The Philippine Navy will hold a presscon tomorrow, 08 July 2010, 9 a.m. at The Villa Cristina Resort and Hotel, Taktak Road, Antipol city on the surrender of fugitive Captain Nicanor Faeldon.

Rear Admiral Danilo, Flag Officer in Command and Maj. Gen. Juancho Sabban, commandant, Philippine Marine Corps will have a presscon and media presentation of Faeldon.

Faeldon: Justice possible under Aquino gov’t

Detained rebel Marine officer Capt. Nicanor Faeldon on Thursday said he voluntarily surrendered after more than 2 years in hiding because he believes that justice can be attained under the Aquino government.

Faeldon, who was among 29 junior offers who led the failed Oakwood mutiny in 2003, said his surrender is in keeping with his promise that he will surface if the May 10 presidential elections are credible and reflect the true mandate of the people.

“We have a new government who has the mandate of the people. I am surrendering to the will of the people, which is the opposite of the previous administration,” he told reporters.

He said the new administration gave him new hope that he will attain justice in the charges he is facing before civilian and military courts. He said he did not seek any help from political organizations but just surrendered to his commander, Philippine Marines commandant Maj. Gen. Juancho Sabban.

“I am one of those hopeful that justice will be attained not just for myself but for all those who are facing charges. I hope we can attain justice…Justice in a sense that I believe this new administration will not meddle [with] our justice system. It will allow the processes. That’s what I meant,” he said.

Asked if there is a bigger chance to reform the Armed Forces under Aquino, he answered: “Definitely, yes.

Sabban said Faeldon will not receive any special treatment while under his custody. He said the rebel officer will be detained in a marine brig while awaiting trial.

Faeldon is one of more than 300 junior officers and military men who participated in the short-lived Oakwood Mutiny in 2003. The mutineers, led by Army Capt. Gerardo Gambala and LtSG. (now Senator) Antonio Trillanes IV, accused then President Gloria Macapagal Arroyo of massive corruption and of planning to declare martial law.

Faeldon was detained after the Oakwood Premiere (now Ascott hotel) takeover.

He escaped from custody on December 14, 2005 but was recaptured in January 27, 2006.

He again escaped, along with 3 Magdalo leaders, during the Manila Peninsula incident takeover on November 29, 2007.

Rear Admiral Danilo Cortez, officer in charge of the Philippine Navy, said Faeldon surrendered to Sabban last Tuesday.

He said the fugitive officer surrendered without any concessions and even expressed readiness “to face the consequences of his actions including the penalties that may be meted against him in the cases he is facing before our courts.”

‘My conviction became firmer’

Faeldon said he had no regrets about his decision to rebel against the Arroyo administration, which he viewed as illegitimate. “I cannot choose my own commander-in-chief but in the case of the previous president, I was one of those who believe she doesn’t possess the mandate of the people,” he said.

The rebel officer said he received a lot of help from fellow members of the military while trying to evade capture by authorities. He refused to name his beneficiaries.

Asked what he learned about living outside the law for the past couple of years, he said: “I think I became more firm in my belief that we should oppose the things that should not be happening in government. The conviction became firmer.”

He also noted that he had yet to achieve anything but that the hope of a better future for the Philippines was now in place.

For his part, Sabban said Faeldon’s surrender does not mean a closure of the reforms being pursued by participants in the Oakwood Mutiny. He added, however, that all reforms should be done within the system.

“As the commandant of the Marines, I am happy that we have accounted for all our officers and men. This will result in unity in the Marine corps and the whole Armed Forces,” he said.

He added: “For so long we have been telling everybody that the Armed Forces now is more professionalized kaya nga we exerted efforts to bring them back. Reforms should be taken within the system. If they want to go outside, then I think ibang kaso na yun.”

Meanwhile, Vice-President Jejomar Binay said Faeldon’s surrender is a good sign because it shows that justice can be achieved under the Aquino administration.

“It is a gesture of confidence in the capability of President Aquino to address the legitimate concerns and grievances of our soldiers. These are the same concerns and grievances that are at the root of military restiveness and forced Capt. Faeldon and his fellow soldiers to undertake concerted action,” he said.

    Ibig lang sabihin nito ay mas may tiwala si Capt FAELDON sa bagong administrasyon na makakamit niya ang patas na paglilitis at hustisyang batid niyang malabong maganap sa walang pakiramdam na gobyerno ng hindi hinalal na si never presidnet gloria macagarapal-arrovo.

  9. It’s good to hear that Capt Faeldon is ready and willing to own up to his actions.

  10. Hmmm… He’s brave and trusting. A bit naive but admirable qualities. But as Henry said, very hard to be a fugitive so hat off to Faeldon.

    While I have no doubt that he is entrusting his fate to the current Navy leadership under the new Aquino administration because he has faith that he will perhaps get a fair trial, I’m not too sure that things will go quickly for him so he can finally enjoy freedom.

    He shouldn’t have said, “I’m prepared to be in detention for as long as it takes…” (That’s tempting the devil 😛 ) Instead, he should have said, “I would like my day in court as quickly as possible.” 🙂

    What I’m worried about is DND Chief Gazmin, erstwhile PSG chief, Mindanao warrior and CGPA meaning Gazmin is a professional and not easily the kind of guy who you can soften; Gazmin is capable of making Navy leadership know through proper channels that he won’t mind if Faeldon is given the whole treatment, made to go the whole hog, i.e., Court Martial must be held for as long as it takes (and absolutely no short cuts), that Faeldon must not be accorded special favours, never mind that he surrendered on his own volition, thus he should be/must be incarcerated for as long as it takes.

    His only ally in this battle for his freedom is Sabban. But Sabban will be retiring soon…

    While he may not be afforded immediate liberty, Faeldon is at least assured that he will not be in solitary confinement and subjected to psychological torture like what Ass did to him when he was in Isafp custody. I know Sec Gazmin very well as my former boss in PSG. He is an honorable person. Gen Sabban will take good care of him. Dati niyang bata iyan si Nick kaya nga pinili nyang dito sumuko. Finally, magkakalinaw na rin kaso ng mga yan. I know Nick personally. Mabait na bata yan. Tsikboy lang. I wish him well. 😛

It’s an obscene display of double standard.The ampatuans should have been executed by firing squad a long time ago, before the ghosts of their 57 massacre victims beat lady justice to it.

    When Gazmin was asked in the Strictly Politics how he will address the detained soldiers’ cases, he said, it is not his priority at this time. He said he will address the AFP modernization muna daw. WOW! Ang tao nga naman. The MATERIAL thing is more important to him than the violated rights of the soldiers. Ano nga naman ang mapapala niya kung palalabasin niya ang mga nakakulong? Wala. Sa modernization, limpak limpak na pera ang kikitain. Happy days are here again sa AFP. With this statement of Gazmin, I am doubtful if Faeldon will see justice soon.

    I’m not surprised. As I posted earlier on, the man is not a softie. Besides, Faeldon’s case is now purely military business. It will be wrong to pin your hope on Gazmin bypassing or shortcircuiting the military in something that’s now become purely miltary business.

    Strictly speaking, as DND chief, it’s not his call. Gazmin may be the DND chief but is no longer with the military. He is now a civilian. The AFP has guidelines. There is a chain of command and assuming that the current administration means what they say, I’m sure military justice will be applied. So, strictly speaking, Gazmin is right to say what he said. He can and should tackle other things that require his attention as secretary of national defence.

    People’s trust, if you have it, keep and nurture it; once you lost it, its hard to earn it back, but with appointments like Romulo, Davide and other remnants of gloria’s evil government, one would think that Noynoy’s government is not too keen in maintaining it.

    PSB, magtatagal pa sa kulungan si Trillanes at Col.Querubin kung ganyan. Pwede namang sabayin ni Gazmin ang AFP modernization at i-address ang kaso ng natitirang mga opisyal sa kulungan, bakit ganyan ang sagot nya? Baka maburo din si Faeldon sa jail.

    Best is to “heckle” David to finish the AFP’s General Court Martial businesses than to push Gazmin. As chief of staff AFP, David has full authority to order the services to expedite trials.

    All David has to do is to issue a written order and the wheels will start grinding. Really not necessary for Gazmin to join the fray.

    However, failing that (David ‘unable’ to do it), Faeldon’s lawyer can seek DND chief’s intervention. But it’s David’s call. The other service chiefs will follow suit.

  27. TYB, there was an ongoing seminar of Philippine Navy officers in that hotel. So instead of coming to Manila for the Faeldon press conference, they decided to bring Faeldon there.

    I believe Capt Faeldon and the other Magdalo boys were not treated so harshly while in ISAFP custody. In fact, I used to play badminton with them back then. That was the time when Adm Danga was still the ISAFP Chief. But then again I could be wrong.

    re #4O Danga’s time was I think 2004 (He was implicated in the Hello Garci scandal). I refuse to say anything about Lt San Juan nor his intentions as I do not know him personally. What I do know, I’d rather keep it to myself.

    re #44 and 45. I was talking about the time when I used to regularly see Sen Trillanes and the rest of the core group. Security got tighter only when Sir Nick escaped with the help of Atty Candy. We were’t allowed to see them anymore since we are not members of the immediate family. That was way back in 2005. Besides, I do not claim to know everything that happened behind the walls of ISAFP as I usually go there strictly for official business. More importantly, I did not state that Maj Aquino had a very pleasant stay at the ISAFP Compound.
