Arroyo lifts martial law in Maguindanao

Martial law will be lifted in Maguindanao at 9 p.m. Saturday, eight days after it was imposed by President Gloria Arroyo.

Executive Secretary Eduardo Ermita said Arroyo lifted Proclamation No. 1959 on the recommendation of the Cabinet which concluded that the government has met its main objectives in placing Maguindanao under martial rule and suspending the writ of habeas corpus following the Nov. 23 massacre that left 57 people dead.

Ermita said, however, Maguindanao, Sultan Kudarat and Cotabato City will remain under a state of emergency.

The executive secretary said Malacanang will be transmitting to Congress soon the proclamation lifting martial law.

Congress has convened a joint session on Proclamation 1959 and was scheduled to vote for or against the declaration of martial law on Tuesday.

Ermita said the decision to lift martial law was based chiefly on a joint report of the Armed Forces and Philippines National Police that the five objectives in declaring martial law had been met.

He said rebellion and multiple murder charges have been filed against the suspects of the massacre before the courts.

The police and military have cleared “rebel positions” in several towns in Maguindanao and the criminal justice system was “in place and working,” he added.

The executive secretary also said normalcy has been restored to the local government units. Autonomous Region in Muslim Mindanao Vice Gov. Ansarrudin Adiong has been appointed acting governor of the region.

Lawyer Harry Roque, one of the petitioners to revoke Proclamation 1959 before the Supreme Court, said, “It’s typical GMA:violate the Constitution and lift it when review and defeat are imminent.

“I hope the Court will repeat what it did in David vs Arroyo:declare martial law as unconstitutional as despite mootness, it involves a major violation of the Constitution and capable of repetition and yet evasive of judicial review.”

    Sa isang banda, mabuti na rin na alisin ang martial law at hindi ito ayon sa constitution.

    Baka masyadong mataas ang hirit ng mga congressmen at hindi nakayanan ni Poblador kaya lift the martial law na lang. O baka naman makukuha talaga ang majority vote for the revocation.

    Ngayong na lift na ang martial law, dapat bang ituring na moot and academic ang issue at hindi na kailangan mag desisyon ang Supreme Court? Para sa akin, dapat mag desisyon pa rin ang Supreme Court to establish the presence or absence of factual and legal bases in the declaration of martial law.

    Ikatlo, yung justification ay mayroon ding mali at may ipinasok na amendment si Ermita before the joint session convened.

    Tsismis lang siguro yung balita na kukulangin ng pambayad sa boboto ng Yes to ML tapos malamang NO rin ang mag-prevail dahil matatakot bumoto ng Yes kahit kaalyado baka ikatalo nila.

    At wala rin namang nababalitaan na tumawag si Obama kay GMA na naka-confined sa St. Luke’s at sinabihang i-lift na ang ML.

Probably Malacanang smells Supreme Court justices’ consensus that it will declare martial law unconstitutional. She may look good for mood and academic resolution by the Supreme Court. At the same time, a PR before her Denmark climate change conference.

    There is an exception to the mootness doctrine. That is the case where the situation is

    “capable of repetition yet evading review.” An example is ” those cases in which the defendant voluntarily ceases, at some advanced stage of the appellate proceedings, whatever activity prompted the plaintiff to seek an injunction.”

    The decision will determine whether or not CJ Puno wields any moral influence on the Court. It will also determine whether these old men and women care for their place in history. It will also define their generation – the men and women in their sixties now, who were the youth of the 60s.

    Yes, I smell also an acquittal. The Bill of Rights is not totally suspended under Pandak’s martial law declaration in Maguindanao Province. Only the writ of habeas corpus is suspended. Therefore, searches and seizures conducted by government forces in Ampatuans’ properties are illegal. All material/documentary evidences illegally seized are not accepted by the court of law.

He is just a chainsaw killer. Even if he will speak about the 2004 cheating, his crime will actually increase because he has the direct jurisdiction of his province. He as a governor has a direct duty to report of the cheating in the first place in 2004. Instead, he cheated and conspired against the people by bribery and selling his province to Gloria.     This is a strict requirement of the constitution if the authorities are to secure a search warrant. If the search warrant is defective, the accused can move to quash the warrant. Kung walang search warrant issued by the judge, the evidences seized during the raid are inadmissible in evidence.

    Talo pa ng mga Ampatuans ang mga kilalang serial killers. Ilan lang ba ang na massacre ng Mason family compared dito sa mga Amps. Kahit hindi directly nagparticipate si Charles Mason, he was found guilty by joint-responsibility rule, which should apply to Glueria as well.

    By 2010 dapat magkapitbahay ng kulungan ang mga Arroyos and Ampatuans. Serial killers and plunderers.

    Executive Secretary Eduardo Ermita announced that the President will lift martial law and the suspension of the writ in Maguindanao effective Dec. 12, 9 PM tonight.

    The Filipino people deserve praise for the vigilance and scrutiny they have exercised since the Maguindanao Massacre took place, and since the President imposed martial law. Public outrage and devotion to constitutional principles pushed Congress, in particularly the House of Representatives which was uninclined to even meet with the Senate, to assemble in joint session.

    During the joint session we saw the government stumble and falter, proving itself willfully ignorant of the law and of the Constitution’s requirements. Focused and fearless reports by the media showed that much more was accomplished to obtain justice for the massacre victims by the Human Rights Commission and by the police and military before martial law was proclaimed.

    However, let us not be carried away by feelings of relief over the lifting of martial law.

    By this action, President Arroyo has deprived Congress of its constitutional mandate to exercise oversight. On cue from the Palace, the Speaker says he wants to adjourn the joint session reviewing the declaration of martial law thus sparing Malacañang from the scrutiny of its disastrous illegal misadventure. We believe the administration will make the same case when it comes to the Supreme Court, which was due to hear the government’s response on Monday, to the many cases questioning martial law.

    As the President has done before, so she’s doing it again: she has pushed the envelope but withdrawn her controversial proclamations before anyone can actually render a verdict on their legality or wisdom.

    The Supreme Court and Congress must continue to examine and pass judgment on this illegal martial law declaration in order to set the proper guidelines for the correct exercise of the President’s powers.

    I was so looking forward to the next session. It was hard for the Devanadera, Ermita, Gonzales and the others to hold on to their reasoning when the senators were asking very pointed questions. Perhaps the panel recommended the lifting of the martial after that.

    In any case, I do agree that the Supreme Court and the Congress must continue to examine and pass judgment on this even if the order was lifted. Supreme Court did it before with GMA’s order for state of national emergency.

    When they announced the lifting of martial law, I noticed that they all looked so glum. Mukhang Biyernes Santo. Ermita, Devenadera, Puno, etc.

    It was as if they did not want to do it. Like they had to do it because… they saw they’d lose the cases at the Supreme Court? Or they were made to feel like idiots at the joint session of Congress? Media reportage? Vigilant human rights and watchdogs and legal eagles? Or was there international pressure? All of the above perhaps?

    But this Martial Law bunch have tasted blood. Like vampires, they love it. But they have seen where they made their mistakes. They will polish their act. They will not be so stupid next time.

    They will continue to “wag the dog” and wag it correctly next time.

    The next few months calls for even more vigilance, vigilance, vigilance.

    The survey, which was distributed to the press by Lakas spokesperson and Zambales Representative Mitos Magsaysay, showed Aquino with 31 percent of the respondents, while Villar got 24 percent. Estrada was third with a 19 percent share while Teodoro breached the double digit mark for the first time with a 10 percent share.     The lifting of Martial law in Maguindanao should not make us relax. We must keep up the pressure on the Arroyo Administration to bring the criminals of the massacre to justice. It is only when the criminals have been convicted by final judgement can we say that the rule of law has been followed in this case. Justice for the victims, penalty for the criminals. There have been many speculations about why Gloria Macapagal-Arroyo declared Martial Law in Maguindanao. Others say that the Maguindanao Martial Law declaration is only a test case for a larger, expanded Martial Law.     Removing the Ampatuans from power will not solve the problem. If we remove the Ampatuans, they will just be replaced by Gloria Macapagal-Arroyo with another warlord clan. What we must do is dismantle the Mafia system whereby an illegitimate Gloria Macapagal-Arroyo Administration depends on warlords all over the country for continued stay in power. The Mafia system is simple. In every election, the warlords cheat for the Administration Gloria Macapagal-Arroyo. In return, the warlords can do anything they want in their area, even breaking the law. The Administration of Gloria Macapagal-Arroyo will simply look the other way.
