SC suspends impeachment proceedings vs Ombudsman

The Supreme Court has temporarily stopped the House of Representatives from hearing the 2 impeachment complaints filed against Ombudsman Merceditas Gutierrez.

Court Administrator and SC spokesman Jose Midas Marquez confirmed the news Tuesday, a day after Gutierrez filed the petition.

Eight magistrates supposedly ruled in favor of Gutierrez, citing the one-year ban rule in lodging impeachment cases, a source said.

Three magistrates ruled against the status quo ante order, which mandates parties to set aside all actions so far rendered on the issue. They are: Associate Justices Antonio Carpio, Conchita Carpio Morales, and Ma. Lourdes Sereno.

The source said most of the 8 magistrates are familiar faces, who also voted to give then President Gloria Macapagal-Arroyo the leeway to choose the next chief justice despite a supposed constitutional ban on appointments.

Bias for crooks

I beg to disagree with Ombudsman Merceditas Guttierrez that the “independence and objectivity” of the Ombudsman would be “endangered, diminished or destroyed” if they would not impose more restrictions on the public to secure the Statement of Assets, Liabilities and Networth of government officials and employees.

In fact, by making it difficult for taxpayers to get those documents that are important in anti-corruption investigation, the Ombudsman is showing her bias for crooks in the government.

Enshrined in the Constitution’s Bill of Rights is the provision that “The right of the people to information on matters of public concern shall be recognized. Access to official records, and to documents, and papers pertaining to official acts, transactions, or decisions, as well as to government research data used as basis for policy development, shall be afforded the citizen, subject to such limitations as may be provided by the law.”

Following a series of negative reports on the First Family’s wealth based partly on their Statements of Assets, Liabilities and Net Worth, the Office of the Ombudsman has tightened rules in giving out copies of government officials’ SALN “to protect the integrity of the document.”

Militant government workers have filed with the Ombudsman a graft complaint against Pampanga Representative Juan Miguel “Mikey” Arroyo for not declaring his P63.7-million property in California in his statement of assets, liabilities and net worth (SALN).

“With the small salary he gets, it is unacceptable that his assets more than tripled,” said Ferdinand Gaite, president of the Confederation for Unity, Recognition and Advancement of Government Employees (Courage), which filed the complaint at 12 noon Thursday

Assistant Ombudsman Mark Jalandoni said the Ombudsman field investigation unit has already been looking into Arroyo’s assets after receiving an anonymous online complaint against him weeks ago.

Instead of a simple letter-request, requirements now include a sworn statement before a prosecutor of the anti-graft body stating the reasons for the request.

Parang instruksyon yun sa mga congressman na depensahansi Gutierrez.Pampalakas loob din kay Gutierrez. “Ang mensahe ay, huwag ka mag-alala. Prutektado ka namin.”

Hindi na tinatago ng Malacañang na kaalyado nila ang Ombudsman. Na hindi dapat ganun. Ang Ombudsman ay para ma-check sa mga katiwalian na nangyayari sa pamahalaan. Independent siya dapat.

Sa ginawang pagdepensa ng hayagan ni Mike, buking na buking na hawak nila si Gutierrez. Anong klaseng Ombudsman siya?

Multuhin sana sila ni Marlene Esperat

marlene-esperat Ito ang nasabi ng abogadong si Harry Roque nang malaman niya na ibinasura ng Ombudsman ang kasong isinampa ni Marlene Esperat laban kina Agriculture Sec. Arthur Yap, dating Agriculture undersecretary Jocelyn “Joc-Joc” Bolante, sa salang ilegal na paggamit ng pondo ng bayan.

Ito ang kasong kaugnay sa P728 milyon para sa abono ng mahihirap na magsasaka na ginamit para pambili ng boto para kay Gloria Arroyo noong eleksyon ng 2004.

Ang resolusyon ay inaprubahan ni Overall Deputy Ombudsman Orlando Casimiro at Assistant Ombudsman Jose de Jesus Jr base sa rekomendasyon ni Director Elvira Chua ng Preliminary Investigation, Administrative Adjudication and Monitoring Bureau ng Ombudsman.

Siyempre lahat yun aprubado ni Ombudsman Merceditas Gutierrez na kaklase at matalik na kaibigan ni Mike Arroyo.

The Office of the Ombudsman on Friday junked the 2004 case filed by slain journalist Marlene Esperat against Agriculture Sec. Arthur Yap, former Agriculture undersecretary Jocelyn “Joc-Joc” Bolante, and other officials over the illegal use of public funds.

In a telephone interview with GMANews.TV, Anna Sanchez – media officer of Ombudsman Merceditas Gutierrez – confirmed the ruling on Esperat’s complaint but did not disclose any further details, saying a press conference will be held Monday regarding the resolution.

Lawyer Harry Roque, who has made it a personal crusade to find truth and justice in the fertilizer scam, said: “I hope that Merceditas Gutierrez can explain that to the children of Marlene Esperat who all witnessed her gruesome murder.

Sabi ni Assistant Ombudsman Mark Jalandoni, aalamin daw nila kung pera ng gobyerno o sariling pera ni De la Paz. Kung sarili raw pera ni De la Paz, imbestigahan raw kung saan galing ang ganyang napakalaking pera.
