The Commission on Elections (Comelec) 2nd Division on Wednesday junked separate petitions seeking the disqualification of former President Joseph Estrada in the 2010 presidential elections.
In its resolution, the poll body said it junked the petitions filed by lawyers Ely Pamatong, Evelio Formento and Merelo Estrada due to lack of merit.
“Let the people decide who will be the next president,” the Comelec ruled.
Comelec spokesman James Jimenez said the petitioners could still a file a motion for reconsideration before the commission en banc.
“We suppose they would want time to study the decision because certainly a motion for reconsideration that’s filed as a matter of form simply as a kneejerk reaction will not get very far. The motion for reconsideration will have to state good reasons why the original decision has to be overturned,” he said in an ANC interview.
According to the petitions, Estrada is banned from running in the presidential election due to a constitutional ban on former presidents from seeking reelection.
Estrada’s lawyers have argued that the ban applies only to those who have served as president for more than 4 years.
Estrada served for only two-and-a-half years. He took office in June 1998 but was removed from office after EDSA 2, a military-backed revolt in January 2001.
Erap: It’s all systems go
Estrada thanked the Comelec for its decision, saying that nothing would make him happier than serving the Filipino people.
“This decision has lifted that cloud of doubt with respect to my candidacy. Now the people know that it is all systems go for Erap for the May elections,” he said in a statement.
The former president also noted the date of the decision coincided with his ouster from office 9 years ago.
“This date of the promulgation of this decision saying that I, Joseph Estrada, am qualified to run for president, is significant to me personally because it was exactly on this day nine years ago, January 20, 2001, when the honor to serve the Filipino people as president was stolen from me. Today, the opportunity to serve has been returned and it seems as if I am being told that I need to complete the mission that my administration started in 1998,” he said.
He added: “I wish to thank the Comelec commissioners for their sense of fairness and for deciding to act expeditiously on this case. This victory is not mine; but a victory of our people and our democracy. Finally, it is settled: as sovereignty emanates from no less than the people, in this matter of choosing our president, we should let the people decide.”
The Supreme Court earlier dismissed with finality the petition filed by the lawyers’ group Vanguard of the Philippine Constitution Inc. seeking Estrada’s disqualification since there is a pending petition with the Comelec.
During the reading of the decision, Comelec Commissioner Nicodemo Ferrer cited Pamatong in contempt and ordered his removal from the Comelec session hall in Intramuros, Manila after he accused the poll body of corruption.
The Comelec 2nd Division also junked Pamatong’s petition to disqualify President Arroyo from running as representative in the second district of her home province of Pampanga. With reports from radio dzMM and ANC

Former Negros Occidental (5th district) Apolinario ‘Jun’ Lozada, who is running for the Senate under Estrada’s ticket lauded the Comelec decision.
“On the same day that he was humbled, the phoenix will rise again,” Lozada said. “Nine years after a powerful few imposed their will on the people, it is time that the will of the poor and the powerless prevail.”
Now that the legality of Estrada’s candidacy is cleared, Lozada said “the playing field will be changed once more. We expect the followers of President Erap who vacillated to return to the fold and support his candidacy to finish his term and redeem his name.”
The decision will also boost the PMP’s campaigns, Lozada said.
I doubt if it will change Erap’s numbers in the survey, it could but not significant. He will still be in 3rd place since I think a lot of people has already decided on who to vote for president. Unless of course, something big happens, as in the case of Villar who has his problems with the Senate ethics report.
By the way, I was just wondering what Satur Ocampo and Liza Maza reation on the senate report. They seem eerily quiet on the issue. Hmmmm…..

With an Erap vs. Noynoy, Gloria’s delusions, nah, hallucinations of perpetuity become nil.
If Erap wins, so be it, for as long that it is the majority’s will – that’s a maturing democracy (I can’t help over-emphasize that) – I can sleep with the thought. Ditto if he loses. Fair?

On graft and corruption:
1. Transparency
• Economic Coordinating Council composed of prominent businessmen to review government contracts.
2. No person is above the law. There will be no sacred cows like the Ampatuans.
3. Appointment of men of integrity, base appointments on meritocracy to Cabinet positions and heads of offices.
4. Certainty of arrest and punishment by appointing good men to (1) Ombudsman (2) CoA (3) Sandiganbayan
On political warlordism and private armies:
1. Instruct DILG to act swiftly and decisively on this.

On the Justice System: 1. We have to erase the notion that Justices handpicked by Malacañang are puppets of Malacañang, which is the impression under this administration. Therefore, there has to be prudence in appointments, supported by policy of meritocracy and respect for seniority.
2. We have to erase the notion that cases against the rich are not acted upon. This will be solved by ensuring that the next President does not interfere in the affairs of the Supreme Court and by ordering the Justice Department to pursue present unresolved cases.
3. Minimize the fixing of cases.
4. Police witnesses who do not show up must be dismissed.
5. Increase number of policemen.
6. Review rules of engagement
7. Lifestyle check on police officers
On Climate Change:
1. We must hold the First World countries who are the biggest polluters responsible.
2. We must do our part, no matter how small. Implement Clean Air Act, introduce more environmentally friendly concepts like electric jeeps, solar cars.
3. Be on the forefront of developing environmentally-friendly technology, e.g., DLSU developed solar cars.
On Foreign Investment Policy:
1. This goes back to peace and order. Because peace and order is prerequisite to attracting investors in the countryside.
2. Another must is erasing the impression of being the Number 1 most corrupt country in the world. If investors believe that they can do business in the country without the cost of corruption, investments will flow in.
3. Reduce red tape
On Charter Change: 1. The economic provisions of our Constitution are restrictive. ex. Land ownership, foreign participation in telecommunications. However, Charter change must be done thoroughly and, therefore, studied immediately when the next president sits. 2. Not in favor of parliamentary system because you should not take away the right of the Filipino to cast his vote and choose his leader, that one instance where the voice of the poor counts as much as the voice of the rich.

Erap for president, Binay for vice president, Bongbong marcos for senator.

Hindi rin “banned for re-election” si Erap dahil hindi naman siya nanungkulan nang higit sa apat na taon.
Sa taong 2016 kung hindi pa tayo Parliamentary, palitan natin ng “gloria” si Erap…
Hindi “banned for re-election” si gloria (“kagalang-galang” na kinatawan ng Pampanga) dahil hindi siya “incumbent president.”
Hindi rin “banned for re-election” si congresswoman gloria dahil hindi naman siya naging presidente bilang “successor” nang higit sa apat na taon.

Baycas — I am not a lawyer but I think I understood that a person who has been elected president may not be eligible to run again. But seems to me there are caveats, eg., that the person 1) is incumbent 2) or has served for 4 years.
The provision is not clear. Hence, there is a big question mark with regard to Erap. The lawyers who framed that provision bungled it up.
They should have simply written something like this: No person who has been elected president shall be eligible to run for president again. Full stop. Such unequivocal provision leaves no room for doubt.

The framers didn’t bungle up the making of The Constitution. It’s just that some interpreters like to understand the meaning of the Constitution to suit their needs and fancy. Some would like to make a statement ambiguous or controversial.
The keyword is “ANY.” So, an elected president (regardless if incumbent or not) is banned for re-election forever. Even a successor to the presidency is banned for life if he/she remained a president “for more than four years.”
Anyway, the interpreters who made the statement equivocal would be the ones to benefit from the ambiguity. However, statutory construction (in interpreting laws) will dictate that proceedings during the framing of the law must be considered for the unequivocal understanding of such law in question.
It may be said Erap is banned for reelection for life. The trouble is he maintained before that he didn’t resign and only the SC then made his “constructive” resignation because of his “abandonment” of the throne.
The framers didn’t discuss whether an elected president who wasn’t able to complete his tenure of 6-year-term of office must be banned for re-election. By this appropriate reason, is Erap really banned?

Yep, you’ve got a point there. But if that particular provision had been more specific or unequivocal as I said earlier on, there would be no beating around the bush.

I’m happy for Erap. He deserved another chance to ask the electorate if they still want him again to be the president. It’s only fair considering that he was not able to complete his given mandate.
Expect slings and arrows to be thrown at him, but just as was the last time it will not work. The late Cardinal Sin and his yellow evil society worked so hard to beat him and even pleaded to the people to vote anyone but Erap, instead the electorate gave him a land-slide victory. His “erap-citizens” were all adoring and loyal that no amount of convincing and propaganda will make them abandon him. He and the “poor masa” were able to connect and understand each others language. His dealing with them is straight-forward, no pretensions and hypocrisies and that made him click and well-liked by them.
Will they be able to carry him again this time? Going to the ratio between the elite-rich and the poor, it looks like a no brainer.
Some are saying that the SC will give Erap the green light when the case is elevated to the SC, of course with the “blessings” of Gloria their benefactor. Why? So that it can create a (bad) precedent. The next elections after 2010 is just 6 years away, Congresswoman Gloria Macapagal Arroyo, being an EX-PRESIDENT can run again. 🙁 😛
I was wondering why Gloria’s election lawyer Makalintal was suddenly so quiet about the issue. Even people from Malacanang didn’t object to the ruling. When Erap and his supporters brought up the issue about his running again for the top post, Makalintal was all over the radio/ news saying that Erap cannot run again, same goes with Gloria’s allies. But now, they seemed so quiet. 🙂
What better way to sum up Ferrer’s decision than to rally the crowd?
“Let the people decide who will be the next president.”

However, underneath this seeming victory for Erap (and the Filipino people) is the fact that such decision will ultimately be beneficial to gloria as well come 2016.

Politics has a lot of uncertainty especially to those people who knows a little about how the monkey business of politics work.
Like in America we watched Barack Obama take the oath of office, serenaded by the awesome Aretha Franklin (wearing her awesome hat)everyone were hoping for change.During the campaign it was heartening to see young people become involved.They were all under the delusion that Obama was a peace candidate. Of course Obama was not a peace candidate. His sole claim to that mantle was a single speech he gave at an anti war rally before we invaded Iraq.
Bush’s policies took Americans back to the dungeons and Obama is just a continuation.
What I’m trying to say, Philippines has no different from America yet it’s more worst.No matter who we elect President to control our lives,There will be NO CHANGES until they prosecute all the criminals from the President to the lowest barangay officials.. Any reasonable high school debate student would tear this arguments to shreds.

“Personality,” “character,” pretty soon they become indistinguishable and very resistant to both “hope and change.”

Young people are NOT notoriously to become registered voters. It’s all part of the maturation process. Back in the 60’s young people were experimenting with various forms of counter culture.
People assume that more people voting would be better. Frankly speaking, we want people who are educated on the issues voting. Unfortunately, most young people don’t have a very deep understanding of politics. The only problem with Democracy is that the vote of a fool counts just as much as the vote of the wise.
You have to realize that your vote is utterly worthless if your ‘elector’ decides the precinct you lived in voted for the wrong person. Then you also have the ‘winner take-all’ system of awarding these electoral votes where as much as 50 percent of a precinct is essentially cast aside.
These are reasons for you to vote, you HAVE to vote. If a pathways sets in even further with the coming generations then we will truly wind up as two separate societies.
You do realize if ‘we the people’ voted en masse how different things would be, right?

Cory to Erap: Sorry for EDSA 2
Hinalukay ko pa ito sa baol…Former president Corazon Aquino has apologized to deposed president Joseph Estrada for participating in his ouster in 2001.
Aquino said she is one of those who would plead “guilty” for her role in the military-backed popular uprising that removed Estrada from power and replaced him with his then vice president, now President Gloria Macapagal-Arroyo.
“Lahat tayo nagkakamali, patawarin mo na lang ako [All of us make mistakes, please forgive me],” she told Estrada.
Later, Estrada escorted Aquino, who has been diagnosed with colon cancer and is undergoing treatment, to her car.
Asked for his reaction to Aquino’s apology, Estrada said he felt “vindicated” by the statement.
“I feel vindicated, coming from a respectable person, our icon and symbol of democracy,” he told reporters in an interview after the event.
He said he did not expect the apology to come from Aquino.
“It’s unexpected, that’s why I am very happy today,” the deposed leader said.
“It is fantastic,” he said in a separate interview, repeating the word again and again.
“She [Aquino] told the truth [about] what she feels. I am very happy she is very true, an example of a president who is transparent, who is honest and tells the truth,” he added.
At the height of the national broadband network deal controversy, Aquino and Estrada joined the interfaith rally in Makati City in February calling for truth and accountability, reform and the resignation of Arroyo.
Asked how he felt being surrounded by personalities from EDSA Dos, as the uprising that ousted him as called, Estrada said: “As they said, the weak cannot forgive, but forgiveness is the attribute of [the] strong, so I forgive them because I have the attribute of being strong.”

Estrada’s lawyer Estelito Mendoza stated that Estrada will file a motion for reconsideration (before September 27) of the 262-page Judgment and then appeal the verdict to the High Tribunal. The Philippine Chamber of Commerce and Industry said it will support a presidential pardon for Estrada. Jinggoy Estrada said The people will receive this with moral outrage and disgust. The time of reckoning will come. That time may not be too far now. “This verdict is intended to legitimize the occupancy of an illegal tenant in Malacanang[5][6]
Estrada, in Filipino Barong Tagalog (pineapple fibre dress shirt and cream trousers) with his trademark wristband stated that “I thought the role of justice would prevail here but really it’s a kangaroo court.” President Gloria Macapagal Arroyo stated that the court’s decision must be accepted: “We hope and pray that the rule of law will prevail.” Estrada’s counsel Rene A.V. Saguisag issued the statement:”VICTORS’ JUSTICE” – “It’s victors’ justice. It’s ruling class justice. The special division (of the court) was programmed to convict. We never had a chance.” Estrada will appeal the verdict and would be under automatic review at the Supreme Court of the Philippines.[7]
Estrada told AFP that he was resigned for the latest drama in his presidency: “last and best performance of my life.” The prosecution’s lead counsel Dennis Villa-Ignacio proudly asserted: “It shows that our judicial system really works.This is the last chance for the state to show that we can do it, that we can charge, prosecute and convict a public official regardless of his stature.”[8]
Joseph Estrada rose from obscurity to having been top Filipino film star, then hit the mark, by claiming the Presidency until destiny sent him to jail. He stated to AFP “I feel depressed, but it’s my style not to show it.” Before the release of the fatalistic judgment, he warned that he prevent his fans from making street protests.[9]
