Now that it’s becoming clear that the Memorandum of Agreement on Ancestral Domain between the government and the Moro Islamic Liberation Front is unconstitutional and could be grounds for the impeachment of the one who authorized it, Gloria Arroyo’s minions are scrambling to protect her saying she never saw the document that has now claimed more than 200 lives and rendered homeless more than 250,000 people.
At the final hearing of the Supreme Court on the MOA-AD, Solicitor General Agnes Devanadera said “The panel conveyed to me that the MOA was not submitted to the Office of the President..She never saw it, she was never shown a copy.”
After the hearing, we reminded Devanadera that Arroyo talked about the MOA-AD in her state-of-the nation address, a week before the scheduled signing in Kuala Lumpur. These were Arroyo’s words:
“ A comprehensive peace has eluded us for half a century. But last night, differences on the tough issue of ancestral domain were resolved. Yes, there are political dynamics among the people of Mindanao. Let us sort them out with the utmost sobriety, patience and restraint. I ask Congress to act on the legislative and political reforms that will lead to a just and lasting peace during our term of office.”
Devanadera said Arroyo was just given a general outline of the agreement.
The decision not to sign the MOA-AD “in its present form” was made only last week. Even after a petition was filed by former Senate President Frank Drilon, Senator Mar Roxas and Atty. Adel Tamano, spokesman of the United Opposition to declare the agreement unconstitutional, Malacañang officials have been defending it as not violative of the Constitution. Didn’t Gloria Arroyo bother to read the controversial document?
Drilon said if Arroyo had indeed read the MOA, she could be impeached because under the Constitution, the president “shall ensure that the laws be faithfully executed.”
In the first hearing, commenting on the lengthy enumeration of the lawyer Lourdes Sereno, counsel of Drilon and Tamano, of the provisions in the MOA-AD that are violative of the Constitution, Chief Justice Reynato Puno suggested in jest that to save time she should just have enumerated provisions that were not violated.
As in the first two hearings, Justice Antonio Carpio was incisive and unrelenting. He interrogated Jeffrey Candelaria chief legal consultant of the Philippine panel in the peace talks with the MILF, about the provision “non-derogation of prior agreements”.
Paragraph 7 under Governance states:
The Parties agree that the mechanisms and modalities for the actual implementation of this MOA-AD shall be spelt out in the Comprehensive Compact to mutually take such steps to enable it to occur effectively.
Any provisions of the MOA-AD requiring amendments to the existing legal framework shall come into force upon signing of a Comprehensive Compact and upon effecting the necessary changes to the legal framework with due regard to non derogation of prior agreements and within the stipulated timeframe to be contained in the Comprehensive Compact
.
Paragraph 2 -D under Territory states:
Without derogating from the requirements of prior agreements, the Government
stipulates to conduct and deliver, using all possible legal measures, within twelve (12) months following the signing of the MOA-AD, a plebiscite covering the areas as enumerated in the list and depicted in the map as Category A…
Carpio was able to elicit from Candelaria the information that the phrase “non-derogation of prior agreements” refers to six agreements signed by the head of both panels in the peace talks.
Carpio asked: What is so sacred with these agreements that they should be outside the purview of the Constitution?
Candelaria’s answer was neither here nor there.
“Does the President have the authority to commit to the MILF that these provisions would be exempted from the coverage of the Constitution?”
Candelaria said, “The President is not the one signing the agreement.”
Carpio hammered on: “So, the President is delegating the authority to sign so that she will not be held accountable to the violation of the Constitution?”

The real reason Gloria Arroyo must be impeached, though, is that if she is not impeached, this usurper will simply ignore any bills passed by Congress, will act despite any resolutions passed by Congress, and will break any law that she thinks gets in her way. Furthermore, future presidents, will use this moron Arroyo as a precedent to ignore the legislative law making body and break laws themselves.
The real question for impeachment skeptics then, is: “What are we waiting for?”—Pullido and Lozano?

Normally the staff submit what we call a DF or a brief on a half A4 form stating a one line subject, another line of argument, a third line of conclusion and the last line is the recommendation whether to approve the amount of tongpats and distribution. The tongpats must be so great its not necessary to read the attachments whch is the MOA-AD.
Electing an individual to a position is not as much of a problem since we don’t know how such individual will perform in the office until they’re actually in office. If that is the case, what the hell is the impakta doing in hte stinking palace and saying the she is the president??? is she faking (always) her leadership, who’se in control of what and who??? Tell that to the marines mahadera, the fact that the foreign secretary of the Philippines was sent to malaysia to witness the signing is a sign that the impakta knows the content of the MOA-AD. The fact that a few TONGressmen were in Malaysia to witness the signing is FACT that the impakta knows MOA-AD, the fact that a few Manila-base diplomats came to Malaysia to witness the signing is a sign that she knows it.

Puno asked, “With all those rights and prerogatives given to the MILF, what would have happened if the MOA-AD was signed and approved in a plebiscite?
Devanadera replied: The Filipino people will not agree.
Everybody laughed including the justices.
Puno asked Devanadera: So, why did you go into the MOA-AD?

SG Devenadera was the unluckiest creature during the SC oral hearing defending the government. No one even the brightest lawyer would like to be in her place. Indeed, if the people would not agree if the MOA was signed, why did the government attempt to have it signed in Malaysia in the first place? The motive was too obvious. The government almost succeeded in signing the MOA in secret witnessed by foreign cohorts led by the US. Once the MOA was signed, the government would argue that both side needed to honor the agreement; and there was nothing we could do.
Manny Pacquiao has joined KAMPI, the administration party. He soon would retire to enter politics and run as Congressman in 2010. With no popular candidates and personality to help the administration party, they’re picking Pacman. Let’s see. I hope he loses to De La Hoya so that Pacman would be defeated again in 2010 like what happened to him last election. What a stupid guy allowing himself to be used by the crooks in Malacanang!

A pugilist is now added to the pool of politician talents, the earlier ones being a priest, broadcast journalist, doctors and a slew of lawyers and almost-lawyers. I can detect some benefits contributed by the various skills, but I’m not so sure about pugilism with its attributes of violence. Contemplating the magnet of blood sports such as cockfights and boxing and the enormous betting involved in these events, I am fearful for the future of Filipinas. Pacquiao has no chance against Darlene Custodio in General Santos as proven by his defeat last election. One reason the Pacman is running for Congress in 2010 is because it’s Custodio’s last term. Unless there’s a strong candidate from the opposition to run against him in that District, too bad Pacquiao will win…another idiot obeying his master.

when several high level officials of her administration as well as the Ambassador of United States to the Philippines and representatives of the Organization of Islamic Countries
were in Kuala Lumpur, Malaysia for the signing of that agreement?
Even ordinary citizens had an inkling on what the MOA-AD is
all about and radio commentators and columnists had their share in the discussion on the issue of ancestral domain and the proposed Bangsamoro Juridical Entity (BJE).
Clearly, she has already blood on her hands with the killings of civilians and soldiers by the MILF. The problem must be eliminated and we know who the problem is.
