Convicted ex-Magdalo officers seek pardon

‘Scripted clemency’ playing out?

Nine junior officers who have been meted prison terms by a Makati court for the 2003 Oakwood mutiny yesterday asked for forgiveness for their misdeeds as they said they are seeking “mercy” from President Arroyo.

The nine, led by Capt. Gerardo Gambala, faced the media in a press conference in Fort Bonifacio for the first time since the promulgation of their sentence last Tuesday.

Gambala said he and the eight other officers drafted the letter seeking pardon from Arroyo after the promulgation of their sentence. The letter is now with their lawyer.

Gambala and Capt. Milo Maestrecampo were sentenced to life imprisonment after Judge Oscar Pimentel found them guilty of coup d’état.

The seven others, with ranks of captain and lieutenant, were sentenced to six to 12 years in prison.

The nine last week changed their plea to guilty.

Twenty other officers and two enlisted personnel are undergoing trial.

After their change of plea to guilty, defense counsel Ernesto Francisco said the move was “part of the script” of the Arroyo administration to secure the conviction of former Navy lieutenant and now Sen. Antonio Trillanes and the rest who remain opposed to the administration.

AFP chief Gen. Hermogenes Esperon has said a presidential pardon is possible for the nine. On Thursday, government prosecutors said they would not object if the nine would apply for pardon.

Gambala said they are not filing a motion for reconsideration.

“There is nothing I can do right now. I have accepted my verdict. The only thing I can do right now is to ask for mercy and grace from God and the authority. I am asking for mercy and I can give nothing in return but my purest intention,” he said.

If he is denied pardon, Gambala said, he would continue to “knock and ask for mercy and grace.”

“What I’ll do is I will apply for pardon, I will ask for pardon everyday, every week, every month, every year until I will be given my freedom. That is what I am asking for, that is my desire. I will be hypocrite if I will not tell you that,” he said.

Gambala said they thought of applying for the pardon even before they decided to change their plea before the civil court last April 1.

Gambala, Maestrecampo and six others – Captains Alvin Ebreo, Louis Somera, Albert Baloloy, and 1Lts. Cleo Donggas and Kristopher Bryan Yasay – faced the media with permission from the military leadership.

The ninth convict, Capt. John Andres, was brought to a hospital before the press conference because of vomiting.

The nine were part of a group dishonorably dismissed last year by a military court for conduct unbecoming an officer, but they remain members of the military because their discharge has yet to be approved by the President.

Only hope

Gambala turned misty-eyed after a member of the Foreign Correspondents Association of the Philippines asked him why they were afraid of further incarceration and why they are appealing for pardon when they already said they are accepting the court’s decision.

“I am doing that not because I want to evade the sentence. I am doing that because it’s one option that I can hold on to. Strip a man of everything but not his hope. It’s a hope that I can have and the only hope that I have right now. Please don’t take that away from me,” said Gambala, adding they have been in detention for already five years.

“I need to hold on to that not only for myself but also for my family. I have a son, a one-year-old son. He does not know what is happening to my life now but I would like to see him grow… I will bow, I will ask for your humility because that’s the last hope that I have. Please don’t take that away from me,” he added.

‘We are guilty’

Gambala read in the conference a statement he and the eight others signed.

The statement said while there are different interpretations of the Oakwood incident, “we know in our hearts that we are guilty.”

“We have trudged the wrong path when we crossed the boundary between professionalism and adventurism so we got lost along the way. But during the years we spent in detention, a sense of conviction dawned before each one of us in unique and wondrous ways, which led us to acknowledge that we undoubtedly made a mistake. Since then, we learned to live each day with a contrite heart,” the statement read.

The group said while it is their right to seek redress for their grievances, which was corruption in government, they should have done it within the framework of democratic institutions under the rule of law.

“And as long as these institutions are functional, it is our duty to strengthen them – not to destroy them through force, violence and unlawful means,” the statement said.

Bad example

“We apologize to the Filipino people. We humbly ask for your forgiveness for our act of rebellion, for setting a bad example to the future generations and for presenting ourselves as the only individuals who have the monopoly of idealism. While we have envisioned genuine reforms for our country, our actions at Oakwood brought political upheaval and further disunity. We have seen that instead of helping, we weakened the very country we dearly love,” they added.

“We have committed ourselves to the decision we have made, and we have nothing more to hold on to except to continually seek for mercy and grace from God and the authorities we have submitted ourselves to. So today, we earnestly ask for your prayers as we face another chapter in our lives,” they also said.

Nothing to offer

Gambala and Maestrecampo belied talks they entered into a deal with government in changing their plea. They said they had nothing to “We have nothing to place on the table for any arrangement and for any deal,” said Maestrecampo.

Maestrecampo said their group had alliances with political interest groups and the Left when it mounted the mutiny.

He refused to name names, saying he might not be able to identify all of them, “but we all know our political scenario, there is a grand political battle between the opposition and the administration.”

He also said they have not decided on whether to return to the service if pardoned. But the military has said convicts are not allowed in the service.

Gambala, asked for his message to the group of Trillanes who have not changed their plea, said Trillanes’ group has to respect their decision.

Trillanes’ group remains critical of government.

Gambala’s group split from Trillanes in December 2005 when it signed a manifesto supporting the Arroyo government and expressing regret over their action at Oakwood.

Puno favors pardon

Interior Secretary Ronaldo Puno told a press briefing in Camp Crame that he is favor of a pardon for Gambala’s group.

“They have recognized their mistake and they have turned away from violent means of asking reforms. I think they can be constructive members of the society,” he said.

Puno also brushed aside fears that granting pardon to the nine officers would invite more adventurism.

“Their lives are in disarray. That doesn’t mean that going against the chain of command has no bad effect,” he said.

    What is really horrendous about this is that Filipinos are getting used to these illegal things that are being made legal by the the crooks and go scotfree because the criminal has managed to put their friends, relatives and cronies in the Supreme Court and other agencies supposedly responsible for putting criminals like her to prison.

    I have actually met Filipinos who commit crimes overseas and say that it cannot be helped because life in the Philippines is just that difficult and hard as if poverty can be an excuse for circumventing the law and trying to have the law adjust to how they can make their illegal acts look legal. It’s really shocking.

    I am shocked, mind you, because at least the Filipinos we left behind when we migrated to the USA still had some sense of right and wrong, and understood that laws were actually made in heaven that men are inspired to adopt on earth not to restrict men but to improve their lives. When the laws of the land fail to do so, then for sure there must be something wrong somewhere as it is in the Philippines, etc. now.

    That is why it is imperative that those men implementing the law like those men and women of the Philippine Supreme Court should be of the highest morality, and that is not just being faithful to the law against adultery but being chaste and pure in following the laws of the land that should have been inspired of God, and most of all, not conniving with a criminal who cannot get caught because she is now the law!

    Worse is that in the Philippines, more often than not, the laws are drafted, passed and approved by arrogant men who should not be there doing such as a matter of fact. Sabi nga ng isang babaero sa Congress, kung kakasuhan daw siya ng adultery and asked to step down, baka maubos daw ang mga kinatawan sa Kongreso kaya nga tawag ng marami, “Tongress.”

    Apparently, it is one of the dilemmas of the Philippines now, that is, having laws drafted and passed by the unrighteous men not to be followed but to circumvent and serve the unrighteous only. Saklap!

The written statement signed by the ‘infamous’ nine has been carefully and masterfully conceived and custom tailored to fit a dream. It is beyond the capability of warriors to concoct such ‘convincing’ words. And their pronouncements before the press faltered many times that revealed guilt beyond reasonable doubt that of parroting driven words from their tormentors. A classic doctrine of war is withdrawal or retreat, a possible strategy of the nine to recharge their batteries.

    GMA goes to St. Luke’s for check-up

    President Arroyo squeezed into her tight schedule yesterday what officials said was a long overdue regular check-up at the St. Luke’s Medical Center (SLMC) in Quezon City.

    Presidential Security Group (PSG) chief Brig. Gen. Romeo Prestoza and Press Secretary Ignacio Bunye, in separate statements, said Mrs. Arroyo visited SLMC around 1:30 p.m. and stayed until about 2:15 p.m.

    Prestoza said the President was not complaining of any ailment despite her heavy workload. She was only interviewed by her doctors and no tests were done on her.

    These past few days nga ang dami kong translation job. Konti lang ang tuloy ko. Buti na lang I have Sunday to rest and reserve for my religious responsibility. In fact, that for me is more invigorating spiritually and physically. Wala pang hypocrisy!

    I’m actually not impressed. Iba talaga when you get used to something more progressive and superior than the expensive publicity stunt of the dorobos in the Philippines. In fact, from the first time I heard of their turning back to the ideals of Magdalo, I have realized why Trillanes and the braver of his companions did not succeed in pulling the criminal out of the palace by the murky river. They deserve the prison, the maximum sentence. What’s truly amazing about this injustices is Angelo Reyes, if anybody guilty of coup is Angelo. But, this is Philippines.

    Sadyang nagpapapayat iyan hindi dahil sa bigat ng problema sa Pilipinas kundi dahil sa diet pills pihado. Sadyang nagpapapayat iyan para hind masabing baboy din siya gaya noong fatso at anak na boyba din ang itsura.

    Sana terminal cancer din ang sakit niya kung sakali na siyang dahilan ng pagpayat ng maysakit ng cancer sa totoo lang. May pinsan ako in a matter of one month, bumagsak ng 39 kilos from 58. Iyon pala may may lymphoma. Namatay siya due to complications caused by her chemo.

    even if Sen. Trillanes ‘surrendered’ (for the sake of the media, or for his life, i really don’t know) at the Makati standoff, at least, he’s still consistent asking for GMA’s resignation. i hope he fights for his stand and won’t ask pardon (from GMA of all people. but i know that he won’t) or else our country would have really turned hopeless– letting an underserving and a questionable leader to run the country, letting all the corruption and the killings to go on because it happens so often that it already seems like normal.

    i’m very disappointed with our justice system that we have (or lack thereof). it should change its name, really.

    BBC NEWS is one sided on its story on rice crises in pinas. Why? BBC is reporting the rice crisis based only on gloria’s point of view. Stated on their headline news that rice crisis occurred because of hoarders and even interviewed gloria’s secretary yap. BBC never interviewed opposition figures, never mentioned about the fertilizer scams of joc joc, and irrigation scams which are causes of rice shortage in pinas. Also, when President Joseph Estrada was pardoned by coup d’etat gloria arroyo the BBC News never interviewed the opposition figures. They only interviewed pro arroyo prostitutes. Even if they interviewed the opposition figures they only publish statements that will not show the truth about gloria’s cheating, lying, coup d’etat, scams, etc….

    BBC NEWS is clearly on the side of that pokpok. Why? Are they afraid of gloria to be booted out of the country? Are our media outlets, that are not in the pocket of gloria, are not making a good job of dissiminating informations to foreign press? It seems like BBC NEWS is on the side of gloria ever since her last visit to UK. At that time there was even a photo op with the queen of England whereas before the last visit of gloria only prince Edward met with gloria.

    I felt the pain of these incarcerated soldiers and their families. I had seen the cages they were put in.     I should know. My uncle was warden at Muntinlupa many years ago, and a few years back I went to visit a Japanese on deathrow, and saw the deplorable conditon of inmates there especially those who came from the lower class of the Philippine society. I understood then what “butabako,” a Japanese slang for prison cell meant. The prison cells in Muntinlupa, unless you have money to bribe the officials there for better accommodations, etc., surely more like pig’s den!

    In a way, I can see why the Americans demanded better cell for Smith whom they even had to rescue and provide him with US standard prison cell in the US Embassy, which should not have been allowed by the Philippine government because it is in fact infringement on Philippine sovereignty since the US Embassy is in principle, a US territory and the Philippines has no jurisdiction over what the Americans do inside it.

    Forgiveness is grounded on genuine mercy. But mercy has its requisites – justice is but one of them, so is truth, the other consideration among the more important ones.

    Lest we forget, Gloria said on national TV, “I am sorry” and immediately afterwards Bunye announces, “The president has apologized, it is time to move on and forget the past”.

    The natural course is that offenders do not dictate the outcome of their admission. The offended must be allowed retribution, the offender – reform, then we can talk forgiveness. It is not automatic.

    Sure they will be forgiven, afterwards. Not yet when they’re just about to commit another wrong.
