Comelec affirms Vivienne Tan’s candidacy

A friend asked me to inform residents of Quezon City, district I that Comelec has made its final decision: Vivienne Tan is qualified to run for a seat in the House of Representatives. Here’s his report:

The Commission on Elections, meeting en banc, junked the motion for reconsideration filed by Congressman Bingbong Crisologo seeking the disqualification of Vivienne Tan as an independent congressional candidate in District 1, Quezon City.

All seven commissioners concurred that “Vivienne Tan possesses all the qualifications and none of the disqualifications as candidate for Member of the House of Representative for the First District of Quezon City.”

In a statement to media, Tan, daughter of taipan Lucio Tan, thanked the Comelec for “upholding the spirit of the law.”

“Mr. Crisologo knows that his appeal to disqualify me as a candidate has no legal basis. But he relentlessly filed appeal after appeal, using this to spread rumors of my disqualification and discourage voters from choosing me to be their representative,” Tan said.

The lawyers of Tan, meanwhile, said the order of Court of Appeals to delist Vivienne Tan as a qualified voter in District 1, Quezon is null and void and without legal force and effect.

Arno Sanidad, chief legal counsel for Tan, invokes the Rules of Court saying, “the jurisdiction over petitions for certiorari of decisions of the Metropolitan Trial Court and the Regional Trial Court is lodged exclusively with the Commission on Elections, and not the Court of Appeals.”

The lawyers said Crislogo’s petition for certiorari “should have merited an outright dismissal” because the Court of Appeals has no jurisdiction over elections matters which is lodged exclusively to the Comelec.

“Vivienne Tan, therefore, remains to be a voter and candidate for the House of Representatives,” the lawyers said.

    Vivienne is an educator and established a management school called Entrepreneur School of Asia and her Dad had been very active helping many kids get exposure sa business early on. Actually dalawang pamangkin ko ang nakibang sa mga scholarship ni Lucio Tan. Napadala sa China all expenses paid para mag-aral mga high school students pa lang sila…so for me, why not probably she mean well. Really hope so considering her background. Kesa naman sa mg subok nang walang nagawa para sa bayan…pero di ako botante sa Quezon City..sayang!

    Pero nakapagtataka na binitiwan na ni Kapitan ang control sa Fortune Tobacco kapalit ng shares sa Philip Morris. Wala yatang tiwala sa mga anak niya na magpatakbo ng negosyo. O pagod na ang matanda (sa negosyo, hindi sa babae, hehehe). Kaya itong anak na babae, imbes na negosyo, politika ang inaasikaso.

    Marunong din itong si Vivienne, walang partidong sinamahan, independent. Bakit pa nga naman, di naman niya kailangan ang pondo o makinarya ng kahit sinong partido. Kung pera-pera lang, lamang siya.

    Siguro naman, kesa suportahan ni Kapitan si Escudero sa 2016, dito na niya gagastusin sa anak niya muna. Malabo na yatang makakuha si Escudero ng sponsor, ayaw na sa kanya ni Danding, tinabla pa ni Lucio, may atraso pa siya ngayon kay Erap, saan siya pupunta?

    Sa akin lang, hindi na kailangan ang candidacy ni Vivienne Tan para lang protekthan ang kanilang negosyo. The Tan’s family’s conglomerates has proven that they can survive and progress without any politician in the family. Di ba sa isang maliit na department store lang sa Carriedo yan nagsimula. Dapat pa nga nating maging ehemplo si KapiTan sa pagpapa-unlad sa negosyo. And besides ang daming trabahong naibigay sa mamamayang Pinoy. At binibigyang pagkakataon ang mga maliliit na enterpreneurs na mag-supply ng kanilang produkto. To Vivienne, may you be a good politician. Siguro naman di mo na kailangang mangurakot.

  31. Lucio Tan has always managed to strike favorable deals in the past administrations even though he’s been hounded no end taxation. Rumor is that Noynoy refused his offer for campaign assistance (maybe he knows something we don’t) and Philip Morris has been knocking on their doors for quite some time, the offer was good, so he took it. The Philippines consumes around 90 billion sticks of cigarettes per year, 60% of that is from Fortune Tobacco while PM supplies 30%, the rest is shared by smaller players ie La Suerte, Mighty Corporation, etc…PM has taken over the management. So the once old, manual, fortress like compound is now abuzz with so many changes (SAP, etc). The management team is composed of Malaysians, Filipinos, etc. that it looks like a ASEAN during meetings…
    …Lucio Tan may be chuckling to himself, whatever happens, lets see them go after PM, they’ll have the US embassy to contend with…

    I don’t know…but I’ve heard from some people that he’s irritated some “shady” businessmen (big time smugglers, etc.) because he’s so “maarte” of course referring again to “not accepting” their offers.   49. Perhaps she really wants to reach out to the people of her district by representing them in Congress and so decided to run. If that’s her personal decision, then fine. But if it’s to have a direct hand in Congress to serve Daddy’s interests, i.e., legal backstops, etc., that’s another thing.

    Except when Guingona was Exec Sec to FVR and the party needed “donors” for JdV in the election of 1998.

    There was no goddamn finesse from the future “receiving party” there — Guingona upped the ante by telling another business group: The Australians are prepared to “donate” 100 million dollars (Aussie) for the campaign, etc, what about xxxxx?.

    Tongue, you nailed it.

    There’s a code of silence between a politician and businessman. The act alone of giving and accepting already sealed a transaction. Both parties agreed on a silent and unspecified deal and no need in going to details.

    Payback time will come later, in times of need and in times of problems. That’s the time to lay cards on the table.

    Politicians can claim whatever they want that contributions are accepted with no strings attached, but maybe they should tell that to the birds and the bees.

    Speaking of provincial sorties. I would like to know if aircraft for Noynoy-Mar’s provincial sorties to, example, Mindanao, are paid for by the Noy-Mar campaign or was offered for free by the aircraft owners?
