Questions on Aquino’s clearance of Naguiat

Iba na talaga ang Classmate.
President Aquino immediately cleared his classmate and friend Cristino Naguiat Jr of allegations by Wynn Resorts that he was the recipient of of the generosity of his former friend and partner Kazuo Okada.

Of course, Aquino later asked Executive Secretary Paquito Ochoa Jr. to investigate allegations of breathtaking gifts showered by Okada, whose Universal Entertainment Corp is building a casino at the reclaimed Manila Bay area, to Naguiat whom Aquino has appointed chairman ang chief operating officer of the Philippine Amusement and Gaming Corporation.

PAGCOR regulates and operates casinos in the country.

Malacanang has brushed aside the impropriety of the perks that Naguiat, members of his family including their nanny and other Pagcor officials got from Wynn Resorts in one of their visits to Macau (free accommodation in Wynn Resorts luxury suite, $1,673 dinner, $20,000 cash gifts, $1,878I Chanel bag which Naguiat returned) saying that’s “industry practice.”

In Tagalog, ganyan naman talaga ang kalakaran.

A friend forwarded to me a letter which raised common-sense issues on Aquino’s clearance of Naguiat. I’m sharing some parts because they reflect the sentiments of many I talked with:

“If there is a bribe-giver, then it follows that there is a bribe-taker.

“Regardless of where you are or in which country you belong, if there is an accusation of bribery, there should immediately be an investigation rather that clearing the alleged bribe-taker (and then ordering an investigation after the public cries foul of the exoneration).

“If this happened in Singapore, Malaysia, Hongkong or Japan, the person would have immediately resigned.

“ Naguiat’s excuse is that the perks are industry practices and that he stayed at Wynn Macau for business purposes. He also says that the license given to okada had been issued in the past, so there is no reason for bribing him. Let us analyze these excuses:

a. If Naguiat’s claims are true, why did he check- in the hotel with his party incognito? Why didn’t he register under his name or Pagcor? Who goes to a business meeting in a hotel and checks-in incognito? Sa pagkaalam ko, iyong mga nag-checheck-in incognito are those who engage in illicit activities.

b. They said Okada has been issued a license so there is no more reason to bribe.

“Look at the exhibits in the case. It says that the license given to Okada is only provisional until the completion of the project, when the regular license will be given.

“I believe Okada was playing it safe because he knew that when the new administration came in, all contracts entered into by the past administration will be reviewed. If you follow the claims in the complaint that Okada manipulated the ownership of the Philippine company that entered into an agreement with Pgcor for the entertainment city project, it’s expected that Okada would make sure that he is in good graces with the new regulators who will issue the regular license.

c. Pnoy stressed that the Chanel bag meant for Naguiat’s wife was returned.
“Take note of the details found in the complaint, i.e.- Naguiat insinuated that his wife wanted such a bag; Okada’s people bought the bag and showed it to Naguiat. Okada’s man later reported that Mrs. Naguiat did not like the bag and, hence, did not accept it.

“It was also stated in said complaint that the bag went to the wife of Okada’s representative.

“Question: Had Mrs. Naguiat liked the bag, would the Pagcor chair have accepted the bag? Why, in heaven’s name, did he to tell his host that his wife wanted a Chanel bag? Couldn’t he just asked one of his Pagcor people (who was with him) to go out and buy the bag with his own money, assuming that he did not have time to go out and purchase such a bag?

“It’s expected that the host would make sure that his guest’s needs are satisfied. So, when Naguiat made the insinuation about the bag, what would the host do,play dead-ma?

“Is this daang matuwid?”

  3. So much for the daang matuwid. For those who want to take a break from such lofty pursuits of daang matuwid and the loftier pursuit of making bantay that its really matuwid – there are things we can do where we can actually make a difference to some people.
    Help our poor fishermen who lost their houses during the fire in Navotas last Saturday, send food, clothes, money, etc. it wasn’t very news worthy it seems.

    Nakakahiya ka Naguiat! Masamang kalakaran ng mga nagdaan ayaw ninyong baguhin. Kung ganyan din lang na hindi masipa sa pwesto dahil sa klasmeyt e tigilan na ang pagmanalaki ng Aquino administration sa laban nito sa korapsyon.

    Nakakapagod na ang mga bribe-takers na ‘toh, masayadong weak ang mga pagkatao!

    Pnoy may be clean but what about his friends and associates?

    Pinapaikutan lang kaya siya? What does that say of him as a leader then?

    He is so defensive about his KKK. It diminishes credibility to his “matuwid na daan” campaign.

    This is his biggest weakness. So quick to find excuses for his appointees. The list is getting longer.

    How easy could it be to just say “Okay, we will investigate that immediately and let you know within a week or so.”

  8. It’s hard to tell if Naguiat is innocent or not.

    Okada is a businessman with a contract and a franchise worth billions. Something many businessmen would kill for. He tries to impress his Pinoy clients by flashing them his friend Steve Wynn who in the past have been very impressed with Pinoys practically run the hotel in Macau from top to bottom, and in Vegas too.

    But sadly, Wynn’s board disapproves of the Nayong Pilipino venture being a competitor of its Macau branch and Okada, a mere pachinko supplier cannot let pass the opportunity he decided to let Genuino, fronted by dummies, comprise the 60% “Filipino”-fronted portion.

    Okada’s Pinoy advisers surely told him Genuino and his boys are no-no to the new PAGCOR so he must do everything at all cost. That greed led him to use his position at Wynn’s to provide the same VIP courtesy to Naguiat as was, for years, extended to Genuino.

    The question now is, why did Wynn’s just very recently require their employees to attend these ethics seminars when they have been practicing the contrary since 2008 or even earlier? Did Wynn’s Macau finally realize it was facing a real challenge from Okada they bought back all his shares?

    There are many issues that need to be cleared by both Okada and Wynn. As to Naguiat, he better make up a good excuse fast because people are becoming impatient of Noynoy being forced the take the bullet for his men and not the other way around.

    In order for PeNoy to fully win the trust and support of majority of Filipinos he promised reforms and transparency by avoiding being bias. He should refrain from defending and acquitting his friends and political allies when caught in the midst of any anomaly even without conducting investigation while charging his purported enemies with no hesitation.

    PeNoy should not practice double standard as it pictures himself not different from the former (never elected) president widely despised by most Filipinos. Cases involving his allies should be tried and decided in proper court and not by his pronouncements of defense and acquittal. He should put an end on the contemptuous political culture that invites corruption and breeds animosity in almost all sectors of the society – “pagtanaw at pagbabayad ng utang na loob”.

    I hope the investigation whatever the out come should be implemented. Remember the hostage taking incident where De Lima was task to investigate? There are some recommendations but nothing came out of it. Oh well…

    Most Pinas politicians are corrupt and so is Okada and Wynn.
    Steve Wynn is under probe for his generous $135 million donation to U of Macau by the SEC (Securities and Exchange Commission), payable into a 11 year period. Las Vegas and the state of Nevada critics were quick to point out that a mere one million handout would not have raised an eyebrow, but $135m? What Wynn is getting in return is the main focus right now.

    Disclaimer: There’s no truth to the rumor that Wynn Casino and Resort is owned by Ilocanos and patronized by same.

    Wynn’s Macau is in fact a corporation registered in Cayman Islands – notorious for its reputation as country of choice of money launderers. Why not register in China or US? Is Steve Wynn expediting for a client by dumping all those cash in an institution such as U of Macau?

    Frigging 135 million dollars could have bought him a brand new university!

    Honestly, I doubt more the honesty and integrity of Wynn, the company, than Naguiat.

    Sus naman, itong si Wynn, parang hindi niya alam na ang Las Vegas is a “mafia” playground! Built by the mafias ang Vegas and until now, lahat na yata ng money laundering, prostitution atbp ay nandyan bukod sa gambling. So for Wynn to play clean, mukha yatang hindi bagay.

    My take is, na-underground siya ni Okuda. Whatever Okuda is cooking, baka hindi kasali si Wynn doon. Kaya tuloy pati ang mga kausap ni Okuda napasama sa gusot. But for Pnoy to say na industry practice ang ginawa nitong tauhan niya is contrary to his “matuwid na daan”. He should have at least investigated first before he opened his mouth.

  25. psb, Wynn was earlier supporting Okada on the project it is stupid to say that he wasn’t looking when Okada was cooking all these since 2008. Mas malalaki pa nga yung gastos nila sa panahon ni Genuino. But Okada was a good businessman. He pursued getting a franchise and a contract and he did. Akala nila Wynn siguro at first “hindi yan uubra, pachinko lang ang negosyo niyan, tayo casino-hotel, pag wala tayo wala na yang kontrata niya”. Kaso nga nabuking sila ni Okada na itatago na nga yung malaking pera ng Wynn’s Macau. Sinabayan na nila ng kaso sa Tate.

    Malas lang ni Naguiat inabutan siya ng away. Sabi nga ni Cong. Bagatsing dapat lang na ibigay nila kay Naguiat yung Villa 81. Sa high rollers pinatitirahan din nila naman yun ng libre. Kagaya ni Pcquiao, $200,000 pinatatalo sa Vegas sa gabi ng laban niya gasino na yun $6,000 na kwarto?

    I can’t find the gumption to condemn Naguiat no matter how I try, years in the pharmaceutical industry has taught me to wine, dine, bribe, undercut, manipulate cancellation of competitors’ PO, etc, etc.
    Naguiat swam with the sharks and he wasn’t ready for it thats all.
    Everyone has a price, its up to the closer.
    A free meal here, a free concert ticket there, free accomodations, free trip abroad, even volunteering to pay for hospital bills, organize parties, sponsor post graduate studies…

    Jug, naging trabaho ko rin yan nung nasa sales ako, wined and dined my clients, organized sports events for them (golf etc). Kung B-day ng client, may kasama pang party and free hotel rooms. There are perks talaga. But I am more interested with the under the table negotiations. Yung “lagay” sa mga decision makers ng mga projects coz this is the more corruptive practice. Kaya gustong gusto ng government employees and sobrang daming permits etc kasi bawat isang permit, lalagyan mo ang lahat ng mga nasa department ultimo clerk. Nandyan ang sobrang corruption! PADULAS, ika nga!

  31. Jug, PSB. You have to remember that Pagcor is not just a casino owner. it is a regulator.

    Industry practice? you are not required to practice that if you think there’s conflcit of interest. In media, it’s common that reporters accept money from sources. But if you are an upright reporter, you don’t do that.

    If you just go by industry practice, stop talking about “tuwid na daan” na.
