Colonel cited for contempt and ejected by court martial

Marine Lt. Col. Achilles Segumalian, one of 28 officers being tried for their alleged attempt to overthrow President Arroyo in February 2006, was cited for direct contempt, taken out of the court by military custodians, barred from participating in yesterday’s resumption of the court martial proceedings, and brought back to his cell at the Intelligence Service of the AFP inside Camp Aguinaldo.

Prior to that, Segumalian had confronted prosecution lawyer Col. Jose Feliciano Loy who had been engaged in a heated debate with defense lawyer Vicente Verdadero over the summoning of prosecution witnesses.

Segumalian told Loy not to shout at Verdadero and let him finish presenting his point. Loy replied it was Segumalian who should stop shouting. When Loy asked the court to cite Segumalian in contempt of court, Segumalian went to Loy and angrily pointed his finger at him.

Security personnel pacified Segumalian and court martial president Maj. Gen. Jogy Leo Fojas cited him in contempt and ordered him taken back to his cell.

Segumalian’s lawyer Trixie Angeles tried to get the court to reconsider but was denied. The court also told a grinning Segumalian to stop making side comments.

Loy said this was the second time Segumalian confronted him during court proceedings, the first being at Camp Capinpin in Tanay, Rizal. He later had himself excused to see a doctor about heart palpitations triggered by the confrontation.

Outside the courtroom, Segumalian said it is Loy who should be disciplined, not him. “We are officers, we are line officers, we are warriors and we will never allow that that kind of behavior of a prosecution lawyer. Dinadaan niya sa pasigaw-sigaw, hindi na makapagsalita iyong defense lawyers namin. If they have to be respected, they should also respect the people inside the court.

“I did not intend to show disrespect to the court. I was provoked by the behavior of Col. Loy… Kung ikaw ba naman ang nandiyan sa loob, nakipagbakbakan ka ng more than 29 years sa serbisyo tapos babastusin ka ng isang prosecution lawyer na ganoon, no way sa akin iyan, bastusin ka ng isang pulpol na abogado.”

    I could just imagine the patience and emotional constraints these Magdalo officers carry in their hearts. On the other hand, criminals civilians and in the service are free out there doing their things. The latest report is that CA has granted the petition of the Alabang Boys to be released from PDEA detention. Over at the Makati Jail, convicted murderer Tony Leviste lavishly celebrated his birthday with foods and lechom. Yet, they say all inmates are treated equally…there are no VIPs.

    Iyong pagsigaw-sigaw ng prosecutor, dapat binabawalan din iyan ng kung sinong bobong hukom. Sa amin iyan, pihado case dismissed ang labas ng kaso sa maraming paglabag ng prosecution panel sa rule of law. Golly, walang imbestigasyon na matino, kinakasuhan? Bobo talaga! Ang daming abogado, puro di kampanilya naman pala! Yuck! And over here, hindi itinutuloy ang trial na wala ang accused lalo na kung under custody ng court. Siyempre nga naman, baka lutuing makaw ang procedure as they do in the Philippines where the court is more like a Mafia operation than a real court of justice.

    Kawawang Pilipinas! Betcha, hindi natatahimik si Rizal, et al sa libingan nila.

    The plight of LCol Segumalian and other resistance warriors among us Filipinos will continue unless we apply a properly formulated solution. If we are truly one with them, one with the Filipino Nation, we should aside from feeling angry or sympathetic, or acting if indeed we are, think. Yes, we should think of a solution. Have we ever wondered why is it that we have been doing a number of things yet it seemed the rest of our Filipino brothers are not participating? Have we ever wondered why our actions do not seem to be a social movement when in fact this case is a social development case?

    We can triumph against the enemy if we develop the precise solution. We can develop the precise solution if we can identify the problem. We can identify the problem if for a start, we can pick the right answers to the following questions:

    Why is it that GMA has been corrupting our election process (hello Garci incident) yet many of us including those among us who have witnessed it, are either not doing anything about it or are just supporting her?

    Why is it that GMA has been corrupting our justice system (never allowing evidences against her cheating and looting to be presented and cross examined before us Filipinos) yet many of us are either not doing anything about it or are supporting her?

    Why is it that GMA has been corrupting our moral values (corrupting our legislators, our judiciary, our soldiers, or our farmers, by punishing those who resisted and rewarding the guilty), setting an example to be followed by us and our children, yet many of us are either not doing anything or are supporting her?

    Why is it that GMA has been corrupting our sovereignty (helping an American convicted of having raped one of our women bolt Manila City Jail, allowing the Chinese to control our rice distribution system, allowing the Chinese to control our national information system thru the ZTE broadband deal and allowing the Chinese to invade our Spratley Islands) yet many of us are not doing anything about it or are supporting her?

    Why is it that GMA has been suppressing or persecuting those among us who have been resisting her having been corrupting the justice system, the moral values of all our institutions and her collaboration with foreign enemies (charging before a court martial with the support of the Supreme Court those who testified against election cheating, kidnapping witnesses against corruption in government contracts, killing of students and journalists, and throwing into prison soldiers among us) yet many of us are not doing anything about it or are just supporting her?

    I’m trying to imagine what happened in the court and it’s unfortunate for all the parties concert: the court, the prosecution and Lt. Col. Segumalian.

    There seems to be something wrong with the way the prosecution is handling the case. But, the action of Col Segumalian does not speak of that of an officer and a gentleman.

    Officer don’t go charging at persons whom you don’t like.
    Goons do that. Segumalian is supposed to be an officer and a gentleman.

    I agree with the actions of LCOL Segumallian considering the situation he was placed into. Balita ko, lumaban daw yan si Segumallian nung balak paposasan ni Esperon ang mga Tanay boys. Marami akong narinig na kwento dun. Kaya lang off topic. Saka na lang siguro.

    But what is important is that Segumallian, by standing up against the goons of Esperon and Gloria, has stood up for the rest. Yan ang mandirigma.

    be, it seems like Ninez Olivarez is starting to attack Ping Lacson but she did not yet mention any derogatory remarks on him.

    Just recently, Ping said that he is in favor of the government’s priority on dealing with economic issues rather than political issues. Ninez might have interpreted this that Ping is starting to side with the administration which I strongly doubt.

    Ping also mentioned that he can no longer run for president because he does not have the money to finance his campaign.

    Paty, what is the connection of your military discipline and the resistance by any Filipino among us including soldiers against the corruption of our institutions which have been destroying the moral fiber– the determinant of the way we Filipinos behave towards each other and our nation?

    We are talking here of struggling to recover the health of our infant nation established a century ago and fought for by our forefather warriors against foreign invaders and their collaborators who have been corrupting it. Where is the connection of your military discipline and the resistance being continued by our present generation of warriors against the continuous replication of corruption by our foreign invaders a century ago being continued by collaborators like GMA today?

    What is the connection of your military discipline and the resistance against continuation of that opportunity of corruption by GMA of our systems including our justice system (never allowing evidences against her cheating and looting to be presented and cross examined before us Filipinos)?

    Inspite of this situation including that of the aforementioned, why is it that people like you are still supporting her?
