‘Tanay boys’ motion to dismiss raps junked


A military tribunal yesterday dismissed the motion of defense lawyers to dismiss the mutiny charges against Army and Marine officers linked to the alleged power grab attempt in February 2006, saying the motion was premature.

At least 19 of the 28 accused officers, through their lawyers, earlier filed motions citing lack of evidence. They said evidence and exhibits marked by the prosecution were not enough to prove their guilt.

The 19 include Maj. Gen. Renato Miranda, former Marines commandant, and Brig. Gen. Danilo Lim, former commander of the Army’s First Scout Ranger Regiment.

The two are accused of attempting to lead their men to a march to Edsa in February 2006, where they were to supposedly withdraw support from President Arroyo.

At the resumption of court martial proceedings at AFP general headquarters in Camp Aguinaldo, the tribunal said it agrees with the prosecution that the government must be given the chance to make a complete presentation of its evidence.

The court also said it “must see the evidence and hear testimonies to determine its sufficiency before it can decide (to dismiss the case)…Therefore, demurrer to evidence is denied. The state is entitled to due process.”

The prosecution has yet to start the formal presentation of its evidence as the court martial is still in the pretrial stage.

The accused have been on trial since December 2006.

Before the start of yesterday’ proceedings, Miranda issued a statement through lawyer Trixie Angeles saying he has lost faith in the military justice system. He said he submitted to the process on the belief it would work.

“Today, the court martial will rule on the demurrer to evidence filed by the defense lawyers. The outcome of this trial today – dismiss or continue with the trial – will not change my loss of faith, because the damage has been done,” said Miranda.

Miranda said the careers of his co-accused officers are being derailed by their detention. Worse, he said, some of the accused have lost their loved ones while in jail, the most recent of whom was Capt. Ervin Divinagracia whose wife died of leukemia.

“I look at the upstanding officers detained with me and I see careers derailed, and the country deprived of their honest outstanding service. Worse, I see undeserving people, cowardly, callous, selfish and greedy perpetrating themselves in power, at the expense of these detainees,” he said. – Victor Reyes

    This kangaroo court know they do not have a case but they want to continue incarcerating these officers at the pleasure of the asspweron and the evil bitch! This court will do everything in their power to stall the hearings and present their bogus witnesses only to prolong the agony of these soldiers.

    It is very unfortunate that these men put their lives on the line for a supposedly better Philippines but in a country where those running our institutions are a bunch of hoodlums and criminals, there is no law but their crooked law.

    The more reason we have to be vigilant in not extending the rule of the mob under the evil bitch!

    Total wala rin lang pag asang makakuha ng justice ang tanay boys eh mag ingay na lang sila sa media.

    Suportahan nila ang December 12 rally at sabihan nila ng diretso sa media na si bansot ay illegitimate occupant of malacanang. Para lalong magliyab ang galit ng bayan. Total, they have nothing to lose anymore. Pinaaasa lang sila ni bansot para tumahimik sila, pero wala naman talaga silang aasahan na justice under bansot.

  10. What can you expect of those making up the military tribunal na pihadong nakasahod lahat ang mga kamay para doon sa “grasya” ng hudas na dapat sa totoo lang kinukulong. Makes me wonder if “bribery” is a crime in the Philippines as it is in most progressive countries like Japan, UK, etc. for that is what Gloria Dorobo and her minions do. She has in fact institutionalized what they call as “lagay system” in the Philippines.

    Val: nagulat ako sa balitang nag rally ang mga kabataan sa Greece..kasi mukhang tahimik naman ang lugar…we stayed at the downtown area (just a couple of weeks agro) and while ma traffic din hindi nakakatakot lumakad sa kalye (around our hotel). One thing I noticed though wala akong nakita na Pilipino except when we took the cruise..and they were so good and service with a smile..ang babata and so charming…mga beauties..a number of them came from the Visayas..mukhang maganda ang deal sa kanila..they were recruited from the Phil. through an agency and they work from Feb. to Nov. we were the last cruise and then they go home via Cyprus kasi taga roon ang kanilang barko..then to the Phil.. and after three months they will be back again..
    they made me feel proud of being a Filipino..at Bisaya pa..

    Manila Auxiliary Bishop Broderick Pabillo and chairman of the National Secretariat for Social Action-Justice and Peace of the CBCP needs it.

    He vowed to campaign against politicians backing fresh efforts to revise the Constitution instead of pushing for the elections.

    He said “We want to know first who those lawmakers that signed the resolution [for Cha-cha] are so that we’ll be able to campaign against them”.

    Pabillo said they were surprised why the list of signatories of the resolution has been kept secret until now if “they have nothing to be afraid of.”

    1- The Arroyo government acquired more loans compared to the summation of all loans made by the first Philippine President up to Pres. Erap. I am not surprised. I am used to it. Damn.

    2- 1/3 of our USD 29.2 Billion budget goes to debt servicing, e.g., payment for its interest only! Principal remains the same. That leaves us USD 19.5 Billion only for our government to pocket, ooops my mistake, government to spend.

    3- The interest alone of our government loan is staggering at USD 8.44 Billion per annum or USD 23 Million per day. Very soon, this interest will climb. GMA just approved today another USD 500 Million loan from the WB and ADB for food security and judicial reform programs and another USD 2.08 Billion stimulus package for infrastructure projects. Tongpat-tongpats na ang bulsa ooops mali na naman, utang pala ng Pinas!

    4- Our debt-to-budget ratio is practically over the edge. Surprisingly, we are not going down the drain. We are already in it !!!!! The ratio of 1/3 will soon become 1/2 and the economy will move from bad to worse and from worse to worst. Most likely, international banks will no longer lend us unless we give away our rich resources. The country will be chaotic. It’ll be like Haiti or Somalia.

    The solution. Change of government? Communism modeled by China is progressive but I still believe in democracy with good governance. Change in government form is not needed now, so much so, for Cha-cha’s parliamentary form. What is needed is a Terminator or Terminators to terminate the public services of all corrupt politicians.

Gordon explained that Bolante gave his word that he would return if called. Word of honor? After all the lies and evasiveness, how could a lawyer like Gordon trust this architect of the Fertilizer scam? I told you making this Gordon the Chairman of Blue Ribbon Committee was wrong. I would prefer Chiz Escudero. Enrile and Gordon are Malacanang allies. If Bolante could escape to US and fake illness, why should we believe him now they he would cooperate after being released. Another big corruption case
