Justice Undersecretary Ricardo Blancaflor yesterday said the lawyer of the so-called “Alabang Boys” attempted to “feed” Justice Secretary Raul Gonzalez a release order for the three suspects caught in a buy-bust operation at the Araneta Center, Quezon City and in Alabang, Muntinlupa last September.

During the hearing of the House oversight committee on dangerous drugs chaired by Rep. Roque Ablan (Lakas, Ilocos Norte), Blancaflor named Felisberto Verano, a mistah at the Philippine Military Academy Class 1994 and Utopia fraternity brother at the Ateneo law school, as the one who sent the draft release order to his office last Dec. 23.

Verano is the lawyer for the so-called “Alabang Boys” namely Richard Brodett, Richard Tecson and Jorge Joseph. The three yielded 60 tablets of ecstasy, packets of marijuana and sachets of cocaine.

The three were not released from custody of the Philippine Drug Enforcement Agency (PDEA) as the case was still under review after the charges were dismissed by State Prosecutor John Resado, Verano’s former law student at the Far Eastern University.

Maj. Ferdinand Marcelino, head of PDEA’s Special Enforcement Services, also disclosed in the hearing that a Joe Tecson alias “Joetec” offered him P3 million in exchange for not filing the charges.

“Ano ba ang kalakaran? Tama na ba ang P3 million?” he quoted the caller as saying.

After ignoring the offer, Marcelino said a “mistah” from the PMA Class ’94 approached him to drop the charges in exchange for the same amount which he also declined.

Blancaflor said Gonzalez later admitted to him that he had a prior conversation with Verano and the parents of the suspects whose cases were dismissed for alleged technical lapses by PDEA agents.

NEVER ASSURED

However, he said Gonzalez told him that he never assured Verano that he would sign the draft release order which carried the DOJ letterhead.

Janet Payoyo, Blancaflor’s secretary, said she received the envelope containing the draft order, and asked Verano about its contents.

“We had already talked with Secretary Gonzalez,” she quoted Verano. “Since it was for the Secretary of Justice, kailangan ma-forward sa kanya.”

After finding out that it was a release order, Payoyo asked guidance from Blancaflor who referred her to Resado, the prosecutor in charge.

Resado ordered Payoyong to forward the “draft release order” to the office of Gonzalez which she did.

“Ang sabi niya po sa akin, may usapan na sila ni Secretary Gonzalez tungkol diyan (draft release order),” she said.

Verano, in an interview, confirmed Blancaflor is a fraternity brother.

Verano admitted he drafted the order.

Based on his account, he said that he had talked to Gonzalez to act on the release of the suspects, citing the December 2 resolution of the prosecutors. However, Gonzalez told him that he will first study the case.

He said Gonzalez’ statement prompted him to prepare the draft order. He said he dug into his files to get a sample of the DOJ letterhead.

Verano admitted that his act of preparing a draft order for Gonzalez’ signature was not normal procedure, but justified this by saying that his clients were getting desperate as Christmas was getting near.

“I asked if they could release the boys even temporarily, in the spirit of Christmas,” he said.

‘TATLONG MANOK’

Tecson’s father, Joselito, belied allegations that he called up Marcelino and supposedly offered him “tatlong manok,” or P3 million, for the release of his son.

“I never called him up. Hindi ko naiintindihan ang tatlong manok. Hindi ko siya kilala, and I never offered them money,” he said, adding that PDEA should be more responsible with their accusations.

Rep. Roilo Golez ( Ind., Parañaque) questioned the practice of lobbying in the DOJ, saying it should be reviewed by Congress.

“I cannot understand the temerity and presumptuousness of this lawyer (Verano) to feed draft documents to Secretary Gonzalez,” he said.

Bayan Muna party list Rep. Teodoro Casino questioned Gonzalez’ “awkward” practice of entertaining lawyers and litigants with pending cases before the DOJ.

Rep. Darlene Antonino-Custodio (NPC, South Cotabato) suggested that Verano be subjected to an investigation for violating the Code of Legal Responsibility.

PROSECUTOR CHIDED

Congressmen took turns lambasting Resado for dismissing the case.

Golez slammed Resado for not clarifying the information filed before him.

Rep. Elpidio Barzaga (Kampi, Cavite), a lawyer, insisted that in dismissing the charges, Resado anchored his arguments on the defendants’ affidavit.

Barzaga belied Resado’s claim that a fiscal acts as a judge during the preliminary investigation, citing the Supreme Court’s ruling in Bautista vs Court of Appeals that a prosecutor “does not determine guilt of innocence of the accused.”

Resado said PDEA might have “short cut” the operation because only one operative conducted the buy-bust operation when the operatives should be stationed “strategically within the vicinity so they can respond when necessary.”

But PDEA director general Dionisio Santiago clarified: “Hindi ho single-man team ‘yan. There was the arresting team na kasama ho ng poseur buyer on signal, nagka close-in ‘yan.”

Marines commandant Ben Dolorfino said he hopes Marcelino would be guided and motivated by the Marine core values which are honor, valor and duty.

“I expect him to be a true Marine and give his best in any job that he might be involved in,” Dolorfino said.

Marine Lt. Col. Edgard Arevalo, spokesman for the Navy, advised Marcelino to stand up for what he thinks is right.

“He was telling me that he stood up against the offer and on the matter of having the suspects released,” said Arevalo.

SHOW CAUSE

The families of Brodett and Tecson filed a writ of habeas corpus at the Court of Appeals for their sons’ temporary liberty.

Petitioners asked the CA to order officials of PDEA to show cause for the restraint and detention of the subjects.

Named respondents were Santiago, Maj. Marcelino and Atty. Alvaro Lazaro.

Brodett was arrested in Alabang, Muntinlupa along with Jorge Joseph. Tecson was arrested in Araneta Center in Quezon City.

They were charged with violation of the Comprehensive Dangerous Drugs Act of 2002 (R.A. 9165).

Verano said PDEA should have immediately released his clients with the DOJ’s dismissal of the drug charges pursuant to a resolution approved by Chief State Prosecutor Jovencito Zuno dated December 2, 2008. – Wendell Vigilia, Evangeline de Vera, Victor Reyes, and Jocelyn Montemayor

    I never knew the DOJ prosecutors were of such low quality until I saw and heard them testify at the House hearing. They not only could not speak straight, plain and simple English; they could not even write as pointed out by one congressman regarding their poor grammar. More than their poor qualities, they’re so corrupt in their young age.

    The respondents’ lawyer, Atty. Perano, must not only be disbarred but sent to jail. How could a veteran lawyer who even taught law for many years did such a thing? He could have been doing it for a long time to his clients in exchange for fat legal fees; and it’s only now that he got caught.

    Blancaflor used to be Gringo’s chief of staff during his first two or three years as senator. Then, the two had a falling-out. Blancaflor was fired, for unknown specific reason. From Gringo, the guy drifted in circles, until Angelo Reyes noticed him; then Ed Ermita.

    Raul Goonzalez dislikes Blancaflor because he did not recommend him to the post of Usec. He was appointed by the Evil Bitch at the prodding of Ermita even though Blancaflor and Raul are both Ilonggos. Blancaflor used to be married to a Yulo.

    By the way, if he was involved in intelligence work that led to Abu Sabaya’s neutralization, he was most probably working with Col. Querubin, is that right?

    Next question, does anybody here know who the mistah he might be referring to, is?

    If Verano was already known as the mistah who offered Maecelino the bribe, why did Marcelino still need an executive session to name him?

  8. Yes, Tongue, he was under Col. Querubin in the operations to rescue the Burnhams in Basilan. But he got transferred to another assignment when Querubin’s team followed the Burnhams in Zambo peninsula.

    Col. Querubin has good words for Maj.Marcelino. He is confident Maj. Marcelino will stand by what is true and what is right.

    No less than the Secretary of Justice Gonzalez stated that there’s an ethical issue involved in the action of Atty Verano (drafting release order and sending to Sec Gonzalez).

    The “Code of Professional Responsibility” for lawyers is very clear that lawyers must respect legal processes, to wit:

    “Canon 1 – A lawyer shall uphold the Constitution. Obey the laws of the land and promote respect for law of and legal processes.”

    This opens Atty Verano to an ethics case in the Supreme Court or the IBP.

    this is probably the only country in the world that prosecutes the “prosecutors” at yong mga addicts are enjoying their freedom.

  15. After long absence in Ellen class,finally i’m back.I could not comment more,I’m on jury duty starting tomorrow,hope the court will speed up the trial because i still have an schedule flight to catch before the end of this month.

    All I can say is that I missed you all.Maybe,the court won’t allow me to read the newspaper and blogging.I will be sitting on a jury on a high profile case.

I am not surprised that the three stogees want to be released by December… not only that they can immediately take a flight out of the country while government offices are on holidays but December and new year’s eve is a good market for their stuff … you know parties here and there…and everywhere… would be a lot of M (manok) and 3M Pizzas… for their business. And this Atty. Verano? my goodness! he should be in jail and disbarred for life.

    I have to correct the impression that the Sabaya Intel Project was Col. Querubin’s. It was not. Let’s give credit where credit is due. It was Gen. Sabban’s Intel Project from start to finish. This project started when Gen Sabban was the Deputy Bde Commander of Gen. Miranda in the 2nd Marine Brigade in Basilan. Major Marcelino was then the Intel officer of 5th Marine Bn under Col Banez. As such, Marcelino was deeply involved in the intel operations under the direction of Gen Miranda and Gen Sabban (the Project Officer). When Gen Sabban was reassigned to the Marine Forces South, he continued with the project while concurrently holding his previous position with the Brigade. Sabban recommended Col Querubin to assume his post as Dep Bde Cdr so that the latter could assume a billet also. This gave Sabban fulltime attention to the Sabaya project. Col Querubin was, I think, only less than a month with the Bde before Sabaya was neutralized, and this is what happened……

    On the eve of Sabaya’s neutralization,Sabban was on official business but was directly in control of the operation. He called up Querubin, asking the latter if he would like to join the operation. That was the only time his participation came in. However, there was even no need for an officer with the rank of a Col to be in that operation. Maybe, there were some reasons for that….. Maj Aragones, who was the team leader of the operation, is the most able officer who did the job.

    I should know….I loaned some of my men for that operation.

    Napaka-resourceful ni Atty. F. Verano. May letterhead pa siya ng DOJ. Super close siya sa ins and outs of the DOJ. It is very unethical of him and the DOJ staff to have casual communication with a lawyer representing the accused in a high profile case. Blancaflor and Verano are “brods”, but I see a wider connection between Verano and the DOJ.
    Felixberto Verano is the same lawyer that represented the PNP, NAIA, PSPO during the Senate inquiry on the kidnapping of Jun Lozada. I guess, Verano has been reassured of the impending release of his Alabang Boys clients, as he knows that the DOJ and the government “owes: him for the Kidnapping Case inquiry by the Senate. It is payback time for him. Fortunately, the media and PDEA made this public.
    Can Verano be charged with criminal liability for his use of the DOJ lettehead in drafting the release order? Disbarred at least, jail time would be a welcome relief as well. Use of DOJ letterhaed by non-DOJ staff is Falsification of Official Document/s and therefore a criminal act.

    You are correct. Maj Marcelino is my junior. We were both in Basilan and Sulu during the Sipadan/Dos Palmas operations. In fact, I was the one who sent him reinforcements during a time that his unit was engaged by enemy forces from morning till night. He is one brave Marine and his courage extends to his character. I have no doubt that he stands on high moral ground on the current controversy among corrupt “Justice” personnel and the “Alabang Boys”.

    Kalakaran is the omnibus term of SOP. It applies to everything in the government. It would be unethical if in a context of an adversary. Otherwise, it facilitate things sometimes through the informal organization that includes fixers like in that draft document on a downloadable official stationery which was a result of a DF common with the military learned from staff schools while the responsibilty remains always with the approving authority.

    The release order prepared by Atty. Perano was not a draft. Raul Goonzales said it was a final copy for him to sign. Atty. Perano looked like an old idiot during the hearing. He’s not a Mistah but a fraternity brother of DOJ’s Blancaflor. Marcelino’s Mistah who approached him is in the private sector.

    Perano told the House that Goonzalez refused to sign the release order upon learning the P50M bribery on the news headline while Goonzalez stated that he had not read the resolution yet so why would he sign. Each one’s word against another. But whoever was telling the truth, it was very clear that the two met and discussed about the case which in itself was unethical.

Pero, na-release na naman kahapon ng umaga dahil walang dalang ID yung taga-PDEA dahil kasalukyang nag-expire yung ID at papalitan pa. Inirelease yung pusher dahil ALAS SIYETE na ng umaga, at mag-eexpire yung 36-hour rule pagdating ng ALAS NUWEBE Y MEDIA, Jan. 7.

    Tangina talaga, hindi pa pala tapos yung 36 hours, na-release na! Nang tignan ng mga congressman yung release order, nung isang gabi (Jan. 6) pa isinulat nung piskal!

    rose, hindi lang baliktad ang justice system sa pinas kundi BULOK na. simula pa ito nang manungkulan ang bulok na PGMA (Power Grabber Macapagal-Arroyo) kung saan ang ginawang pundasyon ng kanyang administrasyon ay PANG-AAGAW, PANDARAYA, KASINUNGALINGAN at PAGNANAKAW sa kaban ng bayan.

    balweg: they have common sins..corruption, false witnesses’ stealing, si satanas ang kanilang dios..etc. hindi kailangan ang death penalty kung sinusunod ang batas ng Dios..(the ten commandments). I am not for death penalty but I take exceptions to crimes like this..ibalik ang death penalty..at firing squad sa Luneta..and life would be better in the Phil…
