Gusto ni Navera baluktot pa rin

Ang tapang naman ng apog nitong si Senior State Prosecutor, Juan Pedro Navera magreklamo sa desisyun ni Pangulong Aquino na magbigay ng amnestiya sa mga sundalong nanindigan sa illegal na administrasyon ni Gloria Arroyo.

Kasama sa nabigyan ng amnestiya si Senador Antonio Trillanes IV na hanggang ngayon ay nakakulong pa. Mga 300 na opisyal at enlisted men ang sakop ng amnestiya kasama na rin sina Maj.Gen. Renato Miranda, Brig.Gen. Danilo Lim, at Col. Ariel Querubin.

Ang amnestiya ay magpawalang halaga kung sakaling magdesisyun sa Oktubre 28 si Judge Oscar Pimentel na “guilty” sina Trillanes at mga lider ng Magdalo ng “kudeta” sa nangyari noong Hulyo 27, 2003 sa Oakwood Hotel sa Makati kung saan binulgar nila corruption sa military kasama na ang pagbenta ng mga armas at bala sa kalaban na siyang ginagamit para patayin sila.

Kung “not guilty” naman ang magiging desisyun ni Pimentel, di mabuti. Swak sa amnestiya.

Nagpuputok ang butse ni Navera dahil pitong taon daw niyang pinaghirapan ang kaso. Tama pitong taon siyang galamay ng administrasyong umuusig sa mga nanindigan sa katotohanan at lumalaban sa pagbabastos ng Constitution. At pinagyayabang pa niya yun.

Ang nakakapagtaka ay nagsalita na ang Pangulo, nagdadaldal pa itong ni Navera.Kung ang kanyang amo, si Justice Secretary Leila de Lima ay hindi na nga nagreklamo, siya ang lakas ng loob.

Ilegal ba ang ginawa ng Pangulo? Wala namang sinabi si Navera na ilegal. Kung iba ang opinyun niya, at hindi siya sumasang-ayon, umalis siya. Akala mo naman magaling na abugado.

Dito lang nagpapakita na kahit napalitan ang hepe ng DOJ ng matino (ang layo naman ni de Lima kay dating Justice Secretary Raul Gonzales at kay Secretary Agra), hawak pa rin ng mga bata ni Arroyo ang departamento na tinawag ng abogadong si Frank Chavez na “Department store of justice”.

Nabulgar ang bentahan ng kaso sa DOJ sa kaso ng Alabang Boys. Naala-ala natin ang buong tapang ni binulgar ni Major Ferdinand Marcelino ng siya ay sa Philippine Drug Enforcement Agency.Di ba nagkampihan sila noon?

Itong kaso ng Ampatuan sundan namaigi dahil mukhang ang usap-usapan ay sadyang pinapalpak. Nabuking nang inalis ni dating Secretary Agra si Zaldy Ampatuan, dating gubernador ng ARMM at kapatid ng principal suspek na si Andal Ampatuan Jr. sa listahan ng mga akusado. Ibinalik na lang ng nagwala ang taumbayan.

Kawawa nga si de Lima dahil talagang matino siya at masipag. Hindi naman niya maaring basta-basta pagtatanggalin ang mga hindi matinong prosecutor dahil prutektado ng civil service.

Marami ang nagiging biktima ng kawalang hustisya nang panahon ni Arroyo kung saan baluktot na pamamalakad ang umiiral. Unti-uting nang itinutuwid ito ni Aquino.

Itong mga katulad ni Navera ay gusto pa ring manatili sa baluktot. Tanggalin na nga yan. Sayang ang pera nga taumbayan na sinisweldo sa kanya.

    Simple lang ang solution para kay De Lima. Huwag niyang bigyan ng assignment yung mga gago. Mag-hire siya ng bago – yung hindi mukhang cheke (negotiable).

    Kung may nakaharang na prosecutor na nakaluklok, gawin ang tinatawag ni Lawrence J. Peter (The Peter Principle) na lateral promotion. Mag-imbento ng ibang division – Research Division, Malacanang Liaison Division, etc., at doon italaga ang mga negotiable. Hayun wala na sa frontlines, at puwede ka nang maglagay ng bago.

    Ganyan ang ginawa ng aking Boss sa isang government agency. Mayroong matanda, tamad, at naghihintay na lang na mag-retire na abogado. So gumawa ng research division, at si tanda ang manager. So yung mga young and hungry to prove themselves ang humarap sa mga kaso sa korte.

  6. Si Gloria Arroyo ang nambastos sa Constitution.She grabbed power in 2001 and she cheated in 2004. She rewarded those who helped install her, without the people’s mandate, with lucrative positions. She allowed them to make money as in Abalos brokering a telecom contract.

    What Trillanes and company did was bring to national consciousness, in a dramatic manner, the anomalies going on in the military. Yes, they violated military rules and they submitted themselves to the courts (even if Malacanang violated the agreement that only officers would be charged and that it would only be in the military court).

    They were imprisoned for 7 years. Sobra-sobra na ang punishement.

    Gloria Arroyo and her husband and their cohorts with all the crimes they committed against the Filipino people have not spent a minute in prison.

    What Trillanes could have done without spitting on the Constitution is resign from the military and get involved in mainstream politics, like become a Senator.

    The ballot was the pardon. That to me, carries more weight than the pardon or amnesty of the President, who merely represents the people. That to me, also ends the debate as to whether it was right or wrong. We cannot be more Catholic than the Pope.

    This amnesty, or Oscar Pimentel’s acquittal is a belated recognition of the people’s will.

    Simply lang, diba? Matagal ng paraan yan and is used in situations popular and notorious cases.

    Actually, maraming hindi sangayon sa amnesty dahil parang nagshortcut na lang at hindi nabigyan ng kaukulang ‘day in court’ ang magdalo na as you can see mutineers ang tawag. Ang dapat mangyari ay maabsuwelto sila, maparusahan ang mga kurakot at maalis ang taguriang mutineers sa kanila.

    Vote against Gloria? Maybe that is the motive. But whether a father chooses his disowned son as his representative to spite his oldest son, or does it in recognition of the formerly disowned son’s representation skills, the choice is inconsistent with punishment.

    Same with the vote on Trillanes. Now there were other candidates to vote as a means to spite Gloria. But Trillanes was chosen.

    Now as to the courts, they are also representative of the people. Once in a while, the people choose to speak directly, instead of through their representatives. That is the basis of Cory’s people power government, and also the Glue’s ouster of Erap.

    But how many were there in the streets? And not all of them were there for the same reason. Even Ambassador Stephen Bosworth was there, nagmimiron.

    But the active intent to write Trillanes’ name in the ballot is a clear choice of him as a representative, thereby implying the choice not to punish.

    I agree, that the courts are the way to resolve this, but the once in a while direct voice of the people cannot be ignored by mere representatives.

    My lawyer friend said Fadullon is wrong in both the Trillanes and Lacson cases because the prosecution of criminal cases remains with the executive no matter what stage the criminal case is in.

    He said even if the case were already submitted for decision, still a manifestation from the executive that the charges are frivolous and politically motivated would send a signal to a co-equal branch that the accused may have been a victim of injustice.

    Part of the executive’s power and obligation is to implement and enforce all laws.

    Agree Al # 16 and 17. That was the basis for Eric Holder’s motion to dismiss the indictment against Senator Stevens, even after a conviction. Dismissal was sought because there was prosecutorial misconduct.

    Now maybe Stevens was really guilty. But the government, which enforces the law, cannot break the law. Heck, even if the government does not break the law, it cannot engage in unethical behavior.

    If you try to achieve justice by unjust means, is there really justice?

    On a related subject, here’s a piece from Herman Tiu Laurel:

    Remember the “Alabang Boys” drug and bribery case involving state prosecutor John Resado? Remember the shit that hit the Department of Justice (DoJ) fan in 2009 when Resado was accused by the Philippine Drug Enforcement Agency (PDEA) of illegally releasing drug suspects Richard Brodett, Jorge Joseph and Joseph Tecson because of purported “defects” in PDEA’s case?

    The DoJ prosecutors at that time rallied around Resado. The two agencies then traded charges. Government was thus compelled to conduct an independent investigation, where it found a suspicious, unsatisfactorily explained P800,000 deposit in Resado’s account on the same day he signed that infamous resolution.

    Good thing someone pursued the Alabang Boys and Resado cases. PDEA agent Maj. Ferdinand Marcelino at that time impressed the nation by standing up to the browbeating of then DoJ Chief Raul Gonzalez and other DoJ top brass.

    …So, what’s up with this Resado? All forgotten?

    Cheche Lazaro’s show last night was about Hubert Webb and to me it looks like an injustice to both the Vizcondes and the Webbs. What struck me most was the order of the SC allowing for the DNA test on the sperm found on the daughter is allegedly missing. The NBI earlier said that the specimen was being kept in its best condition. This was at the time the court rejected the idea of DNA sampling since it was not available yet. Now they are pointing fingers at the prosecutors and the prosecutors are pointing back.

    My God, Hubert has been languishing in jail for FIFTEEN YEARS. His demeanor has changed from that of a refined young man born to an elite family, now he looks and sounds like just anyone of his smelly kakosas – no finesse whatsoever – he even sports the Sige-Sige Sputnik tattoo.

    Now here’s this piece of evidence can finally put to rest any and all doubts about the real rapist/murderer and the fucking NBI suspiciously loses it!

    This is the kind of stuff that brings the countless Insp. Rolando Mendozas out there out of the system. The show was very depressing, watch it once its uploaded on YouTube.

I’ve been into heated debates with friends and colleagues regarding this issue and I’ve always maintained that Hubert Webb is innocent and that drug addict “star witness” Jessica Alfaro is a farce.

    Lt Raymundo was acquitted of conduct unbecoming of an officer and gentleman and other offenses. I can’t recall now. But he was found guilty of disrespect of an officer. He wanted to fight this out ecause he did not want a blot in his records but his career has suffered a lot. Pina-Diyos na niya yun.

    He is back in service. I think he is assigned in Marines Armory.

    If you search for his name in this blog, I think I reported on his acquittal most of the accusations except one.

    The swabs were taken from the cadaver in 1999, and the en banc decision was rendered Per Curiam? Wasn’t DNA evidence admitted in that case? So as early as 1999, two years after Webb, DNA evidence was already being used.

    However, there is doubt whether the semen sample kept by the NBI can be used for the DNA test after so many years in storage.

    The crime occurred in 1989. The first DNA testing in 1996 was inconclusive, because of the technology then. Retesting was done in 2008, 19 years after, and it yielded an exoneration.

    There have been instances that experts of the UP National Science Institute had inconclusive DNA test results because the sample they tested had been contaminated or improperly stored.

    If the sample is contaminated, it will only add the DNA of the person handling the evidence. It will not erase the DNA already existing – that of the perpetrator.

    It is possible that the DNA testing will prove Hubert Webb did it after all. It is also possible that the test will exonerate Webb. But the foot-dragging of the Supremes is a denial of due process – for both Webb and the State.

    Oh, and now that the Supremes have suddenly realized the realibility of DNA testing, can they explain why there is probable cause to indict those men in the Dacer-Corbito case? After the testing proved negative for human DNA? (The testing was done only months after the alleged crime.) The bones were also determined to be from animal skulls.

    Looks like selective justice to me.

    Oh and in the book “The Jesus Dynasty”, it states that DNA tests are being conducted on the bones found in ossuaries (box of bones) in Israel, to determine if the individuals are related.

    One supposedly is Mary’s, and the other that of Jesus. Now your Christian scruples may rail against this, but just focus on the DNA angle. Scientists can actually take bones buried for 2,000 years and determine if they are mother and son.

    The reason why Hubert was pinned down has something to do with Sen Webb’s investigation of the 11 Indian nationals involved in drug trafficking. The said Indians who was detained inside NBI cells suddenly disappeared. NBI ang lead agency investigating the Visconde case.

    “Partly because of my being in politics, my son got caught in the middle,” he finally said. “There were Indian nationals who were developing drugs in Las Piñas City, They were caught by the NBI (National Bureau of Investigation) and were locked up.     This news only got my attention since my best friend’s name is Gerard Webb of Santa Rosa NC California, and I jokingly told him “hey your relative in the Philippines is in trouble”.

    At that time, what irked me most was the defense not aggresively pursuing the timeline; i.e. passport stamps of arrivals/departures in Pinas and US. Heck, if Hubert was in the states and the crime happened while he was skiing (or whatever he was doing in America)in Lake Tahoe, Nevada; he should had been exonerated.
