Update:AFP, PNP defy SC ruling on National ID

Senators say GMA can’t be trusted on National ID

The Armed Forces yesterday batted for the national identification system which was shot down by the Supreme Court during the Ramos administration.

The military made the recommendation to President Arroyo during a command conference in Camp Aguinaldo. The President directed the defense department to study the military’s proposal.

The conference, attended by Defense Secretary Gilberto Teodoro, AFP chief Gen. Hermogenes Esperon Jr., top military commanders and PNP chief Avelino Razon, tackled internal security operations.

“The recommendation for the revival of the national ID system is to accelerate accomplishing the marching orders given to the AFP. The President has directed the DND to conduct a study with the guidance that it should be within the purview of what is lawful,” said Lt. Col. Bartolome Bacarro, chief of the AFP public information office,

In 2006, the President directed the Armed Forces to end the insurgency problem before her term ends in 2010. Latest military estimates show the New People’s Army has around 5,760 fighters and 87 guerrilla fronts.

“That recommendation was made by the Armed Forces of the Philippines but we would like to highlight that it is subject to a very tedious study (by the DND) that it should be within the purview of the law,” Bacarro said.

Asked if it was Esperon who made the recommendation, Bacarro said: “No. It was brought out by the AFP, not necessarily by General Esperon.”

Bacarro declined to discuss details of the military proposal. He also refused to say when the military wants the system implemented.

Razon said government is thinking the system would be “based” on the Social Security System or PhilHealth identification cards, among others.

“The concentration is not on a security concern but on government service that will be provided like PhilHealth, SSS, among others… We should really establish an ID system and the people should not be scared of this,” he said.

Razon said a national ID system would also help in the fight against criminality.

He said the ID system would be adopted as soon as possible so that insurgents, terrorists, criminal elements could not hide behind the cloak of anonymity.

The ID, he said, would contain the name, picture, address, and age, among others, of the holder.

He expressed optimism no one would oppose the measure as he said no one is opposing the drivers license ID, PhilHealth and SSS IDs.

A national ID system was first proposed in 1996 under Administrative Order 308 issued by former President Ramos. Two years later, the Supreme Court declared AO 308 unconstitutional as it said it “pressures the people to surrender their privacy by giving information about themselves on the pretext that it will facilitate delivery of basic services.”

In April 2005, Arroyo issued Executive Order No. 420 implementing a national ID system for government agencies and government-owned and controlled corporations. The system aims to unify and consolidate all the ID systems used in government and in transacting business with government agencies like the Social Security System, the Government Service Insurance System, the Philippine Health Insurance and Land Transportation Office, among others, into a single ID card.

The Supreme Court upheld the constitutionality of EO 420 in April 2006. Those who opposed Arroyo’s issuance said it was a mere revival of Ramos’ AO 308.

Last August, Muntinlupa Rep. Rufino Biazon filed a bill on the implementation of the national ID system, which covers all persons aged 18 years old and above.

Systems analysis’ stage

Interior Secretary Ronaldo Puno expressed skepticism a single national ID card would materialize this year.

“We will do first a review of what the status is because we want to presume that they are up to date but if they are not, that is when we would figure out what we need to do,” he said.

Puno said the National Economic Development Authority was tasked two years ago to look into the possible consolidation of all the ID systems.

“I think it’s still at that stage of systems analysis on the consolidation of all identification files…So if you are going to judge it by systems requirements, it would take some time before that study can be completed. It’s very difficult to do that,” Puno said.

Not New

After the tribunal upheld EO 420, then planning secretary Romulo Neri said the implementing rules on the “government national ID system” would be effective Jan. 24, 2006.

Neri also said the government ID system contains information like the ID holder’s name, birthday, residence, parents’ name, and marital status. “Sensitive information” like criminal records is not included.

Puno said the national ID system is not new. He said the Local Government Code requires barangay secretaries to have the full identification of their residents.

“This is in the law that was passed in 1991… The problem is it has never been implemented. There have been some discussions on this… but that is not a new idea, it is a statutory obligation of all barangays to complete an identification system,” he said.

Accelerate Momentum

The command conference also tackled amendments to the Human Security Act. Razon said it was proposed that mere possession of explosives be made a non-bailable offense.

Bacarro said the President was given a briefing on the military’s campaign against threat groups. He said the President directed the AFP to “accelerate its momentum of successes against threats to national security.”

He said the President was informed that the strength of the NPA which is down by 20 percent compared to end 2006.

On the Abu Sayyaf, Bacarro said the military neutralized 69 Abu Sayyaf terrorists last year, reducing their number to only about 383 as of December 2007 compared to the previous year’s 452. He said military operations have “contained” the Abu Sayyaf in Basilan and Sulu.

Apart from accelerating the momentum of the campaign against the threat groups, Bacarro said the President issued four other directives “that set the tone on how the Armed Forces of the Philippines would carry out its marching orders of defeating the CPP/NPA/NDF by 2010.”

The four are conduct of humanitarian offensives in conflict areas; adherence to human rights; to remain united and steadfast to their sworn duties; and joint military and PNP efforts.

Press Secretary Ignacio Bunye said the President ordered Teodoro to ensure that the military maintains its thrust against communist terrorist activities, and that its thrust should support national development. – With Jocelyn Montemayor

    That the AFP should start the campaign for a national ID is absolutely scandalous!

    Who does frigging Esperon think he is? He must think he is Himler personified!

    Anyway, there’s lots of money to be made out of a national ID system Ellen. I know, because national ID technology used to be part of the catlalogue that I used to handle for the conglomerate I used to work for and had proposed the idea to FVR at the time.

  2. Besides the tactical use of the ID for the AFP, maybe, just maybe, Esperon wants to handle the national ID thinggy — just think of the bundles of money he’d make!!!!

    Hmmm, maybe this ID system will lead us again into another computerization project. Isn’t that the natural consequence of an activity that requires digital tech?

    From what I see, a lot of govt work is now around, overlapping as usual. Why can’t the bright boys of Malacanan think of a way to synchronize pre-existing systems (drivers’ license ID, GSIS pensioner/members ID, SSS ID, Comelec voters ID, etc.) into one, coherent, integrated master system that wouldn’t call for another system to be created anew?

    Instead of solving one problem, another one is created and added to the already long list.

  5. The SSS cards are handled by Ayala group… they went into partnership some 10 years ago with Sagem, a French group. Don’t know if they are still with the group.

  6. A national ID? Neknek nila. Just who are these crooks kidding when they have not even thought of correcting a lot many people’s records.

    I know a lot many Filipino women married now having problem with the Japanese Immigration because of multiple records and IDs. One Filipina who has just got out of prison in Japan in fact has had 3 or 4 IDs, all valid and issued by the NSCO and the NBI. Ilang beses pa ngang namatay ang babaing iyon.

    Nothing good will come out of this attempt to retry this crap of a national ID similar to the one they have in the US because it is being done for the wrong reason, purpose and intention.

    Puede ba, mag-resign na lang ang mga kurakot?

  8. I agree that a progressive nation needs a national ID, nothing wrong with that but not while Gloria and her Esperon ass licker are still around.

    (Maybe that’s why Esperon went to Malaysia — to pre-negotiate the purchase of ID technology from Malaysia? What say you Tongue?)

    I dont see anything wrong with the national ID. At least the banks wont look for other sets of IDs anymore. It should be issued to replace the community tax certificate. and to go with it is the issuance of passport, free also. That way we are giving the Filipinos a future to look forward. Even convict be given the IDs and passport. That way we will get rid of them here. For sure they will do everything just to get out and live happily abroad. Marami nga mga criminals na umaalis na. so lets make it easier for them. They can even bring me along with them.

    Sa DMZ (demilatarized zone) ng North and south Korea,napakahigpit ang imlementation ng ID. Kapag ang ang isang pamilya ay may bisita na hindi residente ng zona, the head of the family is obliged to report to the authority na may bisita sila. (This article i read several years ago). But in theory, palagay ko, effective nga ito.

    Sa Italy, if the police authority found out that if you are accomodating (meaning pinatitira mo) an undocumented person, magmumulta ka. I know it kasi yung kapatid ko noong araw, he was undocumented and when the time comes na pwede na siyang magawan ng documents for his legal stay, I reported his stay in my house 3 months before at ako ay pinagmumulta.

    Ang ID for sure will help propel our economy kasi everything is established electronically. Kung uutang ka sa bangko, makakabawas sa red tape i.e. background investigation etc.

    Kung ma i implement to, you will see the difference!

    Let’s give it a try sa ating bansa.

    Nga lang, kung iimplemnet to ng gobyerno natin, dapat noong araw pa. Pinagsumikapan nila. E bakit ngayon ipipilit nila to sa kadudadudang panahon.

    OOOPs, baka naman kasama nila yung magbibigay daw ng 500k pesos sa Rizal Park o ginagaya lang. Kumita yon sa mga ID lamang. Making a fast buck na si Esperon. Kaya ayaw tuloy bumaba. Hati sila sa presideng officer ng command conference. Imagine, magiging compulsury and new IDs.

  21. What they need to do first is correct the system of registration that is definitely faulty. They should have a similar family registry for instance that we have in Japan, and its former territories, Korea and Taiwan. It makes tracing missing persons really easy.

    The problem is Filipinos have gotten used to monkey business that I don’t believe that with the Dorobo initiated ID system, I doubt if they can make this registration of Filipinos right and proper. Puro arte lang, puro daya pa rin! Pwe!

    Kung ano-ano na naman ang balak ng gobyerno samantalang mas dapat nilang asikasuhin at umpisahan na ang ELECTORAL REFORMS pata maiwasan na ang maruming eleksyon sa 2010. Dapat nang bulabugin ang gobyerno at COMELEC para sa computerization ng eleksyon. Asan ang mga CIVIL societies at groups na maingay nuong eleksyon na wala naman yatang nagawa? Dapat na nilang umpisahang mag-ingay. Asan ang PPCRV? Umaangal si Jose Nebrao ng Engaged sa parinig ni Erap, pero dapat ay COMELEC ang kanilang bulabugin. Huwag nating asahan ang mga politiko na may balak kumandidato. Kung talagang gusto ni Gloria ng malinis na eleksyon ay ang gobyerno ang dapat manguna. At malamang nga sa hindi na hindi sila gagalaw kung hindi kakalampagin ng taong bayan!

    Senate Majority Leader and Independent Senator Kiko Pangilinan today downplayed suggestions to revive the National ID system, “The ticklish question is simple: In reviving the proposal, can we trust this government to respect the basic, constitutionally guaranteed rights of its citizens? The Armed Forces of the Philippines (AFP) recommended the implementation of a national ID system to hasten the fight against threat groups.

    In 2006, PGMA directed the AFP to end the insurgency before her term ends in 2010. In 1998, the Supreme Court rejected the proposal saying the system posed a “clear and present danger” and would violate the right to privacy guaranteed by the Constitution. “Unfortunately, as has been ruled by no less than the SC in a string of landmark cases that includes EO 464, People’s Initiative, CPR, Proclamation 1017 among others, this government has been found to have consistently acted in a manner contrary to the rule of law and the constitution.” Kiko added. “If the SC has found this government in repeated violation of the rule of law and the constitution then we view this latest proposal with grave reservations.” Kiko ended.

  27. Statement of Paranaque Rep. Roilo Golez:

    I support the national ID system but it would have been better to highlight its role as an economic development instrument by facilitating commercial, business and official transactions which require need for proper identification of person in the following:

    (1) negotiating and signing business/commercial agreement;
    (2) applying for permits from municipio and other government agencies;
    (3) in public order matters such as identification in police matters when a person is subject of complaint; and very importantly
    (4)registration as voter.

    To alleviate fear that it is a threat to human rights, the lead agencies to handle this should be jointly the Dept of Trade and Industry and DILG, instead of the AFP-DND.

  29. on the rationale of national ID system, I go with Golez but I view with “grave reservations” Kiko’s criticism of this government, as if the senate is not part of it, as if this senator has a good record of human rights advocacy and praxis. He should have focused his “political” critique to the executive department, if not directly to gloria.

    There’s no question that RP citizens and even non-citizens staying, living and working in RP need a national ID, i.e., citizens’ national ID for nationals and a foreigners’ ID for non nationals, but like Golez, I am opposed to the idea that the AFP!!!!! and the DND!!!!, particularly under this regime should be tasked with its development and implementation — ano yan, shades of Himler?

    ang akala ko lahat ng nakatira sa Phil. ay may ID..hindi ba since birth one is registered?..and then at 18 you have to get a residence certificate? Is this not an ID?..What happened to things done since 1946 when we were given our independence? nawawala na ang records? In the US we are identified by our Social Security No. Talaga naman..pag puedeng kuartahan hala bira!

    Alam mo pag ang Bangladesh ang sumakop sa Pinas tapos na ang maliligayang araw natin kasi pangtapat lang nila eh curry na isang damukal na sibuyas at sili wa epek na tayo.

    Kita mo ang kanilang jet figters such as:-

    1) Russian MiG-29s
    2) Russian MiG-21s
    2) An-24s
    3) An-26s,
    4) Mi-8 helicopters
    5) Chinese jets, A-5s and F-7s and 35 Shenyang F-6s.
    6) US C-130 Hercules
    7) 12 F-7MB’s in the mid ’90s & recently in 2005- bought 16 F-7BGs from China.
    8) 12 T-37 jet trainers.
    9) acquired 12 Jian F-7MG’s and 16 F-7BG, which were modified F-7MG (with single piece canopy) with reconnaissance capability (similar to F-7MB) in 2005-6.
    10)acquired a new improved version of Mi-17 (with nose mounted radar) in 2006.
    11) showed interest in procuring J-10 multi-role fighters from China.

    SEE, di ba poor country ito, but how this poor country acquired all of these above mentioned military hardware? Ang Pinas kuno ang dami nagsasabi rich in natural resources and manpower pero ano tayo ngayon kulelat as very poor ang AFP natin talo pa sa mga bandidong abusayaf.

    Ang kayabangan kasi eh pang showbiz lang kasi nandoon ang pera, at wag ang kabang-yaman ang pinagnananakaw.

  36. Rose, a residence certificate is not an official ID.

    In principle, an official national ID is proof of your nationality but a residence certificate is easily frauded. I had an experience long ago.

    A friend of mine (cousin of Jose Pidal) needed to register something in my name in RP and needed to present a residence certificate but I wasn’t in RP at the time so he suggested that his secretary procure and sign on my behalf a residence ID complete with fingerprint, etc and present it as mine — he assured me that there would be no problem and that it was done quite often. I was shocked and promptly rejected the quick-fix.

    Imagine pagkakaperahan uli yan ni GMA kasi nga naghahanap sila ng source kung saan makakakuha panggastos sa 2010. Ang laking pera if they will issue yan ID sa lahat, computed na nila ito 80M + x magkano ang cost ng isang ID = bilyong pesos yon jackpot uli na naman ang mga switik.

    Sa OFWs eh 25US$ x let say 9M pinoys working abroad = million US$ di ba plus 900+ OWWA fee grand total _____.

    Matagal na nila tayong pinagloloko, morethan 7years na ha!

    Paki ask mo nga yong nalalobby niyang ID System, saan nila dinala yong nabawing-yaman ni Macoy? PCGG ang utak nito, ngayon naman AFP+PNP sa NIS, ano ba yan? Garapalan na eh.

    Balweg,

    In principle, the S211 may not be the best trainer aircraft on the market (at the time) but it wasn’t exactly bad.

    In my view, the reason why nagbabagsakan ang mga planes na yan noon is 1) lack of proper maintenance due to lack of spare parts and 2) not enough training

    My suspicion is as ever — and this is where the kayabangan syndrome creeps in — is that PAF didn’t purchase or negotiate for enough supply of spare parts and they halved the training contract with Augusta thinking that after all, ang mga Pinoy pilots have a record of being topnotch pilots, hence tama na, huwag ng gastusan ang training of those PAF pilots who in turn would be training the new recruits.

    Iyan ang problema when our major services purchase equipment — they cut down on the basic logistical needs when they are inherently very very important, more likely because they think they can do away with bahala na and quick fixes. Hindi puwede yan!

    I told the fellas at NMO (Naval Management Office) that they were dreaming — they had better get their management of assets correctly first before they could even begin to think of submarines. 1) they need to get their doctrine right first 2) the cost and the training will exceed their wildest dreams

    Submarines are a class on their own — you need at least 10 years of up to speed naval submarine education before you could even begin to call a navy a submarine class navy.

    AdB/Balweg: thanks for the info..I wonder if all these information records on a Filipino’s national identity is centralized…here in US…a social security number is issued to a new born..to a new permanent resident..and this could be done too in the Phil. and with all this hi-tech equipment..it would not be difficult..malungkot talaga kung walang ganito..ang ibig sabihin malaboy laboy ang mga Filipino walang identity…here in New Jersey after 9/11 all records were sent to Trenton..thus it was quite difficult to establish identity..however, in catholic records of baptism a person can be identitied..hindi problema..ako lang ang may problema to look for their records…malay ko na ang Giovanni pala ay John; ang Guissippe pala ay Joseph; pero natuto ako.

    Di ba granted yong pangarap nila ng gising? AT4 battleship ang regalo nila di ba, yan ang nagpayanig sa kanila ang Navy corruption thesis ng kgg. AT4. Unfinished business pa ito till PEN missiles kargado pala ang AT4 destroyer at di battleship.

    Buti pa si Singson eh may submarino ang Pinas eh mayroon nga di naman umabot sa speed boat ng mga abusayaf.

    Hindi kailangan ang national id system as of this time kasi:

    1. Yung mga identified na kriminal at terorista ay hindi naman nakakulong (gma, esperon, fg, puno, abalos, garci, bedol, ang dami pa)

    2. Di pa nga maaayos ang voters list at yung sa NSO.

    3. Ang AFP-DND hanggang ngayon walang maayos na record system sa mga sundalo nila.

    4. Sino mag implement? Ang mga kriminal sa gobyerno? Hello?!!!!

    Razon thinks it will be “based” on the Social Security System or PhilHealth ID Cards. It would he said, contain the name, picture, address, and age, among others, of the holder. He expressed optimism no one would oppose the measure as he said no one is opposing the drivers license ID, PhilHealth and SSS IDs. (But notice that the PNP chief himself only “thinks” why doesn’t he know!).
    What immediately comes to mind is are we now residing in a Democracy or a Dictatorship. What happened to government by the people; especially : rule of the majority and a government in which the supreme power is vested in the people and exercised by them directly or indirectly through a system of representation usually involving periodically held free elections.
    I ask myself why, if we are really a democracy is the military taking a lead in proposing ID Cards and many other things recently that are not their mandated duty or in truth are we half a step away from being a dictatorship it seems we are a democracy in name only.
    Could this sudden interest in ID Cards be that because in a few weeks time many armed forces leaders start a run up to retirement and that a laminating ID card business would be lucrative to have as a retirement supplement. I guess some people would not agree with me, but not many.
    Other countries around us are going forward whilst we are determined to cause ourselves problems by going backwards.

    In the US, there’s a big controversy going on right now regarding a plan to have a uniform national driver’s license to replace those being issued by individual states. The main objection is that it is tantamount to a national ID system that violates the citizens’ right to privacy.

    And here we are going to embrace it? To improve the delivery of public services, kuno? What services? Do you think a mere piece of plastic will make those lazy and corrupt government workers industrious? They will still make things hard for you until you slip them grease money.

    The national ID, far from being a “tool to discipline people”, as desensitizerman said, is a tool to scare people from dissenting especially against this administration.

    C’mon, give me a break!
