Let Trillanes fulfill his mandate

Senate Majority Floorleader Miguel Zubiri should not worry about the Philippines setting a precedent in allowing a detained senator to fulfill his duties to the people.

The Philippines has already set a precedent for having a president who has never been elected to that position by the people.

Zubiri, defending his sitting on a Senate resolution allowing detained Senator Antonio Trillanes IV to participate in the sessions and other legislative functions through remote or electronic Zubiri asked, “Is there a parliament anywhere around the world that allows legally detained members to participate in their sessions?”

Zubiri’s press statement did not say if he sent that query to the Geneva-based International Parliamentary Union, an organization of the parliaments of the world’s sovereign states of which the Philippine Congress is a member, which wrote him a letter urging authorities to “ensure that the (Senate) resolution is implemented without further delay.”

“The Philippines is a party to the International Covenant on Civil and Political Rights which enshrines fair trial guarantees and that, as a member of the United Nations Human Rights Council, it has pledged to uphold the highest standards of human rights,” the IPU said.

The lawmakers organization expressed concern that Trillanes has been on trial and remains in detention for more than six years, a violation of his fundamental rights based on international jurisprudence.

I would also like to ask Zubiri: “Is there a president of a democractic country who was never elected by its people? Is there a president of a democractic country who was caught cheating in an election, yet continued to hold on to power?”

Trillanes has been in detention in 2003 when he and 300 soldiers took a stand against corruption in the Arroyo government especially in the military in what is known as the “Oakwood mutiny”. He and the core group of Magdalo officers have been charged with coup d’etat.

The Maguindano massacre a month ago and the plunder case of Gen. Carlos Garcia much earlier have proven Trillanes and his fellow officers correct.

He is also charged with rebellion for his involvement in the Manila Peninsula incident in November 2007

Waging his campaign from prison and with very limited resources, Trillanes garnered more than 11 million votes. His convincing win was considered a resounding protest vote against Gloria Arroyo.

Trillanes, in fact, stands on more solid ground as member of the Senate than Zubiri, whose seat in the Senate was courtesy of the Ampatuan’s Maguindanao votes. Zubiri’s Senate seat is a subject of an electoral protest by Aquilino “Koko” Pimentel III.

Senate President Juan Ponce Enrile had already approved the proposed videoconferencing project with the necessary budget in place since June 2009 which would allow Trillanes to participate from his detention quarters in Camp Crame.

Because of the IPU letter, Zubiri says despite the “big legal question”, ““I will finalize and present the proposed draft resolution to be discussed in plenary, and will request the authors of the said resolution especially Sen. Pimentel who is the legal luminary of the group of individuals who filed the resolution to defend the legal question.”

Dapat lang.

Brussels-based Anna reminds us of the Oakwood “terms of agreement” in her comment:

“I may not be a Trillanes fan but one thing that I’ve always defended, and this has been from the very beginning, was his right to a military trial which was part of the agreement or terms of surrender at Oakwood.

“The government broke the terms of agreement, i.e., that the junior officers would surrender on the condition that they would be charged under Articles of War, tried by a military tribunal and not in a civilian court.

“(Former AFP Chief of Staff) Roy Cimatu, negotiating on behalf of the government gave his word. Gen Efren Abu, who was poised to attack at the time and was privy to what was going on during negotiations — (he also had direct line to Malacanang at the time or during the terse moments), and who later on became CSAFP, knew that they would break their word.

“In this country, there is no such thing as “My word is my bond!” It’s an unknown quantity, just doesn’t exist! So, to me, the junior officers owe absolutely nothing to politicians nor to their military superiors and definitely not an iota of loyalty to the dwende in Malacanang.

“As to what Zubiri is saying — all coming from his backside. He’s merely farting from his mouth.

“Who does he think he is? The people of the land have decided. Trillanes possesses a clear national mandate from the people of the Philippines authorising him to perform Senate duties. The people have spoken. How can an elected Senator of the land whose authority emanates from the people perform his duties from a dog cage?

“Trillanes did not rape anybody, he did not massacre a group of journalists nor did he harm women politicians. He did not kill anyone to achieve his status. And more specifically, he did not cheat or steal.

“His fault was that he didn’t succeed in toppling the illegitimate leadership in place. His fault too was his naiveté when he believed that he was talking to fellow military officers whom he thought possess a word of honour and thus accepted to be tried by a military tribunal.

“Zubiri should therefore just shut up and quake in his boots in silence instead of uttering imbecilities!”

    Yan na, na-bullseye ni Ellen!

    Palagi din lang world breaking record ang Pinas sa kababuyan ni Gloria Arroyo, at least sa isyung ito ay makabawi man lang sila ng konti sa positibo at tumpak na hakbang.

    Kanino ba talaga takot si Zubiri? Palagay ko ay sa kanyang pekeng presidente who, at all cost, would not like Trillanes participate/heard of again while she still pretends as Pinas president.

    Hindi rin naman ibinoto ng tao itong si Bb. Zubiri, ang tapang ng apog niyang tanggapin na senador siya eh tropa lang ng Ampatuan at ni Gloria naglagay sa kaniyang krona. Si Trillanes totoong tao ang naglagay sa kanya sa senado. Ang kapal naman ng mukha mo Zubiri, manang-mana ka talaga sa amo mong pandak, pareho naman kayong peke, makapal pa kaysa gulong ng eroplano mukha ninyong dalawa ni Gloria.

Ikalawa, sa paglilitis ng mga Ampatuan, darating ang punto na mababanggit ang papel ni Lintang Bidol sa dayaan sa Maguindanao upang makaungos si Zubiri. At ikatlo, lamang na lamang sa kanya si Trillanes na kahit nakakulong, mas maraming boto ang tinanggap samantala siya ay napipintong maitsapwera. Sa bilang na resolution at panukalang batas na naisulong sa senado at siempre, sa kapogihan.

    Elected by the people or not,this is the republican democracy we won after EDSA I. We have allowed all brew of justice and law on the prescription of who is in charge not necessarily along the tenets of what is right and just. And many suffer for the error.     hnaggang kailan ba ang term ni Sen. Trilanes? Seguro pag wala na si putot the military courts will have a decision on his case..kung kay Ampatuan ay pinagmamadali ang trial, twice a week daw…bakit pa sa kaso ng mga sundalong ito ay kay tagal tagal..

    Lumalabas na hindi nagtatrabaho ang hitad na ito. Inuupuan niya ng mahabang panahon ang resolution at humahanap ng butas upang hindi maipatupad.

    Our lawmakers should be aware na kaya sila hinalal ng taong bayan ay upang manungkulan at hindi pumigil sa anumang nararapat isakatuparan, lalo’t nakasalalay dito ang kapakanan ng kanilang kasamahan at ng taong bayan.

    Marapat lamang na ipaalam sa mabining senadora ng Maguindanao na isang malaking kasalanan sa mandatong hindi kanya ang pagkaitan ng pagkakataon ang mga bumoto kay Senador Sonny Trillanes upang sila ay mapagsilbihan.

    At lalong isang napakalaking kasalanan sa taong bayan ‘yung pinapasuweldo siya bukod pa sa milyon milyong pork barrel na inaaring kanya ay hidni niya ginagampanan ang kanyang INAGAW na tungkulin mula sa tunay na hinalal na senador.

    Kunsabagay, magkano, este paano ba siya nanalo?

    Just like to know what is happening to this atty fortun? how can he say that andal ampatuan, jr does not know how to speak tagalog? e kung hindi naman pala hunghang ito si fortune, e madalas sa maynila yang si andal jr at madalas mambabae, hindi marunong magtagalog? ano kala mo sa amin TANGA!!!!!?????

    Sayang at magaling na ABUGAGO este abugado pa naman sya tapos ginagawa nyang tanga ang mga pinoy.

    We are not privy to the inner workings of the young senator’s defense team. But I’m of the mind that the “delaying tactics”, if ever there’s truth to it, are intentional.

    As I’ve said, Trillanes and his group and govt negotiating panel at Oakwood had an agreement, i.e., they would surrender on the condition that they would be tried under the Articles of War, in other words tried by a military tribunal — and not by civilian court, which, to me, smacks of logic.

    Government broke the terms of agreement and hauled them off to civilian court! Is it any wonder that these young principled men should in turn defy the illegitimate authority’s decision to try them in civilian court?

    I therefore don’t see the case taking this long or unresolved “because” of his lawyers — the guilty party is not Trillanes’ party… It’s Gloria and her dogs that are greatly culpable.

  20. And to me, Trillanes was absolutely right to insist on a military tribunal during the Oakwood standoff.

    In a military tribunal, they would be able to present their case against and challenge the very same military superiors they have accused of corruption, greed, abuse, election cheatings, tampering with votes, etc., etc. They would have been able to summon these military officers to the witness stand; they would have been able to present their case against the military hierarchy for the public to see.

    In sum, they took a great risk in order to be able to achieve that and got what they wanted during the negotiations — let’s not forget that government accepted to give them that venue, and yet again, government cheated them.

    So, Trillanes in this particular case stands on high moral ground. He fulfilled his end of the bargain, govt did not.

    Who is then guilty of “delaying tactics”? Who is guilty of treachery?

    Ang kapal ng mukha ni Migs Zubiri. Ayaw niyang makapaglingkod si Senator Trillanes sa mga taong bomoto sa kanya. Malinis ang pagkapanalo ni Trillanes. Kusa siyang ibinoto ng mahigit 11 million votes na naniniwala sa kanya.

    Si Migs Zubiri, ano ba siya? Wala siyang karapatang manungkulan bilang senador dahil siya mismo alam niyang pang labintatlo lang siya. Magnanakaw siya ng katungkulan katulad ng kanyang PANDAK, MAGNANAKAW at PEKENG PANGULO. Kaya nga nananahimik lang siya sa mga pangyayari sa MAGUINDANAO dahil ang mga Ampatuans ang nagpaluklok sa kanya sa senado.

    Migs Zubiri magsalamin ka muna. Mas may karapatan si Trillanes bilang Senador kaysa sa iyo na naupo lamang diyan dahil sa pagmamanipula at pagnanakaw ng boto nga mga Ampatuans.

    As for the defense team summoning many witnesses, tell me, do you think Trillanes et al will get justice with Gloria Arroyo in power?
