Noong Biyernes ng gabi, lumabas si Pangulong Aquino (mga isang linggo din siyang hindi nakikita at naririnig mula nang pumunta siya sa lamay ng 44 na miyembro ng Special Action Force sa Camp Bagong Diwa) at nagsalita sa telebisyon tungkol sa trahedya sa Mamasapano, Maguindanao noong Enero 25.

Pangalawang pagsalita niya ito tungkol sa trahedya na hanggang ngayon ay hindi pa natutukoy ng opisyal kung sino tala ang may responsibilidad. Ngunit sa unit-unting lumalabas na balita, kahit mag-kakaiba nagkakaroon ng ideya ang publiko kung sino-sino ang may pananagutan.

Maliban kay Pangulong Aquino mismo, bilang commander-in-chief at nag-amin na alam niya ang tungkol sa operasyon at ang hepe ng SAF na si Chief Director Getulio Napeñas, may kinalaman din and suspendido na hepe ng Philippine National Police na si Alan Purisima.

Sabi ni Napenas kay Purisima daw siya nagre-report. Itinanggi naman ito ni Purisima.

Akala ng marami, may malaking sasabihin si Aquino na magbigay liwanag sa trahedya kung saan 44 na buhay ng ating pinagamagaling na pulis ang nalagas sa misyon na pagdakip sa dalawang terorista na nasa lugar na sakop ng Moro Islamic Liberation Front.

Ngunit nag inanunsyo ni Aquino ay ang pagbibitiw ni Purisima na sinabi niyang tinanggap niya kahit mabigat sa kanyang kalooban.

Sabi ni Aquino:”Kaya nga po, siguro naman ay maiintindihan ninyo kung bakit masakit para sa akin na aalis siya sa serbisyo sa ilalim ng ganitong pagkakataon. Tinatanggap ko po, effective immediately, ang resignation ni General Purisima. At nagpapasalamat ako sa mahabang panahon ng kanyang paglilingkod bago mangyari ang trahedyang ito.”

Malaki daw ang tulong ni Purisima para mapatay paghuli at pagpatay kay Zulkifli bin Hir alias ”Marwan.” Kaya paslamat tayo kay Purisima?

“Naging malaking bahagi din po ng layunin nating tugisin sina Marwan at Usman ang papel ni General Alan Purisima. Marami siyang iniambag sa mahabang proseso at maraming operasyon na pinlano para dito,” sabi ni Aquino.

Ikinuwento na naman niya ang malalim nilang samahan ni Purisima:“Hindi rin naman po lingid sa kaalaman ng publiko na mahaba ang aming pinagdaanan. Noon pong coup d’etat, o iyong attempted coup d’etat ng 1987, panatag ang loob ko bago kami na-ambush na may sapat na kakayahan ang aming security personnel. Dahil nga po halos naubos ang mga kasamahan ko, nayanig ang aking kompiyansa. Si Alan Purisima po ang nag-design, nagpatupad, nagtrain sa amin ng isang modified VIP protection course; malaki ang naitulong nito sa panunumbalik ng aking kompiyansa. Mula noon, hanggang ngayon, marami kaming pinagdaanan; kasama ko siya sa pakikipagtunggali sa mga makapangyarihang interes na maaari kaming ipahamak. Noong mga panahong bahagi ako ng oposisyon, bagama’t peligroso sa kanyang karera ang pagiging malapit sa akin, hindi po ako iniwan ni Alan.”

Ito ang problema kay Aquino. Madali lumabo ang kanyang paningin sa kapakanan ng bayan kapag kaibigan ang sangkot.

Masama ang loob niya na bitawan si Purisima. Kaya lang sinasabi sa kanya ng mga malapit sa kanya na tumitindi ang galit ng sambayanang Pilipino. Kapag hindi niya bitawan si Purisima, baka pati siya matumba.

Ang hinihintay pa ngayon ng taumbayan ay kung kaya niya manindigan laban sa MILF.

    The closest I can find is:

    Art. 231. Open disobedience. — Any judicial or executive officer who shall openly refuse to execute the judgment, decision or order of any superior authority made within the scope of the jurisdiction of the latter and issued with all the legal formalities, shall suffer the penalties of arresto mayor in its medium period to prision correccional in its minimum period, temporary special disqualification in its maximum period and a fine not exceeding 1,000 pesos.

    It talks of any superior authority. Is the Ombudsman superior to the Preaident?

    But one can argue that within the scope of her jurisdiction (discipline of officials), the Ombudsman is the highest authority. The Supreme Court can only say that the Ombudsman did not correctly apply the law. But the Supreme Court cannot alter or modify a suspension order, if done within the bounds of law.

    Is that a high crime for purposes of impeachment? Maybe not, but treason is.

    The numbers are not there, however. But the liability does not go away; and the Penoy may be hit when he leaves office, just like Goyang.

    Weather weather lang, ika nga ni Erap.

    This is where appointing a reputed straight shooter like Aling Conching works against the Penoy. If the facts are there, she will prosecute.

    Her term does not end until the Penoy has stepped down.

    Mike @ 7..the President of any Head of the Govt can accept the Resignation of any Official even under Criminal Investigation (so much so since he will surely lose confidence in someone under even suspicion) but it will Never preclude for the said official from being investigated after his Resignation…

    You must be aware that the agency created or established tasked to conduct criminal probe or any investigation is Independent from any branch of the Govt…that is the normal assumption for every layman without even to know the specific provision of the law or the constitution.

    Section 12. Termination of office. It is to prevent the act of resignation or retirement from being used by a public official as a protective shield to stop the investigation of a pending criminal or administrative case against him and to prevent his prosecution under the Anti-Graft Law or prosecution for bribery under the Revised Penal Code. To be sure, no person can be compelled to render service for that would be a violation of his constitutional right. A public official has the right not to serve if he really wants to retire or resign. Nevertheless, if at the time he resigns or retires, a public official is facing administrative or criminal investigation or prosecution, such resignation or retirement will not cause the dismissal of the criminal or administrative proceedings against him. He cannot use his resignation or retirement to avoid prosecution.”

    Vic Fornier:

    He has not resigned his commission, only his position. He is still under suspension but cannot leave the service by resigning or filing for early retirement. He will reach compulsory retirement in November. Then he will be out of the service but retirement benefits will depend on outcome of cases against him against him before the ombudsman.

    It is starting to look like this SAF 44 may be Pnoy’s worst blunder so far. Allowing Purisima to even be involved in the operations and not involving Roxas and Espino in the whole planning etc ended in this misencounter. This operation was not planned very well. Hilaw ang dating.

    The Revised criminal code has many laws that should be challenged and written off…that is one of the Objectives of the Court Judicial Review..to rid of the Bad Laws or some that is no longer relevant to today’s society…

    Lost the Election, but it was Enacted by the Winning Liberal Govt…and it was challenged…

    Dr. Donald Low, the face of the nation during the SARs Crisis, left the nation a message to discuss the
    issue upon his death from Terminal illness, helpless as he can not Ethically asked his fellow Doctor
    to assist him to die in Dignity…and the Politicians and the Nation Listened and the SC agreed to hear
    the Case…

    And Two Days ago in a Unanimous Decision, the SC struck down the Criminal Ban on Doctor’s assisted
    Suicide and give the Parliament a Year to draft a new a new Legislation to conform with the ruling or
    otherwise the law is null and void…

    The option left for the Federal Govt is to Invoke the “non Withstanding” clause, overruling the Supreme Court
    Decision that no Federal Government has ever Done..

    Sec 33 gives any legislature the power to have the Court judicial review over ruled for a maximum period of 5 years
    or less and can be reeacted indefinitely, and will lapse without being re-enacted and the Rulings will take effect…

    And that simply means that the Electorate can also overRule the Govt. by means of Election…and the Govt is not about
    to commit Suicide when the Majority of the People supports the SC decision…

  19. That a US agent died in that encounter, and the following non-reaction from the US Embassy, makes the Times story more incredible. The 60 million entrance fee makes it even more unbelievable. The actual reward money will take months to be confirmed by the FBI, the Times makes a silly claim that the US advanced a huge portion of it to a renegade group?

    Bakit ngayon ay sinasalo at binabaligtad ni Napenas ang istorya. Di ba siya nahihiya sa 44 na napatay at hanggang ngayon ay mag sisinungaling pa siya. Inaako niya ang kasalanan. Okay iyan dahil kasalanan talaga niya pero iyun baguhin niya ang unang sinabi niya na ang nag utos ay si Pu*?ma at ngayon ay di si Put?// ang na utos direct at siya ang nag desisyon.

    MALAKING KAGAGUHAN ang pag sisinungaling niya. Walang field commanders na gagawa ng mabigat na hakbang na walang utos sa itaas.

    # 29..I always believe the Senate inquiry is the wrong way to go..it is not impartial, it is very short cut..no defined objectives and no experts panels to help out the committee…

    Now for comparison…Madame Justice Charbonneau just wrapped up her more than a Year long inquiry into Corruption Scandal in Construction industry in Quebec..the objectives of her inquiry is to find the root causes of the Corruption and report to the Provincial National assembly with her recommendation for legislative measures..She was able to bring before her Inquiry the Biggest names in Mafia Bossings in Quebec, the Govt Leaders, some of them already been Charged by the Provincial Police for Corruption Related Offenses…(testimonies in Inquiry can not be used in Criminal proceedings, it is always BLAMELESS) and right now she is preparing for her reports..

    Meanwhile one of the biggest Fish, the wife of the MCGill University Hospital CEO already pleaded guilty and her assets of $5 millions plus been forfeited, while her husband Dr. Arthur Porter still in Panama waiting extradition with his assets worldwide of $22 millions Frozen and is Sued by mcGill university for the money back..it was from the kickback from SNC Lavalin Engineering Firm whose CEO and officers were also charged for crimes of Corruption…

    I think there is no shortcut in doing either an Inquiry for legislative measure or Criminal probe by Police Authorities…And Perjury is a very Serious Crime..and you can see and hear it being committed in a senate inquiry…it is a shame…
