Hindi kailangan ng taumbayan ang bastos na opisyal katulad ni Ferrer

Kawawa naman itong sina Melchor Magdamo at Arwin Serrano.

Naglakas ng loob isiwalat ang bulok sa Commission on Election. Sa halip na purihin at binigyan ng medalya, minura at dinuro pa sila ni Commissioner Nicodemo Ferrer.

Nangyari itong insidente isang linggo sa miting tungkol sa anomaly ng P700 milyon na kontrata tungkol sa plastic folders na pantakip para daw magiging sekreto ang pagboboto.

Si Magdamo ay dating nasa staff ni Comelec Chair Jose Melo at si Serrano naman ay sa Parish Pastoral Council for Responsible Voting, ang isang pribadong organisasyon na binigyan ng Comelec ng lisensya magigigng taga-pagbantay.

Maala-ala natin na inapbrubahan ng Comelec ang pagbili ng 1.8 na folders sa halagang P380 bawat isa. May ginto yata ang folder na yun.

Ang nabulgar na may kagagawan ay si Executive Director Jose Tolentino, na palagi nyo nakikita sa TV ngayon sa imbestigasyon ng Committee on suffrage sa House of Representatives tungkol sa automation.

Nakalipas na ang eleksyun at alam naman natin na talaga namang walang pakinabang ang mga folder nay an. Kayo ba gumamit ng folder na yun sa pagboto nyo? Ako, hindi.

Nakita nyo naman ang nangyari kay dating Pangulong Joseph Estrada, di ba? Anong secrecy ang pinagsasabi nila?

Talagang despalinghado ang pag-iisip nitong si Ferrer dahil ang miting ay tinawag para kastiguhin sina Magdamo at Serrano kung bakit raw nagsumbong sa media sa halip na sa kanila?

Sa TV interview kay Magdamo ,sinabi niya hindi totoo na inuna niya ang media bago sa mga opisyal ng Comelec. Isinumite niya ang report sa mga commissioner ngunit hindi nila pinansin.

Binigay niya ang report sa hepe ng legal department na si Ferdinand Rafanan na nabahala sa impormasyon. Paano napunta sa media, hindi niya alam. Ngunit nagpasalamat rin siya sa media dahil sabi niya, ang paglabas ng katotohanan ay naging protekyun niya.

Sabi ni Magdamo, may mga natatanggap siya banta sa buhay niya. At sabi niya, “Kung may mangyari sa akin at kay Dr. Serrano, si Tolentino ang may responsibilidad.

Ipinagmalaki pa ni Ferrer na nanduro siya. “I can point my finger at you whenever I want to. Who are you anyway?”

Bastos pala itong si Ferrer. Ang yabang pa.

O ano ngayon kung pumunta sa media sina Magdamo at Serrano? Ang mahalaga ay katotohanan ang sinasabi.

Itong si Ferrer pala ang nagdesisyon laban sa Ang Ladlad, sa Migrante at sa Magdalo.

Mas makukuha ng Comelec ang tiwala ng taumbayan kung wala ang mga opisyal na katulad ni Ferrer.

    Pag na-add mo raw yung null votes at yung number of votes ng lahat ng presidential candidate ang total daw ay ang total number of voters who voted. Nasa dokumento ng Comelec yon, binabasa pa nga ng Secretary General ng Senado kanina sa canvassing.

    Ano raw yung null votes? Pag nag-overvote ka raw sa presidente, one null vote daw iyon. Pag wala kang ibinoto sa presidente o nag-undervote ka, plus one din sa null vote yon.

    Ganun din sa VP, null vote ang under at over vote.

    Ang naging problema kung bakit hindi binilang yung boto ng COCs ng Baguio City dahil sa reklamo nung abugado ni Erap. Alerto yung abugado ni Erap ha. Pag na-add mo raw lahat ng boto ng mga kandidato sa pangulo at dinagdag yung null votes, lampas sa number of voters who voted.

    Kaya naman pala nagkakaletse-letse ang bilangan, bobo yung EXPERT. Kung blangko ang presidente ko, plus one sa null vote. Pag blangko uli sa VP plus one uli sa null vote.

    E di dalawa na ang null vote na nabilang samantalang isa pa lang ang bumoboto, hindi nga magta-tally yung total voters who voted at yung scores. Tanga!

    Paano na kung pati sa Senators, Mayor, Vice Mayor, Councilors, etc ay merong over at undervoting? E di sa isang balota pa lang binibilang na nilang ilang tao ang bumoto. Tapos merong 75% voter turnout daw na ang pinagbasehan pala ay maling datos ng ‘total voters who voted’?

    I believe there was just a coding problem in aggregating the totals per position. They should have distinguished null votes per position, instead of total null votes. Double counting nga, kaya over.

    I think there can be one null vote per position. If this were the old manual system of totaling, there would be one column for Aquino, one column for Erap, etc., and one column for abstain (if no president were marked). There would also be one column for spoiled vote (the term we used in UP Law, when I was in the Electoral Tribunal, when somebody wrote nonsense, like Nora Aunor or some other name). In this case, spoiled vote would be the overvote, marking say Aquino and Erap.

    So if you count the total of Aquino + Erap + Villar + etc., + abstain, + spoiled, then you would arrive at the total of those who voted. So null vote here, I take to mean either abstain or spoiled vote for that position.

    There can also be a spoiled ballot, which is, when the entire ballot is spoiled, because it is defaced, unread, etc. In that case the spoiled ballot should yield one null vote per position.

    Since totals are counted per position, they can check for consistency by simply comparing the totals of the president and the vice-president. They should yield the same number of total voters. In other words, the total of Aquino + Erap + Villar + etc., + null (abstention and overvotes), should equal the total of Binay + Mar + other candidates, + null (abstention and overvotes).

    I agree with your arithmetic.

    You can arrive at the total number of voters based only on the votes for the president and vice. The totals of both positions will be equal no more, no less.

    Add all the votes for the president plus all the voids, null, etc. that went into the ballot box, and that’s the total number of voters. If you arrive at a difference between the votes of the president and vice president, then there’s something wrong, because it’s impossible to have a discrepancy when you are adding the same ballots.

    It’s one ballot for every voter; the null or void votes are those filled up by voters that were either unreadable or defaced but still to be considered and counted only as under the null votes.

    The total number of ballots cast, good or spoiled is the total number of voters.

    The entire Comelect topside will have gotten a lot of money from the contract they signed with Smartmatic and most likely, they still have receivables, i.e., for a couple more years to come.

    (Ellen, I believe Ferrer won’t resign today even if he’s being kicked out by the people because his staying in office is his insurance so that the money will keep pouring in.)

    There is just NO FRIGGING WAY the wouldn’t have. They may deny it until they are blue in their faces but they can’t say they’ve become saints all of a sudden and did not accept tongs or won’t accept further tongs. No way!

    No commerical contract with Pinas govt or its agencies can go through without a cut or % of the contract amount. That’s how you do business in Pinas govt or its agencies.

    Melchor Magdamo and Arwin Serrano should be commended for blowing the whistle, instead they are being harassed. And it’s because a multi-million peso easy money that supposed to go to their pockets went into the drain (?) because of them.

    It’s been the norm under Gloria that whistleblowers were given a hard time, being sued, threatened or terminated from employment. Ferrer’s action is not surprising, he is just being consistent with the policy of Gloria that whistleblowers be aware of who are they up against. Oh yeah, who are these whistleblowers anyway?

    Ferrer is a constitutional officer so he can not be fired. The only way to kick him out is impeachment, and corruption is an impeachable offense, so maybe the next government may intitiate an impeachment to get rid of him.

    People like him who is bastos, arrogant, mayabang and magnanakaw has no place in a government service.

    This is the point I’m raising as to why we have to be mindful of the declarations of so-called EXPERTS. More so, of those lawyers and politicians in the House who were never trained in programming. (eg, Rodriguez praising Smartmatic’s “Fail-proof and tamper-proof” system.)

    THERE IS ABSOLUTELY NO WAY to determine precisely how many voters ACTUALLY voted BASED ON ANY of the totals appearing in the COCs. Even in the ERs. Unless NULL votes were summed up PER CONTEST (president or VP, etc.) and not one lump sum of all null votes. The only way to do it is via a ballot counter.

    We know it didn’t happen that way since in the Baguio COC, the number of votes (I presume it was for president since it was Erap’s lawyer who questioned it) plus null votes FOR PRESIDENT exceeded the number of voters who voted.

    The canvassing program module (several modules or “routines” make one complete program) is a very simple program in itself and it’s very similar to the very first code any programming student is taught. (FYI, yours truly has 3 Certificates of Proficiency in Programming, one each for a different language, ehem.)

    That is why the competence of Smartmatic is very much in question after they came out, first, with a total registered voter of 153M, and later when it was transmitted to the House, total registered voters of 257M when this data didn’t even require any computation but merely an I/O read-write process – READ from Comelec’s database and WRITE into Smartmatic’s printout report. At the worst, maybe an addition program if Comelec’s spreadsheet/database didn’t have any totals (which I doubt).

    According to the manual they were reading and the DOST “expert”, a vote becomes null when: 1) NO candidate was selected, and 2) when MORE THAN THE REQUIRED NUMBER of candidates were selected.

    Iba pa yung VOID, that is when the machine cannot read the security code. Like if the voter spills the indelible ink on the barcode at the sides of the ballot, that ballot is VOID and all votes therein are disregarded.

    In the May 7 email of Puno to the Glue, he states:

    Distribution of our Cf cards will
    continue. Actually some were never actually withdrawn and remained with our people in the respective
    places. Tomorrow, we are gonna finalize the action plan for the day itself and which manipulation
    system to use for which place.

    In an earlier post, I was reminded of the anecdote of a chef, where when the wait staff dropped the turkey, the chef said, go inside and get the other turkey. They took the “fallen” turkey inside, and garnished it, and re-served it.

    Ganyan nga ang nangyari, it seems. There was a big to-do about replacing, and everybody was saying there was no time to reconfigure. Yung pala, same same din pala.

    2.6 Million is four, almost five percent of the 51 million voters. The null votes for president are said to be one million, or two percent of the voters.

    The figures for the president don’t look like an improbability to me. Dito lang sa Ellenville, marami kayong nagsabing none of the above ang boto niyo for President.

    Now about the VP, as the Comelec said, the null votes are either those who abstained, or those who marked more than one candidate. If somebody wanted to vote for say Mar, then the last minute instructions were, ilaglag si Mar for Binay, there is the possibility that that voter could have forgotten. He marked one, then tried to erase and marked the other. That may result in overvotes which count as null votes.

    Five percent error, in a new exercise? That may be plausible. I don’t think nadaya si Mar. Nilaglag lang, like you revealed in an earlier post.

    It is the cheating at the local level that I am more interested in, especially after the emails in the website linked by ken above, reveal that Puno was interested in some particular provinces.

    Maybe we are talking of different things.

    What I am trying to bring out here is the total number of voters who voted during the election. To determine just how many voters cast their votes, just as I said add all the totals of the votes for president plus all totals of blanks, null, void or spoiled and that will be it.

    The thing here is one ballot per voter. Blanks, null, void and spoiled ballots are also counted in a separate column and cannot be credited to any candidate. Of course that will be the case, but still a voter cast his vote so even if his vote was not read or credited to anybody that will still form part of the total number of voters.

    To take the case of one ballot per voter,my understanding is the total number of ballots in the ballot box whether its blank, null void, spoiled or good equals the total number of voters who cast their ballots.

    The total of all these can not be over or under the total of voters against the total ballots cast or else something is wrong.

    Ang manual voting ay gold standard ng voting process kumpara sa automated voting ayon sa experts at sa mga experiences nila sa Amerika. Bakit? dahil mas madaling mandaya sa automation kesa manual.

    Tungkol diyan sa digital signatures ano ang napakitang digital signatures ng Smartmatic machine noong nagkaroon sila ng demo kahapon o kamakalawa? WALA!

    So, kahit sino ay pedeng mag transmit ng resulta. Hanggang ngayon hindi pa rin pinaalam ng COMELEC kung saan saang lugar nanggaling ang basehan nila ng transmission para ma check ng mga tunay na opposition yong pinanggalingan noong transmission.

    Just finished reading the emails from the ken’s link above.

    Assuming its truth, it looks like there was indeed some cheating operations being planned, with advice from some NJ IT expert. The beneficiary was to have been Gibo. Considering how miserably Gibo fared, it would seem that the conman (Puno) was conned. The hacks he was advised to undertake did not work. Magkano kaya ang binayad?

    Hindi kaya na-trojan sila? After Haraway gave the advice, he could have turned around and informed Smartmatic. Maybe that is why the hacks were blocked and did not work. Or maybe it could be plain ineptitude. The hacks were not so sophisticated (which a computer illiterate like Puno would not know), that it was easy to thwart.

    My purpose for posting the 2.6M discrepancy is not about Mar. I have given up on his chances after a chat with his campaign head. What I was demonstrating that the fact that 5% is NOT ACCEPTABLE deviation in any computer system. It’s about the technical aspect.

    The specifications requisitioned by Comelec, and the specifications in Smartmatic’s proposal is explicit. 99.995% accuracy or a tolerance of plus-minus .005% is the only error acceptable. Meaning, for every 100,000 votes, only 5 errors can be allowed.

    That’s why we paid a hefty sum of P7.2B for the whole thing. As a businessman, I am bound to deliver to the client whatever is specified in my quotation. Whether I lose money in the end is immaterial. We are always tied to our commitments. Likewise as a buyer, I see to it that my supplier delivers only items that fall within the agreed specs.

    Smartmatic’s partner, TIM has a pending case with GSIS over another failed P1-B computerization deal completely different from the election automation. TIM has a captured market in the banking sector ATM systems and is acknowledged as the go-to guys in bank computerization, but in this case, they failed to consider the huge data that the GSIS will process such that the software designed by their principals, IBM, was insufficient and failed upon deployment.

    Comelec knew this TIM problem beforehand, and I’m positive they are aware, too, of the consequences of any failure in delivery in their own AES.

    What I am not comfortable with is the cavalier defense by Comelec of its supplier, likewise the 180 degree turnaround by Locsin who now sales-pitches for Smartmatic for 2013, and some journalists too.

    Looking forward, we’ve had this experience with Smartmatic, we should try another supplier in 2013 which is not as critical as 2010’s. It is true that computerization is the only way to go. But not with a supplier that specifies one thing and delivers another.

  57. BTW, There was a BIG revelation earlier in the canvass wherein Comelec’s controversial Exec. Dir. Tolentino was placed in a hotseat for issuing a last-minute (May 10) memo authorizing DOST’s regional offices to undertake the burning of data/program CF Cards should any CF Card fail during voting. What makes it controversial?

    First, it wasn’t issued by the Commission en banc. The memo effected the distribution of some 1,600 blank CF Cards which were to be used for “emergency purposes”.

    Second, DOST was never authorized in the election law to even touch the CF Cards. He can not even answer if DOST’s FTP servers were secure, heck, he didn’t even know what FTP means.

    Third, as read verbatim by Cong. Dilangalen, a congratulatory letter by DOST’s Reg. Dir. in Cagayan De Oro thanks his subordinates for working as late as the next morning of the election day “reconfiguring the CF Cards”. If this were true, all the voters have already voted (and fed their ballots to the machines) BEFORE the “defective” CF Card which read, counted, and tallied the votes were re-configured. Since the voting ended at 7PM of May 10, what votes did the reconfigured cards report?

    Fourth, a confirmation by PPCRV’s Tita DE Villa and later, Cam. Norte’s Liway Chato that they were never informed and never witnessed any of the “reconfiguration” undertaken by DOST for replacing the defective CF Cards as per Tolentino’s Memo.

    Fifth, which to me was the most shocking, is the revelation by Sen. Pimentel that Tolentino’s wife is WORKING WITH Smartmatic in Cabuyao. This, Tolentino did not deny and even told the committee that his wife works in Comelec’s IT Division and was first assigned during the printing of the ballots in NPO. He later admitted that his wife is in Smartmatic’s Cabuyao warehouse, doing “inventory”.

    The Committee seems to be closing in on Tolentino, earlier revealed as the brains behind the design of specifications and also in the very expensive Ballot Secrecy Folder. It seems that too much power was in his hands, and his wife’s too, remember that they removed the security features in the printing of ballots when all the while, Tolentino’s wife was in NPO supervising it.

    We can only speculate. Why then would the Comelec not reveal the results of the manual audit? Because the actual results went way beyond the 5 errors per 100,000 tolerable limit. Suffice it to say, the commissioner in charge said it was “small”.

    But even if so, 5 out of 100,000 IS small and Smartmatic should deliver accordingly.

  61. My own speculation is that the machines did not count the votes even if the ellipses were substantially filled with the supplied pen which in the manual audit may appear to be a valid vote while in the machine appears to be null.

    A forensic technical audit can help improve the accuracy of reading the ballots. It all depends really on the program that identifies which rectangular area belongs to which candidate.

    For example: Given that the left topmost corner of the edge-of-paper barcode in the ballot as origin (0,0) – in rectangular x,y coordinates – the rectangle defined by the program as belonging to Erap, for example, may be (250, 80) in pixels, for the first corner and (280,100) for the opposite corner, hence a rectangle.

    If the requirement was 75% fill in order to be read, a smaller rectangle within this very rectangle would have improved the percentage fill. Lesser null votes would have been encountered and the results for the manual audit vis-a-vis the automated count would be the same.

    The undershading is possible. But a faint-handed old voter would be consistent in undershading all positions.

    There is still the inexplicability of more undershadings (2.5 times more) for VP than for president.

    Kung nagkalaglagan, that may explain it. Noy boys not shading Mar’s, and Erap boys not shading Binay’s. That would produce an abstention (null vote for failure to shade).

    A confused, or undecided voter may have chosen one, then changed his mind, and shaded another. That would produce an overvote (null for shading more than one candidate).

    The percentage for the president is not too different from the three percentage of total over and undervotes in Florida, produced by the hanging, dangling and dimpled chads in 2001.

    If pure machine error produced the percentage of null votes for the president, the null votes for the VP should not be that different. So I can only attribute the disparity to human error, or human intent (nagkalaglagan nga).

    The Locsin tirade is a standard operating procedure for many members of Congress. They threaten to use the floor to blackmail the supplier. How do they know about it? Some local agent is a friend and feeds the member of the house with tips and the agreement is for representative to denounce the said supplier on the floor until the said supplier comes up with some cash proposal. And then what do you know… when the transaction is done, the whole thing stops!

    Many members of Congress are corrupt to the bone. And I’m sure this Locsin knows his way around.
