Acts of kindness to the fallen

Lawyer Edward Serapio, former presidential counsel during the Estrada administration, once told me when he was under detention in Camp Crame in connection with Estrada’s plunder case way back in 2001, that he was so grateful for the wife of then Philippine National Police head Leandro Mendoza serving him coffee when he surrendered early in the morning at the White House, the PNP chief’s residence.

One can imagine Serapio’s level of stress at that moment and he said Mrs. Mendoza’s act of kindness did a lot to calm him down. He said he’ll never forget it.

Yesterday, Sen. Juan Ponce- Enrile thanked the PNP for treating him kindly, allowing him to stay at the PNP General Hospital in Camp Crame upon his surrender last Friday and allowing him to have his check up at the Asian Eye Institute in Makati the next day.

At this time when the popular sentiment is to throw stones at all those accused in the plunder of people’s money (Enrile, Jinggoy Estrada, Bong Revilla et al), any act kindness to those who are down is the true essence of humanity.

It is not about the guilt of the accused. It is humaneness.

While we should be vigilant that justice is obtained in the pork barrel scam, we should also be conscious of the danger that in pursuing justice, we become hardened and lose our sense of humanity. That would be a tragedy.

The government is getting flak for giving the three senators and their co-accused a decent treatment.Never mind that it is not up to the lifestyle that the accused are accustomed to.With the whole room to each of them and an electric fan, that is luxury.

Those who have been a Philippine jail know the inhuman condition of prisons in the country.

A report by The Optional Protocol to the United Nations Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment (OPCAT) documents the “brutalizing” conditions in Philippine prisons and jail.

Part of the report says: “Extreme overcrowding is the most punishing aspect of doing time in jails maintained by the Bureau of Jail and Management Penology (BJMP), which is an agency of the Department of Interior and Local Government. In 2001, about 35,000 inmates were fighting for space in jails supervised by the bureau. Today, the number has jumped to 69,500.

“The jails in Metro Manila account for 22,000 inmates which is more prisoners than the official capacity they can accommodate. At the Manila City Jail and other prisons in the National Capital Region, inmates have to take turns sleeping on the floor.

“Based on government projections, the total jail population in BJMP-supervised jails could reach 89,000 in 2008, 101,250 in 2009 and 114,930 in 2010, way beyond the capacity of these holding facilities. These figures are only for the municipal and city jails which are under the care of the BJMP.

“Over congestion also brutalizes life in penitentiaries and in provincial jails. The projected populations of national prisons administered by the Bureau of Corrections, an agency of the Department of Justice and the jails maintained by the provincial governments must be as dreadful.

“Herding individuals in cramped spaces is cruel, inhuman, ill, degrading, and unjust punishment. Overcrowding is dangerous to health and to human life. It breeds diseases, breaks down discipline and exacerbates tensions. Having to fight for air and space 24 hours a day make prison, in the words of inmates, a living death.

“Add dirty tap water, dingy toilets, substandard meals, gang war, poorly trained guards and prison administrators, favoritism, and you have a system built for punishment, not for rehabilitation. This is not the enlightened approach to penology which is reform geared towards a subsequent productive life upon reentry to the community. It is a throwback to the 18th century that treated prisoners as animals unfit to renew themselves and rejoin society.”

While others may want to dump Enrile, Estrada, Revilla et al to one of those God-forsaken jails, Sen. Antonio Trillanes IV, who spent seven years in detention (three in that Camp Crame quarters where Revilla and Estrada are confined now) is pushing for the passage of Senate Bill No. 793 or the Jail Integration bill which proposes for an integrated prison and jail system that provides professionalism in the rehabilitation and treatment of prisoners.

“We are promoting a just and humane society and to treat detainees like dogs is not the way to go. We have to improve our detention facilities and construct new ones to make sure that these detainees will not lose their dignity while in jail,” Trillanes said.

    Sen. Enrile and his chief of staff Gigi Reyes filed a joint motion with the Sandigan that they be held in the same cell. The court, showing it had not lost its sense of humanity and kindness, approved their request… on condition that a video camera be installed in their cell.

    The PNP leadership told the Sandigan that it could not enforce its ruling, “We can’t force our policemen to watch them.” 🙂

    I am all for treating Lolo Johnny with kindness and compassion due to old age, maka-lolo kasi ako. 🙂

    I-hospital arrest na lang sya, hindi na rin lang magtatagal. Si Goyang nga ay walang sakit at hindi naman oldie talaga pa pero pinayagang magpasasa sa karangyaan ng VMH, libre pa.

    Pero si Bong at Jinggoy, let them suffer, learn, and mag-mea culpa mea maxima culpa till their old age…tapos ilipat na rin sa ospital. O di ba?

    I do not have compassion for Enrile. He always took the easier road to be absolved of all his wrong doings. Nagpakasasa na yan. I feel sorry for Gigi. She was used over and over again. Ironically now, Enrile gets to stay in an air-conditioned room and Gigi is in a super hot room and may even possibly be transferred to a real jail. To have wasted her youth, ended even her marriage to be with Enrile, I really do feel bad for her. But somehow, she had all the perks for two decades. Well…

    Some of the Legal Rights of an individual accused of crimes is to be treated Humanely and his human rights respected, but kindness and compassion are for people deserving such charity and individuals accused of very Serious crimes are not deserving…

  5. May karma talaga. Ang mga tao na dahilan para mapatalsik ay unti unti nararanasan na ang karma.

    Sa diaryo na Police Tonite kanina maganda ang nakasulat para sa isang column. Bibili talaga ako kapag nagkaroon na. DIARY NI APO MACOY ILALABAS SA PUBLIKO. Ito ang ibang nakasulat sa diaryo.

    Ang makapal na libro naglalaman umano ng tunay na buhay, plano ng dating pangulo sa Sambayanang Filipino, nilalaman din ng naturang libro ang huling pakiusap ni Marcos kay dating Pangulong Corazon Aquino na sana’y ipagpatuloy nito ang operasyon ng Nuclear Power plant sa Bataan, bilang kasagutan sa problema sa kuryente na mararanasan ng mamamayan, subalit mariin umanong tumanggi ang mga Aqunno sa pakiusap ni Macoy dahil sa pag aalalang habang tumatakbo ang naturang planta ay hindi mabubura sa isipan ng mga Filipino ang ginawa ni Marcos.
    (opinyon ko ay ito si Marcos lang ang pangulo na may pag aalala sa hinaharap na panahon. Iniisip niya ang kinabukasan ng mga Pilipino. Ang singil sa kuryente ay tiyak mura lang talaga. Kung corrupt man siya ay may napupuntahan naman na maganda ang Pilipinas.

    Ito pa nakasulat sa diaryo. Mababasa din umano na ang Manila Electric Company ay pag aari ng gobyerno na binili sa mga pribadong kumpanya, pero noong maupo si Ginang Aquino biglang hindi na pag aari ng gobyerno, gayundin ang malalaking Network ng Radyo at Telebisyon pag aari ng gobyerno, bakit ngayon nawala sa gobyerno.

    Ito pa ang nakasulat sa diaryo. Iniwan ni Marcos na siyang patalsikin ay nakikita ng mga bawat mata ng mga Filipino tulad ng Light Rail Transit na kanyang sinimulan Cultural Center of the Philippines, Film Center, Philippine Convention Center, mga State of the Art na pagamutan tulad ng Heart Center of the Philippines, Lungs Center, Kidney Center at iba pa, ngayon ay unti unti ng binebenta ng gobyerno lahat ng mga Ospital sa ilalim ng programang Private Public Partneship Program.

    Kung sa ngayon ay pamumuno pa ni Marcos at high tech na katulad ng mayroon ng cellphone ay napakaganda. Kahit maglakad ka at hawak hawak ang cellphone ay walang pangamba na may mag snatch. Kahit sa gabi walang pangamba kung lumakad mag isa dahil walang mang aabuso dahil mayroon ng disiplina ang tao.

Maganda talaga na magkaroon ng Diary ni Marcos na mabibili dahil para na rin mamulat ang isipan ng mga tao lalo na ang naisilang pagkatapos ng pamumuno ni Marcos na si Marcos ay isang mabuti na tao. Kasi karamihan na nababasa patungkol kay Marcos ay ang bad effect lang ng pamumuno niya pero ang good effect ay hindi nababasa. Unfair talaga para kay Marcos na ang mga kabutihan niya ay hindi naisusulat. Madalas na nasusulat patungkol sa kanya ay ang pagdeklara ng Martial Law. Ang mga nagawa niya ay hindi man lang nabibigyan ng credit. Sa panahon ni Marcos ay mura ang mga bilihin dahil may price control, ang bigas ay mura talaga. Ang mga magsasaka ay ganado mag trabaho dahil ang abono ay halos libre lang. Ngayon ang abono siguro almost 2 tawsan. Ang binhi ng palay ay pinamimigay lang sa kung anong variety ang bago. Ngayon ay wala na ang ganun, lahat para sa magsasaka ay binibili na. Ang ibang mga tao na sa pagsasaka nabubuhay ay nawalan na ng gana na magsaka ng mapatalsik si Marcos dahil bumibili na sila para sa gamit sa pagsasaka. Maraming dapat pagtaniman ng palay ang hindi natataniman iyon ay dahil walang pambili ng abono. Higit sa lahat kulang ang suporta para sa magsasaka. Samantala sa panahon ni Marcos sagana ang mga magsasaka.

    It’s not for the accused that we should be humane. It’s for ourselves because to be unkind diminishes our own humanity.

    Yendor Diola: By the looks of it they are already getting the pampering and yhe comfortable accomodation even without your plea for humane treatment.

    Ellen:I’m not lobbying for the accused. The discussion about acts of kindness is for us, the public. We should watch out that in our anger over these greed, corruption, and betrayal of public trust, we become bitter and hardened.

    Yendor Diola: I just wonder how much kinder can we continue to be for all these politician balasubas who have not shown an ounce of contrition for the abuses they have committed even when their sins have already been exposed to the public.

    Ellen:It all depends on each and every one of us. Yung kaya ng bawa’t isa. If in your heart you feel you cannot be kind to them, that’s okay. That’s your choice. This is a democracy.

    I think Yender Diola finds your timely reminder untimely.

    Also I think that, in a general way, the public is aware of how awful our prisons are and their thinking is if it’s good enough for the others it’s good enough for the three, until we can come up with better prisons for everyone concerned.

    Maybe they should have thrown some of their pork for the improvement of jails because doon din naman talaga sila babagsak, if not for pork it will be for some other crime. 🙂

    manuel at # 9… Mr. Pacificador, the son was detained in Don Jail for some time during his extradition hearings which the Superior Court Justice refused on the ground that Mr. Pacificador will not get a fair trial if sent back home…and during his detainment (he was the longest non-accused person to be detained due to the complex issues of his case) there were so many complaints of “inhumane” conditions and treatment of detainees and inmates at the Don…This is also the Prison where they hangman execute the condemned by hanging, which was abolished in l975…That Prompted the Provincial Government to Call for the Inquiry into the OVERALL State of the province Correctional Services …and Two of our Biggest prison and Detention facilities were Closed and replace with the State of the Art New Facilities built on P3s (public private partnerships)

    and here is the latest one…it looks like a College campus up front but inside it is a safe, modern, humane, and will achieve its objectives of reforms, punishment and retraining of its clients after life in Jail and or detention…it also have provision for Weekend prisoners where Ellen was emphatic about kindness for offenders that are deserving to serve their sentences on weekends so they can continue making their normal living…

    Pati si manang Gigi, nasa-ospital na rin. Hindi raw makayanan na makita ang mga Tiongson, at iba pang pula sa Bagong Diwa prison. Ang karma talaga, walang pasabi kung tumira.

    Sanay sa layaw, mahinang babae itong si Gigi Reyes. That weakness brought her to where she is now.

    Nagta-tantrum, ayaw daw kumain, hindi na yata ako naaawa kasi ayaw lumaban ng parehas. Baka akala ay papayagan rin siya na hospital arrest. Ihanda na ang wheelchair, pronto! Artista rin ba o hindi?
