members and very good friends but some of them are not as lucky as the others. The education of their kids too are part defrayed by benefactors. But some of these officers are still in dire need!

    Greetings and letters of support would be great! Books, as long as they are not political in nature can be sneaked into their cells. I wanted to buy several copies of Nelson Mandela’s book but refrained from doing so. Some of them love puzzles and Sodukus.

    Most importantly, we should start pressuring our congressmen and senators to pay attention to the incarcerateds’ horrible living conditions!

    LOTS OF PRAYERS ARE FOREMOST FOR THE PANEL TO REALIZE THAT THEY SHOULD LET GO OF THESE OFFICERS AND GIVE THEM THE DIGNITY THEY DESERVE ASAP!

    If indeed the evil bitch is serious about a “God centered” governance, she shoould stop oppressing all citizens and that would include these incarcerated officers. Through her lapdog, asspweron, she should order these men released in good faith. Only then will I believe that she is worthy to be our leader. She also should stop her stealing ways! Dahil sa kakukurakot niya, wala tayong dignidad sa buong mundo at ang mga mahihirap nating kababayan ay halos namamatay na sa gutom!     Toney Cuevas, your ideas are commendable. The problem is it will take a lot of time before those ideas will sink in. The prevalent way of thinking right now is that individual contribution and coordination is not possible at all.

    The other problem is there is not much time left. We are about to lose Spratly. Just the other day gloria had a deal in China worth about $2 billion in exchange of what?? Maybe she sold mindanao, and other islands, already for $2 billion. Who knows?

  40. Off topic but another US military serviceman was arrested by Japanese police after he was turned over to them by the US military in Japan. Murder with robbery over here is punishable by death or life, no less, that is why the pre-publicity that he did not rob the taxi driver he killed.

    U.S. Ambassador Thomas Schieffer also took time to go to Yokosuka and met Thursday with Yokosuka Mayor Ryoichi Kabaya, together with the U.S. Naval Forces Japan commander, Rear Adm. James Kelly, to offer an apology.

    Iyan dapat ang attitude ng mga kano sa host country nila, unlike the US ambassador to the Philippines who acts as if the Philippines is still a territory of the USA, and worse, the Philippine fake president living up to it.

    The problem is, before congress catches up with any anomaly, malayo na ang narating ng transaction! Nagastos na pati ang pera! Congress should be pro-active in uncovering all these anomalies. Kung hindi pa abducted ang witness ng ZTE, baka hindi pa nadagdagan ang nalalaman natin tungkol sa ZTE.

    parasabayan, what is at stake in Spratly deal is our undisputed territory. It is not about the territory of China and/or Vietnam but solely the territory of Philippines.

    So, in my opinion the Spratly deal is just a test case for arroyo la cosa nostra. If the Spratyl deal went through without any hindrances from our congress, arroyo supreme court prostitutes, military, and especially the filipino people then it is not far fetch to think that arroyo la cosa nostra will also sell not only territories but philippines islands too like mindanao, batanes, etc…..

    Kaya palagay ko lang yong $2 billion ay di kasama sa Spratly deal.

    Earns Respect from Others

    A man joined the army and was immediately assigned to serve a captain. The captain was very severe and required lower ranking soldiers to strictly obey his commands without any reservation. Of course, the inherent duty of a soldier is to absolutely obey command. One day, the captain told the soldier to paint his residence. After painting it, he told the soldier to wash the brush. However, the soldier could not find a cleaning rag to wipe the brush. The captain pointed to a stack of clothes nearby that belonged to other soldiers, and told the new soldier to take one and wash the brush. At that time, the young soldier faced a dilemma; he did not know how to handle the situation. If he obeyed the captain’s command, he would have to steal clothing for use as a cleaning rag. Stealing from others, once found out, would be a violation of law. However, disobeying a command from a superior officer would violate the military law.

    After struggling with his thoughts, he decided not to steal the clothing. So answering the captain with a firm voice he said: “I will not do that.” His captain was very surprised that he dared to disobey his command, and immediately asked him: “Why won’t you do it?” The new soldier did not answer, and only looked at his superior with a decisive facial expression that conveyed his determination not to steal. The captain then knew that the soldier had made a firm decision, so he did not say anything more.

    To be respected by others, you must have the attitude to earn that respect. If you respect yourself, others will naturally respect you. Since the military law also barred stealing, the new soldier set a firm resolution not to steal under any circumstance.

    Off topic: Just finished listening to the evil bitch at the Food Summit. Bilyon bilyon na naman ang promise niya sa mga farmers. Knowing her stealing ways, we the people should be very pro-active in making sure that all the funds she said will go to agriculture will not end up in a Jocjoclike operations or another Swine project. She said that she will be creating more Ombudsman in the agriculture sector. I just hope these Ombudsman are not like Merceditas who will work only for the Pidals.

    For seven years nothing good ever came from the evil bitch! How can I be convinced that she will indeed deliver? When she said she was not going to run for presidency, she turned around and ran. Worse, she cheated. Then projects after projects are plagued with anomalies all leading to her door but she makes all the efforts to block all avenues to find out the truth. How will we know that this evil woman is not preparing all these billions to fund in the 2010 elections if there will ever be one? Or maybe another charter change move?
