Good news is rare these days that the text of my friend, Atty. Romel Bagares last Friday was like rain amidst drought.

Romel informed me that the motion of his client, Marine First Lieutenant Artemio Raymundo’s motion for finding him not guilty was sustained on all serious charges.

“Light charge remained but maximum sentence already served,” he said.

Romel was referring to what we call the “Erap CD case”. This is a classic example of injustice in the military system. I’m glad that after almost three and a- half years, the military court has corrected the injustice. Although not yet fully.

Since September 26, 2006, Raymundo has been in detention at the Marines Brig accused of violations of Articles of War 96 (Conduct Unbecoming an Officer and Gentleman) ; 97 (Conduct Prejudicial to Good Order and Military Discipline) and 64 (Disrespect Towards Superior Officer).


What did Raymundo do to be charged with these offenses that would have resulted in his dishonorable dismissal from military service?

On Sept. 25, 2006, 1Lt. Artemio Raymundo Jr., was riding the LRT and he saw someone distributing DVDs of “Ang Mabuhay para sa Masa”, “The Original Sin” and “At All Costs”. Since it was for free, he got six copies and upon arriving at the Marine barracks in Fort Bonifacio, he shared the extra copies with his fellow soldiers.

“Ang Mabuhay para sa Masa” is a biopic of former President Estrada while “The Original Sin” and “At All Costs” are about Gloria Arroyo’s power grab in 2001 and the rigging of the 2004 elections.

Afraid of the truth, the Arroyo administration had banned the public showing of “Ang Mabuhay para sa Masa”. The documentary has not been declared illegal and therefore can be viewed privately.

For sharing the CDs with other soldiers, Raymundo was ordered detained by Maj. Danilo Luna. When he protested about his detention, that’s when Luna slapped him with “disrespect towards a superior officer.”

In the course of covering Raymundo’s trial, there have been hilarious incidents like when the Estrada biopic was shown in court, everybody, even the waiters in the next-door restaurant, were watching. One of the lawyers quipped, “Baka pagmatapos ito, lahat boboto na kay Erap.”

We were amused also when a sergeant who was a prosecution witness was asked why he accepted the CD shared by Raymundo. He answered, “Kasi libre.”

We had talked with a Marine officer who said that they knew from the very beginning that the case against Raymundo was “no case” at all but it was the order of then Brig. Gen. Jonathan Martir, the brigade commander of Combat Service and Support Brigade.

What Martir has against Raymundo, we do not know.

What’s difficult to accept in this case of Raymundo is that, even if the major charges have been dropped, the people who have committed injustice against him have been promoted. In fact, Martir’s promotion to major general was confirmed by the Commission on Appointments last week despite the fact that he still has a pending case before the Ombudsman for having gone on AWOL (absent without leave) for more than one year (477) days from July 1998 to January 2000.

A number of ordinary soldiers have been punished for going AWOL for a few days but Martir has been amply protected and rewarded. Equality is a strange word in the military.

Romel said they are appealing the denial of their motion to dismiss the charge “disrespect towards a superior officer” because Raymundo does not want a taint in his service record.

He has been unjustly imprisoned. That’s the least that the military can do to make up for the injustice done to him.

    ..ang pag AWOL ni Martir na isang officer (never mind the gentleman) ay hindi conduct unbecoming of an officer? kaya siya ipopromote?
    ..sa Senate naman ang hindi pagsagot ni Money Bill sa mga tanong sa investigation..ano ito..is it not conduct unbecoming of a senator?
    ..ang pagbastos naman ni Dirty Old Man Pimentel..hindi ito conduct unbecoming of a senator? Never mind the gentleman..wala sa vocabulary niya ang being a gentleman…
    ..iba nga ang difinitions of terms sa adminstration ni putot kaya iba ang justice ng kanyang Supreme Judges ni putot (Court?)..kaya hindi natin masisi si Ping at pumunta sa Australia..kasi kung sa Pilipinas siya baka ma Ping! Ping! siya ni Martir…at hindi siya makaabot sa Crucifixion sa Pampanga sa Holy Week!

  3. Lt Raymundo has not been dismissed from service. So, once the dismissal of the major charges is finalized, he can now be released from detention and report back to service.

    But he still has this minor case of “disrespect of a superior superior officer” which he is contesting because he wants his record to be clean.

    Now, granting that he is found guilty in the minor charge, which I understand is punishable by six months detention, sobra-sobra na yung punishment nya. He would be back in service but with a tainted record.

  4. The case of the Magdalo is complicated. Yes, there were two groups, one was the Gambala/Maestrocampo group who apologized to Arroyo. They were found guilty of coup d’etat and other offenses. They were dismissed from the service.
    They apologized to Arroyo and they were granted pardon.

    They were released from detention and some are now working with the government.

    Flashback to 2004. Remember there was also a time, before the split that they all apologized to GMA? That was for the release of more than 200 enlisted men (remember there were more than 300 of them in Oakwood). It was hard for the core group that included Ltsg Antonio Trillanes, III, James Layug, Capt. Gary Alejano etc. but they had to do it for the enlisted men.

    Of course, the perverts in Malacañang, milked that dry to discredit the young officers.

    Subsequent events showed Malacañang that they had not broken the spirit of Trillanes and and his group. They are now dismissed from the service and are facing charges in the civil courts.

    Two weeks ago, the judge at the Makati RTC, dismissed the charge of mutiny re Manila Pen.

    I can assure you that military friends of mine here at NATO were just gobsmacked when I said that in the Philippines they can promote a colonel back to back for going AWOL!

    Mind you, such things happen all the time in the military… of a banana republic.

    Military values don’t exist — an unknown quantity in the AFP.

    How do you expect the AFP to win military victories against their enemies?

  11. The rights of this poor Marine officer were violated back to back. He was entitled to a quick trial but the AFP violated his most elementary military right.

    This is no way to treat your officers and expect them to lead men into battle and die in service fighting their enemies.

    This is the way to demoralise your military!

  14. Ibrado is largely to blame! He should have done something about this — the incarceration of a junior military officer for distributing a CD about the ex-president of the Republic is not a crime. Even my dog could have told Ibrado that.

    As chief of staff, his duty was to oversee that sense of fairness and justice is instituted in the AFP.

    He failed and failed miserably to perform his basic military obligation as chief of staff when he allowed the court martial of this poor officer to last MORE THAN THREE GODDAMN LONG YEARS!

    That major should not have given the order to the marine officer not to give away the CDs — especially if he knew. that the CD was not in any way a mutiny manual.

    This is not a Leninist state! Besides, he shouldn’t have given an order that he believes would not have been obeyed! Siya ang gago. Dapat sampalin ng back to back iyang major na yan.

    Mayroon bang libreng ganito sa gobyerno de bobo ng rehime…di ba WALA, but ang pagnakawan o waldasin ang pera ng bayan e libre sa kaso.

    Just curious: Articles of War 96 (Conduct Unbecoming of an Officer and Gentleman)Is that how the AFP printed the violation committed in the charge sheet?

    Technically, it should simply be “Conduct Unbecoming an Officer” — without OF [an Officer]. (That’s how UK Armed Forces Articles of War manual prints it.)

    Re Ibrado. In fairness to him, the trial was ongoing when he assumed the position of Chief of staff. The fact that a decision has made before he retires (March 10) is a credit to him.

    I think it was during the time of Esperon when the case was filed. I think Dolorfino then was the Marine commander.

    Isn’t Dolorfino the guy that was held hostage by the MILF or MNLF (can’t remember which) and for whom the AFP was obliged to pay ransom (to offset the cost of his board and lodging daw?)

  32. Luna promoted too? The guy gave an order that he knew wouldn’t be obeyed or cannot be obeyed and was promoted?

    That is contrary to the code of military officership — officers must ensure that the order they give can or must be obeyed — otherwise, mustn’t do it (at least in peace time). For being a 3rd rate officer, he should have been demoted, not promoted!

    Military regulation says no one who has less than one year left in the service should be promoted.

    Not sure — I might be gravely mistaken — if the regulation applies only to major service command promotions, i.e., CG PA, CG PAF and/or FOIC, PN.

    Is that so? But when did he assume the position?

    For such a “misdemeanour”, ordinarily, court martial should have been held within 3 months after recommendation for trial and trial over in less than 6 months at the very most. So, if Ibrado assumed his post a year ago, this should have been fast-tracked long ago under his leadership if he was serious.

    I’m sorry but I feel that he was remiss about this case especially if he got to the post last year.

    As CSAFP, he could have given the order to fast track the trial in 7 days after all it’s been going on for a couple of years before he became CSAFP years!

    He should have given the order, “Find him guilty in one week 1 week or release him, if not you all get the sack!” (Somethinng like that..)

    I’m simply repeating what I’ve heard about major service commanders (not chief of armed forces pa yan) reaction in the UK Armed Forces in cases of this sort.

    (Of course the military courts — much like the judiciary — in UK armed forces are independent and usually cannot be dictated upon but it really is up to the major service commander to set the pace.)

    Ang pagkakaalam ko e promoted na si Martir to 2 star ng matagal na so di na sya covered ng regulations na yan. Iba yung process ng confirmation. He can actually wear 2 stars even if nof confirmed which he did. The only effect is, di tatakbo ang time in grade mo sa present rank kung di ka confirmed. Disadvantage sa yo yan pag bata ka pa at vying for higher positions kasi di ka ma promote to LT General unless confirmed yung MGEN mo. Kung di naconfirmed si Martir at inabutan sya ng retitrement nya, balik sya sa BGEN. However, MGEN pa rin pension nya. Pero dahil confirmed sya, LT GEN pension nya. Magulo ba? Swerte ng switik na yan! Grrrrr. . . .

  40. Pareho ni drunkard “VAdm” Madamba (Class 62). He was rear admiral but was promoted to 3 stars a few months before his retirement and was awaiting confirmation — he was so proud of his 3 stars, fortunately he wasn’t confirmed! Hah!

    He is still a MGEN. What i mean is, if he retires on March 5, he gets to receive the pension and other benefits of a LT GEN because he was confirmed as MGEN. Retirement benefits are always one rank higher.

    Noon pa nakita ko na ang maling sistema, dyan sa ating military protocols ( panahon noon ng mga Crisology_Singson ) matindi ang hidwaan..isang halimabawa lamang ito,…saka kailangan ” kissing the ass ” paitaas,.hindi yong ka-alaman mo sa military at tunay na sundalo sa mga Taong dapat ipagtangol, na ayon sa batas, etc…kaya sa halip na ituloy ko noon ang CAD ( advance rotc-graduate ko, may mga kaklase din akung tatlo naging heneral, at junior officer ko naging, almost top 3-sa AFP ), nag concentrate na lang akung mag-trabaho sa abroad, ibat-ibang bansa…nakita ko ang listahan, noon dadalhin ako sa Mindanao. By God’s grace, nauna ang call ko sa abroad, kaysa sa assignment sa CAD, kaya minabuti ko nang paglingkuran ang bansang TAkbuhan, at kanlungan ng Pilipinas. Siguro, baka natulad ako sa grupo nila na “KKK” ala, Andres Bonifacio ideals..yong mga vision ko noon, nangyayari..di mo alam kung kanino ka nagli-lingkod ( sa, by “assing-your boos” o sa Bayan ).
    Minsan sabi ko, ano ba talaga ang itinuturo sa PMA ???..kasi maraming ibidensya na lumabas…mula noon, hanngang ngayon..katulad nitong Lt Raymundo, Gen. Danny Lim, Senator-Trillanes, Magdalo, at iba pa ( sundalong naging tau-tauhan ng mga politiko, para lamang magkaroon ng promotions )…Isang analysis lamang po..na sana magkaroon ng tunay na “pagbabago sa atin, di lang governance, kasama na ang AFP-etc )… Sana tingnan din ng pansin ito sa bagong panguluhan sa Mayo-2010-eleksyon..sana ang automated-election ay successful, para naman tumakbo nang mainam-malinis-patas ang resulta ng eleksyon…pag-may ” hello-Garci” na naman, wala na tayong pag-asa pang hihintayin…baka maging “human-volcanic-eruption ” mangyari dyan…manalig palagi tayo sa Diyos sa kalutasan ng mga problema sa Pilipinas..

    As I’ve said before, wish those marines who are/were aghast about Martir’s instant promotion should all go awol. Maybe it’s an easy way for promotion for all of them. Only in da Pilipins and this AFP is nothing but the laughing stock of the world over, a poster child of military comedy at best.

    Singling out the AFP chief in Raymundo’s case is not fair. While it’s true that this has dragged on for 3 years already and surely, this is just no ordinary case, the General Court Martial of the Navy/Marines has the jurisdiction over Raymundo and not the AFP Chief. Anna is correct that Ibrado should have given the FOIC, PN a deadline to wrap this up but I guess, Ibrado is no micro-manager. Toto Golez should bawl out the President of the GCM trying Raymundo.

    Di naman siguro lahat unfair. I have had my share of ups and down while in the service but I can assure you, it was truly a rewarding experience, not in terms of monetary benefits, but on the over-all development it afforded me as a soldier. But I also agree with you and the bloggers here that for the past years since Glue was the Commander in-Cheat, the AFP’s image took a beating, what with the shenanigans of the top dogs identified with her. But then again, I would say that these rotten apples are in the minority and the good ones in the service still have the best interest of the people in their hearts and minds. While this may be debatable to you and the others here, I’m sorry but I still believe in the AFP as an institution. In due time, all the shenanigans of Esperon, et al will be unearthed and hopefully, we can have closure on these cases in the next administration.

    A military tribunal has dismissed two of three charges filed against a Marines lieutenant who allegedly circulated copies of “Ang Mabuhay para sa Masa” compact discs depicting the life of former President Joseph Estrada.

    First Lt. Artemio Raymundo was charged in 2006 with violating Articles of War 96 (conduct unbecoming an officer and a gentleman), 97 (conduct prejudicial to good order and military discipline) and 64 (disrespect for a superior officer).

    Officials earlier said Raymundo turned unruly after his superiors ordered him to stop distributing the CDs which had been rated “X” by the Movie and Television Regulatory and Classification Board.

    He defied the order and was later detained and charged.

    The military banned the distribution of the video CD among its officers because there was a “political color” to it.

    The first two charges were dropped Friday during the court proceedings, said Navy spokesman Lt. Col. Edgard Arevalo.

    “His lawyer filed a motion to declare Raymundo not guilty with respect to Articles of War 96 and 97 and the court granted the motion,” he said.

    The court is headed by Commodore Jose Luis Alano, chief of the Naval Forces Northern Luzon.

    Arevalo could not say specifically what prompted the court to dismiss the two charges.

  64. Not long ago, I distributed a lot of printed paraphernalia to the Navy that were definitely politically coloured — a jab at former USSR sourced equipment that they were looking into; particularly ships that came from East Germany.

    How can you expect a 100% effectiveness of troops kung meron silang kasamahan na alam nilang walang kasalanan subalit napakatagal nang nagdurusa gayung walang malinaw na sakdal?

    Ilang taon na bang nakakulong ang Oakwood mutineers? Sina MGen Miranda at BGen Lim? Col querubin? And other senior and junior officers? Itong si Lt Raymundo na maliwanag na isang panggigipit at kapritso lamang ni Major Luna?
    ‘Yung mga dishonorably discharged EP na walang nakuhang dapat na tanggaping suweldo?

    Ilang CS, AFP na ba ang humawak sa armed forces matapos magretiro ang supot na berdugong duwag naman na si EsPWEron bago itong si Gen Ibrado?

Kahit kailan ay hindi naman nagkaroon ng autopsy kung ano’ng klaseng bala ang tumama at saan tinamaan. Ang importante lang ay merong after encounter report na madali lang gawin kahit walang actual encounter.
