PNP: Government troops seize more guns in Maguindanao; 47 persons arrested

(Take note of the spin of “armed plot to resist government takeover…” Where is murder, which was the beginning of all these?)

From the Philippine National Police Public Information Office:

Government security forces seized more high-powered weapons in Maguindanao as intensified operations went underway to arrest and disarm all persons behind an armed plot to resist government takeover of vital local government functions in the province.

At 10:40 a.m. Sunday, police and military troops raided a ranch owned by Maguindanao governor Datu Andal Amptauan Sr in Barangay Limpongo, Datu Hoffer town.

Initial reports reaching PNP Chief, Director general Jesus A. Verzosa, indicate that search operations continue in the ranch after the raiding team found a strash of 39 assorted high-powered gunds including two M60 high machineguns, a grenade launcher and a Cal. 50 and Cal. 30 machine guns.

Dir Gen. Verzosa said a total of 47 persons have been arrested in Maguindanao since Martial law was declared on Saturday morning. Those arrested and undergoing investigation for involvement in armed resistance against the government as indicated by the massing of forces in several towns, mobilization of local government employees for a stand-off with government forces and stockpiling of weapons.

    Si Misuari nga na acquitted sa Rebellion so malamang bago matapos ang termino ni Gloria they will be acquitted too…kapalit nito sure winner ulit sila sa Maguindanao

    Aha! Spin-a-wheel ule, trying so hard to redirect and whitewash the issue of murder to conform with Agnes D’s “brewing rebellion”.

    Armed plot ha! Talaga, libingan ng mga armas na supplied by the AFP from the Bataan arsenal and crook persons like Chavit Swingson.

    I-hilera ang mga murderers na yan, ratratin at i-backhoe!

    Gloria Arroyo can’t and won’t pursue murder charges so she resulted to declaring martial law in Maguindanao. Speaking of short cuts…killing several birds with one stone.

    You may want it to be so, pero hindi ganoon iyon.

    These two things are not mentioned in the 1987 constitution to justify martial law:
    –Solving mass-murder political-clan-versus-political-clan
    –solving mass-murder of media personnel

    Gloria is so used to override/ignore Pinas Constitution, that’s why there’s martial law in Maguindanao.

    Di ba’t si Brenda ang nagpupumilit na rebellion ang dapat maging kaso nina Ampatuan na katulad niya ay dikit din ang nguso kay the goyang?

    Siguro nga ay nasilip din nitong isa (goyang) na kung murder ay mahirap niyang matulungang makalusot ang kanyang magician sa eleksiyon at kinumbinse na pumayag silang idiklara ang martial law sa Maguindanano at kasuhan sila ng rebelyon upang maabsuwelto sa teknikalidad at mabura ang kasong murder na kaakibat din ng imbentong kaso.

    Kaya walang angal na sumurender ang mag-aama sapagkat alam nilang nasa panig nila ang mapagpalang kamay ni the goyang.

    Kawawa naman ang mga inosenteng parang mga manok na kinatay!

    Kung sa kabila ng tambak na ebidensiyang nahuhukay, gaya ng bultong armas at mga bala ay ipawalang sala pa rin ang mga Ampatuan sa inimbentong kasong rebelyon ay tapos na ring lalo ang ating pag-asang magkakaroon ng malinis na halalan sa Mayo 2010.

    Kung papayag din ang mga hepe ng AFP at PNP na basta ganun na lang masasayang ang kanilang pagpupursige sa pangangalap ng ebidensiya ay maliwanag na wala tayong maaaring masasandalan sa sandali ng pagdatal ng banta sa ating kaligtasan.

    Kunsabagay, magsasampung taon nang para tayong mga dagang walang masulingan.

    If there is a so-called armed resistance against the government, then, there should be a stand-off or fire fights involved. There’s no news report about shoot-outs with the government forces. I’m confused like a baby.
    Paano naging armed resistance kung nakabaon ang kanilang armas at bala. Onli in the Pilipins.

    Paano kung lumipat sa ibang provinsia ang mga suspect? Di walang saysay ang warrantless arrest dahil sa Maguindanao lang nag may martial law rule. Hehheh.

  14. Maguindanao Governor Andal Ampatuan Sr. was in a Davao hospital but they were able to arrest him there.

    Davao is not under martial law.

    May writ of amparo directed against the police, NBI and the military di ba? Contempt of court ito kung nagkataon. Si Devanadera ang makukulong sa Cagayan de Oro.

    Now if Justice de Borja were mischievous, he could say, okay, ikulong si Devanadera sa Maguindanao.

    Martial rule in Maguindanao provokes new legal questions. The 1987 Constitution gives power to the judiciary for the first time “to promulgate rules to protect constitutional rights.” This power of the Court is new and is not found in our previous constitutions. As a result of this innovation, the Supreme Court recently promulgated the Rules on the Writ of Amparo. This writ provides protection to those suffering from a proven fear that there exists a threat to their “life, liberty and security.” Further remedies available are production of evidence and inspection. Prior to the issuance of the writ, the only remedy to protect the right of liberty is the Writ of Habeas Corpus. Under this latter writ, the court is given the power to direct any person detaining another to produce the body of the person on whose behalf the petition for the writ is filed. The detaining authority is also asked to justify the legality of the detainee’s continued detention.

    The power to declare martial law, on the other hand, is amongst the extraordinary powers of the President as commander in chief. Once martial rule is declared, military authorities supersede civilian authority. The all important Writ of Habeas Corpus is also suspended. The end result is that individuals arrested in areas where martial law is declared is denied a remedy to question the legality of their detention.

    An interesting issue has now arisen. What is the effect of a protection order arising from the grant of Amparo on the declaration of martial law? While the constitution authorizes the suspension of the privilege of the writ, it did not contemplate a scenario where the Court, also in the exercise of constitutional power to protect constitutional rights, would issue rules relative to a new writ such as that of amparo.

    Simply put, with the Court of Appeals having issued a protection order in favor of some members of the Ampatuan family, could the same members subject of protection be detained as a result of the declaration of martial law? And if so, what effect, if any should the protection order on their right for a judicial remedy to question the validity of their arrests?

    These are very difficult legal issues to answer. The fact that the Writ of Amparo is new compounds the controversy since we are denied the benefit of jurisprudence. In any case, in the resolution of this issue, it is imperative to consider the nature and function of the bill of rights. These rights exist precisely as inalienable and as guarantees against excesses on the part of the State. In case of doubt and despite the magnitude of the offense, one must resolve the issue in favor of freedom.

    Nabuang ang mga korap na militar na madiskubre ng husto ang kanilang business with the Ampatuans kaya biglang hostage nila si Goyang na walang leverage dahil tinakot rin ng militar na ibubunyag rin ang kanyang Hello Garci operations.

    Huh! Kabi-kabila ang blackmail kay Gloria, buti nga! That explains why the bitch has not been seen nor heard, hostaged nga siya ni Ermita.
