Justice Secretary Raul Gonzalez yesterday ordered the NBI to reopen its probe on John Resado, one of the state prosecutors who dismissed the drug charges against the so-called Alabang Boys after allegedly receiving bribe money.

Gonzalez asked the Anti-Money Laundering Council for advise over the bank deposits of Resado following the circulation of a one-page anonymous letter faxed to his office, and to NBI Director Nestor Mantaring and ABS-CBN news anchor Ces Drilon.

The letter sender, signed “Juan dela Cruz,” claimed that he has personal knowledge of the alleged P800,000 deposit to the joint account of Resado and his wife Rowena in Banco de Oro (BDO) in Bacoor, Cavite.

Gonzalez asked AMLC executive director Vicente Aquino if the deposits fall under the ambit of anti-money laundering investigation, “considering that Resado is involved with the Alabang Boys’ illegal drugs case.”

Gonzalez pointed out that the deposit was made on Dec. 2, 2008 the day Resado came out with a resolution dismissing the drug charges.

Resado, in a press briefing, said the P800,000 deposit was part of his and his wife’s revolving capital for their money-lending business at a market in Camiling, Tarlac.

Resado said they have a bank account in BDO branch in Bacoor where they used to reside but the money was deposited in the BDO branch in SM North Edsa in Quezon City.

He said they have been living in Quezon City since 2003 and have yet to have their account transferred from Cavite.

Resado said the money was given to him by their clients in November but was deposited only on December 2.

He insisted that the fact that the deposit was made on the same day of the resolution only showed good faith.

Resado could not recall whether it was he or his wife who deposited the P800,000.

    If you look at Resado’s face, he looks like a young pimp or runner of a syndicate. I don’t mean to ridicule his English, but any elementary kid speaks better than him. One common impression I get from these DOJ prosecutors is that their communication and public speaking sucks. It was very apparent during the Senate hearings. How they became lawyers is a big question.

    The only error of the Chief Justice is pronouncing the word “faithfully” after a phrase, not before it.

    It is the substance that matters, not the form. Similarly, had he said, I Obama, Barack Hussein, instead of I, Barack Hussein Obama, it would make no difference.

    My theory regarding Resado’s deposit – Gonzales made-up the anonymous letter supposedly sent to the NBI!

    The NBI ALWAYS checks with the AMLC whenever there is a suspected illegal payoff. Whether P800,000 or P1.6M, it will fall under the ambit of the Anti Money Laundering Council whose mandate is to flag and investigate sources of bank transactions beyond US$10,000. They did this to Erap’s mistresses and concluded that it was Laarni who funded the Magdalo, and also in the Kawal Foundation of Beaver Lopez to see where money was coming from.

    The info could have only come from AMLC, and the anonymous letter was concocted to be able to show it to media since AMLC works under extreme secrecy and they are bound by the recent court decision that they can only investigate an account after the depositor has been informed and has allowed the AMLC to do so. The letter made possible circumvention of the prohibitions of that ruling.

    Why did Gonzales release it? Because he is in hot water due to the charge of IBP of bribery (again!). He will deflect the bribery insinuation to the least important person in his team and that happens to be Resado who appears to be the most junior among those involved in the Alabang Boys case.

It should be lent to maximize interest and not parked in a bank to earn minimal profit. Only profits are sometimes deposited to monitor how much the investment has earned and if he uses this argument, it means there is much much more money where it came from. Now how does he justify that? From previous dismissals?

    This could be verified from the bank by AMLC. They can disprove if there was such regular deposits due to their business. But since the lawyer presumably knows the court ruling, he can just deny AMLC access.

Kasi minsan while I was still working at the St Joseph;s School for the Blind…after counting the cash from the night before Phil Rizzuto golf tournament I went to the bank to deposit…Como ang cash were proceeds of the “mulligan” and the auction, they were in small bills. Ang intindi ko kasi sa limit na$10,000 ay they should be in one deposit slip kaya hinati hati ko..hindi pa ako nakabalik sa school at may tumawag na sa boss kung sino daw yong nagdeposito ng more than $10,000 in one day from SJSB..mahigpit ang law dito lalo na sa cash deposits…

    The Senate should ask the NBI or themselves could ask the courts for authorization or court’s order to investigate the banks accounts for the purpose and purpose only of probing the Bribery allegations of all the personnel involved including the Secretary. this will at least clear all who claim innocence and give all those involve to also have the opportunity to clear their names before the court thru the Judicial Process, not by Political Process…

    How were they able to deposit Php 800,000.00 cash without notifying the AMLC. I was under the impression that all transaction exceeding Php400,000.00 should be reported and monitored, where possible, investigate as to the purpose and source of the money.
    This inaction and remiss in responsibility of the AMLC gives credence to Sen Ping’s pronouncement that the AMLC is not doing its job, especially on how was Joc the Joke was able to withdraw some petty cash from his recently
    ‘defrosted’ account.

    Your suspicion (#2) is the same as mine. It seems that one P800,000 deposited in the prosecutor’s account and as they read from the letter, “another P800,000 deposited in the account of Rowena Resado with the same account number” is intentionally misleading on the guise of ignorance of bank transactions. I find it extraordinary that an anonymous whistleblower who obviously had access to bank records (two groups of suspects here – bank employees and AMLC investigators) or someone who witnessed the deposit being made (one group of suspects here – a relative or Resado himself) would divulge two transactions when there was really only one.

    What’s further surprising is Resado’s eagerness to show all his bank books FOR THAT SPECIFIC ACCOUNT yet would not issue a waiver to the bank secrecy code.

    Another is that Resado did say he traced the letter was created and printed in a computer shop in Las Piñas! Amazing! All that sleuthing in just a day’s work.

    I borrowed Dean Jorge Bocobo’s Bullshit Detector and that claim of Resado registered a wall-to-wall fullscale readout.

    Well, he can now claim he has satisfactorily disproved the anonymous letter-sender’s claim as false by showing his passbooks where there is only one P800,000 entry and he has all the reason to clam up as far as ANY OTHER account that may exist is involved, since his right to secrecy has been violated. Neat, ha?

    What are the other possibilities?

    1. The sister-in-law’s business is a convenient conduit for laundering this and other bribes that came before this one.

    2. That he has shut the possibilities of investigators dragging his wife and sister-in-law (who may actually have different bank accounts of their own with one account having the “missing” P800,000 as suggested by the letter) into the mess using the famous Jose Pidal Right to Privacy excuse.

    3. The AMLC will let it pass using the court ruling that AMLC can only investigate and open accounts with the full consent of the account owner as justification.

    4. That Sir Raul O. Gonzalez will for the next days continue to feel the public pulse until such time that everything is dead and forgotten before he finally approves the Alabang Boys’ release.

    5. In the worst-case scenario, Resado will still be the scapegoat. Raul saves his skin.

    6. All our kids will soon be addicts because the cops, PDEA, DOJ, AMLC, Customs, politicians, and the anti-drug czar are all scumbags conniving with the pushers and manufacturers for a cut off the P600B annual drug trade.

    rose, usury, corruption and bribery are legal in our beloved country. It is part of our normal life. It becomes illegal only when you are caught or in seldom cases, situational as in the case of Resado.

    In fact, after so many years, this is my first time to see a case of usury will be filed, which I doubt. Resado said this was not a registered business as he considered this as part of his informal economy. This is BS, bombay style that I believe started usurious practices.

    5/6 lending is easy lending. It does not require collateral. Interest rate is around 17% in 40 days or a staggering 153% per annum. In palengkes, daily transaction is easy. They pay P20 interest per P1000 per day. The usual borrower, a vendor nets around P80 to P120 for every P1000 he borrows. Some lenders deduct the interest before handing you the monies. You can easily find this lenders in palengkes.

    Majority of our farmers are also victims of usurers who charges up to 1 sack of palay for every P1000 borrowed. A sack of palay when milled may be sold up to P700. Interest rate on this kind of lending averages 20% per month or a very exorbitant rate of 240% per year!

    It is possible that the P800K being used by Resado for their lending business came from their own pocket. They can cater around 160 borrowers with that amount. He will however be in a very hot water if he cannot prove the facts and figures of his business. Really and truly, he succeeded in waiving his right to back secrecy, and may have succeeded in diverting our attention to his other and hidden bank account by having us focus on his BDO account. Due this, I believe he or they in DOJ made this letter up to again divert his case of bribery to a simple case of he called informal economy. This is their option 1. Their option 2 was to involve Atty. Lazaro to further divert our attention from him.

    Ellen, when Resado deposited that 800 thous, the Bank should had asked for the source of the money as compliance against anti-laundering law. here, they don’t, but the bank alerts the authorities every time and let them do the checks, for every movement more than $10 thousands..My brother told me last month that his Bank, the PCI Equitable asked for justification of source when he deposited a bank’s manager cheque for the proceed of the house sale for his needs and of his wife.

    The banking system in the Philippines sucks. Many are in cahoots with big time depositors. Look at Jocjoc Bolante who has several accounts. Possessing that many accounts would have already attracted suspicion from the banking sector. Resado’s alibi is the common practice of most crooks. Even Generals use the same line. They say their wives and in-laws have business. Let’s not go far. Cong. Iggy Arroyo used to be delinquent in his house rental. He was broke. After becoming Congressman, you would be surprised how much he has.
