Senator Antonio Trillanes IV and senatorial aspirant former Brig. Gen. Danilo Lim will remain in jail despite being allowed by a Makati court to post bail on a rebellion charge, the military said on Wednesday.
“The group of Senator Trillanes cannot be released until after the military has agreed already, because they are still facing general court martial,” said Armed Forces spokesman Lt. Col. Romeo Brawner Jr.
He said the two have pending cases before the military tribunal in connection with alleged attempts to overthrow the Arroyo government.
“Under the military law, there is no such thing as bail,” Brawner said.
Brawner made the statement after the Makati Regional Trial Court Branch 150 granted the plea for bail of Trillanes, Lim and 16 other soldiers. The bail was set for P200,000 each.
Brawner said the military is securing a copy of the court decision for study and “to determine the circumstances, the basis” why Trillanes and Lim were allowed to post bail.
Trillanes, a former Navy officer, is facing conduct unbecoming of an officer and a gentleman before a military tribunal for his participation in the July 27, 2003 Oakwood Mutiny. He is also charged with coup d’etat before a Makati court for the same reason.
On the other hand, Lim and 17 other Army and Marine officers remain charged with violation of several Articles of War, including mutiny, before a general court martial for the alleged plot to overthrow the Arroyo government in February 2006.
He is also facing court martial for the so-called Manila Peninsula siege in November 2007.
Trillanes also took part in the Manila Peninsula siege but was not charged before the military tribunal as he was already a civilian then. He was deemed separated from the military when he ran for senator in the 2007 elections.
Government prosecutors, meanwhile, will contest the Makati court’s decision, according to Executive Secretary Eduardo Ermita. “Our government prosecutor definitely will set their motion for reconsideration in motion,” he said at a press briefing in Malacañang.

Military hasn’t finished trial of Trillanes and colleagues for Conduct Unbecoming an Officer and Gentleman after so many years detaining the group.
If military had been efficient and really wanted justice served, they should’ve tried officers; if found guilty of said military violation, officers would serve sentence (unless military was planning to sentence them to 20 years of hard labour), then discharged from service — all should be over and done with. They should be walking free today.
(No need to discharge Trillanes — wasn’t he considered automatically resigned when he ran for the Senate?)
5 – 7 years in detention without trial is a lot of time served in prison.
So, even if you consider govt’s case against them under trial in civil courts, with the bail being granted, they should already be out of detention.
In other words, military has been remiss all throughout. And I thought it’s the civil courts that would be slower than military justice/courts.

martina, nagbigay lang ng mensahe noon si Trillanes, not endorsed Villar. In fact, before that nagpahiging si Trillanes na mukhang susuporta sila kay Noynoy-Mar. Hindi lihim sa LP na may namimintong negosasyon ng alliance sa Magdalo at LP…tanungin ninyo ang pamunuan ng LP. Sa basa ay mukhang hindi ganado ang LP sa kanila. Hindi yan lihim sa mga nagpapaandar kay Noynoy-Mar.

Correct me if I’m wrong… ang alam ko kasama si Gen. Lim na nagkudeta kay Cory. If this is true at makitid pagiisip ni Noynoy, bakit nasa LP ngayon si Gen Lim at tahasang sinabi na palalayain si Gen. Lim.
In my view, many Magdalo’s already signed a fact with the devil, considering many plead guilty to whatever charges where thrown at them. Key members even pledge to support the candidacy of Villaroyo! Can’t blame these guys for whatever decision they made. They have to decide what’s best for them. They were the ones who were unjustly treated. Persuasion by extended incarceration is hard to bear for anybody. Sadly, it looks like they forgot what they stand for before, with exception of the few holdouts and the support for Villaroyo may probably mean we have to endure more of the same.
I only wish the people will know the facts of the accounts in the talks between the LP and the Magdalo.

The supreme court is trying hard to function, or be useful by issuing the writ of habeas corpus on the military oblivious of the fact that it has been de-fanged by gloria. The result: the military acts like the SC does not exist. Even in the lower kingdom, when the lion is without teeth, it will die ‘cuz it cannot bring down its prey, and thus starve. Likewise, the SC without its muscle to enforce its edict will DIE – and so will democracy.
Keep watch during the coming days … while the people are regaled by the moro-moro callled elections, the military will tighten its grip … WATCH EDUARDO ERMITA!!
