In a historic vote of 212 “Yes”, 46 “No”, and four abstentions Ombudsman Merceditas Gutierrez was impeached by the House of Representatives for betrayal of public trust.
After eight hours of deliberation, the House vote was completed at 12:13 a.m of March 22, 2011.
This is the first time in the country’s history that an anti-graft chief has been impeached.
The Articles of Impeachment, which will be transmitted to the Senate for trial, contained in House Bill 1089 cites inaction on the following cases : fertilizer scam; $329.5 million controversial National Broadband Network-ZTE telecommunications deal; Mega Pacific poll automation contract; Euro-Generals cases; 1995 death of Navy Ensign Phillip Pestaño; low conviction rates.
Under Section 3, Article XI of the 1987 Constitution, the impeachment case against the Ombudsman would have to get a one-third vote of all House members (95 ) before it can be transmitted to the Senate for trial.
In the Senate, two-thirds vote of all senators— 16 out of the 23 senators—is needed to convict the Ombudsman.
In 2001, the Senate was converted into a court in the impeachment of then President Joseph Estrada. The trial was cut short when prosecutors walked out when the pro-Estrada majority voted against opening an envelope supposedly containing the President’s back accounts. The walkout sparked a predominantly middle-class rally that led to the ouster of Estrada and the installation of then Vice-President Gloria Arroyo as president.
Gutierrez is closely associated with Arroyo and at least four of the cases in the Articles of Impeachment also involved the latter.
Arroyo, who is a member of the House representing the second district of Pampanga, voted “No” together with her two sons, Dato and Mikey and brother-in-law Ignacio Arroyo.
In explaining his vote opposing the impeachment, Rep. Mikey Arroyo, whose representation of drivers and security guards has been controversial, said the stipulation “betrayal of public trust” in the Articles of Impeachment was “vague” and was “overwhelmed by a political agenda.”
He appealed to his colleagues in the Aquino administration that “After tonight, let’s come up with ways to control the price of rice, basic commodities and help each other to bring home our OFWs safely.”
The minority bloc had attempted to delay the proceedings after its members questioned sponsors of the articles of impeachment, drawing lengthy debates that questioned the grounds for impeaching the Ombudsman.
Minority Leader Edcel C. Lagman (1st district, Albay) tried to delay the voting by insisting for an investigation of a text message allegedly sent by Cavite Rep. Joseph Emilio A. Abaya (1st district), chairman of the influential committee on appropriations, to congressmen Sunday purportedly warning of losing their pork barrel fund if they didn’t vote for the impeachment.
“I ask the leadership to immediately cause the investigation of this latest assault against our institution. More than the impeachment proceedings, the preservation and protection of the independence and integrity of our chamber must be upheld and prioritized,” Lagman said at the plenary.
Abaya denied that he text came from him. Lagman’s insistence gave rise to suspicions that it was the handiwork of those against the impeachment.
Cavite Rep. Lani Mercado-Revilla (4th district) abstained from voting saying her husband, Sen. Ramon “Bong” B. Revilla, Jr., will serve as judge during trial at the Senate. Same with Las Pinas City Rep. Mark A. Villar, son of Senator Manuel B. Villar, Jr., who also said he didn’t want his vote to affect that of his father.

Pacman voted “no” through his twitter account. It did not count! Ang takot lang ni Pacman baka yung susunod na Ombudsman eh ma-paper trail kung saan yung nagagamit na dollar account sa money laundering. I hope he did not allow himself to be used. Sobrang close siya kina putot nuon.

Ang Impeachment na ito ay parang “Earthquake-Tsunami” sa GMA admin noon. Yong “nuclear radiation” naman, ay katulad ng mga lagay-pabaon ng palasyo noon para sa NBN-ZTE, Ensign P. Pestanio case, at iba pang karumaldumal na human rights violations, kung totoo at mapatunayan.

…matanong ko lang is there a chance for Maldita to appeal and for a review of the impeachment..kung sino man ang nakakuha ng picture after this decision…paki share naman dito para makita ng buong mundo ang kanyang dirty face..
Maldita’s Dirty Face!
Palaging naka-focus kay gloria ang TV camera. Kitang kita tuloy ang ibidins na hindi na makatulog dahil nangangalumata. Nagwalk out na noong maguumpisa pa lamang magsalita si Rep. Tupas, eh bumalik pa.
Si Rep. Lani Mercado, nag abstain. Palagay ko, para hindi magkaroon ng speculation kung how her husband, Sen. Bong Revilla will vote kapag nasa senado na ang usapin. Alamin nating kaalyado ni gloria itong si Bong Revilla kaya abangan natin at matyagan siya at ang lahat na senador.
Para sa akin, pinakamatindi ang YES vote explanation ni Anak Pawis partylist Rep. Mariano. Tinukoy nya ang pagwawalang bahala ng Ombudsman sa mga sangkot sa Fertilizers Scam. Sinabi nyang ang pondong dapat pakinabangan ng mga magsasaka ay kinurakot upang gamitin noong 2004 elections para manatili lamang sa pwesto si Gloria Macapagal Arroyo.
Naglakas loob ding magsalita si Rep. Mikey Arroyo, ang partylist representative ng mga Security Guards. Binasa nya ang kanyang gustong sabihin pero parang hindi magkantuto sa kanyang speech. Sa bandang huli wala na sa topic ang binanggit sapagkat ang mataas na presyo ng bigas at gasolina at pagpapauwi sa OFWs ang kinalantari.
Oo nga, Joeseg.napunta na sa presyo ng bigas at OFWs ang pinagsasabi.

If and when Merci’s defense falls short of her expectations in the senate trials, I don’t think she is the type who will be willing to be the fall guy and take all the rap for Gloria. No way !!! But Pnoy still had a high popularity rating. I hope that there will be no “I invoke my right to…” on the Malditas case. Just watching the Garcia plea bargain hearings, sumasakit ang ulo ko sa kapapanuod ng mga BATO na katulad ni Garcia, at pamilyang Ligot. Walang nangyayari sa senado kahit na anong estilo ng pagtatanong.
I am most touched by the death of Pestano. I want his death to be re-investigated and those who killed him be put to trial. I hope it is not too late for this to happen. Ang pera ay maibabalik pa, ang buhay, hindi na.
Hindi yan papasa sa Senado dahil kaya lang bomoto ang majority ng Yes para e impeach si Merci ay dahil sa 2011 pork barrel kung wala yon e siguradong ang majority vote ay No.
Sa US ang pork barrel ng Congress ay hindi kontrol ng presidente, automatic yon na binibigay sa kanila regardless ng boto nila ke pabor o hindi sa presidente. Ang pinakamalaking korapsyon ng Congress nila doon ay yong mga lobbyist na nagbibigay sa kanila ng pera at maraming pang ibang pabor.
Bakit nagkaroon ng ganitong batas sa Pinas na kontrolado ng presidente ang pork barrel at direkto din na maglagay ng meyembro ng korte suprema? Dahil yon ang dikta ni Cory noong revolutionary government kuno.
Expected sa Lower House na ma-impeached ang kambal ni Gloria. Sana sa Senado ay mag-isip ang maka-Gloria na no way na pagpasensyahan ng publiko sakaling vote NO sila. Hindi malilimutan kung paano sila boboto sa impeach issue na ito, singilan blues sa election.

Indeed watching, listening tirelessly last night on this historic impeachment trial of Merciditas Gutierrez for a couple of hours was not put in vain. Galit na rin ang mga Senador sa kanay dahil sa palpak na plea bargaining ni Garcia.At nag recommenda na i impeach si Maldita mahigit 14 yata iyung pumirmang senador kaya finish na si Maldita.

Corruption in the INC?
The news about the Iglesia ni Cristo (INC) lobbying congressmen to desist from voting for the impeachment of Ombudsman Merceditas Gutierrez is very disturbing. Support for Gutierrez actually means support for Gloria Arroyo and her cabal.
Everyone knows that the INC is a monolithic sect that is politically very influential. The fact that it demands favors from those candidates it successfully helped win elections is well-known. But that’s par for the course.
What is disturbing is its tendency lately to lobby for persons who are not exactly deserving, to put it mildly. The lobbying for Gutierrez, if true, is a prime example. The support that it has given and still is probably giving to ex-foreign secretary Alberto Romulo is another.

Oo nga ano Cocoy, si Pineda na ang kabarkada ni putot kaya walang delihensiya si Lito sa Pampanga. Yung dalawang retirees (Joker at Angara) ang nakikita kong baka sakaling papanig kay Maldita. Si Zubiri malaki ang utang na loob niyan kay putot at na-magic nila yung pagkapanalo niya. Salamat sa “soup” ni Abalos sa high class na hotel.
Di talaga nag walk-out si Aling Gloria nung nagbotohan sa plenaryo. Naihi siya sa panty sa kaba at takot kaya siya nag “may I go out”. 😛

Huwag lang sana maging tulad ito ng nangyari sa panahon ni Pangulong Cory Aquino na sa dami ng kalaban at kinalaban hindi makausad ang gobyerno.
Suggestion sana sa prosecution para lumakas ang kaso nila, ipakita nila based on statistics ang conviction rates ng mga previous at present ombudsman. Alamin kung within the average ba ang conviction rate ni Ombudsman Gutierrez. Alamin din kung gaano nga ba katagal ang proseso ng pag-imbestiga hanggang sa pag-file ng case on the average sa Office of the Ombudsman. Kung matagal, paano mapapabilis ang proseso? Kailangan bang maghain ng batas ng Kongreso para mapabilis ang pag-usig? Di ba yang mga kongresista natin, ilan dyan me pending cases sa Ombudsman? Si Neil Tupas, ilang years na ang kaso nya sa Ombudsman? Normal ba na hanggang ngayon wala pa ring desisyon sa mga ganoong kaso?
Mahirap ding ibatay ang impeachment sa hindi natin gustong naging desisyon ng Ombudsman. Halimbawa ang Pestano case. Negative ang desisyon ng Ombudsman doon. Dapat bang ma-impeach ang Ombudsman dahil taliwas sa opinyon ng publiko ang decision nito?

If this news of the Iglesia Ni Cristo (INC) influencing congressmen to vote “NO” for Merci Gutierrez impeachment was indeed true then why they are no heavy reactions among the congressmen, senators, print & media practitioners to critize INC’s move? This is clearly a violation of separation between church & government.
A lot of our legislators in the past issues such as the recent controvercal RH Bill attacked the Roman Catholic church of meddling state affairs and even coercive threats to our church leaders inorder to mellow their position. Yet, the church stand is only for the good & enlightenment of its flock like a parent who wants only for good his children, no hidden agendas, whatsoever.
But I am not surprised if this is true, since INC has been publicly doing this kind of dirty tricks for so many years (forgive me of the word) specially during election time to support a certain politician in one block eventhough this politician candidate is not an ideal leader. I just wonder what is the favor ask from this officials once elected. Is’nt this also a shameful practice?
