Corona is finished

As I was writing this piece, Supreme Court Spokesman Midas Marquez was having a press conference announcing the Temporary Restraining Order that the High Court issued against the Senate, seating as an impeachment court, to subpoena information on the foreign dollar account of Chief Justice Renato Corona.

The vote was 8-5-1. Corona inhibited.

As to the petition of Corona to stop the his impeachment trial, no action was done because when it was raffled Wednesday, it went to Associate Justice Presbitero Velasco, who inhibited because his son is a member of the House of Representatives from where the Corona impeachment emanated.

Whatever would be the final decision on the Chief Justice’s dollar account or accounts, Corona is finished.

In last Wednesday’s hearing, PSBank President Pascual Garcia revealed that the five peso accounts of Corona as of Dec. 31, 2010 contained P19,728,555.39.

Yesterday, the manager of the Bank of the Philippines Island, Ayala branch testified that as of Dec. 31, 2010, the balance of Corona’s checking account with them was P12,024,000.67.

What has been revealed in the impeachment court was that as of Dec. 31, 2010, Corona had about P32 million in the bank.

Corona stated in his statement of assets, liabilities and net worth (SALN) for 2010 that he had only P3.5 million in cash and investments.

The huge discrepancy is glaring proof of dishonesty.

There is a side issue on the legality of the sourcing of the bank records of Corona which was the basis of the impeachment court’s subpoena. However this particular issue would be resolved in line with theory of “fruit of the poisoned tree”, the prosecution has scored a victory by showing what seems to be the untruthfulness of Corona.

To the senators-judges, the impression created by this damaging information carries a lot of weight.
We understand the voting by the senator-judges on the issuance of the subpoena for Corona’s bank deposits during a caucus was close. That does not bode well for Corona because if the administration allies were able to get a majority in a closed-door environment, where the senators would not have to worry about a public’s backlash, he is in danger of conviction in the final voting.

No wonder Corona ran to his colleagues in the Court for help. He asked for a TRO, both on the opening of the dollar account and the cessation of the impeachment trial. He got a TRO on the first petition but not on the second.

Lawyer Teddy Te, who follows closely the impeachment proceedings while based in New York, is of the view that Corona is near surrender.

“From a tactical point of view, the Corona petition is almost the white flag–almost. The allegation about ‘grave abuse of discretion’ by another branch of government is, I think, deliberate: to avoid an outright dismissal on the ground that it is a political question. The re-allegation of the insufficiency of the impeachment complaint is also, I think, deliberate: to allow this petition to be consolidated with the other pending petitions to stop the trial and also to confer standing in case the standing of the other petitioners (Lozano, Paguia, Adaza, Millora, et al.) is denied.

“ From a purely academic point of view, however, the Corona petition is a mother lode of ethical and legal issues that would keep every law class occupied. Some interesting questions that the petition raises, for instance:

1. Is it ethical for a sitting Chief Justice to ask for relief from the very Court he leads and from which he has not taken leave?

2. Is it ethical for a sitting Chief Justice to not disclose in his petition that the documents and testimonies subject of his TRO application are NOT YET ADMISSIBLE as they have yet to be formally offered and considered?

3. Is it ethical for a sitting Chief Justice, who should be primus inter pares (first among equals), to ask for inhibition of two of his fellow Justices?

4. Is it ethical for a sitting Chief Justice to treat the public office he holds as his personal “property” such that he should invoke the due process clause (which covers ONLY life, liberty and property)?

5. Is it ethical for a Chief Justice to not say “no” to the petition in light of all of the above?

    I love the title Ma’am Ellen.

    TRO has now indeed become the tool for the rich but corrupt who wants to get away from Justice. To have it their way, not the right way.

    What Corona did is exactly that. He became the very same rich but corrupt man who is running away from Justice.

    That very fact is enough for people to say (simple or brilliant mind), he does not deserve to be Chief “Justice” or a mere “Justice” for that matter.

    On a side note, Corona is no man of words. As TT pointed out, the nation want the Pesos he promised he will give if we found it. A small lady also showed us the Dollars, which he is obviously trying to keep. Wala sa salita si Corona!

    I think Corona’s attempt now maybe to say the money is from his family. His daughters for the dollar account, and his wife for the pesos. Without a monthly or detailed transaction list, he can run to that excuse.

    This seems to mirror the opinion of the guy who cut the Bible with the Hilarious Divided, in an article recently written.

    Impeachment does not involve Corona’s life, so walang due process. Tumpak.

    Liberty is not involved, because Corona is not in danger of incarceration; impeachment only extends to removal. Tumpak na naman, no due process is necessary.

    Employment is not property (public office is a public trust), so no due process pa rin.

    So the hell with due process, lynch the SOB.

    Nice logic.

    BUT.

    While the soundness of the assertion that a public office is a public trust and as such not amounting to property in its usual sense cannot be denied, there can be no disputing the proposition that from the standpoint of the security of tenure guaranteed by the Constitution the mantle of protection afforded by due process could rightfully be invoked.

    Now on the concept of liberty, Morfe v. Mutuc also declares that:

    liberty as guaranteed by the Constitution was defined by Justice Malcolm to include “the right to exist and the right to be free from arbitrary personal restraint or servitude. The term cannot be dwarfed into mere freedom from physical restraint of the person of the citizen, but is deemed to embrace the right of man to enjoy the facilities with which he has been endowed by his Creator, subject only to such restraint as are necessary for the common welfare.” In accordance with this case therefore, the rights of the citizens to be free to use his faculties in all lawful ways; to live and work where he will; to earn his livelihood by any lawful calling; to pursue any avocation, are all deemed embraced in the concept of liberty.

    If Corona were convicted, he would be ineligible to work in government. So he would not be able to teach at the Batangas State University, were he inclined to do so. So clearly, this impeachment affects Corona’s liberty to seek employment in government.

    Due process is still required, despite the contortions of experts.

    Additionally, the opinion by one who is now an ordinary citizen. Ranged against that, is what I cited above, which is a Supreme Court decision en banc.

    Why don’t we cut the Bible again? We might get better guidance this time, about the restoration of Zion?

    This man in robe who robs the people know exactly that his dollar accounts are safe. The Supreme Court knows that the dollar accounts are hollier than thou. Kaya lahat ng walong nagpa TRO sa pagbukas ng dollar accounts ni Corona, pihadong may maraming dollar accounts. This law should be repealed. It should not be used as a hiding place for corrupt officials to deposit their loot into. Dapat may limitations ang mailalagay sa bangko na dollars for officials who has the power to amass wealth. Can you just imagine if all these corrupt officials have dollar accounts that can not be touched! The Philippines will trully be screwed! The Filipino people will be left with just crumbs of Filipino pesos. Mas maraming di hamak ang naka-deposit sa mga dollar accounts nila. The law makers along side with the financial big hanchos should repeal this outdated law of not being able to look into the accounts of suspected crooks. This is why corruption never stopped coz the most corrupt ones know where to hide the stolen money.

    Why even go through the impeachment process if the key evidences are suppressed?

    Judging from the questions of the two Cayetanos, they are now starting to shoot questions hinting that they want to know the truth on Corona’s amassed wealth while in the Supreme court. Biruin mo kung ilang kaso nga naman ang dumadaan sa kanila. Imagine how much money can be given to each and everyone of these justices if they are corrupt. Kaya naman pala, halos lahat ng mga malalaking isda ay nananalo and the poor people like the laid off PAL employees lose.

    The more Corona and his justices suppress his dollar accounts, the more likety he is perceived to be hiding more in those accounts and the more guilty he looks in the eyes of the people. Mas lagot siya talaga sa mga Senator judges. Di ba sinabi na nga na quasi political ang impeachment trial? It will not be based on evidences but more on the judgement of the people. Siguro ang mga boboto sa kanya na senator judge na hindi siya guilty ay yung mga may kaso sa supreme court who would benefit by keeping a corrupt chief justice.

    It would be interesting to see how the Senate will react to the TRO. Bakit nakikialam ang Supreme court sa impeachment court. At least, pampalubag loob, inuupuan ng Supreme Court yung desisyon na hindi ituloy yung impeachement. Akala siguro ng Supreme Court eh mas supreme siya sa impeachment court. Yan ang obvious na obvious sa Arroyo Supeme Court. They have to save the corupt Supreme Court so they can save their queen pandak later.

    Hinusgahan mo na Ellen si CJ Corona eh hindi pa naman tapos ang impeachment proceedings. Hindi pa nakapagbigay ng side ang defense. Hindi ba sabi ng defense they can explain or justify the discrepacies, eh bakit ganyan?

    Ang explanation nila diyan ay dahil para silang daga o pusa na nasa corner ngayon. Kung nanonood kayo ng tv, maraming motion or objection si Cuevas pero hindi siya allowed to argue with the senator judges. So kahit na very obvious na ang ilang judges ay parang sila ang prosecutors, hindi maka object ang defense. Nasaan ang fair go?

    Please kung hindi ninyo napapanood ang proceedings at mga yellow media lang ang base ninyo, ganyan nga ang mangyayari, guilty na di pa tapos ang boksing kung baga.

    Martina, araw araw, gabi gabi pinapanood ko ang trial. The reason why Cuevas can not do so much is because the impeachment court has its own rules. Pati nga prosecution eh ilang beses ng binabara at sinasabihang mga sisiw lang sila. It just happens that the evidences are so glaring on how Corona divulged his assets in the SALN. I am not with the yellow army but I can see the point of cleaning up our government of corrupt officials. If Corona stays with his gang of 8 (all appointed by the pandak), imagaine what will happen to all the cases of the pandak! Lusot lahat ang mga kaso niya. Hindi ka ba nakakahalata na ang mga kaso ni pandak kung naka-fila sa Supreme Court ay instant resolution kaagad? Imagine that Corona had to virtually take the next plane to Manila from the US so he can sign and possibly influence the gang of 8 to sign in favor of the pandak’s TRO.

    Huwag tayong bulag. I do not like injustice but in this case, gusto kong malinisan ang mga institutions natin na sinira ng husto ni pandak. It is an uphill battle for Pnoy to clean the rotten system. Kung gusto talaga nating umunlad ang ating bansa, bawas bawasan natin ang mga magnanakaw sa gobierno. STOP PROTECTING THE DOLLAR ACCOUNTS OF corrupt politicians!!!

    Sa tinatakbo ng impeachment ay makikita mo na naman kung ang isang tao ay Guilty or hindi eh. I base mo na lang sa mga nakitang ebidensiya. Milyones ang binayad sa mga ari arian at almost 30 millions pesos pa ang natitira sa dalawang bangko. Siguro ang mga bulag lang siguro at kapwa magnanakaw ang mag sasabi na hindi nag nakaw ng pera or malinis si Corona.

    Kahit sa Boksing, kahit hindi pa tapos ang laban ay nakikita mo na kung sino ang mananalo sa laban.

    Dito sa US mag-remit ka lang ng more than $ 1000 marami ng tanong tanong. Saan mo kinuha ang pera, ano ang trabaho mo at kung saan gagamitin ang perang ipadadala mo sa Manila. May check and balance. Sa atin sa Pinas, tila baga ang mga bangko ay bulag. Look at what happened to Garcia, Reyes atbp. They were able to hide their loot in these dollar accounts. Bakit ganun na lang ang pagka-pursigido ni Corona to prevent the Senate from knowing his balances in these accounts? This only means one thing to me, that he has just as much or even more in dollar accounts than in his peso account. Alam niya kasi na hindi mabubuksan ang mga ito ng basta basta.

    Another thing too why Cuevas can not talk anymore is the overwhelming evidence on Corona’s concealment of his assets. Tameme siya. Siguro laking sisi ni Cuevas kung bakit ipinagtatanggol pa niya itong si Corona. Sabagay sa mga lawyers, the guilt is sometimes not even an issue. It is their winning the case that matters more. The more challenging the case is, the more they shine.

    The impeachment process is just but for the removal of the official under the law and it will not Absolve the individual for further proceedings criminal or civil and other sanctions that may results from such. yet he is still entitled to all his Legal rights under the bills of rights as guaranteed.

    But there must. Be a better way of doing this process than it is being done now. Most of the evidence presented in the trial are of evidence to support Criminal acts and not the conduct for which the official is to be removed. as the constitutions guarantees equality, the chief justice chould have. Been investigated for criminal wrongdoings. Graft, Launderings. Possible Bribery, tax evasion.

    ang duda ko is that yung dollar deposit gagawin nila ng paraan sabihin, sa mga anak nya talaga yan, pangbayad sa condo. pero since wala sila sa Pinas, si daddy CJ na bahala. Believable, maybe? Truthful, no way!

    Dahil the proof is the transaction slips or itemized remittance or bank to bank transaction.

    I also would give Corona the benefit of the doubt that the money in the accounts are not his. Well itemized nya. Tell us. Pero ayaw. Puro resistance. Puro irrelevant.

    If the item is under your name, legally its your property. The very fact si Corona ang account holder meant si Corona has the legal authority to do what he please with the account.

    The very fact his team is are now blocking and seeking home court relief meant only one thing….:

    Corona is hiding something.

    Wag na sya umiyak. Face it like a man. Diba may takot sya sa Diyos?

    Kung physical therapist ang anak ni Corona, she or he may make good money but not capable of buying properties for multi millions. Again, in the US, when one is buying a house, only a third of what one makes is the money allowed for ones mortgage payments. So, granting na masipag ang anak niyang magtrabaho, a therapist can easily make anywhere from $ 60000 to $ 80000 unless he/she is a sports therapist. Big time athletes here need a lot of theraphy specially after play season. They have a lot of injuries. Let us take the higher average. The allowed monthly motgage here is only about $ 2,200. This would buy a house in the $ 300000 to $ 350000 range only. Then a third of the income will go towards taxes and a third is supposed to go to food, clothing etc. Kung matipid ang anak ni Corona, she/he may be able to at the most give the father $ 1000 per month if she /he has a loan. This should be about 40,000 to 50,000 pesos per month. The total will not even be a million a year. Kahit na sabihin natin na sampung taon na ang ank niya sa US, still the money he has in his bank accounts in pesos will not be justified by the daughter’s income unless of course paid all cash na yung bahay ng anak dito sa US and all her money were sent to the Phillipnes for the past 10 years. I doubt so much though that the daughter sends so much moneyh to the dad. Super social kaya ang mga anak ng mga nasa pwesto ang mga magulang sa Pinas. Baka puro LV at Hermes bag pa ang mga gamit ng mga yan! Big time si daddy eh!

    In short, may hocus fokus ang yaman ng mga Coronas. We need to know where it came from. Malay natin may mga patago si bansot kay Corona. Di ba lahat na lang ng mga opisyales ni pandak ay ginamit niya sa kanyang pagnanakaw?

    All those who were close to bansot somehow got caught. I still want asspweron and all the other generals who helped her in her cheating operations have their day in court too. Tahimik lang ang mga ito praying that the long arm of the law wont catch them. But I am optimistic that they will one day be answerable for doing the dirty job for her.

    In any event that a grave abuse of authority is committed, a court is formed to determine if the abuse of authority warrants a removal from office. This court that will be convened is the “Impeachment Committee”. This committee is the voice of the people, for the people and by the people. In summary, the “Impeachment Committee” is beyond the Tripartite System and is above it.

    In a Democracy like the Philippines, it is not the President, Politicians or Judges that are the supreme authority but us. The people’s voices remain the highest authority.

    In other words, the Supreme Court has no right to tell the “Impeachment Court” what to do.

    It irks me to think that the Supreme Court acts as if it was above the “Impeachment Court”. Someone should tell them that they are servants of the people and not the masters.

    He is finished because people have already decided without listening to the other side. The prosecution still has to finish presenting its evidence; and the defense has not even begun to present its own.

    People have already decided because even so-called legal experts have advocated dispensing with due process, arguing that impeachment does not affect Corona’s life, liberty, or property, despite Supreme Court decisions to the contrary. They say the impeachment is sui generis. To me, it is these experts who are sui generis.

    Most lawyers I know will find reason to employ the principles of due process to any dispute, even squabbles between their teenaged children. But the experts will have none of it, opining that ordinary people cannot be bothered with technicalities.

    But other ordinary people do work with technicalities every day. The thousands of jurors rendering verdicts each day on civil and criminal cases in the US attest to the fact that ordinary people can work within the confines of these “technicalities”. This is not unique to the US. Neighbor Hongkong employs the jury system; so does mother Spain. Their jurors all suspend judgment until all evidence is in.

    Due process is not a technicality, as many partisans opine. It simply requires that one listen to both sides before deciding; that one gives the accused the meaningful opportunity to be heard. But how meaningful is that opportunity, when the judge has already made up his mind before listening to the accused?

    Maybe Corona’s evidence will be a reasonable explanation. Maybe it will only be a palusot. But a fair judge will suspend judgment until he has heard; to determine whether the evidence of the accused is reasonable, or a Sophistic excuse.

    The media abets this rush to judgment in the various surveys asking whether or not people believe that Corona will be convicted. One might finesse this issue by stating that I am only asking for their belief. But the question impliedly asks the people to already decide, before all evidence is at hand.

    I thought media was one with the principle of due process, based on the journalistic ideal of presenting both sides of any issue. But when one asks for judgment before the other party has aired its side, media becomes a partisan instead of an agent for journalistic ideals.

    Yes Corona is finished. So is our desire to develop a mature citizenry. And we are finished because the sui dissant intellectuals encourage the people to take a partisan stance instead of suspending judgment until the matter has been completely heard.

    Congratulations Benigno Simeon. You have successfully divided the country that your mother and father united.

    The Supreme Court only has the final say with regard to interpretation of the law. Now the Senate was interpreting RA 6426, kaya puwedeng iakyat sa Supreme Court.

    By being the sole authority to try, ibig sabihin, kapag nagpasya ang Senado, wala nang appeal. Tigil na doon. So if Corona is removed because of his ugly face, that’s that.

    Their authority is also with regard to the trial – no TRO on it. But interpretations of the law, that is the sole domain of the Supreme Court.

    Now the dollar account is just corroborative evidence. Napatunayan na, na may hindi inilahad sa SALN. Ewan ko lang kung bakit nagmamarkulio ang mga usyoso. Point proven na yan, the issue of non-disclosure, whether of a single peso account, or one hundred peso and dollar accounts, makes no difference as far as proof of the allegation that there was a failure to disclose.
