Roldan’s friend

Anti-crime crusader Tessie Ang-See was angry when I saw her on TV last Wednesday.

Ang-See, spokesperson for Citizens Against Crime, finds it incomprehensible that Judge Agnes Reyes-Carpio didn’t see the role of actor and former Quezon City representative Dennis Roldan (real name: Mitchell Y. Gumabao) as mastermind in the kidnapping of three-year old Kenshi Yu last year, in her decision the other day to grant bail to him.

Kidnap for ransom is a heinous crime and is supposed to be non-bailable but Roldan walked out from his detention cell yesterday after posting a P500,000 bail bond.

Ang-See can’t help but suspect somebody’s hand from Malacañang moving and helping Roldan. She can’t forget that one day after Roldan was arrested, presidential son Mikey Arroyo, now representing the second district of Pampanga, told media that Roldan would not do that because he is a good man.

That statement of Mikey could be the reason there are talks that he continues to help Roldan in many ways up to now.

Roldan is accused of masterminding the kidnapping of Kenshi Yu in the morning of Feb. 9, 2005 at the AIC Gold Tower on Emerald Avenue in Pasig. The boy was kept in a safehouse for three days. The kidnappers demanded P250 million ransom from the family.

The CAAC and the Yu family, dumbfounded by Judge Carpio’s decision to grant bail to Roldan, issued a statement titled “Believe it or not.”

It said: “Believe it or not, obviously Judge Agnes Carpio gave more weight to the testimony of Mitchell Gumabao’s witnesses Romeo Orcajada and Noel San Andres, who were Gumabao’s cohorts in the kidnap-for-ransom case.

“Believe it or not, two criminals’ testimonies are weightier than seven policemen and two victims’ testimonies.

“Believe or not, the judge gave credence to Roldan’s contention that the testimonies of seven policemen are either inadmissible, incredible, incompetent and not supported by independent evidence. That’s seven police officers, who testified under oath and described what they saw, and the transcript of records will show that the cross examination of the defense lawyers failed to weaken or assail its veracity.

“Believe it or not, the judge said nobody corroborated the testimony of the state witness Albert Pagdanganan, the driver of the van used in the kidnapping . The defense said nobody among the witnesses pointed to Dennis Roldan despite the fact that Pagdanganan pointed to Roldan. Also, out of the seven police officers, three positively identified Roldan.

“Believe it or not, the judge keep on pointing out during the trial that this is only a bail hearing and that both sides should not go into details. But in her decision to give bail, she was assailing the prosecution for not providing details such as, the audio tape was not authenticated to pinpoint that the voice heard in the negotiation was that of Roldan.

“The authentication can come during the trial proper and that authentication will prove beyond doubt that the voice is that of Roldan because that is the truth and nothing but the truth.

“The court said the cellphone SIM card confiscated was not verified but the transcript of records was very clear that when Inspector Jose Ali Duterte testified that he said that when he arrived at Camp Crame, the technical team called the phone that was used in the negotiation and it was Roldan’s phone which rang, proving that he was the mastermind and that he was the one doing the negotiation.”

The Yu family is considering a number of actions including filing a motion for reconsideration, filing a motion for Carpio to inhibit herself from the case and filing a formal complaint with the Court administrator and/or the Ombudsman for the blatant disregard for the rule of evidence and the rule of law.

They will also ask the Bureau of Immigration to put Roldan in the hold departure list to prevent him from doing a Joc Joc Bolante.

    I also believe a very powerful hand is behind the release of actor Dennis Roldan. Wow!! what a lucky man? If this is allowed by the court, then let’s also free Pres. Estrada from his detention since he has finished all the hearings and the prosecution fail to support their accusations.

In the Inquirer today, Mikey Arroyo said of those who thinks he has something to do with the temporary release of his friend, Roldan:”I know where they are coming from,and I am one with them in their quest for justice. But it is also an injustice to link me or Malacañang to the decision of the court to grant bail to an accused.They should direct their complaints and appeal to the court.

    “At the time he(Roldan) was arrested, I was asked about this. I expressed surprise that he was involved, but I also called for justice to be quickly served on the parties concerned.

    “Hopefully, the court will give due process to the victim and all the accused so it can arrive at a fair and just determination of the case.”

    My source told me that at least two senators who are Roldan’s friends helped him. Also, Roldan’s lawyer is the Fortun Law Office known for taking in difficult cases even if the clients are guilty for a fee. Fortun is also the favorite of most well paying celebrities.

    Teresita Ang-See is an honest and brave civic leader. She is always on the side of the victims and the helpless. Unfortunately, she often runs into some powerful forces that frustrates her so much.

    Frankly, I have difficulty understanding Philippine justice system especially between 2001 and now that has little regard for precious life.

    ..speaking of kidnappings…i think i previously mentioned in a long time blog of friends who were victims to this heinious crimes…kahit they want to indentify the perpetrators, they always think not twice but nth times…kc nga mga kadugo din ng mga pag-susumbungan nila. a close family member was jst kidnapped last month n all he could hear was “chief and major” while he was blind-folded…a kumpare was also abducted (where after 2 weeks his inlaw met the same fate)..lo and behold, may nakakilala..the guys are/mostly frm the wpd…
    doble-standard??? hindi lang doble but quadruple standard pa! if u dont know anyone, ur dead!…kaya kaming mga pre-need victims, till now…just-tiis parin!!!!

    It looks to me that the Arroyos has mastered the art of manipulation. In the last five years they have manipulated everything that came their way, including justices, local government officials, congressmen, and even foreign diplomats. Their most prized victims are the powerful Generals of the AFP, their last line of defense to survive. They made sure that the full strenght of the military is behind them. As long as Pandak has the military, it is impossible to oust her by civil means. Take away military from the equation, and she’s kaput. But how? The military is a bigger challenge to contend with. Revolution is out of the question. The people do not have the weapons to fight with, even if they chose to. Not unless, the military fights among themselves until the whole military institution breaks down. Can we help do that? Maybe. To think of it, the Arroyos do not have the exclusive rights to the art of manipulation.

    sori frends..i cant help it!!! talagang desperate lang ako with regards to being a pre-need victim being a double-whammy (PPI and CAP)…this is anther issue na pinipilit takpan at kalimutan ng bruha sa EK ksi wala sya magawa dahil puro padrino nya ang mga hudas na kumpanyang ito…the newly appointed chairman of cap is Raul I.Goco, former Solicitor Gen. puro all praise ang nakalagay sa write-up sa kanya. E ano…eh he’s another lawyer who will try to twist and turn things for the best interest of cap not for the kawawang planholders!..remeber folks…almost aabot ng 1M ang mga planholders, but imagine kung ilang anak ng kada pamilya ang ikinuha sa mga hinyupak na pre-need companies na yan!

    My nephew and my niece are victims of those heartless pre-need educational firms. My nephew was with CAP and my niece was with Success, a small-time fly- by- night pre-need firm.

    How can Mikey be sincere in helping pre-need victims when her mother is coddling Yuchengco. Binigyan pa ng sikatuna (whatever, kung sinong datu man yun) award.

    I was disgusted to learn that Roldan’s van was full of items taken from his cell. Among the items were TV, video player and other expensive electronic gadgets. How was he able to bring in these so many expensive items to his cell? Roldan even gained weight. He didn’t serve his sentence inside. He seemed to have enjoyed it as if he just went on a brief vacation. That’s the kind of justice for the VIPs in RP today!

    He escorted personally LTFRCB chair Bautista and entered a STRICTLY NO ENTRY ZONE kung wala kang pass from the airport security….to refrain the agents of the Court to serve the warrant of arrest to Bautista.

    This arrogance and blatant display of prostituting the Law by the un-Justice Secretary himself must be condemned to high heavens!

    Another example of how a VIP is being treated in RP even if he’s accused of murder is a certain Sugay, the Little Mayor of Manila, very close and an aide to Mayor Lito Atienza. Sugay shot and killed a poor jeepney driver due to an argument in parking. Despite Sugay previous criminal record (in prison once for homicide), he was appointed by Atienza as a Manila official. That’s not the end of the story. Sugay was not arrested by the Manila Police but was just invited for questioning upon order of Director Bulaong.
    Sugay then flew to Cebu and has now left the country to an unknown destination. How many like him under this Arroyo government got such special treatment? Garci, Bolante, Roldan, Sugay, etc.

    He is the Justice chief, but for him, there appears to be one law for the Arroyo foes and another for the Arroyo allies, and in this specific case, his protegee, Land Transportation Franchising and Regulatory Board (LTFRB) chairman Ma. Elena Bautista.

    Justice Secretary Raul Gonzalez yesterday violated the law when he deliberately harbored LTFRB chief and deliberately aided her in evading an arrest warrant without bail for her yesterday.

    Even the airport officials reportedly also ensured that her arrest would be prevented, by refusing entry and exit access to the arresting police team and by ensuring that the LTFRB official would gain access to the entry and exit points from the domestic to the international airports.

    The incident occurred at the Ninoy Aquino Interna-tional Airport Centennial Terminal 2 when Gonzales

    harbored Bautista, who he knew has a pending warrant of arrest but prevented her arrest.

    The coddling of a criminal is a crime, as Gonzalez himself has stated too many times, the latest of which was when he threatened to file charges against Novaliches Bishop Antonio Tobias for harboring Army Lt. Lawrence San Juan while he was on the run. San Juan has since pledged allegiance to the Arroyo government, after his capture.

    Bautista arrived at the NAIA Domestic Terminal 2 from Iloilo on board Air Philippines flight 2P-735 at 3:30 p.m. yesterday.

    When she was informed that a team of police officers armed with a warrant of arrest issued by Quezon City RTC branch 196 judge Pablo Cajigal, was waiting at the NAIA domestic arrival area, she refused to step out of the arrival area and instead made a phone call.

    The lady LTFRB official managed to avoid the arresting policemen when the Justice Secretary, who was on the same flight from Iloilo escorted her personally and facilitated the transfer to the NAIA International arrival area where she was reportedly taking refuge.

    Despite not having a NAIA access pass to go through NAIA restricted areas, Bautista managed to slip out of the domestic area and moved on to NAIA international arrival area, breaching airport security measures.

    “That’s a blatant disregard of tight security measures being implemented by NAIA,” one of the policemen in the arresting team who waited in vain for her to emerge, said.

    The policemen were not allowed to get inside the airport to serve the warrant as the NAIA officials did not issue the policemen an access pass. They were only allowed to wait outside the arrival area.

    Judge Cajigal issued the no bail warrant of arrest against Bautista for indirect contempt of court as she had been ignoring at least five-court summons since May 3.

    However, after several phone calls and more than hour of negotiations, Bautista managed to file a motion for reconsideration, thus allowing her to leave the airport without being arrested.

    She boarded a black van which was followed by several vehicles, along with that of Secretary Gonzales.

    The Justice Secretary is also known not to move against those allied with the President and Malacanang.

    He has been asked by the lawyers of detained President Joseph Estrada to issue a hold order against Blanquita Pelaez, mother to ex-beauty queen Joelle Pelaez who had earlier accused Estrada of money laundering,.

    The elder Pelaez has a pending warrant of arrest after her conviction—which is already executory—by the Makati Regional Trial Court for estafa, and on this basis, Estrada, through his counsel, asked the Justice chief to issue a hold departure order against her, to ensure that she does not flee the country and instead face her sentence in jail.

    Blanquita is said to be a recidivist con artist who has a final conviction for estafa not once but twice.

    Former Immigration Commissioner Rufus Rodriguez, a legal counsel and spokesman for Estrada disclosed this Thursday as he renewed his call to the Department of Justice for the issuance of an HDO and for the Department of Foreign Affairs to cancel Blanquita’s passport.

    Rodriguez called on Gonzalez for a fair and impartial enforcement of the law for all offenders as he chided the DoJ chief for being harsh on members of the opposition and lenient with friends of the administration of Mrs. Arroyo.

    Rodriguez made this call as he pointed out that Blanquita has two outstanding alias warrants of arrest for final conviction for two separate cases of estafa from the Makati RTC and the Pasig RTC.

    Rodriguez said he discovered that aside from the conviction of Blanquita for estafa by Judge Winlove Dumayas on March 14, 2003, she was also previously convicted for violation of B.P. 22 otherwise know as the Bouncing Check Law by Judge Florito Macalino of the Pasig Regional Trial Court last October 25, 2002.

    In both cases, Blanquita did not appeal the conviction and instead went to the United States making the court decision final and executory which now makes her a fugitive from justice

    With regards to the Roldan case, a friend said that the fiscal could also be blamed. Aside from the private prosecutor, a government prosecutor is also at hand to assist the complainant. He said that some of the more incriminating evidences could have been witheld by the fiscal thus making the case weaker.

    All evidences and other documents are presented before the court to justify the charges. What the fiscal could have done was to submit only certain documents and evidences but not all. He could have witheld the police evidences especially those that would really tie Roldan to the crime.
    This is of course only one way, the other is your view which points to those occupying the palace by the murky river.

    Why do they have to have a private prosecutor in the Philippines? Never heard of such thing in the US, Japan or anywhere else.

    I can understand a lawyer pursuing a case against his client’s foe, but he is not called a prosecutor, who usually works for the government connected ith the Ministry or Department of Justice. Kaya siguro nagugulo ang batas diyan at ang daming nakikialam.

    Iyong pulis diyan ang gulo din. Hindi malaman kung sino ang susundin nila, kung iyong heneral ng military o Superintendent ng pulis tapos nakikialam pa iyong isa pang walang alam na bansot! 😛

    Agree with you Yuko!!! Never heard such thing. The Government have all kinds of prosecutor specializing in every field, and whichever case the State is facing it will utilize and field the best of its manpower, because most often, like in our situation, the defendant can also choose the best defense lawyer at taxpayers expense (legal aid).

    And always, for criminal case, it is the State that file charges, not the complainant. The Complainant, in criminal cases is the “victim” and it is solemn duty of the state if evidence warrants to seek justice and relief towards the victim. That’s the way I understand justice, and that’s the way I see it applied here.

    That’s how it works here. The victim is given an option to hire a private prosecutor to work side by side with the public prosecutor. Sad to say, most government prosecutors bungle cases that leads to the acquittal of the suspects.

  33. What a crazy system indeed, Schumey! Sa kaaarte at pagnanais ng mga tao diyan na makaloko, ang gulo ng system. Kaya pala palpak. Pero makipag-usap ka sa mga abogado diyan, ang yayabang! Sino ba ang nag-introduce ng private prosecutor na iyan? Sira pala ano?

    Siguro ang totoo ay hindi nila naiintindihan ang ibig sabihin ng mga terminology ng batas katulad ng hukom na tagalitis, prosecutor ay taga-usig at ang abogado ay tagapagtanggol! Mas lalong malinaw in fact kapag nakasulat sa sulat hapon (in fact Chinese symbols we call “kanji” in Japanese).

    Katulad na nga nitong kasong inirereklamo ni Ang-See. Dito iyan, hindi puedeng magpiyansa dahil sa bigat ng kaso. Dito kasi malaki ang pagpapahalaga sa buhay ng tao kaya anything na nakasalaylay o may kinalaman sa buhay at kaligtasan ng tao ay mabigat na kaso. Lagot ang kikidnapin pa ng Roldan na iyan kung talagang kasangkot nga siya sa mga krimen na ibinibentang sa kaniya. What an in-JUST-TIIS, talaga!!! 🙁

    Actually, private prosecutors are hire because government prosecutors are “palpak”. Unfortunately, before a private prosecutor can be introduced in a case, the public prosecutors handles the investigation and filing of the complaint. And this is were the problems and lapses occur. A perfect example are those cases the government lost to the Marcoses because the public prosecutors mishandled the case. Even the police who surveyed and arrested Roldan where shocked of the decision because they knew they had solid evidences to put Roldan behind bars for good. The fiscal obviously poorly assessed the evidences presented. He could have “overlooked ” pertinent evidences in the case. This is what usually happens to most high-profile cases. It seems that even the public prosecutors succumb to pressure and money.

  36. Alam mo, Schumey, dito ako hanga sa sistema namin dito, because it makes everybody busy. This is how justice works in Japan for example that I think is no different from Canada or UK or even in the US except that in the US, likewise, justice is rendered useless because of abuses of human rights and racial discrimination.

    Over here, the police have to work hard in their invesitgation of a reported case and they work with the prosecutor who takes charge of getting the needed warrants to enable the police to investigate and make arrests. Then, they form teams to do the job especially in solving heinous crimes with a hundred or more policemen with ample expertise on the case being solved. The dedication and perseverance of these policemen really are that admirable, especially those on top working the hardest to imbue the lower ranking officers to do likewise.

    The limit for investigation over here is 21 days before the prosecutor decides on whether or not to pursue the case to the court with an indictment, which is issued when the case is established with ample evidences and there is no ounce of a doubt that the case can be pursued in the court where the perpertrator is presented as an accused.

    Over here, when a person is under investigation, he is merely a suspect, but once he is indicted, he is already presumed guilty and considered an accused, and presenting him in court is more or less to find out if he is corrigible or not. If he is beyond correction, he is sentenced to die, which is a good way of ridding this world of bad men as a matter of fact, and reason I guess why Japan is more orderly than any of the countries I have lived in.

    It is rather simplistic, but when you have a majority of simple-minded persons, this system surely works. Over here, a simple statement that the police has used brutality or that the accused has not been provided properly with an interpreter who speaks his own language if he is a foreigner can already be enough ground for dismissal of a case in court.

    Sa Pilipinas, nandiyan na at lahat ang ebidensiya, nakakalusot pa rin ang mga walanghiya basta may kakilala sa itaas!

    Matanong ko lang…sa Japan ba may jury din? Parang sa America na may jury system? Pabor ba kayo na gawing jury system na lang ang Korte natin sa Pinas? Mas magastos sa mga mayayaman ito dahil marami sila lalagyan maliban ang judge ano? Isipin niyo lang kung ang mapiling mga jurors eh corrupt…

    Marami din akong naririnig about dyan sa judge AGNES REYES CARPIO na yan,,, maraming nagsasabi na biktima rin sila ng maling desisyon ni AGNES REYES CARPIO. Nakakahiya naman po dahil pati sa abroad nababasa ang mga ganitong kaso ng isang judge na may pinapanigan. O baka naman nagkabayaran para sa maling desisyon. Dapat mag retiro na yang judge na yan, nakakahiya pati pamilya nya nadadamay sa pagiging CORRUPT nya
