Malacañang is coming out with a masterpiece to divert attention from the unholy alliance between Gloria and Mike Arroyo and Merceditas Gutierrez, the Ombudsman.
A highly reliable source said anytime soon the Ombudsman will be filing a graft case with the Sandigan against Benjamin Abalos, the former chairman of the Commission on Election who was exposed to be brokering a $329.5 million national broadband network project for a Chinese firm, ZTE Corp.
Abalos is the subject of two complaints (filed separately by lawyers Ernesto Francisco and Harry Roque) before the Ombudsman in connection with ZTE deal for violation of Anti-Graft and Corrupt Practices Act and Code of Conduct for Government officials. It will be recalled that Abalos offered then NEDA chief Romulo Neri P200 million to endorse the ZTE contract which was allegedly overpriced by P9 billion. The peso equivalent of the Abalos-packaged ZTE deal was P14.8 billion.
By filing a case against Abalos before the Sandiganbayan, Gutierrez thinks she would be able to disprove accusations by those who filed the impeachment complaint against her as a “coddler of the powerful and corrupt.”
But the public should not fall for this because it’s all part of Malacañang-produced moro-moro. Abalos has been assured that eventually the Sandiganbayan will clear him.
But I’m waiting for the Ombudsman case against Abalos and see how Gutierrez can insulate Mike Arroyo who is included in both the Francisco and Roque’s complaints. In Harry Roque’s complaint, he even included Gloria Arroyo and Neri.
The NBN/ZTE case, by the way, is not included in the list of cases cited in the impeachment complaint of betrayal of public trust and culpable violation of the Constitution against Gutierrez. But Abalos is involved in the Mega Pacific case which is No. 1 in the list of cases that Gutierrez mishandled.
The impeachment complaint filed by former government officials and civil society leaders led by former Senate President Jovito Salonga cited Gutierrez’s deliberate disregard of the Supreme Court’s findings declaring as null and void the P1.3 billion equipment purchase contract entered into by the Comelec under Abalos with Mega Pacific.
Gutierrez, in brazen disregard of the High Court’s decision, exonerated Abalos and other Comelec officials involved in the anomalous deal.
In the NBN/ZTE case to be filed with the Sandiganbayan, Gutierrez will try to make a show of doing her job of going after corrupt government officials but it’s still a charade. Just like the other cases cited in the impeachment complaint which are:
• Deliberate and inordinate inaction on the collusion in World Bank-financed road projects.
• Gross inexcusable inaction on the P1 billion fertilizer scam involving former Undersecretary of Agriculture Jocelyn “Joc Joc” Bolante filed by lawyer Frank Chavez and journalist Marlene Esperat, who was later murdered;
• Effectively bungling the case against former Secretary of Justice Hernando “Nani” Perez by filing late a defective extortion complaint.
• Complete failure to resolve promptly the dollar smuggling case of PNP officials tagged by media as “euro generals.”
• Arbitrary dismissal and suspension of Iloilo Governor Niel Tupas and Bataan Governor Enrique Garcia.
Given Gloria Arroyo’s control of the House of Representatives, I don’t expect the impeachment complaint to prosper. Gutierrez protects the Arroyos. So Arroyo will use her clout to protect Gutierrez.
As long as Arroyo is in power, Gutierrez will be protected. Gutierrez can only be held accountable if and when Arroyo is out of power.
But just like the failed impeachment complaints against Arroyo before, it should be done because she has betrayed the public trust and she has violated the Constitution.
President Gloria Macapagal-Arroyo’s husband, Jose Miguel “Mike” Arroyo, Tuesday came to the defense of beleaguered Ombudsman Merceditas Gutierrez, the target of an impeachment case in the House of Representatives.
Mike Arroyo, who belonged to the same batch at the Ateneo Law School as Gutierrez, said those seeking the Ombudsman’s removal from office should lay off her. He denied having close ties with Gutierrez, who was Ms Arroyo’s chief presidential legal counsel and acting justice secretary before the President appointed her Ombudsman.

Nine City of Toronto employees have been fired for allegedly submitting fraudulent benefits claims.
The employees were let go yesterday as a result of an audit by Manulife Financial, which administers the city’s benefits.
They had been put on paid leave Feb. 20.
Mayor David Miller said yesterday he was disappointed to learn of the alleged fraud, but pleased that senior city staff had acted promptly when information came to light.
“If you’re in a position of public trust, you have to uphold that public trust,” Miller said.
Saying they don’t want to interfere with an ongoing police investigation, neither Miller nor other city officials would say how many fraudulent claims had been filed or reveal the amount of money involved.
Nor would they say whether the fired employees were filing claims on their own behalf or also processing claims for others. They also declined to say whether the city will try to recover any money lost.

Right now, the secretary, et al o Ozawa, the head of the Democratic Party of Japan, are being investigated on charges of taking bribes disguised as contritutions to the DPJ.
Now the police have started investigating contributions to other political parties, too, even before Ozawa complained about harrassment, etc. of the prosecutor’s office and the police. All the more reason for the police to do a good job to pin down the culprits.
The courts, prosecutor’s office and the police over here, like in Canada and UK are in fact not under the control of the Prime Minister or the members of the Japanese Diet. That’s why they can put any offending politicians here to jail if they do not commit suicide to save their honor, dignity and pride. It is also a way of curtailing influence peddling, etc. engaged in by lobbyists, who may even have connections with crime syndicates.

I saw Dacer’s daughter in the news last night saying Lacson need not be too defensive because Mancao might implicate someone higher. But who is higher than the PNP chief? Only 2 people: the DILG Sec. and of course, the president. Erap’s then DILG chief, now Manila mayor, Lim is out of the picture. Erap is the obvious target, therefore.
I concur with your opinion that the guns are now trained at Erap. Erap CAN become the spoiler to Gloria’s plan to evade prosecution post-2010 via a new president who is subservient and sympathetic to the forces of evil. For now, the numerous opposition bets will just cancel themselves out of the equation and leave the admin candidate all alone at the finish line.
