Draft Senate report seeks Villar censure

A draft report by the Senate committee of the whole is seeking the censure of Sen. Manuel Villar Jr. after finding him to have engaged in improper and unethical conduct in connection with the C-5 road extension project.

The report, which an official of a political party furnished the Philippine Daily Inquirer, said Villar’s involvement in the C-5 project in Parañaque and Las Piñas cities “made the Filipino suffer the total amount of P6.22 billion.”

The committee demanded the money’s return.

The money came from the realigned P4.28 billion for the extension project, the P1.8 billion spent for the original project but which was wasted due to the realignment, and the P141.1 million in overpriced right-of-way payments for Villar’s real estate companies.

The report was released before Congress took its holiday break last month to get the signature of senators. It needs the signature of the majority of senators or 12 for it to be reported out in the plenary.

Villar, the presidential candidate of the Nacionalista Party, was investigated by the committee in June last year on allegations that he was behind the double funding of the P200-million extension project in the 2008 national budget and the diversion of the road so as to benefit his real estate business.

The report said Villar violated Section 14, Article VI, of the Constitution for intervening in the project of the Department of Public Works and Highways (DPWH) for his “pecuniary benefit.”

The report noted that Villar had proposed that the extension project “pass through properties of his corporations, which in turn benefited from the use of such road, from the compensation for road right of way, and from the resultant economic development in and increased market value of the vicinity.”

The report recommended that Villar be censured for violating the provisions of the Constitution and the Code of Conduct of Ethical Standards for Public Officials and Employees, and for engaging in improper and unethical conduct that damaged the integrity of the Senate.

In the interest of fairness and public accountability, the report recommended that the Senate demand the return and restitution by Villar to the public coffers the money or pecuniary advantage “he has or his companies have illegally gained or obtained as a result of unlawful acts and improper and unethical conduct.”

Failure to notify Senate

It said the senator violated the conflict-of-interest rule by not divesting himself of his interests in Adelfa Properties, Golden Haven Memorial Park and Azalea Real Estate Corp. (now Brittany Corp.) when it was apparent to him that these corporations had a contract with the DPWH for right-of-way acquisition.

The report said Villar was a substantial stockholder of Adelfa Properties, which owns Golden Haven Memorial Park and Azalea Real Estate Corp. and whose properties benefited from right-of-way payments from the diversion of the road project. The companies still have unpaid claims, it said.

It said Villar violated Section 12, Article VI, of the Constitution by failing to notify the Senate of a “potential conflict of interest” when he proposed an amendment to the 2008 national budget by appropriating P400 million … for a project that would benefit his corporations and which amount may be used to pay the claims of his corporations for unpaid road right-of-way compensation.”

Other findings of the report:

• Villar was the proponent of the Las Piñas-Parañaque Link Road Project and the DPWH C-5 extension project which were made to pass through the properties of his corporations “following a curved, instead of a straight alignment.”

• The alignment of the C-5 segment of the Manila-Cavite Toll Expressway Project of the Toll Regulatory Board was changed to accommodate the two road projects.

• The properties of Villar’s corporations that were acquired for the Las Piñas-Parañaque link project and the C-5 extension project were given zonal valuation for different areas (not the zonal valuation of the area where they were located), jacking up the compensation due them.

Not direct participation

But the report said there was no evidence that Villar had directly participated in the overpricing of his properties.

It said it was safe to assume that Villar knew about the overpricing because his corporations stood to gain from the transactions and because of his closeness to Anastacio Adriano Jr., an official of Adelfa Properties, who was directly involved in the transactions.

The report added that Villar had allowed Adriano to propose an amendment to the 2008 national budget, the appropriation of P400 million for the C-5 road project, when there was no specific program of work for the project and despite the fact that there was already an allocation for the project.

The only apparent reason for the amendment was to make available an appropriation for the payment of right-of-way compensation claims of about P200 million, according to the report.

“As admitted by Adriano, it was in the interest of the corporations of Senator Villar to be paid for such road right of way,” the report said.

It said this “interest may be opposed to or affected by the faithful performance of official duty on the part of Senator Villar who has the power to appropriate public funds by proposing amendments to the national budget.”

The report said Villar used that power to satisfy the interest of his corporations, violating the conflict-of-interest rule and Section 14, Article VI, of the Constitution.

Noting that Villar had proposed the C-5 extension project when he was still a member of the House of Representatives, the report said he “continued to fund” the project when he was already a senator and yet did not disclose his pecuniary interest as required by the Constitution.

It said Villar funded the two projects chargeable against “various infrastructure, including local projects” or against the Priority Development Assistance Fund [pork barrel of lawmakers] from 2001 to 2008.

A source in the Senate confirmed Sunday night that the Philippine Daily Inquirer’s copy of the draft report on Sen. Manuel Villar’s involvement in the controversial C-5 road extension project was authentic.

Reacting to the Inquirer report, Sen. Alan Peter Cayetano, a party mate of Villar’s, declined to discuss the contents of the draft report, saying that Senate President Juan Ponce Enrile had instructed the senators not to discuss it with the media.

“Until the report is signed by the majority of the senators, it’s nothing but a piece of paper,” he said in a phone interview.

Cayetano was not the Inquirer source who confirmed the authenticity of the draft report.

Cayetano, a member of the Nacionalista Party whose standard-bearer for the May presidential election is Villar, asked why the report was leaked to the media when it was not an official document.

Questionable timing

He said the release of the report at this time was questionable.

Cayetano said it came at a time “when the survey period is coming out.”

“The report was released when the numbers of Sen. Benigno Aquino III and Senator Villar are close,” he said. Villar is trailing Aquino but has cut the latter’s lead.

For the report to be presented in the plenary, it will require the signatures of 12 senators, Enrile said over dzBB radio. Otherwise, he said, there will be no report on the [unethical conduct by and financial gains of Villar in connection with the C-5 road extension project].

“But it will be part of the records of the Senate,” the Senate president told dzBB radio. “If someone wants a copy, he could make a formal request.”

Enrile shrugged off a Senate resolution filed in November last year that saw 12 senators saying that Villar was innocent of the charges filed against him by Sen. Ana Consuelo “Jamby” Madrigal.

Enrile asked why senators signed the resolution when the committee report had not yet been released.

He had the committee report circulated for signature when Congress took its holiday break in December last year.

    Of all the presidentiables, I think Villar is the most undeserving and unqualified to be elected mainly because of his questionable backgrounds. Tingnan lang ninyo attitude niyan, he never attended the hearings conducted by his peers against his involvement in the C-5 Road Extension, NBN-ZTE Broadband, Joc-Joc Bolante, etc., etc., yet, he is claiming to be a genuine oppositionist. He does not even know how to speak. Pag masdan ninyo mabuti ang sinasalita niya pag siya ini-interview, very simple at ordinary na kung minsan walang sense ang sagot niya. Kaya lang naman yumaman siya dahil taumbayan ang kanyang kliyente at biktima. Shame on him!     It’s a good thing we have elections. This is the only time that we get the chance to know the real and what kind of leaders we have.

    Election is a political exercise and candidates’ sling each other whether it’s about legitimate issues or not just to gain points over the other and by so doing the voters are informed on what kind of leaders are they on all sides of the political landscape. It’s up to the electorate to separate the white from the black. But nobody can truly say that everything they do or say is not politically motivated.

    A case in point is this Villar case. It’s a legitimate election issue but the question is, his “cheating” has been going on since he was a congressman and how come that it only came out as a serious political issue when he declared for the presidency? The timing surely shows a political color, nevertheless, better late than never and only time will tell if it affects his presidential run.

    The unusual actions of Noynoy has nothing to do with or without balls. It’s all because of his swing moods and hot flashes. Maybe men also are affected with PMS.

    Consider this:

    Noynoy snapped at Gordon when asked about his accomplishments in Comgress. He said arrogantly “I don’t dignify questions from survey-tail-enders”. Who does he think he is? He is not even elected yet and look at his manners. Does he have to do that to his fellow senator?

    His reaction about a SWS survey showing that his lead was reduced: “Maraming nabibili sa Quiapo na survey”, while he was all praised when the same outfit showed a big lead for him.

    And about the plan to appoint a new CJ, threatening a co-equal branch of government is not only arrogant but ignorant on the provision of the constitution that he can not fire anyone sitting in the SC. I am against the Gloria plan to name a CJ, but the action of Noynoy went overboard, more of dictatorial than democratic and he is not yet the president. How much more if? It seemed that polluted air replaced his brain.

    Why not address the report at the Senate? If you agree or disagree, then state your point of view as Senators, deliberate and vote accordingly. By doing so, you are helping strengthen our institution and our Democracy! By doing so, you are giving justice to Villar himself as you claim his innocence, and the people who deserve the facts about it.

    Why ignore processes or non-attendance? This weakens our institution, and can be seen as a disservice to everyone! Para ano pa ang Senado?

    There’s no better way to conclude this but at the Senate. Stand up and depend your claim! In the end of the day, anyone Senator can vote independently on the matter depending on ones conscience, and beliefs! This is your oath and your mandate as Senators isn’t it? Not your individual or collective preference! Your actions reflect utter disregard to the very institution where you gave your oath!

    Claiming C5 realignment issue as pure politics and/or letting the people decide on the merit of it by announcement using the media, is just saying we don’t care about your institution and we will do whatever we want! Dahil election period di dapat pag-usapan? The more you should as Senators! What if the allegation is true? Are you willing to sacrifice the country’s welfare for this? If not? This will clear Villar himself isn’t it?

My only close encounter with Villar was in the comfort room in EDSA Shangrila, I was washing my hands in the sink and he was beside me doing the same, I let him go first with the hand towels (or whatever you call the paper you use to wipe your hands with) wiped his hands, crushed the wipes into a ball and attempted what looked like a 3-point shot from the door to the trash can and missed…he said “oops” and looked at me as if its my job to put the damn thing in, I didn’t, I just walked right past him and pretended I didn’t know who he was…I didn’t know he will be running for president in the near future…

    Giving Villar a tongue-lashing, Enrile could not help but reveal information to indicate that he tried to cooperate with Villar in handling the inquiry on the C-5 road controversy without jeopardizing the process.

    “Many times they (Villar camp) came to me and asked me for my help. I was willing to accommodate him to the extent that it was legally possible and it will not injure the legal process and I told him, ‘present your evidence so that we will have a basis to consider your position.’ But he did not want to present any evidence because obviously he cannot refute the evidence that were submitted to me,” he told reporters.

    “My goodness! He was the proponent of these projects. Second, he continued to fund this project. He was following up the funding of this project and he knew that he had lands that are going to be benefited by these projects. Why did he not disclose this to us?,” Enrile asked.
