President Aquino on SC decision declaring Truth Commission unconstitutional

Marami ang nadismaya sa desisyon ng Korte Suprema na ipawalang-bisa ang Truth Commission. Bilang inyong pinuno, tinatanong ako kung ano ang mga susunod kong hakbang.

Kasalanan ba ang maghanap ng katotohanan? Di ba obligasyon kong tuklasin ang katotohanan? Di ba obligasyon ko rin na maparusahan ang mga lumabag sa batas? Di ba tungkulin nating malinis ang pangalan ng mga inakusahan nang walang base?

Nanumpa po ako bilang inyong Pangulo: ipagtatanggol ko ang konstitusyon; ipatutupad ko ang mga batas; at magbibigay ako ng hustisya sa bawat Pilipino. Sino mang alagad ng katarungan ay sumusumpa rin sa kanilang tungkuling kumapit sa kung ano ang totoo.

Ang hinahabol po natin dito ay katotohanan. Itinatag natin ang Truth Commission upang isara ang sinasabing isa sa mga pinakamadilim na kabanata sa ating kasaysayan—at malinaw na makakamtan lamang natin ito kung patuloy nating tutuklasin at kakapitan ang katotohan.


May mga nagtatanong: bakit pa kailangan ng panibagong Komisyon kung nariyan naman ang napakaraming mga institusyong naitalaga na upang isulong ang katarungan?

Nariyan ang Ombudsman. Ang Department of Justice na patung-patong na rin ang tungkulin at nakabinbin na kaso. Natural, kung papasanin pa nila ang ganito kalaking dagdag na trabaho, mas lalong babagal ang paghahatid ng hustisya sa mga kasong ilang taon nang nakabinbin sa kanila.

Ang hustisyang inantala ay hustisyang ipinagkait. Karapatan ng mga walang-sala ang mabawi ang kanilang dangal, at tungkulin ng sistema ang parusahan at panagutin ang mga nagkasala. Paano natin makukuha ang solusyon kung hindi man lang natin matukoy kung ano ang problema?

Kung may isang Komisyon na nakatutok sa mga alingasngas ng korupsyon nitong nakaraang dekada, natural naman pong mas mabilis nating maaabot ang ninanais nating liwanag.

Ang pinakamahalagang layunin nito: bigyang-liwanag ang anumang sadyang hinarang ang pagsisiwalat, at patuloy pang itinatago ng mga nakinabang sa lumang sistema.

Ang sabi po ng Konstitusyon, anim na taon dapat mamalagi ang isang administrasyon. Paano natin tatratuhin na hindi naiiba ang isang administrasyon na halos dalawang terminong nanungkulan? Kung administrasyon ka na lumagpas-lagpas na nga sa inaasahan natin ayon sa batas, di ba naiiba ka nga sa lahat. Nararapat lamang na natatangi ang batayan para sa isang natatanging administrasyon.

Ang tanong ng ilan: inaapi ba natin ang nakaraang administrasyon? O pinipili lang nating isulong ang interes ng mga inapi at ninakawan?

Kaninang 5:47 pm lang nakarating sa amin ang kopya ng desisyon. Mahaba-haba ang opinyon, kailangang pag-aralan nang masinsinsan ito, at pag-isipan kung ano ang mabuting gawin.

Mga eksperto na po ang nagsabi, ang pangkaraniwan ay lumalabas ang kopya ng pormal na desisyon sa mismong araw ng pagpahayag nito. Pinagtalo lang po yata ang magkabilang panig.

Nagpapasalamat na lang po at hindi kami inutusan na isauli ang lahat ng nalikom na ebidensya.

Lilinawin ko po: Hindi nakatutok ang Truth Commission sa iisang tao lamang, kundi sa maraming iba’t ibang insidente. Kailangan po nating malaman—hiwa-hiwalay bang kaso ito, o ito ang sistemang umiral sa loob ng siyam at kalahating taon? May mga kakuntsaba pa bang nasa puwesto ngayon, at may pagkakataon pang ipagpatuloy ang kanilang pamiminsala?

Di ba’t may pakinabang sa akusado ito na maaaring linisin ang kanilang pangalan? Kasabay nito ang pakinabang sa estado na para makasiguro tayong hindi magpapatuloy ang maling gawain, at magbayad ang may kasalanan.

Kapag napinsala ang mga Pilipino, hindi po ba kayo nababahala? Hindi po ba kasama ang inyong mga anak, apo at mga mahal sa buhay na makikinabang sa paglalatag natin ng maayos na sistema, kung saan mananagot ang mga nagkasala?

Sa lawak ng mga akusasyon, mahaba-habang panahon ang gugugulin sa paghahabol sa sanga-sangang ng pinaghihinalaang katiwalian, kung saan ito tumutungo o tuturo. Kung walang tututok dito, ginagarantiya natin ang patuloy na kapinsalaan sa taumbayan.

May pananagutan po tayo. Hahayaan ba nating maantala ang paghahatid ng katarungan sa taumbayan?

May mga tanong ang taumbayan na kailangang masagot. Totoo ba ang Hello Garci, kung saan sinabing nadaya ang elesyon?

Paanong umusbong ang NBN ZTE na pagkamahal-mahal na wala namang pakinabang ang bayan?

Saan ba napunta ang pondong pambili ng fertilizer? Ito pong fertilizer scam na ito, parang sine, may part one at part two, at napag-alaman nating may part three pa po na mas karumal-dumal.

Saan napunta ang pondong diumano’y nawaldas na dapat sana ay napunta sa mga nasalanta nina Ondoy at Pepeng?

Bukod pa po dito ang napakarami pang ibang midnight deals at midnight appointments. Baka nalimot na po ninyo, 981 milyong piso ang halaga ng isang midnight deal na dinaan sa mabilisang hokus-pokus. Noong ipina-rebid, naging 600 million na lang. Ito po bang mga deal na ganito ay talagang naging kalakaran lang noong nakaraang dekada?

Hindi po ba lehitimong mga tanong ito? Hindi ba kung hindi natin maisaayos ang sistema, ay ginagarantya lang natin na mauulit at magpapatuloy ang maling kalakaran?

Tungkulin at obligasyon natin sa bawat Pilipino ang hanapin ang sagot sa mga tanong na ito, lalung-lalo na sa mga handang magsakripisyo at isiwalat ang buong katotohanan ukol sa katiwaliang naganap. Nananawagan ako, sa mga nagbubulag-bulagan at nagbibingi-bingihan sa malinaw na panawagan ng taumbayan, huwag po sanang harangan ang aking tungkulin.

Gagawin ko ang lahat ng nararapat sa ilalim ng batas upang itigil ang pamiminsala sa taumbayan. Huwag po kayong magduda, bago ang sarili ko, bago sino man, ang papanigan ko ay ang interes ng taumbayan. Habang nandito ako, hindi ako papayag na patuloy na apihin ang Pilipino.

    The decision and dissenting opinions are now available. Magbasa muna, bago magpuna. We talk of due process, let as practice what we preach.

    Due process, as I memorized once upon a time, requires the judge to listen before condemning; and to listen to both sides before deciding.

    I may have my suspicions, but those suspicions will or will not be fleshed out in the words of the decision. So far, there is one statement that I found worth noting as I did a first skim of the decision:

    Lest it be misunderstood, this is not the death knell for a truth commission as nobly envisioned by the present administration. Perhaps a revision of the executive issuance so as to include the earlier past administrations would allow it to pass the test of reasonableness and not be an affront to the Constitution.

    Emphasis supplied by the Court. The above is found in the last paragraph, before what is called the dispositive portion, that says “Wherefore, the petition is granted”.

    well, if that is what the SC wants, then let the Congress create the Commission (according the SC the TC is a public office)and mandate it to also investigate all allegations of improprieties by members of the SC past and present…there were also allegation of payoffs and briberies for a favourable decisions by the body, TRO were usually had a price…and also check their lifestyle and their unexplained assets and just to make sure that the Commission will not be declared unconstitutional, make it an all out investigating body, but just do the GMAs and the SC and done with it…play their games and beat them.

    Hindi kaya sinadya na gawing mahina ang rules ng Truth Commission para ma-reject ng SC? That it was the work of some people around Pnoy to sabotage it for the benefit of Gloria? Remember that those in his administration are mostly from Civil Society or Hyatt 10 which had some kind of relationship with Gloria in the past. Walang iba iyan na gawing mahina ang kaso sa DOJ o Sandiganbayan para mabasura sa Ombudsman. Case in point was Nani Perez’s case.

    More cases of the administration tripping on its shoelaces. Mas maganda ang Tagalog. Sila’y nagkanda-buhol-buhol.

    The EO says that the TC is an independent body. But when defending the basis for its creation, the admin states that it comes under the powers of the President to reorganize the executive. If it is merely reorganizing, then the body, presumably is under the Office of the President. In fact, the budget comes from allotments of the Office of the President apportioned to the TC.

    So is it really independent if it comes under the OP, and reports to the OP?

    For once, I agree with Teresita De Castro.

    Again, let us leave out the personalities. Look at the message, not the messenger.

    In this regard, I think, in this case, De Castro got the better of Carpio. Read both opinions, and judge for yourselves.

    Puwede namang gawin ng DOJ ang investigation, bakit pa gagawa ng TC? In fact, in the Carpio dissent, he stated that:

    The PNP and the NBI are under the control of the President. Indisputably, the President can at any time direct the PNP and NBI, whether singly, jointly or in coordination with other government bodies, to investigate possible violations of penal laws, whether committed by public officials or private individuals. To say that the Ombudsman has the exclusive power to conduct fact-finding investigations of crimes involving public officials and employees is to immobilize our law-enforcement agencies and allow graft and corruption to run riot. The fact-finding arm of the Department of Justice (DOJ) to investigate crimes, whether committed by public or private parties, is the NBI.The DOJ Proper does not conduct fact-finding investigations of crimes, but only preliminary investigations.

    You shot yourself in the foot Justice. Puwede palang gawin ng existing body, bakit pa may TC?

    Isa pa, if you try to save face when the error is obvious, you lose more face. Parang defensive combing, yan ng isang nakakalbo; kukunin yung buhok sa may tenga, at isusuklay pataas? Di ba’t mas pangit yon. Better to shave off all the hair completely, a la Bembol Rocco.

    As any tech guy can tell you, a clean re-install of Windows is easier than repairing by searching for programming bugs.

    Except for some brave souls, not too many lawyers would attack the SC decision for obvious reason. They don’t want their pending and future petitions with SC be jeopardized. And despite his nephew being married to Gloria’s daughter, Fr. Bernas criticized the SC decision. We have not heard from Sen. Miriam Santiago who loves to speak up on every controversial issue. Well, she was or still is one of Gloria’s best friends.

Bakit kung Associate Justice ang inaakusahang nag plagiarize, pasensiya na, wala namang malisya. Di lang nalagyan ng footnotes. Pero pag kaso na ni Goyang, kung ano-anong ipinupuna sa pagkagawa ng EO. Samantalang, dating CJ na si Davide ang tumulong gumawa noon. Tang ina ninyo. Naghahanap lang kayo ng butas sa di naman dapat. Kung inherently defective ang EO, bakit di unanimous ang decision nyo?

    The denial of equal protection and the arrogation of powers of Congress to create offices were actually arguments of the petitions. The decision says so.

    Binigyan na ang admin ng lunas, that is, to re-draft the EO. Yan ang punto ko, sa post # 1.

    Sa halip na makipagbanggaan sa isang 10 – 5 na decision, higit na mabuti yung magsulat nang panibago. Ang mahalaga, makamit ang layunin ng EO.

    Nagturo ng admin law si Serreno. Kahit anong anggulo mo tignan, hindi talaga uubra yang creation of a new office by the President.

    Reorganization daw? A reorganization presumes an existing office; either merged with another, or given new personnel, etc.

    Tulad ng sabi ng iba, ginaya lang yung EO ni Inay. But that was issued noong wala pang Congress, at may legislative powers pa si Inay.

    Kapag tinupad ang lunas, at mag-pe-petition ulit, maaring summary denial, kung walang basehan ang paratang ng denial of equal protection.

    As it is, the basis for equal protection is found in the letter of the EO itself.

    Like I said above, sundan ang line of least resistance. Isulat muli ang EO, isama pati admin ni Inay. Tapos, benign neglect, tulad ng ginagawa ni Merceditas.

    Huwag puro init ng ulo. Do not get mad, get even (JFK). And might I add, get even better legal advice.

    Congressman Ed Lagman is a hell of a lawyer and lawmaker if not for his relationship with Gloria. But let’s see how he deals with the RH Bill. It’s his pet bill. If he succeeds in passing it, I shall salute him.

    So he has not read yet SC’s decision, why the drama speech? Lots of non sequiturs too.

    SC’s decision is a way forward to fighting graft and corruption. Come to think of it, if the Truth Commission was allowed to continue without the intervention of the Court, Gloria may not be convicted in the end because of a technicality. Money, effort, and time would go down the drain.

    If you read carefully, the SC even gave a hint to Aquino’s superior legal minds about the proper way to achieve the EO’s goals.

    OK, so many were broken-hearted by the decision of the SC. Not so fast, and before more cursing and accusing members of the SC, think again. We should be glad and thankful with the SC’s decision for not allowing the commission to reach first base. The role of the appointed head of the commission is being overlooked because of anger and disappointments. It’s better to place bet on the safe side than go on with an uncertain outcome of the inquiry.

    We tend to believe that all appopintments and people who served under Gloria were there as her insurance. We saw the decision as bias, mainly because they were her appointees and bound to protect her ass. But if we look the other way and take for granted that it’s declared constitutional, let the commission do there job, how can one be so sure that the commission will do the right thing under the present head who was a former Gloria’s “altar boy” who served her the seat of power in a silver platter? This “altar boy” is a “magician”, out of thin air he produced what he called “constructive resignation”. If he was able to hand a non-vacant presidency and violate the rule of law with or without the consent of all his peers, what guarantee do we have that he will not do it again to protect his boss?

    That will not only break hearts but tear it into pieces.

    If we go by the logic that Gloria’s people were there to protect her, then we can not take out Davide from the equation. Gloria and Davide were made of the same cloth. They are both traitor, opportunist and corrupt. They are evil partners. His appointment is a mystery that only Gloria, Davide and Noynoy himself know where it will end.

    My guess however, Gloria and whoever will never spend even a second in jail.

    Sino ba ang nag sabi na KASALANAN ito? Wala naming nagsasabi na kasalanan at hindi obligasyon yon. Kahit na si Gloria at ang kaniyang mga kampon, hindi sinabing kasalanan yon. Ang sinabi ng korte ayusin lang ang paraan ng paghahanap, hindi yong “bara-bara” style. Hindi dahil sa nasa poder, magagawa na lahat ng bagay kahit na mali. Dapat sa tamang proseso at tamang paraan. Nasa demokrasya ang gobyerno at ito ay dapat kumilos ng naayon sa batas at konstitusyon.

    Si Mis Lang siguro ang gumawa ng speech, kaya simula pa lang it “sucks” na.

    There you go again with your obvious defense of Gloria. The Truth Commission has no prosecution power. They have already started digging on the many cases of the past administration reaching 200. They would file a motion for reconsideration. Until there’s no finality, the Commission can continue to function unless being told. The Commission has the power to subpoena witnesses and respondents but has no contempt power. It’s an EO. Of course if you’re a current government official, you must appear if called not the former officials who are considered private citizens now.

    First, memo circular of CSC provides that one has to give an allowance of 30 days before assuming the new office to give the previous office time for replacement. So that even if your appointment is say Feb.14, 2010, you can not assume before March 10, 2010 because of the circular. The assumption of office is therefore after March 10, 2010.
    Second, one of the prohibited acts during the election period is ” transfer”. One can not transfer from one government agency to another agency during the election period. If this is how the previous boss interprets the comelec rules, then the appointee can not be given the authority to transfer during but only after the election period. Much as the appointee would like to assume, he can not otherwise he could be charged for abandonment of office or worse for committing comelec offense.
    The poor appointee who had no intimacy with pandak whatsover,( sa tv lang nakita si gma ) is jobless. The family was displaced at ang mga anak huminto sa pag-aaral.The appointee is punished because he did not violate the CSC and Comelec rules.

    I have my disagreements with the equal protection clause argument, it being specious (manipis). But you work with your constraints, not against them. That takes too much effort – fighting the decision, and later, doing the job of the truth commission. And don’t tell me Noy did not know that the supremes may be against him if/when he gets elected.

    Knowing the said constraints, work with them. Later pa naman darating ang kaso sa Supremes kung tapos na sa Sandiganbayan, just like Erap’s case. So there would be time to build a case at the Sandiganbayan, if the Ombudsgirl is pushed aside.

    Kung gusto niyo ng impeachment of the supremes, let the cause of action be the league of cities decision, which was already final, pero binangon after a third motion for recon. I posted this before. That was truly a case of judicial misconduct. And you get all the Glue sipsips in the Court, Velasco, De Castro, Corona, Bersamin, el al. With those out, you can appoint the majority.

    Huwag puro init ng ulo. There must be solid basis. Mere intellectual disagreement with the Court is not basis for impeachment. With this as cause of action, even Manong Johnny will not vote for impeachment. Heck, even if Rene Saguisag were in the Senate, I don’t think he will vote for impeachment on init ng ulo as cause of action.

    Isip, huwag puro init ng ulo.

  133. I have just finished reading the ruling. The decision may be summed up as follows :

    1. EO No. 1 is constitutional because the President has the power to create the Truth Commission by virtue of Section 17, Article VII of the Constitution (the so-called “take care clause” in constitutional law);

    2. EO No. 1 is constitutional because the function of the Truth Commission does not supplant the Ombudsman or the DOJ nor erode their respective powers; and

    3. EO No. 1 is unconstitutional because it violates the equal protection clause of the Constitution.

    Ibig pong sabihin ang may kapangyarihan lamang to remove the President and to the Ombudsman thru impeachment?

    Kaya enough na ang Art. XI, Sect.4, “The present anti-graft court known as the Sandiganbayan shall continue to function and exercise its jurisdiction as now or hereafter may be provided by law.”

    Well, may punto ka Igan…ang sa akin lamang eh enough na yong existing agencies ng gobyerno, ang kailangan lamang e magkaroon ng check & balance upang maging effective and effecient ang bawat ahensya ng gobyerno sa pagtutok sa mga usaping may kinalaman sa kapalaran ng ating bansa.

    Tama ka, ginagawang gatasan o pagkakakitaan ang maging lingkod-bulsa…may pruweba di ba yong GOCC ng gobyerno ni gloria, grabe milyones ang takehome pay ng mga kumag…instant milyonaryo basta maging asshole ng rehime.
