No closure without truth about ‘Hello Garci’

I don’t know if Sen. Alan Peter Cayetano has a hidden agenda in questioning the refusal of Chairman Sixto Brillantes of the Commission on Elections to his call for revival of the investigation on the “Hello Garci” scandal but I see the merits of his proposal because all the anomalies that are now coming out can be traced to Gloria Arroyo’s original sin which was stealing the presidency.

Nothing can be more eloquent than the fiery accusation of Susan Roces, widow of Fernando Poe Jr.: “You stole the presidency not once but twice!”

All that Arroyo could say was, “I am sorry.” To this day, we don’t know what she was sorry about.

FPJ was the second victim of Arroyo’s theft of the people’s mandate. The first was Joseph Estrada, from whom Arroyo grabbed power in 2001 with the help of civil society groups that have since discovered her true colors and have become her critics.

Cayetano is also questioning why two of Gloria Arroyo’s dependable lieutenants (there were a few more, media investigation showed) in the manipulation of the 2004 elections, former Comelec Chair Benjamin Abalos and former Comelec Commissioner Virgilio Garcillano were able to get their retirement benefits.

“Both Chairman Abalos and Commissioner Garcillano were able to get their retirement benefits of P2.9 million and P3.1 million respectively. Not only that but their monthly pensions trickle in regularly,” he said.

He said further: “They were instruments in cheating the Filipino people, but now we are paying them continuously.”

Cayetano does not find acceptable the lame excuse of Brillantes, who ironically was FPJ’s lawyer, that the clearing of Abalos and Garcillano happened before he became Comelec chair.

Nor is the senator convinced by the justification of Comelec spokesman James Jimenez who said the Commission had investigated the scandal and found nothing to prove the guilt of the two and other Comelec officials.

“What would you expect from an ‘investigation’ under the Abalos commission?” Cayetano asked.

At least five plunder charges have already been filed against Arroyo. Well and good. But she has not been made accountable for the greatest theft that she committed which was the stealing of the people’s mandate in the 2004 elections that has spawned a number of crimes against the Filipino people.

It should be recalled that since she took the presidency in 2001 without being elected by the people, she was anxious to get an electoral mandate.. As revealed during the investigation of the “Hello Garci” controversy, Arroyo diverted public funds to finance the massive operation to subvert the electoral process in her favor.

Political analysts observed that Gloria Arroyo must have spent at least P10 billion for her grand electoral heist.

Sources of her 2004 election operation included P2 billion for agriculture including the P728 million for fertilizer; the road users tax, the PhilHealth fund, and public works money. As the Aquino team goes through the documents, we are now seeing proofs of what were just being talked about before: the use of money from the Philippine Amusement and Gaming Corporation and the Philippine Charity Sweepstakes Office for Arroyo’s personal interest.

The subversion of the electoral process started long before Election Day with the tampering of the voters list and bribing election supervisors.

But they were shocked when the election results came in that their massive cheating operation in the Visayas and Mindanao were not enough to offset the lead posted by FPJ. That’s when the Arroyo called on Garcillano to produce more votes.

Recall this conversation between Arroyo and Garcillano 9:43 a.m., May 29, 2004:

Garci: Ok Ma’am. Mas mataas ho siya pero magcompensate po sa Lanao yan.

GMA: So I will lead by more than one M, overall?

Garci: More or less, it’s the advantage Ma’am. Parang ganun din ang labas.

GMA: It cannot be less than one M?

Garci: Pipilitin Ma’am natin yan.

To accomplish that, with the help of the military, the election operators tampered the certificates of canvass which were the documents used in the congressional canvassing of votes for the presidential and vice-presidential race. That’s where the crucial “Noted” of then Rep. Raul Gonzales (who later became Arroyo’s justice secretary) and Sen. Francis Pangilinan paved the way for the rushed proclamation of Arroyo as winner.

The cheating operation did not end there.

When FPJ filed an election protest, Arroyo and her operators were worried that when the election returns would be opened, the tampering of the COCs would be exposed. So they launched another major operation to manufacture fake ERs to match the tampered COCs.

The fake ERs were then brought to the Batasan where the genuine ERs were being kept. The switching operation was carried out by members of the Special Action Force (SAF), an elite combat unit of the Philippine National Police.

Arroyo’s cheating in the 2004 elections has spawned many more crimes against the Filipino people. Why else was Abalos involved in the $329 million NBN/ZTE deal but as a reward for job well done in the 2004 elections?

Why did the Ampatuans of Maguindanao, who delivered the needed votes for Arroyo and her candidates, believe that they could act with impunity that murderous day in November 2009?

A number of military and police careers and lives were shaken by Arroyo’s enlistment of the uniformed personnel in rigging the 2004 election, something that not even strongman Ferdinand Marcos dared to do.

There cannot be closure to all the scams in the Arroyo administration unless we know the truth about the “Hello Garci” operation.

    With hidden agenda or just being a patriot, I support Cayetano in his call for the reinvestigation of Hello Garci scandal. It is only when there is closure to the original sin of Gloria Arroyo that the country can move forward towards the “matuwid na daan” of Pnoy.

    Why does Sixto Brillantes not want to put an end to the Hello Garci operation when “To this day, we don’t know what she was sorry about.” ?

    Mismo! Now that Cayetano made the first move to make someone accountable for the “greatest theft” in Pinas history, the Comelec chief himself refused to open the issue. Hinayupak na Brillantes, kesyon nandyan sya sa Comelec?!

    Abalos got P2.9 million while Garcillano got P3.1 million retirement benefits out of our own pockets. Those numbers were apart from the ‘komisyones’ granted to them by their corrupt patrona Gloria which also were taken from us. Sobra-sobra na tayong nadaya nyan a!

    Zaldy Ampatuan who wants to be a state witness says he was an insider in the 2004 election cheating. In the killing spree, de Lima says he may not qualify to be a state witness. I wonder if he qualifies on the election cheating operations in the 2004. Sabi ni Zaldy, hanapin daw si Bedol as he knows the whole operations. Kaso mo nawawala na si Bedol. Baka 6 ft under the ground na siya. The midget will not allow her wrong doing uncovered.

    Kahit na hindi na natin malaman kung papaano nandaya itong si Midget, with all the plunder cases filed against her, kahit na isa lang dyan ang mag-stick at makulong na siya, happy na ako. I just want all her assets frozen and eventually taken back to help the government. Lahat ng ninakaw niya ay dapat maibalik. I also want her cronies to be jailed and stripped of their stolen goods.

    And how to get to that elusive truth? In my many experience that when all other failed to get to the Truth, the Public usually will demand a Judicial Inquiry of the blameless kind for the sake of getting to the truth…it could be for the legislative measures…for closure to the Parties affected or for public interest…the Judicial Inquiry is a very tedious process, not for those who wanted an Instant Replay…some of them lasted a year or more but the Mandate of the Inquiry most of the times were achieved..and we moved on.

    I think Zaldy Ampatuan never said he wanted to become “state” witness. It was only the media who said so. His lawyer in an interview said that his client didn’t want to become one. He said that applying to become state witness is admitting guilt. He will be a witness for the defense though.

    If you offer to become state witness, you should know about it (crime). He’s saying now that he has nothing to do with the massacre. That would be contradictory to our witnesses who pointed to his involvement in the planning stage,” she said.

    But De Lima said the DOJ might reconsider its stand on Zaldy’s offer should the latter plead guilty during his arraignment and formally apply to become state witness.

    It is good to be reminded of the Hello Garci episode once again. This is probably the biggest original sin of Gloria. This paved the way for her and her mob’s rampage and plundering ways.

    This issue must be pursued. And this Brillantes has no right to sweep this under the rug. He should not be in Comelec if continues to adopt this stance.

But if it’s all just to grandstand to obtain something in return, then I suggest he had better just keep quiet

    If there is a need to make an example of someone that we are committed to stamp out corruption it should be not less than Gloria. Let us make corruption so shameful that committing it will mean suicide for his/her name, and that future generations of family will suffer the stigma.

    Not discussing the merits, this calculus can also be employed in the evaluation of whether or not Zaldy Ampatuan may be accepted into the witness protection program.

    Any person who has witnessed or has knowledge or information on the commission of a crime and has testified or is testifying or about to testify before any judicial or quasi-judicial body, or before any investigating authority, may be admitted into the Program:

    Section 3, RA 5981

    Under section 3, Zaldy seems to be qualified.

    It is the application for discharge (prosecution is stopped) as a state witness that there is a requirement that the applicant be not the most guilty. But under both RA 6981 and Rule 119 Section 17, there is no requirement that the individual applying as state witness should plead guilty.

    In fact, under Section 18 of the same Rule 119, the discharge operates as an acquittal. How can you acquit one who pleads guilty, as De Lima stated?

For as long as this initiative would eventually make Gloria and her ilk brought to justice and then incarcerated for ten life terms (minus five life terms for good behavior), that is all I look forward to.     I understand where Cayetano is coming from. It’s all about politics in Taguig where his wife is under protest as Mayor.

    What I can not understand is Brillantes’ refusal to revive the Hello Garci investigation. He was FPJ’s lawyer in his protest and being the lawyer he should be the one spearheading for a reinvestigation to bring out the truth and let justice be served to FPJ, his client as the president that never was.

    It’s now a case of being moot and academic, FPJ is dead, but all the perpetrators of the crime masterminded by Gloria and Mike are still out there, some are receiving pensions which should have been forfeited and some are still active officers of the Comelec and only God knows what they will do again during election time.

    Such is life in Philippine politics; criminals roam free with all their stolen wealth and power as long as they have the right political connections and money to buy their freedom.

All the plunder issues are fine and must be pursued..but priority should be given to her greatest crime of treason for being a co-conspirator in the rape of the constitution in the illegal ouster of a sitting President. This is not about Estrada, who is merely one arguably forgettable historical personality, but about the desecration of the Office of the President…and raping democracy by stealing the right of 11 million filipinos who chose Estrada as their President. Ironically, Arroyo herself confessed to committing this treason…on nationwide Television! where she arrogantly recounted how she plotted with the military generals the ouster of the President…”from day 1″ of his administration. Surely, there must be a video tape of this self-confession. I suspect, aside from being drunk with the success of their conspiracy, it was a scheming way to make sure the military generals would not as soon turn to do the same thing to her (in case the US decides it to be so). A sitting Vice President plotting the ouster of the sitting President “from day 1” cannot be anything but TREASON…no matter how they pulled off through manipulation of perception their “Emperor’s New Clothing” act of passing off the treasonous rebellion as normal “constitutional” process. The collusion of Arroyo and other political leaders with the right wing military is understandable…but the Supreme Court joining the conspiracy by legalizing the treasonous act is simply abominable. (Clearly, a gun must have been pointed on their heads to make them act so shamelessly ignorant as to proclaim Estrada as “constructively resigned” based on hearsay evidence as flimsy as Angara’s Diary as exclusive perceptual basis…this even in the absence of a written resignation, AND the presence of a letter to Congress asking for a temporary leave of absence as required by the constitution…

    Our constitutional Democracy has been twice raped by the Arroyo cabal! But the most pathetic thing about Arroyo is that she cannot even claim to be the worst President of this country…for she has never been constitutionally President!

    I do not know about the likes of Garci and Bedol. Yang mga yan nabayaran na ng milyones. It is not easy to rig an election. For these two, they must have done it for a promotion or big bucks. Nagyon gusto pa nilang dumulihensiya ulit, kay Pnoy naman. Pnoy has to be very careful in protecting these criminals. I hope he does not encourage these criminals to be state witnessess and be scott free to take advantage of a corrupt system again. Dapat, sariling kayod siya sa paghahanap ng mga ebidensiya at huwag na lang aasa sa mga kriminal na ito para sa katotohanan otherwise, it defeats the purpose of real justice.

    ONE does not need a magnifying lens to know that the economy is improving after it was brought to its knees by the previous regime.

    The indicators tell it all. Unemployment is down. The number of hungry people has been reduced by one million.

    Foreign direct investments have helped swell the international reserves. Inflation rate is half the double-digit level.

    The banks have never been this strong and are fiercely fighting for a bigger share in the whole spectrum of the borrowing market. The trend towards lending money to small and medium scale industry is almost irreversible.

    The interest rates are kept at levels that would leave the borrowers a little more room for profits.

    Sana nga Jug, Macasaet is right in his assessment. Personally, I am holding off in judging Pnoy. Pnoy is not perfect but he seem to encourage some positive development is all aspects of governance. I like the fact that the corruption issues in bansot’s time are coming out quicker than we thought.

    Again, if Pnoy can cut corruption by only a third of what it used to be, I will be very happy for the Filipnos.

    Did anybody bother to do the math at all?

    The deal was that the PCSO will buy 42billion worth of paper in span of 50 years?

    This is a lot of paper, just how much is our total paper consumption (Philipines) is for a whole year?

    Somebody is lying here, someone needs to ask the right questions, it seems that nobody in the senate has any idea about paper.

    MANILA, Philippines – Almost P50-billion worth of anomalous contracts involving the Philippine Charity Sweepstakes Office (PCSO) have been submitted for investigation in the House of Representatives.

    Bayan Muna party-list Rep. Neri Javier Colmenares revealed that an approximately P42-billion worth of thermal paper contract was entered into by PCSO and an Australian company TMA. The contract had a life span of 50 years.

    Colmenares questioned the rationale for the agreement being tied up for half a century, and alleged that the contract was approved without proper bidding procedures.

    Former PCSO Chairman Manoling Morato was quick to deny the allegations. He said the contract was legal and was even approved by the NEDA due to the benefits the government will gain. Morato said the contract includes provisions that the company TMA will build its thermal paper production plant in Clark, Pampanga without cost from PCSO. He added that the contract includes a 20% commission for the PCSO on every sale that the TMA will get from abroad.

    Morato explained that even if thermal papers quality improves in the next 50 years, TMA will be the pioneering company to produce such since they are the global leader in thermal papers.

    “They are the best in the world, walang ilalabas na pera ang PCSO, sila gagastos sa P3 billion plant na itatayo nila, bababaan nila presyo, at lahat ng benta all over the world, may commission na 20% ang PCSO,” he added.

    Morato also said TMA products’ quality is way better than any local and international competitor.

    “Ito isang taon hindi kumukupas ang mga numero, yung ibang thermal paper 3 months lang nabubura na ang mga numbers,” he added.

  62. jug, at current prices of $800-$1000 per ton of kraft pulp, which easily could cover overwhelmingly the material requirement for lotto tickets for one month (or about P40,000/ton for every month), but at P46B, the PCSO has contracted to buy thermal paper enough to last for 100,000 YEARS!

    it looks like a rip off really, the monthly paper consumption for this enduse could easily be just 100-150 mt @ around 1000-1400usd/mt because this is specialty paper. paper costs now are 900-950usd/mt foe uncoated woodfree (imported bondpaper) and 860-880usd/mt for coated (used in glossy magazines).
