Takipan at takutan

Natakatawa itong mga prosecutors sa Department of Justice. Nananakot na mag-resign daw sila at low morale na raw.

Sinisisi nila ang Philippine Drug Enforcement Agency, lalo na si Marine Major Ferdinand Marcelino na siyang nag-expose na may lagayan sa Department of Justice para ma-dismis ang kaso laban kina Richard Brodett, Jorge Joseph, at Joseph Tecson na nahulihan ng marijuana at cocaine noong Septyembe 2008.

Sinong tinatakot nila? Hindi naman siguro ang taumbayan na pesteng-peste sa kanila. Hindi naman siguro ang PDEA.

Mukhang ang kanilang tinatakot ay ang kanilang justice secretary, si Raul Gonzalez.

Siguro ang mensahe talaga nila kay Gonzalez ay, “Huwag mo kaming ilaglag. Kasama ka namin dito.”

Kung maayos sila sa DOJ, hindi sila kay Maj. Marcelino dapat magalit. Doon sila dapat magalit sa mga namba-bastos sa kanilang departamento katulad ni Atty. Felisberto Verano na siya pang gumawa ng trabaho nila. Di ba gumawa si Verano release order, sa letterhead pa ng DOJ.

Bakit hindi man lamang nainis ang mga prosecutor doon? Dahil ba sa ‘yan ang kalakaran sa DOJ?

Bakit hindi sila magalit kay Gonzalez mismo na hindi nagbigay ng klarong guideline na hindi maaring i-release ang mga akusado kung hindi aprubado ng secretary of justice ayon sa Memorandum Circular 46. Noong Lunes , Jan. 5, lang nagpalabas ng klarong guideline samantalang limang taon na ang memorandum na yun.

Sadya yata na gawing malabo ang policy sa pagdismis ng mga kaso para ma-interpret depende sa “manok” na ibibigay.

Mukhang umubra naman ang panakot ng mga prosecutor dahil kinampihan naman sila ni Gonzalez. Ang Malacañang naman, siyempre prutektahan si Gonzalez.

Kung hindi, ipaala-ala ni Gonzalez kay Gloria Arroyo na kung hindi nila mina-ubra (kasama si Sen. Kiko Pangilinan) ang canvassing noong 2004 na eleksyon, wala siya ngayon sa Malacañang dahil talo naman talaga siya kay Fernando Poe, Jr.

Kaya, ngayon lang “cleared” na ng Malacañang si Gonzalez dahil siya ang inutusan mag-imbistiga. Alangan ba naman sabihin ni Gonzalez na guilty siya. Siyempre ang sasabihin ng NBI, na nasa ilalim ng DOJ, walang ebidensya sa suhulan sa kaso ng “Alabang boys”.

Hindi ko masisisi si Major Marcelino sa kanyang hindi pagsipot sa NBI.Ano naman ang mahihita niya doon? Baka siya pa ang lalabas na may kasalanan.

Ngunit ito ang klaro sa mamamayan: may nahuling gumagamit at nagtutulak ng droga. Dinismis ang kaso. At kamuntik nang mapalaya ang mga nahuli.Mabuti lang nag-ingay ang PDEA.

Ang laki ng anomalyang ito. Hindi ito makuha sa takipan at takutan.

    Instead of the Department Head resigning, his staff and prosecutors wanted to resign. Then, he stopped them from resigning. That could only happen in the Philippines where the word “shame” has never been heard of. This Goonzalez has done so much damage to the department, to his Evil Queen, to the country that the least he could do is now to get out of government and retire. I’m reminded of former Justice Cuevas who resigned or fired for standing his ground. Cuevas did not take heed of Erap’s instruction to let Lucio Tan and Mark Jimenez go. In fact, Tan’s counsel Estelito Mendoza was putting pressure and bugging Cuevas to let Tan’s tax cases dismissed. I could say Cuevas was among the best cabinet members. When he left DOJ, his staff and the department regretted losing such a good man.

    Bakit kailangan pang sabihin ni Teodoro na…”I ordered a review of policies regarding assigning military to government agencies.”

    Bakit kailangan pang sabihin ni Dolorfino na….”I hope Major Marcelino is telling the truth.”

    Bakit pa kailangan ni Yano na advisan si Major Marcelino na…”Be on the side of the truth.”

    Malabo ba sa kanila ang truth? Eh kahit sinong Ponsyo Pilato na nag-gradweyt ng Law dun Pedro’s Barbershop and Bakery eh alam kaagad kung sino ang nagsasabi ng totoo, bakit di makita ng three wise men na ito?

    Punyemas talaga!!! Nakakabulag talaga ang pera at sariling ambisyon!!!

    Kung may suholan sa Court of Appeals di lalo na sa Department of Justice. May kumita sa kaso ng Alabang Boys kaya sabit ang Office of the State Prosecutor. Pumutok ang kanilang baho kaya sila’y nagkandarapa.

    I could imagine the fear of siRaulo Gonzales when his equally corrupt prosecutors ‘approach’ him and threatened to resign en masse. Saklolo kaagad si Gloria to save the guardian of her pandoras!

    If you check those who are in jail who are mostly convicted of drug cases, majority are poor. That tells you that one could avoid jail time if the prize is right. How many celebrities and movie stars are in jail? Nino Muhlach, William Martinez are among the many drug users in the movie industry. Yet, they’re out there free. Dennis Roldan who was convicted of kidnap for ransom is out on bail.

    This is a report regarding the GMA government through it´s Department Store of Justice which promptly dismissed in 2005 a P151-million tax evasion case against suspected Chinese smuggler Samuel Lee. He was charged with non-payment of taxes despite his income. He also allegedly ordered the diversion of three container vans of plastic resin from a customs bonded warehouse to a company in Valenzuela City upon his arrival at the airport upon his return from Hong Kong. The lawyer running after tax evaders contested the DoJ resolution on the case through a motion for reconsideration (MR) but the justice department appeared to have been dragging its feet. The Gloria Macapagal Arroyo government through the DoJ cited a legal technicality for dismissing the case.

    Lee was among the suspected smugglers named at a recent Senate hearing along with Vicky Toh and Lucio Lao Co, who were purportedly close to First Gentleman Jose Miguel “Mike” Arroyo.

    This deprived us Filipinos of another P151 million in taxes which could have been used for badly needed capital for rice farming.

    May we know from the Honorable Secretary Gonzales whatever happened to this case?

    May we also know from the AFP Chief of Staff Gen Yano, Sir, if the aforementioned statements regarding the P151 tax evasion of Lee which deprived us Filipinos of food because of collaboration of GMA government with the Chinese invader, is the truth?

    May we know if this act is or is not collaboration with the enemy? May we know if collaboration with the enemy is an act or not an act of treason? Before this situation, may we know what is expected of soldiers who are supposed to adhere to the centuries old tradition you mentioned in your speech at the recent AFP Anniversary celebration?

    the DOJ staff should have been allowed to resign en masse, including the DOJ head. Their credibility has been besmirched and apparently this has been the “kalakaran” in that agency. With the letterhead used by Verano and writing the release order, it only show that this has been done in the past, not merely in this incident. Kapag nilaglag ni Gloria si_Raul_o, pati si Gloria, laglag, kaya inabswelto na ito ng Malacanang. As I have mentioned in my previous posting, Verano is a big guy in the DOJ, this came about especially after he represented the PNP, PSPO, Razon in the kidnapping case of Jun Lozada. Si Verano at si_Raul_o, they are owed big time by Gloria.
    The media pronouncement of resigning in en masse by DOJ prosecutors could have re-started the “delicadeza” of wrong doers in the government, however, their head (sirang head), prevented this from happening, for the reason that he himself is part of the problem in the DOJ_ as someone rightly placed it, DepartmentStore of Justice, a hypermart if you will.
    Major Marcelino would be lambsated in a media blitz by the government staff, Ermita and Fajardo will have a really busy sked.
    Hindi ko maintindihan, bakit hindi galit si_Raul_o kay Verana. Sa halip kay Major Marcelino siya galit?
    Ps. Sa Zamboanga, nangyari na rin pala ito, at hindi matandaan ni Raul ang order niya. Aba, dapat mag retiro na siya, dahil senile na pala siya eh, paano natin masisiguro and pantay na pagtingin sa Hustiya kung “Ulyanin” na ang head ng DOJ? I think he is merely playing the “Selective Memory Lapse” game.

    jose miguel, there are similarities in DOJ’s dismissal of high profile drug cases, tax evasion and smuggling cases. These are as follows:

    1) In general, Sec. Gonzales would declare DOJ’s prosecutor/s discovery of irregularities regarding the filing of the case/s.
    2) Cases filed have no merit, lack of evidence and illegal arrest.

    This is very frustrating to us, the PDEA, BIR, BOC, PASG and etc.

    It is reported that a janitor at the Government Service Insurance System (GSIS) is paid more than a first level prosecutor at the DOJ.

    Sen. Francis Pangilinan is urging Malacañang to immediately increase the pay of prosecutors or fiscals to reduce their vulnerability to bribes.

    “Government prosecutors are underpaid and overworked. Unless we raise the salaries of the prosecutors, bribery and corruption will continue to thrive in government. Keeping our prosecutors honest with their low pay is to prepare them for sainthood,” Pangilinan added.

    According to the National Prosecution Service, an estimated 30 percent vacancy rate, or over 400 prosecutor positions, are vacant due to low compensation.

    Ayon kay Gen. Santiago, posible raw na mayroong isang nasuhulan sa DOJ sa kaso ng Alabang boys pero hindi niya ito pinangalanan.

    Pero halatang halata na siRaulo ito dahil napakamalumanay niya sa mansusuhol na si Verano at napakagarapal niya sa PDEA na dapat ay pinapanigan niya.

    The so-called “Alabang Boys” controversy is not a personal attack on state prosecutors and other officials of the Department of Justice (DOJ), Philippine Drug Enforcement Agency (PDEA) chief Dionisio Santiago said Saturday.

    Rather, Santiago stressed that the alleged bribery of DOJ officials to dismiss the illegal drug case filed against Richard Brodett, Jorge Joseph, and Joseph Tecson serves as a call for all government agencies to go against corrupt practices.

    “We’re not accusing all people in the justice department. This is a fight for all government offices,” Santiago said in the weekly “Kapihan sa Sulo” media forum.

    “There’s nothing personal about this. We’re not saying that DOJ is corrupt. All we’re saying is that something has to be threshed out,” he added.

    Death Penalty (DP) for Drug Traders (DT)?

    Big time DT’s will be happy due to less competition and more profit for their business since DP deters the small time DT’s.

    Corrupt justices and law enforcers will be more happy since bribes will cost much higher.

    Drug prices will be higher. It will become more unaffordable to more users and addicts, resorting to various crimes to satisfy their cravings.

    Possible Solution: Include graduated corruption formula in the death penalty that applies to all and includes from the President of the country up to the indigents. Minors are exempted.

    If all them at the Justice department resign, lumalapit na sa 1 million employment as promised. Marami naman siguro marurunong magbasa at sumulat ng better english sa kabataan na papalit. Baluktot nga lang dahil baluktot din and mga naguturo sa DEPED. Exper lang magluto ng maruya na tinitinda sa classrooms.

    After the GOON rejects the resignation of the prosecutors, GMA orders those that have been accused of bribery to go on leave. Who has been accusing who? The NBI says there is no evidence of any bribery. Why has GMA given the order to the GOON? Shouldn’t he be included among those that should take a leave? Sabagay, si Neri confirmed a 200M bribe attempt for a Cabinet member. Ergo, P50 million is too small an amount to include the Secretary of Justice. He’s not really that cheapo, is he?

    The case of the Lee tax evasion case dismissed by GMA government thru the DoJ is just part of the whole invasion of our nation by the Chinese since the 1900s. The GMA government today has been collaborating with them.

    We need not repeat the details of how GMA collaborated with the Chinese in the ZTE Broadband deal, the Spratly Islands occupation , and the leasing by GMA of 1 Million Hectares of our agricultural land to a Chinese firm in a vague contract. This covers about a tenth of our agricultural land. Where will the farmers among us now go for our livelihood and food production function? How can we have food security? After it was discovered by us Filipinos, Agriculture Sec. Yap made a statement that the deal will be on hold pending consultation.

    The Poro Point controversy boils down to the question: Why does the Macapagal-Arroyo administration continue to give Manny Tan, owner of Poro Point Industrial Corp. (PPIC), the privilege of running the free port? Tan, who was given the privilege by President Erap in 1999, is a well-known importer of rice and fertilizer.     In the 1930’s, the Chinese almost entirely carried on the retail lumber throughout our entire islands. They cut and mill nearly 40% of the timber annually put in the market. Former DENR Secretary Gozun suspended the logging operations in Aurora of Toplite Lumber Corporation, owned by the Chua family, in 2003. Investigation revealed that it had been cutting trees beyond its designated area. But former DENR Secretary Mike Defensor ordered their resumption when he came into office.

    The 25-year license to cut trees, covering 36,660 hectares in the Quezon province part of Sierra Madre, was granted to Wilson Ng on November 12, 2002, during the term of former Environment Secretary Heherson Alvarez. Alvarez’s successor, Elisea Gozun, revoked the IFMA on January 13, 2004, saying “fraud, misrepresentation, and omission of material facts” surrounded the process by which the DENR granted the IFMA contract. Ng appealed to Malacañan. On March 4, 2005, four months after the tragic 2004 flash floods and landslides in the three Quezon towns, Wilson Ng was provided the license to cut trees again in the over-logged Sierra Madre mountain range by the Office of the President.

    GMA recently agreed to allow Chinese intruders, disguised as “fishermen” to go into the Philippine-claimed part of the disputed Spratlys archipelago. In effect, the Philippine military can no longer drive away the Chinese when they show up near the Kalayaan reef. The Chinese have built a garrison nearby.

    Is This Politics or Treason by Collaboration Under Cover of Politics and Legal Issues?

    There was a report which came out sometime 2005 about a Chinese invasion of Clark. Filipinos among us in Pampanga, experienced losing grip of economy with the recent establishment of a Chinese owned retailing mall—SM in San Fernando. This time, the same Chinese businessman, Henry Sy has established another of his retailing mall—SM in Clark and with it economic dislocation of our brother Filipino businessmen there in Angeles City, Mabalacat and other nearby towns. We resisted as they were approaching. But they were too economically, politically and legally entrenched in our country for us to even slow down their movements. Again, with their establishment in Clark and with the tax exemption given them by the GMA government, are the loss of our decades-old hold of our economic resources not to mention the 12% EVAT squeezed from us by the same government. With the establishment of SM goes loss of employment. It is also a gain of personnel for SM which have been traditionally exploiting them with 3 to 5 months contractual and no security of employment. The entry of the mall was facilitated by the GMA government thru the former CDC president Emmanuel Y. Angeles, now chairman of the Consultative Commission or Concom created by President Gloria Macapagal-Arroyo to conduct consultations with people on the proposed amendments in the 1987 Constitution and the then Pampanga Vice Gov. Juan Miguel Arroyo, the President’s son. With the facilitation, all obstacles such as: the site being within the aviation zone; public consultation; publication of the Memorandum of Agreement; were all done away with expeditiously. In 2003, the Angeles lost one multimillion-peso investment when Ayala Land Inc. backed out of a planned 8.7-hectare commercial center after a legal opinion of the Department of Justice sustained the GMA government thru the CDC position of locating the SM-Clark mall at the Clark main gate.

    Is this foreign invasion or not? If not, then what is this, politics? If indeed for the sake of argument this is politics, who will protect us Filipinos who are continuously being displaced from our source of livelihood when all institutions in our country today have been functioning to protect these foreigners?

    If this is politics and therefore Filipino Soldiers among us should indeed not lift a finger to defend the oppressed brother Filipino among us, which institution will protect us? How many years have this been going on? Have we Filipinos been protected against them?

    Around November of 1924, we tried to setup a legal channel of check points for identifying and assessing foreigners entering our country as part of our defense system of checking further foreign infiltration. However, while our legal check points where still in the setting up stage, the Americans, with their military might providing cover to the Chinese, quickly dismantled them. An editorial appeared on June 5, 1926 in The Tribune. It made a comment regarding: the Chinese making a plaything of our exclusion laws; their out maneouvering us from the start of our border checking operations, making a fool out of us.

    We tried strategies based on our present condition to gain control as much area of our nation as we could against the foreigners. The start of our series of manoeuvres thru legal operations with the Retail Trade Nationalization Law in 1954 however, was out-manoeuvred by the Chinese. After we implemented this law, some 8700 of the 10,000 Chinese who rushed to get hold of certificate of Filipino citizenship papers after 1946, did so after 1954. We Filipinos actually overrun previously Chinese-controlled areas the strategic value of which where at most, of low significance. Thus in paper, the number of Chinese registered as engaged in the retail trade was reduced and the number of Filipinos engaged in the same business was increased. In reality however, there was no physical difference. The difference was only in paper.

    Many of these Chinese were able to aquire legal documents of being Filipino Citizens in order to make their control of our resources resulting to displacement of us original Filipinos constitutional. It is they who applied what the famous Chinese General Sun Tzu said something like, “…more superior is an Army who conquers cities without fighting…” They conquered our cities without the use of traditional combat weapons. GMA was more than willing to be their puppet government. They have been protected by the laws of the land. They have been protected by the law enforcers of the land. They displaced us Filipinos from our source of livelihood and we have no big brother to turn to!

    Malacañang could be behind moves to oust Supreme Court Justice Reynato Puno, as part of a “grand scheme” to remove all roadblocks to its push for charter change, former Senate President Franklin Drilon said Sunday.

    Drilon added that former Representative Jacinto Paras did not have the clout to mount such a move all by himself.

    This as Senator Francis Pangilinan said he got from his sources at the Supreme Court that the threat to oust Puno was “real” and “serious” and that he and the group Bantay Korte Suprema (Supreme Court Watch) have been set to divulge “at a later and proper time” those behind it.

    The Chinese was persecuted in Indonesia not because of drugs. It was due to political reason. Indonesia then was anti-Communist. Many Chinese-Indonesians were killed, women raped. They could not even use their Chinese names and attend Chinese schools. Those were the dark days for the Chinese in Indonesia.
