The May 10, 2010 elections gave Liberal Party‘s Benigno “Noynoy” Aquino III overwhelming victory but it was the performance of former President Joseph Estrada in the race that amazed many.

As of Thursday, with 89 percent of the votes in, the Commission on Election Count gave Aquino 13.8 million votes followed by Estrada with 8.4 million votes. With only about 10 percent of some 38 million votes cast left uncounted, Aquino’s over- five- million vote-lead looked insurmountable.

But the fact that Estrada, invariably dismissed by analysts early in the election campaign as either a “spoiler” or “a kingmaker”, one who can help ensure the victory of one candidate in a close contest by his endorsement, is running second, overtaking the expensive campaign of Nacionalista Party Manuel Villar, showed his strong hold on the masses who comprise the bulk of the 50 million voters despite his being convicted of plunder . (Estrada was convicted of plunder in 2006 after more than six years in detention but was pardoned by Gloria Arroyo a month after.)


What makes Estrada’s showing impressive is that he conducted a traditional, no- frills campaign unlike the one he waged in 1998 when it was obviously much better financed.

Estrada’s rallies in 1998 were more organized, showing a strong and extensive local network. This year, we did not see much of that. Rallies were not as huge as in 1998.

What we saw was people coming to rallies on their own, women carrying their babies and senior citizens braving the heat to applaud the man who they believe cares for them and will lift them from poverty.

Estrada paled in comparison to Aquino and Villar in television advertisements. He also did not tap New Media or the Internet as much as his rivals.

Estrada’s campaign was hobbled in the beginning by legal questions whether his return to the presidency would be legal as the Constitution says “The President shall not be eligible for any re-election.”

The Comelec decided last January and re-affirmed first week of May that the Constitutional prohibition does not apply to Estrada. “My opinion is that, applying the deliberations of the 1986 Constitutional Commission, the prohibition imposed upon an elected President who has served the full term of six years is not applicable to herein respondent,” Comelec Commissioner Rene Sarmiento said.

Until last week of April, Estrada was on third place trailing behind Villar.

Those who are concerned about the possibility of a return by a president who was ousted for charges of corruption are thankful that Aquino ran or else it would have been Estrada again in Malacañang.

Journalist Inday Varona gave credit to Villar for blocking an Estrada presidency, part two. In her essay, “Unlikely heroes”, Varona said, “ All ye reformists out there should give thanks to the Nacionalista Party standard-bearer — for spending billions of pesos to shave off votes from Estrada. If Villar hadn’t done that, we would have the comeback of Erap. There is method to this mad logic. Die-hard Villar and Estrada supporters were never going to vote for Mr. Aquino; who knows what would have happened if the Estrada bandwagon got rolling with enough time to gain bulk as it hurtled to the finish line.”

Estrada’s votes came mainly from what survey groups classify as D and E groups, the poor. He was also strong in Mindanao, apparently for his strong anti-Muslim rebels stand.

Estrada may not have succeeded in his comeback bid but he has proven that he remains a force to reckon with in Philippine politics.

    In his separate concurring opinion, Commissioner Rene Sarmiento noted that while the framers of the 1987 Constitution decided to absolutely bar a president who has served a full term from seeking reelection, they were silent on a scenario where a president who failed to finish his term would seek reelection.

    It’s obvious that the only pertinent constitutional provision as regards Erap’s disqualification is:

    The President shall not be eligible for any re-election.

    The provision of the law does not make any distinction as to whether the President is the incumbent or not. Following a well-settled principle in statutory construction, we must not distinguish where the law does not distinguish (1). In addition, where the law is free from ambiguity as to whether a President completed his tenure or not, the court may not introduce exceptions or conditions where none is provided from considerations of convenience, public welfare, or for any laudable purpose (2); nor may it engraft into the law qualifications not contemplated (3).*

    Inasmuch as there is already justiciable controversy here, I really look forward to the SC’s take on the matter in the future.

    Kuro kuro ko lang ito. Si Erap at Villar ang naghilahan sa boto ng mga mahihirap at sila ang tinarget sa kampanya ng 2 kandidato. Sa bawat pag angat ni Villar sa survey, syang baba ni Erap. Sa bawat pag bagsak naman ni Villar sa survey, sya namang angat ni Erap. Kaya nung bandang huli na lumagapak si Villar, kay Erap pumunta ang boto.

    Kaya ako nagpapasalamat sa pagsali ni Erap sa election at kung hindi, baka sa Villar ang nanalo at hindi si Aquino.

    kaya dapat magdiwang si erap kahit paano mas malaki ang nakuha niya kay Villar. Ang naging laban niya ay kung sino ang ang AMA ng masa between him and Villar…siya ang nanalo.

    From the start mahihirapan talaga siyang manalo dahil ang mga fans niya (1998) ang iba siguro patay na tapos nawala siya ng 10 taon ang tumatak sa mga kabataan Corrupt siya.

    Dito nga sa bahay namin tahimik na lang ako…ayaw talaga sa kanya ng mga matalino..ay naku si father-in-law talaga.

    Be happy Erap kasi sa next election parang INC ka din dahil for sure maraming candidates hihingi ng endorsement mo.

    i sure would like to quote one journalist who can actually make such a statement on demographics based on the actual election result…

    The election demographics cannot be done nationwide, but some choice samplings in relatively homogenous areas can be done to get a grip on the choice of the economic classes.

    For instance, for the poor, and their preference, the precincts of Isla Puting Bato in Tondo, Payatas in QC, and rural precincts of poor provinces, like say Samar, or Barrios Ora Estes and Ora Weste of Ilocos Sur.

    The rich, well get the election results of Alabang, Forbes Park, and other rich enclaves.

    Sa senators, bahala na ang kanilang ginawa kasi walang exposures ang mga ito sa kanayunan, hindi sila kilala kaya puro artista yung binoto. Dapat palaging separate ang senatorial election para concentrated ang mga barriotics sa kanila.

    Nathan, I forgot to mention. Ang feed ko kaya nanalo si Binay sa amin probinsya ay dahil sa konek niya kay Da King (sila ni Chiz), hindi raw basta nakakalimot ang mga guerillas, hehe. In 2004 kasi ay 78%-85% ang ibinigay ng probinsya kay Da King, pati mayors at gobernadores ni Gloria ay kasama sa karosa ni FPJ na nalibot pati kasulok-sulukang baryo. Plus plus plus si Tita Cory na mahal na mahal sa amin ng mga Katoliko. Si kuya Mar daw kasi parang diskonek sa kanila, a ewan.

    Ayaw ko ng legislator. Walang track record yan ng executive skills. Si Erap lang, dahil dating mayor. Kahit sa US, mas marami ang presidenteng magaling na ex-gov, kaysa ex-senator.

    I would like to see some local gov stars gaining national attention. People like Mayor Robredo. Kung talagang gusto ng deep bench ni Noy, lawakan niya ang pagpili, hindi yung mga dikit lang sa kanya.

    At puwede bang manahimik muna yung mga nakapaligid? Hindi pa nga declared, marami nang tumatalak. Or is that to force Noy’s hand, para hindi na magbago ang isip? Adelantado kasing masyado kung dumating.

    Roxas says Binay betrayed his Presidential candidate Erap.

    That’s as clear as day. He made it appear in his TV ads that he was part yellow by showing photos of him and Cory. Then coming up with the yellow colored “Noy-Bi” campaign.

    And in the provinces, he had photo posters only of himself that said “Binay for Vice-President”. There was no name of any party he belonged to, no name of his President. Just his photo and those words above.

  57. MB, you are right. Elections results showed that Noynoy topped the votes among the D and E and for that matter the ABC.

    Noynoy’s support cut across all classes. That explains his landslide win.

    Erap,on the other hand, as I said, got the bulk of his votes mainly from the D and E. He fared poorly among the ABC.

    But what is amazing as I mentioned in the article is that he was able to obtain those votes despite his streamlined campaign.

    Many, including myself, didn’t take Erap’s campaign seriously because it was apparently on a shoestring budget.I learned there was not much contributions that came in. Compared to Noynoy’s and Villar’s, Erap’s was ragtag.

    He didn’t even complete his senatorial ticket. And convicted of plunder na yan, ha.

    There was little local organization.

    The handling of media was another thing. Compared to how embedded media in Aquino and Villar’s camp are taken care of, those covering Estrada are orphans.

    As I mentioned in the article, compared to the 1998 campaign, Estrada’s campaign this year is talagang tipid.

    For him to get that much votes is amazing and something to be concerned about.

    In relation to your column titled above subject, I beg to disagree that this is Erap amazing performance. The right word is fair, because his mass base still intact.

    I for one voted for Erap way back 1998, the real reason that I choose Noynoy instead is that he’s too old for the job. If we reverted back the course of time in his peak, I will still vote for him, because I believe that he’s sincere to alleviate the flight of the poor masses.

    I have a second thought during the elections that what happens to Marcos might happens to him once he’d been elected again. The real grip on power must be combined with strong will, character and physical conditions.

    These last element is very vital to who would be elected president of the republic because of the uphill task that waits ahead of him. In the very beginning I know that Erap is the most formidable contender in the presidency against Noynoy, because of never ending support of the masses. You ask the street vendors, the common people, whom they prefered to, the answers without a wink is Erap.

    And why I voted for Noynoy? because he’s the only one I believed can bring to jail all those big time thieves in the government, at the forefront is the first gentlemen and Mikey.

    I’ve been living in Toronto Canada for more than 30 years now but because of TFC I can follow closely the political scene backhome.

    I disagree with Noynoy Aquino’s victory. First of all he is only the son of Cory Aquino and I haven’t heard any accomplishment he made while a senator. When I was there in 1992, my relatives who supported Cory Aquino and the People Power in 1986 told me that it was even worse under the
    Aquino government than during the Marcos regime.

    As for Estrada, me too was amazed by his performance, he was under estimated by the media and his opponents before the election then he came second to Aquino in votes result. I thought he will be back in Malacanan. It will be a huge vindication for him if he did.

    I could feel there was ‘electronic cheating’done to block Estrada from winning. Could it be the same group who were responsible for his ousting in 2001? The Business Elite maybe? They are afraid that Estrada will win because he is the idol of the masses? And even in San Juan Rizal,
    Estrada came third, something suspicious happening.

    I am suspicious that Aquino’s votes wereelectronically padded to give him a 5 million votes margin over Estrada.

    Who knows, but this alleged fraud will be a big issue in days to come once proven.

    Your May 14, 2010 piece, “ESTRADA’s AMAZING PERFORMANCE” in Malaya is a welcome and deserving write up for a man who has become the scapegoat, the “sin bearer” if you will, of the hypocritical scoundrels both in big business and government. Your article on Estrada is one that stands out differently compared to the current revival of anti-Erap articles purposely designed to make people accept a saintly Nonoy and junk a sinful Erap and even project the most hated Gloria Arroyo innocent.

    However, please allow me to comment on two statements you made:

    1. On Noynoy’s “overwhelming victory” : What makes you so sure that Noynoy Aquino’s victory is “overwhelming”? Obviously, you believe that the electronically counted election results are credible. More than a week after the questionable elections, there is no official confirmation yet just precisely how much vote Noynoy has to be ahead of Estrada. Yet just one day after the elections the COMELEC released 38% of election returns declaring that Nonoy had already 5 million votes. This obviously pro-Aquino trending was gladly picked up by its co-conspirators, the anti-Erap media headed by ABS-CBN and the Daily Inquirer which continue to brainwash the people and the whole world, with the assistance of the U.S. media, into accepting a Noynoy “overwhelming victory”.

    In the words of Larry Faraon, O.P. : “Are we then to swallow the figures just like that with a perception of an Aquino victory through a protracted mind conditioning which started day one of the campaign? Any Makati Club businessman member would kick out of the conference room any sales presentor who cannot substantiate his figures on the table!     The truth is Estrada was “convicted” of plunder by a kangaroo court personally selected by Gloria Arroyo, the usurper, on the basis of trump up charges orchestrated by crooks from the Aquino and Ramos administrations using the shady Aniano Disierto as head prosecutor. Naturally, members of that God forsaken court had to convict Estrada or else a not guilty verdict means Estrada should still be president.
    Then the use of the word “plunder”. Just precisely what and how much Estrada “plundered”? Jueteng? The conviction of Estrada is no different from the conviction of Andres Bonifacio by Aquinaldo’s kangaroo court.

And, lastly, perhaps you ought to let your readers know that Joseph Estrada —compared to Corazon Aquino, Fidel Ramos, and Gloria Arroyo — in only 2 years of his presidency — provided the Filipino people with a taste of a better peace and order ( e.g. the police were disciplined during his tenure), a self-sustaining program for agriculture resulting in lower cost of vegetables, social services (e.g. tindahan in Erap) that uplifted the poor, and last but not least obliterating the MILF stronghold.

    Perhaps it is precisely Joseph Estrada’s firm stand against the MILF that got the ire of Uncle Sam resulting in a U.S. backed power grab of the presidency by Arroyo and ultimately his being drawn into the trap of running for the presidency again by taking out all the “constitutional obstacles” so he can run again in order to give the election a sense of credibility. The recently issued order by the Supreme Court asking the Comelec to explain why Estrada was allowed to run again just proves that these conspirators want to make sure Estrada is out just in case by sheer stroke of an electronic glitch Estrada comes out with higher votes.

    If Uncle Sam found an all too willing puppet in Gloria Arroyo, it has found this time a perfect puppet in Noynoy (who claimed that the Americans have been talking to him before the elections even as U.S. ambassador then Kristy Kenney appeared in newsprint and tv wearing a yellow Ninoy T-shirt). How could Joseph Estrada, the true people’s president, possibly be declared winner even if won under such situation? That is the tragedy that confronts the Filipino people again today.

    The real tragedy here continues to be: “mahihirap para kay ERAP” are simply the thorn to any elections in our country, be it local or national. So easily deceived are Mahihirap para kay Erap.
