Bakit ba hindi lumalabas si Gloria Arroyo para magsalita sa napaka-mahalagang bagay na nagyayari sa bansa: ang pagdeklara ng martial law.

Kahit sa Maguindanao lang ang deklarasyon, isang mahalagang desisyun yun at walang presidente ang gumawa nun mula nang maibalik ang demokrasya sa Pilipinas.

Bakit si Executive Secretary Eduardo Ermita ang pumirma ng deklarasyon pati ang report na kanyang pinadala sa Kongreso? Kahit sa TV, hindi siya lumabas para ipahayag itong mahalagang proklamasyun.

Siya pa ba ang nagpapatakbo ng Pilipinas? O puppet na lang siya nina Ermita at mga tinatawag na “hardliners”sa Malacañang.

Sino nga ba ang nagpapatakbo ng pamahalaan ngayon? Noong haka-haka pa lang ang martial law, sinasabi natin hindi mangyari yun kasi hindi hawak ni Gloria Arroyo ang military. Hindi katulad noon ni Ferdinand Marcos noong 1972.

Ngayon nangyari na. Nagdeklara na ang martial law. Ibig ba sabhin nun mali tayo at hawak pala ni Arroyo ang military? O baka naman siya ang hawak ng military ngayon?

Maraming bagay ang nangyayari ngayon na nakakabahala.Apat ba araw pa lang ang martial law sa Maguindanao ngunit gustong-gusto na ni Major Gen. Gaudencio Pangilinan, vice chief of staff para sa operations, na paa-butin hanggang eleksyun sa Mayo.

Kapag pinaabot yan sa eleksyun, sigurado, maghahanap na naman yan ng rason ha pahabain. Kung makalusot nga naman, bakit hindi.

Ang galing naman talaga nitong paboritong heneral ni Gloria Arroyo. Pareho lang siya ng kanyang amo. Bakit magkakaroon ba ng private army ang mga Ampatuan kung maayos ang palakd nila sa miltiary? Paano naman napunta ang mga armas ng military kina Ampatuan?

Hulyo 2003 pa nang ibinulgar ng mga junior na opisyal sa Oakwood ang anomalya ng pagbebenta ng militar ng mga armas at bala sa mga kaaway ng pamahalaan. Nag-imbistiga ba? May naparusahan ba? Ang ikinulong pa ay ang nagbulgar.

Ngayon gusto pa ni Pangilinan pahabain ang walang basehan na martial law sa Maguindanao. Aayusin na nila ang eleksyun. Akala yata ni Pangilinan nakalimutan ng taumbayan na kasama ang heneral ni Arroyo sa pandaraya nina Ampatuan nonng 2004 na eleksyun.

Hindi ko alam kung pareho ang ang pag-iisip ni AFP Chief Victor Ibrado kay Pangilinan. May mga nagsasabi kasi na isa si Ibrado sa hindi kaagad sumang-ayon sa pagdeklara ng martial law sa Maguindanao. Kaya lang, sumunod na rin.

Ang nakakatakot nito ay baka bukas, buong Pilipinas na ang ide-deklara na sakop ng martial law.

Kailangan tayo magpu-protesta ngayon palang. Bukas may rally sa Mendiola ng simula 10:30 ng umaga. Ito ay inu-organisa ng November 23 Movement, ang grupo ng mga mamahayag na naghahanap ng katarungan para sa mga biktima ng masaker sa Maguindanao.

    Supporters of the Ampatuan clan—whose leaders are key suspects in the November mass murders—fired on police on Sunday, two days after President Gloria Macapagal-Arroyo declared martial law on Maguindanao province, authorities said.

    Police commandos were on routine patrol searching for illegal weapons when they were attacked, triggering a 10-minute clash. “Suddenly they were fired upon and there was an exchange of gunfire. They were not able to move so they called in reinforcements,” national police chief Director General Jesus Verzosa said.

    The commander of military forces in Maguindanao, Lieutenant General Raymundo Ferrer, said Monday that troops were hunting down 3,000 Ampatuan followers who had escaped to the hills before martial law was imposed. “The number would not be less than 3,000,” Ferrer told dzBB radio in Manila. “These (militiamen) are in hiding with their weapons. They have said they will fight and there are many of them.”

    May duda ako na may deal ang Ampatuans and GMA and GMA is accommodating the former. Ang duda ko ay base sa mga sumusunod:

    1. Hindi naposasan si Andal Jr at walang warrant of arrest.
    2. Sinundo pa ng Secretary of Justice sa tarmac
    3. Delegation of power to PUno the resolution of Maguindanao problems.
    4. Announcement of Martial law and explaining it to Congress with Ermita signing the documents.
    5. Arresting Andal Sr. beyond the territorial limit of the declaration.
    6. No official announcement from GMA herself condemning the Ampatuans and pointing to them as the cause of the declaration of martial law. Which is unlike the Oakwood and Manila Pen seige where she personally appeared on TV condemning the mutiny. isama na rin ang announcement ni L. Fajardo na friends pa rin ni GMA ang mga Ampatuans.

    Kasama sa deal na hindi mangagaling kay GMA ang “pagtira” sa mga Ampatuans.

    Going back to the question, baka nasa Asian Hospital nga o nasa Lubao Pampanga si GMA undergoing immersion program bilang representative ng District 2 ng Pampanga.

  22. Marami nang kwento at komentong naglalabasan tungkol sa imposition of martial law sa Maguindanao at ito’y pinangambahan na tumagal o gawin nang pangkalahatan. Marami rin ang nagtataka sa continued silence and disappearing act ni GMA at si Ermita na lang ang pumirma sa justification ng martial law declaration na syang isinumite sa Kongreso.

    Sa ganitong kaganapan, may taginting ang katanungan, si GMA pa ang ang nagpapatakbo ng pamahalaan? Ang aking nasa isip ay ang pagkakatalaga kay Norberto Gonzales bilang Acting DND Secretary. Kung ating natatandaan, si Gonzales bilang National Security Adviser ay nagpanukala ng “transition government” na umani ng katakot takot na upasala kaya nanahimik. Kung nagawa ang Proclamation 1959 kahit malabo ang basehan, hindi na tayo masosorpresa kung isusunod na iarangkada ang transition government.

    Kung sakali, sino ang magpapatakbo ng transition government?

    A different view: Let me share what I have learned from my conversation with an Atty. Rebellion is a political crime. But here’s what interesting from another guest :

    When state actors commit mass murder then the offices that have administrative control of these state actors who turned mass murderers are liable. The DILG and DND apart from the Office of the President are responsible down to the men who pulled the triggers.

    The PNP, CAFGU and CVO’s were all legally constituted authority. This entire declaration of martial law is simply a crude attempt to change the legal narrative to absolve the central government of complicity in this mass murder

    I replied according to my understanding of criminal law. In murder, the prosecutor will probably point the Ampatuans as the proximate cause ( location and direct duty) . The rest can be liable as contributorty to the crime regardless if they knew nothing that a crime was about to happen.

    But rebellion is a political crime against the government-the people. Rebellion may have a different judicial process.Those who are supposed to be” contributory” to the crime of murder may not incur liability in rebellion. In my point of view, those ” contributory” becomes one- the government or the people of the government. Could this be the reason why
    Gloria did not show up?

    This gruesome event is very embarrassing for her because she is the commander in chief. Attending the session with all the other guilty like her is too sick… She is probably would just like to relax in bed just like the other rich people in the world 🙂

  32. Tongue re #25, Devanera admitted in the forum with FOCAP that it was a typographical error. Anyway, she said, the relevant provision was stated in the proclamation.

    It may not affect the cases but it shows sloppiness with the way policies that has grave implications for the country and the people are made by this administration which has shown many times their contempt for the law.

    Good of you to clarify the different positions — para mas klaro (especially for Ellen), kompletohin natin: deputy chief of staff in short is always called or referred to as TDCS (that’s how his papers are signed).

    By the way, puwede pa rin maipasok ni Boygee ang sarili niya (contender) for CS if he can get division (even for 3 months, has happened a few times so why not?) then 3 months to 6 months as SOCOM (happened too – Reyes and if I’m not mistaken, Braganza or Senga), 3 months or so as if CG PA (happened a couple of times if not more – Abadia and Reyes) … of course, that will depend on seniority or promotions by merit being respected; happened a lot in the navy, so army should be no different.

    Boygee’s main handicap is he does appear arrogant and full of himself (although he can be muy simpatico to those who are close to him and will go out of his way to be nice and helpful) but if he sucks up to the current CS — and to all the members of the Board of Generals, he stands a chance… he’s still got 2 years anyway if not more (I think).

    But of course, at the end of the day, the best patron he can have is Gloria.

    At the FOCAP forum yesterday, he was asked about his desire to have martial law till elections or beyond and he said. “don’t take that seriously. It’s a rhetorical answer to a rhetorical question.”

    Is he to be taken seriously? What kind of an officer is that.

    Anyway, my firned who is a member of FOCAP said during the forum, everytime a reporter would ask probing questions, she overheard Pangilinan asking Manny Mogato of Reuters, formerly a defense reporter, the background of the reporter.

    He even told Mogato not to ask questions anymore.

    After the forum, he commented, “hostile pala ang grupo na ito.”

    As I’ve said over and over again, you don’t have to capitalize the simplest words to deliver your message. Readers here are intelligent. They will get your message even if they are not screaming, which is what is the impression if you capitalize it.

    Comments with so many words unnecessarily capitalized are a turn-off. No one wants to read it.

    What I don’t understand is why Pangilinan was allowed to make pregnant pronouncements about martial law extension!

    Either he was given the green light to do so by Ibrado, in which case, buck stops at Ibrado, or he did it on his own without Ibrado’s authorisation. If it’s the latter, Ibrado should be livid — if he ain’t, then he is a weakling.

    A mere J-3 making a huge political statement like that? If ever, J-7 should have been tasked with doing it. Particularly at a time like this when gloria’s martial law proclamation is not met with joy, this sort of statement is destablising. They should know that. Why should they telegraph their thoughts. What kind of military tactic is that? Doesn’t make sense.

    Looks like he got burnt. (They should have only one spokesman. Brawner should be the only one doing the talking to media officially. Two officers at that level needing to control the damage that was done the day before smacks of amateurism.)

    Ellen, to be perfectly honest, I’m still a bit sceptical. An officer at that level telegraphing his thought over a critical and controversial political issue is just not done.

    Boygee may be full of himself but he is not an idiot. Somehow, he must have been “authorised” to test the waters. By whom, and why? is a big question mark…

    Not quite true. Erap had the best private army in the land: PSG complete with SAM, etc.

    All he had to do was to give the command. At the time, the PSG were still in his corner. (Kaya nga si Joe Calimlim, then PSG chief umiyak ng mag-give up siya.)

    Contrary to popular belief, the PSG is one branch of the AFP that can be counted on to defend the presidency (and by extension, the president) through thick and thin if the president so wishes. The PSG is composed of officers and troops from all branches of the armed services and the police. That is the best “private army” you can have.

    Also, as I’ve said in the past, then CG PAF was absolutely against the plot to overthrow Erap and had even challenged Angelo Reyes; he was definitely prepared to galvanise following (even if PAF was the smallest armed service of the AFP) but it was Erap who finally caved in.

  81. As to Erap’s running — to me, that’s his prerogative to run. If he wins, good on him. If he loses, tough.

    It would be good to have one major candidate (sana) from the opposition — a united opposition that is, because I fear that with a fragmented opposition and dozens of candidates from all sides of the political spectrum, Gloria’s candidate, Teodoro, will win, or Villar. If one of those two wins, there is a great likelihood that the Philippines will live another execrable life for another 6 years.

    (Obviously, I’m not convinced that if Noynoy, Erap, Gordon, etc. wins, the Philippines will experience good governance — am hoping that if an opposition candidate wins, RP stands a chance of less execrable governance than if Gloria’s designated heir wins.)

    Matter of fact, CGPAF, in a heated argument with Angie Reyes said, “Why don’t we call for a snap election then?”

Ang nangyari, natakot siya ng i-threaten siya ni Rene de Villa that BGen Espinoza’s brigade who were stationed in Quezon would attack Malacanang and hinting at bloodbath which I agree Erap wanted to avoid. But that was probably avoidable had he not lost his nerve, he had the PSG, he could still have enticed following from certain elements of the Armed Forces up to the last minute. He would have been morally and legally right to do so.
    What he failed to do was call the bluff of de Villa, after all the troops that were supposed to attack Malacanang, in case he refused to resign, were only a brigade at most and were still in Quezon.

    Hindsight: he could have contacted an Ex-O or even a lower ranking officer at Espinoza’s brigade (through one of his PSG officers who I’m sure would have either a mistah or a colleague) to check out or to perhaps entice that officer (who would certainly have a following) to break away from Espinoza. Another thing, Leo Alvez of Class 66 (former PSG chief to FVR), retired maj general and Abad, both actually retired were actually the ones who were rousing rabble in the military rank and file (outside of the board of generals) — but while they may have had influence, there was no way, they could command the troops — troops wouldn’t have followed Alvez nor Abat without the ok of the commanders in active service. Espinoza was the only one at that time in active service who was prepared “to physically attack” Malacanang.

    As I said, Era^p lost his nerve during the most critical moment of his entire life, so, lost the battle without firing a shot and ultimately the war.

    Unfortunately, this is a blot on his record that will never be erased. A commander in chief must act with compassion but also must act with conviction and courage at all times to gain the respect of his armies in times of national crisis.

    I hope you understand what you are saying. The PSG is not a private army. They are government soldiers assign to protect the prez and unless the prez is careless enough to use for his own selfish interest he can order them to massacre innocent people. That’s precisely Erap avoided, he can not in conscience see people killed and blood flowing in the streets that’s why he sacrificed his presidency. He is not a violent or a mobster type and he should be getting credit for what he has done, giving up the presidency without bloodshed to a determine military led by no less than his COS Reyes who mutinied and withdrew support from him, but instead he is being ridiculed for his action.

    Well everybody is entitled to their own opinion.

    Of course I understand what I’m saying… Modesty aside, I believe I know more about the PSG than you might think I don’t.

    I simply forgot to put the bloody thing in quotation marks in the above commentary if you really want to know but if we are talking of “private armies” (a figure of speech to highlight your referenc to Erap not having an army…, the PSG is the AFP branch that ensures the private and public security of presidents and in that category acts as “private army” to a president while that president is in office (nothing wrong with that at all) and to that extent, the PSG is prepared to engage hostile forces even from the different major armed services, i.e., their colleagues in battle to protect the life of the president even if it means getting killed.

    In that context, during Erap’s term, Erap had AN ARMY all to himself, a veritable professional armed entity in the private service of the president; they are armed to the teeth, trained in special forces task (British SAS trained them during Henry’s time too), so Florry, whether you accept it or not, the PSG is better than the Ampatuans’ “army”. They are meaner, and definitely no wonker.

    Now, if you feel terribly hurt that I categorise the PSG as the Philippine president’s “private army”, let’s simply call them the president’s dedicated government army, OK?

    A commander in chief has the ultimate duty of ensuring that the Constitution is respected and if he has to send men to battle and be killed, he can and should do it. If he cannot do it, he has no right becoming the commander in chief or to command the armies (plural)!

    When the president is physically attacked or the seat of the presidency of attacked by hostile forces with the aim of toppling him and his government (am using govt here in the British sense), the president must defend himself and his government by using the forces at his disposal, military and civilian, because in so doing he is upholding the Constitution.

    Obviously, surrender is always an option; he can surrender if he so wishes but as Henry said — and I completely agree with him — he should not expect his officers to fight to the death for him if he surrenders. He must command and if he cannot command, he should just go away.

    Why should you, I or anybody else and soldiers for that matter fight for someone who refuses to fight for what is right, morally and legally and instead surrenders? Doesn’t make sense.

  106. Missing was something terribly important: the heated argument between PAF commander Defensor and Reyes. (That’s why Gloria never quite trusted Benjie Defensor from then on… but that is another story.)

    Also, during fiesta at Edsa, one thing that media mistook for as support for the uprising was the aircraft that was hovering over Edsa. Actually that aircraft was hovering over the fiesta NOT IN SUPPORT OF THE UPRISING but waiting for Defensor’s command against hostile forces to the sitting president, eg., Espinoza’s brigade.

    In other words, up to the last minute, Defensor was prepared to challenge Reyes. But there was no word from the commander in chief… That is the reason why Defensor was THE LAST ONE of the major service commanders to climb the stage at Edsa. He did because the die was cast!

    Civil Society was ecstatic about that aircraft — they didn’t know that it was not meant to support their uprising.

    As to Navy, there were officers in the navy, captain rank and below who were awaiting word from their commander (Wong) but up till then were not prepared to mutiny — in other words, then N3 himself was opposed to anything that would be mutiny and would be prepared to fight in defence of the president (Erap).

    Erap lost his nerve, he believed what he was told by retired generals — he still had elements in the armed forces who would have stood by him. But he was demoralised when his bosom friend, Reyes turned against him. He wrongly assessed that Reyes was the be-all of the armed forces. WRONG!

    Maybe it’s because I didn’t have a military training or not having a military mindset, that is always ready to kill and be killed for a cause that’s why I can hardly understand how the military works. Unfortunately or fortunately my training is about figures and numbers, a number cruncher and with this goes a philosophy that I always put into practice, conservatism, that it is always better to err on the side of caution or in the positive side of a situation.

    In 2001, the top man of defense Mercado, COS Reyes and Top cop Lacson witdrew support from Erap. Who could have been the officer Erap have to deal with? Maybe nobody because the moment these trio of traitors withdrew their support, not only the communication lines was cut off but the chain of command was broken. Erap can not afford to speculate about the loyalty of other officers and soldiers and he was right to think that the full force of the military were at the beck and call of Reyes and Mercado, otherwise they were not that confident to announce their withdrawal. Thinking maybe that the fight was against the full force of AFP, PAF, Marines, Navy and the Police, not to mention Cardinal Sin and Cory and the people; Erap opted to err on the side of caution by leaving Malacanang to avoid bloodshed and a violent confrontation between Filipino soldiers on one hand and between people on the other.

    That’s not cowardice but wisdom and courage. Bravery doesn’t always mean to fight, to kill and get killed. Bravery is when you know how to accept and conduct yourself gracefully in humiliation, loss and defeat.

    Some speculations were rife that he still have the support of other officers, but even if verified to be true, it will be still a confrontation, a war and those were the things that he wanted to avoid at any cost even his presidency.

    Firstly, there are wars or armed conflicts that are unjust and there are wars or armed conflicts that are required because the purpose is just, and a conflict that arises out of defence of what is morally and legally right is never reprehensible (unless of course, one wants to be cannonised), and most of all, because sometimes it is the only way to defend your people from evil aggressors and illegal usurpers.

    Secondly, those officials you mentionned were, if you like, the administrators of a huge defence and police machinery but in fact, the president as commander in chief doesn’t even need them to command the troops. The lines of comms were not realistically broken even if for the sake of argument, these officials had resigned. He could have appointed a junior officer if he wanted to, eg., a captain, a major, and of course, a lt colonel, a colonel to replace them ON THE SPOT and given these appointees the command to put order in the rank and file.

    Thirdly, he had the PSG. Elements of the PSG, as I said, were still on his side. Hence, all was not lost.

    Don’t get me wrong. I understand your defence of Estrada’s purpose, believing that his relinquishing the presidency was a “noble” decision — perhaps so. Was that the right thing to do? Would there have been bloodshed had he decided to stay the course and defended what was supposed to be a morally and legally just course of action? Would he have succeeded if he had rallied his remaining loyal troops? Perhaps not, perhaps yes… we can only speculate on what might have been and what might have not been.

    But what we should all acknowledge, and this is the point of my comments, is that a commander in chief must be capable, have the ability, the courage, to rally his forces, give command to his troops — no matter the number, decide to take action in defence of what is Constitutionaly just, defend the presidency, fight for his people, do everything in his power in order to prevent the fall of the govt and the Republic. At the very very very least to give it a try!

    Unfortunately, what Henry said about the man simply not having a clue as to what was going on around him tells a lot about the man and why he failed. Never mind… it’s no longer here nor there.

    You yourself are a living witness to the havoc that was created because he offered no resistance to the aggressors and the usurpers of his legitimate mandate. It was as if he purposely had allowed it to happen so ultimately, he could be delcared as guilty as the usurpers!!! What we also know is that he did not even give it a try and because he didn’t, we will never ever know if Gloria could have been prevented from becoming the nation’s ‘president’ today.

    All we know is that today’s confused, damaged, incredibly dirty political landscape is a living testimony to what happens when a duly elected president who is supposed to uphold the Constition prefers to purposely back out of his responsibility as the nation’s commander in chief.

    And paradoxically, if you notice, there’s bloodshed all over the place virtually at every level of society, where you insisted that the purpose of Erap’s giving up his presidency without a fight is to avoid bloodshed.

    All this to say that because he did not act the part, I don’t believe he has a right to be commander in chief again.

    You made your point and I made mine. You cant’s see what I see and I can’t see what you see. Military trained point of view seems to be irreconcilable with a civilian point of view. So I rest my case.

    Anyway if Erap wins, whether he is qualified or not, whether he has the right or not, whether we like it or not, he will be the commander in chief again and we can’t do anything about it.
