Mancao and Dumlao documents

Justice Secretary Raul Gonzalez, in an obvious effort to divert the headlines from the corruption cases involving Gloria and Mike Arroyo, has been titillating the public with the affidavit of former Senior Supt Cesar Mancao.

I got these documents pertaining to the cases involving former Senior Supts Cesar Mancao and Glenn G. Dumlao. There’s nothing that resembles what Gonzalez and Malacañang have been trying to imply the past weeks.

    As usual, Malacanang keeps saying it has nothing to do with witnesses against opposition personalities including this Mancao against Lacson. But, why is the Palace securing Mancao’s arrival? If Mancao doesn’t watch out, he might suffer the same fate of Jun Lozada. The administration is eliminating both Lacson and Erap to narrow down the opposition’s strong candidates. Erap’s issue is his eligibility to run again and Lacson’s involvement of Dacer’s murder. Then, it would be Mar Roxas and Loren Legarda. The dirty work has begun as 2010 election approaches.

  2. My fearless forecast:

    Mancao will not testify because he will not be granted state witness status. Any witness who is a gov’t employee cannot be a state witness, according to DOJ’s Sr. State Prosecutor Philip Kimpo (of Alabang boys’ infamy). But he will be kept under the witness protection program to prevent him from speaking prematurely or from recanting his latest affidavit. He is now a gov’t hostage. The case will drag on for weeks until a new issue will hug the headlines. Mancao’s testimony will serve as Damocles’ sword over the heads of Lacson and probably Erap, too in case either one threatens the Malacañang-sanctioned candidate in 2010.

    I hope Mancao turns out to be Dr. Frankenstein’s creature who in the end will slay his maker.

  3. If you look at Dumlao’s Certificate of Extraditability by the New York court, the certification and the order of commitment to the US Marshal have been made as early as Dec. 10, 2008. If the DOJ is genuinely into looking for truth in regard to the Dacer-Corbito case, why is it dragging its feet? Did it take the US Secretary of State such a long time to approve the extradition and if so, why is Mancao’s approval much faster that Gonzalez has promised that Mancao will be home by next week?

    Nah. The Secretary of State has approved both Dumlao’s and Mancao’s extradition with dispatch but DOJ has not yet finalized its script. That’s why Gonzalez is serializing the striptease. For maximum effect, they need to get as much reaction from the media and the critics before bringing them home to make sure they have all the answers ready in case the duo are interviewed by media. Look at he surprise in Gonzalez’ face while reading some of the items in Mancao’s and Dumlao’s old affidavits (video available in Inquirer.net). They may have to tweak the new affidavit “in the vault” to suit the previous ones, right?

    That’s the only reason they are not showing the new one to media. A notarized affidavit is already a public document I assume keeping it from the public violates legal rules. Am I right, lawyers?

    Michael Ray allegedly ordered Teofilo Viña, who told Mancao. Is that hearsay Mr. Secretary? Is it within any exception?

    Also, Michael Ray, allegedly ordered Dumlao, who told Mancao. Is that another hearsay within a hearsay Mr. Secretary? Does it come within any of the exceptions?

    Are those admissible in evidence? C’mon refresh my memory. This is not what Justice Serafin Cuevas taught me. Maybe you have some jurisprudential gems.

    What about the fact that Teofilo Viña is dead? Is that admissible as a dying declaration? Or do dying declarations only refer to (1) statements by a man who knows he is dying, and makes (2) statements which relate to the cause or circumstances of what he believes to be his impending death?

    Another reason why EK focuses its attention from Gloria’s corruption to Mancao’s and Dumlao’s documents. Bakit ngayon lang?! The pResident bitch is now being rejected from Obama’s land to her own native land of Visayas and her favorite cheating ground of Mindanao.

    Even if Lacson does not smile, I don’t believe that he gave the order to liquidate Dacer. He did not have any motives like those of naonse ni Dacer.

    So what happened to the resolution? Ang tagal naman, just to determine probable cause.

    Is he caught in a bind? If he finds probable cause, baka umangal at kumanta yung nagbayad. If he finds none, baka may alas pa sila Marcelino.

    It’s of course shifting away from the many scandals involving Mike Pig Pidal and the Malacanang criminals. Even the Fertilizer scam resolution has not been released by the Ombudsman as promised by Merciless Gutierrez. By the way atty, you mentioned former DOJ Sec and SC Justice Cuevas was your law professor. Do you know that Cuevas and another former DOJ Sec. Artemio Tuquero are now counsels for Gutierrez in the impeachment complaint against her? Both lawyers are INC members. I wonder if INC has something to do with helping Gutierrez just like it did to Nani Perez’s CA confirmation before.

  10. The handwritten affidavit of Glen Dumlao,I think he executed that for his immigration case to stay in the United States because he’s afraid for his life in returning to the Philippines.Nothing in his affidavit that implicate Lacson on the murder of Corbito and Dacer.

    Actually, there are two or three sets of affidavit. No one knows now which is genuine. Obviously, this is to confuse the public.

    Cocoy’s analogy is good. As for me, Dacer’s murder was during the period when Erap was being ousted. Dacer and FVR were close as far back as early 90s. Dacer was suspected by Erap’s camp to be involved with Ramos to oust Erap. Maybe Dacer knew too much about Ramos and opposition’s plans; so he could have been eliminated not by Erap but by the other side.

    On the basis of the Mancao affidavit, Raul Goon says there is enough evidence to convict.

    Compare this to the fact that he has not yet decided, after a half year of evaluating the evidence, whether or not there is probable cause to indict the Alabang Boys.

    Around 50 security personnel will secure extradite Senior Superintendent Glenn Dumlao once he arrives at the Ninoy Aquino International Airport (NAIA) from Los Angeles, United States in connection with the Salvador “Bubby” Dacer and Emmanuel Corbito double murder case in 2000.

    Mukhang takot rin ang EK na isali sa scripted affidavit si Erap at Ping.

    In Mancao’s affidavit, it was Michael Ray Aquino who ordered Dacer neutralized along with driver Corbito, sabi raw ni Vina.

    If that was true, who was higher than Aquino who instructed him to get Dacer? If there was none as Erap and Ping were not mentioned in the affidavit as masterminds, what could be Aquino’s reason for giving the order?

    Merong itinuro si Mancao base sa kwento raw ni Vina at Dumlao, pero walang rason kung bakit nagbigay ng order si Aquino. Anong klaseng imbestigasyon yan, kulang-kulang. March 2007 pa sinimulang pinuhin ang script at hangga ngayon ay hindi pa tapos dahil kulang ang konek-konek.

    Ano bang klaseng affidavit ni Mancao ito, wala siyang direktang kinalaman, puro DAW at sariling interpretasyon. Halatang-halata ang script ng EK.

    “Mancao, who had investigated the killings, said he understood Vina’s statement to mean that Aquino had ordered Vina to “neutralize” Dacer.”

    “In his affidavit, Mancao quoted another former police officer, Glane “Glenn Dumlao,” as saying that Aquino had issued “illegal orders.” Mancao said he took Dumlao’s statement to mean “conspiring” in the kidnap-murder.”

    Assuming Ping Lacson asked his men in the US to dig up information of the corrupt FG Mike Pidal and Lacson indeed met Aquino and Mancao in the US a few times, what’s wrong? Lacson had all the rights to get all the necessary information about Mike Pidal so that his illegal wealth in the US could be exposed. It doesn’t necessarily mean Lacson was the mastermind in Dacer’s murder.

    Tongue T – On your previous post, you indicated that “Mancao’s affidavit” was genuine having been notarized in the US. Most Notary Public in the US are no credible, they’re like flies spawning in every corner shopping mall.
    Here’s a pretty darn good example: About a year ago wifey and I went for notarization in a corner mall. Notary Public asked for driver’s licenses and picture ID’s and signed their book, finished. While driving on the way home, I asked wifey how much was the charge and told me “a lunchbox of chinese food!”. She was a Filipina. That’s how easy nowadays to secure those notarization.

    Stringent regulations need to be imposed whoever is commissioned to this type of work. I saw a show on XXX abscbn, where this guy is notarizing on the bangketa.

    This guy Mancao rings a bell. Must be the same guy I’ve read several years back who fled the Philippines and became a realtor/broker in Florida. It’s not that easy to become a realtor let alone a broker, so he must have faked all his documents pertaining to his educational background, bribed someone for fake ID’s, etc…. Add the amount of money you had to incur to become such, it’s a lot of dough – so this crook had tons of money with him or someone had been wiring him huge amount of money.

    Will he be prosecuted? Are you kidding me!? Looters investigating looters. It’s just one of the many sideshows of the Philippines. And while we’re discussing an old case and the Spratly’s Islands, the long itchy fingers of Gluerilla are pillaging the people’s money.

    A licensed Realtor in the US can easily access all the properties and the bank accounts of any person provided he has a SS number. He can do this in less than a minute through the internet. It will be difficult to search for Mike’s since he does not have a SS number and more so if he uses dummies.

    In CA, it is easy to become a Realtor. All you have to do is pass the Real Estate Salesperson or Broker Exam. After passing the Exam, you can become a Realtor Member in the County where you reside or even expand it provided that you pay for the membership fee. Some counties does not accept such however.

    If I am mistaken a minimum 60 hours of schooling is required and the process in FL is similar.

    If Mancao became a Broker, he should be more capable than Aquino in digging Mike’s Real Estates and Bank Accounts in the US.

    In CA, only 6 hours of schooling is needed to qualify you to take the Notary Public Exam.

    This Mancao/Dumlao case is nothing but a distraction to the Joke Joke Bolate case, WB, Euro General, Alabang Boys and Legacy cases. None of these cases ever found any resolution.

    Plus of course this may be a process of elimination in the upcoming elections in 2010. This is to discredit Lacson and possibly Erap, leaving the possibility of winning to a “clone” of the pandak. Once the other presidential candidates will come out, expect the SMEAR campaign to expand to the other candidates.

    Ellen, am I right in saying that Mancao and Dumlao were under Aquino at the time Dacer and his driver were killed? So the way I understand, Aquino ordered the killings but he was ordered by someone else, supposedly Lacson. Isn’t Aquino in jail in the US for espionage? So, how can this case be solved when the mastermind is in jail in the US. This again looks like lutong Macao to me. Pandak and company will have to wait for Aquino to be brought home too.

    Magaling ang scriptwriter, director and producer ni pandak. Sagana sa EKSENA at mga lead roles ang mga actors. Sobrang madrama pa! Who are these people fooling? Themselves!!!!

    Re notarized affidavits – The fact is, the affidavits have been used in the extradition hearings and legally, have passed the test of regularity as neither party in the hearings have questioned the documents.

    Compare that to locally notarized ones, and as we saw in the Senate hearings, do not even appear in the logs of the Notary Books.

    What this really means is that it has been established that such documents exist, duly notarized, and have been used in legal proceedings in the US Courts.

    That makes it credible and reliable, possibly more than any subsequent ones and will serve as strong basis to debunk possible fabrications should inconsistencies come out.

    The scriptwriter will have a more difficult time to make the pieces fit.

    Mabigat ang mahuli ng illegal na gawain sa US. You would think that a notary public is a dime a dozen but that is not the case. Every time a notary affixes his signature and stamps on a paper, the paper trail is easy to follow. Maraming nakukulong na notary sa US coz they are in cahoots with criminals. The notaries have identification numbers and unlike in the Philippines where one can easily secure one from Recto, in the US it is legitimately acquired. Crime does not pay in the US, unlike in the Philippines, crime PAYS big time!

    It is easy to trace owners of properties in the US. Everything can be at the fingertips of a realtor or a broker. Those from the Philippines who may own properties in the US illegally can be detected easily. Neighbors talk too. Even if the property is in an upscale neighborhood, mas tsismoso pa ang mga Americano sa totoo lang. They can be detectives in their own way.

    Aquino, I understand, has served his jail term and will be released soon. Only then that his own extradition case, IF ANY, will commence. But I doubt if they will want to extradite him at this time.

    Bear in mind that the faster Aquino returns, the earlier that the Dacer case will be subjudice, hence the demolition job will be cut short.

    That is the last thing the scoundrels want.

    Unlike in the Philippines where the “rich” can have 10 ft or even higher fences, tinted windows in their cars and tons of bodyguards, in the US, fences can only be a few feet high. There are even some neighborhoods where fences are not even allowed. Tinting of windows are illegal. Bodyguards are expensive. So it is so easy to see who is who.

    PSB – Tinting of windows is illegal.

    Depending what state you’re from. Cars which are tinted by manufactures are not illegal. They only become illegal when they exceed the percentage of the normal tint (usually 15/20%), meaning the owners took their cars to a shop and modified or increased the window’s darkness. Even in high desert places are not exempt, if there’s too much tint. DMV’s and police uses a laser type instrument to measure you’re not exceeding the county or the state’s law on tinted side and rear windows. Too much are considered a hazard, regardless if thugs/drug dealers or good citizens are inside the car.

If all those documents are what RaulGoon said he’s hiding in his vault, I’m sure even he is confused assuming he’d already read them. Kailangan ang matindi ang ability to memorize na witness para hindi lumiko at mabanggit ang totoo. Kaya pala pinipino pa ang documentos.

    Regarding notary public here.. I remembered a few years back, I needed to have the deed of sale of my car notarized. It was along Shaw blvd. in Mandaluyong where I saw a sign that read “NOTARY PUBLIC.” When I approach the place it was a “tindahan”, more like a sari-sari store. Inside the store there is a small table and chair. A name plate on the table with Atty. XXXXXX NOTARY PUBLIC written on it. Here is what happened:
    Me: Ms. (the tindera), papa notaryo ko itong deed of sale, nandyan ba si atty.?
    Tindera: Wala pu, pwedi pu matignan yung papiles po nyo sir?
    I handed her the docs. and she, without reading the contents started stamping the name of the atty. below. I was about to ask her why she is doing the stamping since the atty. is not around. She started singing the name of the atty. above his name. I said to myself: WTF
    Me: Ms. legal ba yang ginagawa mong yan? (stupid question from me)
    Tindera: Ok lang pu yan sir, binilin pu sa akin ni atty yan. Wala pung problima. Sir, 100 pisos pu ang bayad.
    Since I was really in a hurry that time, I just paid and got the docs. and left.

    What they are doing to Lacson, with regards to the Dacer/Corbito murder case is not about his running in the 2010 elections. They know that he can’t win. The fat guy and his squeeze just wanted to get back at him and at the same time shift attention away from the scandals of this administration as some of the posters have mentioned. It’s like hitting 2 birds with 1 stone.
    As to Lacson’s involvement in the murder case, I really don’t know but why is it that the daughter’s of Dacer convinced that Lacson had a hand in the killing of their dad? Maybe they knew something that we don’t. It was one of the daughters who announced in public that she have read Mancao’s affidavit. She also mentioned that there are names mentioned in said affidavit. Are there any other affidavits that Mancao made aside from the ones posted by Ellen?

    Hindi ko sinasabi na “ayos” na rin yung anak ni Dacer, but why only now if she had a knowledge before that Lacson has to do with the “neutralizing” of her father? Dapat nun pa ay nagsisisigaw na sya. And what are the bases of her conviction that Ping gave the order? Baka naman nauna nang ipinabasa sa kanya ang script ni RaulGoon?

    Pinapasabik lang ni Gunggongzalez ang mga media pipol doon sa mga apidabit daw nila MancaO at DumlaO. Pinapahaba lang ng istorya para mabaling sa isyu sa mga kagaguhan nila.     If Raul Goonzalez really kept the affidavit in his safety volt in Negros, then why did he read a copy of the affidavit to Korina Sanchez when the latter interviewed him? What’s being kept in his volt is his old kidney.

    I’m more surprised and upset with the Smith rape case than this Dacer murder case. The rape victim is now already in the US and terminated the services of her lawyer who took care of her for two years. Why the US of all the countries? Because it was the arrangement between the Evil Bitch and Washington perhaps in exchange for the return of Mancao and Dumlao. This Nicole is now saying she was not raped and that she was so drunk at that time to remember. She also said she liked Smith and had good sex with him. To those guys in the US, I want you to hunt down this Nicole and rape her again. Just buy her a few drinks and you get it.

    Affidavit doesn’t mean anything until one testifies and confirms it. Anything could still happens on Mancao’s declaration. Unfortunately, Malacanang has banned the media when Mancao arrives. That tells us Malacanang is cooking something.

    Didn’t it occur to you that the “lousy” part was intentional? Looks like Viña made sure that there were witnesses and visible or easily dicoverable trails. Of all salvage incidents in Cavite, this one is kid’s stuff! So Viña’s shooting could have been the handiwork of either camp.

    You can get a better job from istambays in the billiard hall in Pasay Rotonda. For less than 20 grand.

    Michael Ray was after documents; that was the “tasking” to Dumlao when made to case the Manila Hotel. Dumlao was even instructed, kung hindi makuha, pasabugin na lang para masira ang documento at mga computers. In fact, the context of Dumlao’s affidavit seems to be that he wanted to steal the docs, but there was a security camera, so he couldn’t enter the room.

    Even when “Delta” was in Cavite, Michael Ray was still fixated on the documents.

    Besides, why do a TI (tactical interrogation) if your objective is to waste him?

    The “other camp”, not necessarily FVR’s, may have had an ax to grind vs. Lacson, Erap or both.

    The explanation is simple, this group found out that PAOCTF was conducting surveillance on Dacer doing a hit while that was ongoing would surely make them suspects to the crime.

    OR

    One or some of Lacson’s boys were actually hired to do Dacer; part of the plan to cover the real masterminds’ tracks is to drag Lacson and Erap. That naturally drew the heat from them to the fall guys.

    Read Lito Banayo’s account of Ronald Roy’s story in yesterday’s Malaya issue. Many people were after Dacer’s neck. He was being evicted from Manila Hotel because FVR refused to pay him for rendered services Roy suggested to approach Erap to work out a retainer. That explains their meeting. At the time Dacer was desperate for money. Blackmail could have been one of his options his victim might have thought he was better dead and quiet.

    Now why would Erap order Lacson to get his men to kill Dacer after he apparently saved him from eviction? These revelations are fresh and never came out of media in the past.
