BOI requested for interview with Aquino

It is not true that the Board of Inquiry did not try to get the side of President Aquino on the Jan. 25 Mamasapano tragedy that claimed 67 lives including 44 of the country’s elite police commandos, 18 members of the Moro Islamic Liberation Front, and five civilians, including an eight-year old girl.

Last March 9, BOI head Police Director Benjamin Magalong told Interior Secretary Mar Roxas that they would like to interview the President and the latter promised to relay the request to Aquino.

This took place when Magalong requested Roxas for an extension to submit the report.

Magalong never got a notification from Roxas on Malacañang’s reply to his request. He submitted the BOI report last Friday.

Malacañang is not happy with the report of the BOI that investigated the Jan. 25 Mamasapano tragedy of which found that the Chain of Command in the Philippine National Police was violated and one of the culprits was President Aquino.

“The President, the suspended CPNP Purisima and the former Director SAF Napeñas kept the information to themselves and deliberately failed to inform the OIC PNP and the SILG. The Chain of Command should be observed in running mission operations,” the report said.

The other items in the Report’s Executive Summary focusing on the President’s role in the tragedy that claimed 68 lives including 44 of the country’s elite police commandos, 18 members of the Moro Islamic Liberation Front, and six civilians, state: “1. The President gave the go-signal and allowed the execution of Oplan Exodus after the concept of operations (CONOPS) was presented to him by Director of Special Action Force (SAF) Police Director Getulio Napeñas.

“2. The President allowed the participation of the suspended Chief Philippine National Police (CPNP) Police Director General Alan Purisima in the planning and execution of the Oplan Exodus despite the suspension order of the Ombudsman.

“3. The President exercised his prerogative to deal directly with Napeñas instead of Officer-in-Charge of the PNP (OIC-PNP) Police Deputy Director General Leonardo Espina. While the President has the prerogative to deal directly with any of his subordinates, the act of dealing with Napeñas instead of OIC-PNP Espina bypassed the established PNP Chain of Command. Under the Manual for PNP Fundamental Doctrine , the Chain of Command runs upward and downward. Such Manual requires the commander to discharge his responsibilities through a Chain of Command.”

Lacierda slammed the BOI report saying it “ introduced innuendos and resorted to speculations.”

He disagreed with BOI’s stand on the applicability of the chain-of-command doctrine saying the PNP is a civilian institution under the Executive Branch of government. “The President, as Chief Executive, exercises full and absolute control and supervision over every official in that branch,” he said.

Lacierda faults the BOI for not getting Aquino’s side. “The BOI in its efforts could have asked the President to clarify matters. The President would have answered any questions they may have had. But no official request was made. Instead, it introduced innuendos and resorted to speculations to reach some of its conclusions. This is all the more unfortunate because the head of the BOI, together with other senior officials of the Philippine National Police (PNP) was present in a meeting with the President where Police Director Benjamin Magalong had the opportunity to ask the President questions or seek further clarifications. As head of Criminal Investigation and Detection Group (CIDG), Police Director Magalong should be particularly aware of the need for due process to be observed.”

Lacierda must be referring to the March 4 meeting of the President with SAF officials at Bagong Diwa in Taguig City which focused on a review of the operations conducted to arrest the two terrorists who were the target of the Jan. 25 Oplan Exodus in order to improve future operations and other related concerns of SAF.

Is Lacierda serious about expecting Magalong to disrespect the President and do an ambush interview with him in the midst of a meeting with top PNP officials?

Lacierda, confirming the President’s complete control of Oplan Exodus, which he himself narrated in his meeting with religious leaders last Monday, said, “The President therefore left nothing to chance. His direct orders to Purisima if obeyed, would have ensured that the OIC Chief PNP would not have been kept in the dark. However, the President was disobeyed by Purisima.”

Lacierda said Aquino himself instructed the suspended Chief PNP, Alan Purisima to inform the OIC Chief PNP Leonardo Espina of Oplan Exodus.

Using Lacierda’s argument that Aquino is not covered by PNP’s doctrine of chain-of-command,because he “exercises full and absolute control and supervision over every official in that branch”, why didn’t he himself inform Espina? Why did he have to course it through Purisima, who had no business participating in PNP operations because of his suspension?

Aquino dealing with the suspended PNP chief all throughout the operations, as shown by text messages between the two, was an anomaly. He disrespected not only Espina but the whole PNP organization. Binastos ang PNP.

Magalong, by coursing his request for an interview with the President through the DILG secretary, showed respect for the Office of the President.Magalong was following protocol. He is with the PNP, which Roxas administers and controls as chairman of the National Police Commission.

The BOI never got a reply from Aquino nor from Roxas. Is Lacierda’s statement a case of story-telling-a lie which we had aplenty the past one and half months or a breakdown in communication in Malacañang?

Either way, it does not speak well of the current state of the Aquino presidency.

    But still, one is inclined to laugh at the last line because I don’t recall when this blog has ever spoken well of the Aquino presidency.

    And in it Separate and distinct Criminal Probe, the RCMP was able to Round up the criminals long after the more than a Year Long Inquiry wrapped up its business.

    Inquiry cN not be rushed. Truth seeking is very thorough Job ,.. While blame finding is just as easy as finger pointing.

    @ 4 JoeAm what ever was true some 50 years or so ago may not be applicable today…and it we keep quoting the thoughts of wise men and women during their time and life and apply them to current situation for justification of our action may no longer valid..

    Yes,Truth is subjective..i’d rather call it “facts” supported by evidence, very strong evidence…perhaps that is the Good Reason why in every Inquiry (other than Criminal probe that is the domain of Criminal Justice and is the responsibilities of the Independent Police Authorities) Inquiry for FACT FINDING is always BLAMELESS…it objective going into the inquiry is to find the answer it is tasked, gather all the facts, detail them, submit a report, prepare a recommendation and protect the testimonies and evidence that it CAN NOT BE USED in any other proceedings, criminal or civil other than for prosecution of perjury and contradiction committed before the Inquiry…

    And for good Measure..all expenses must be borne by the inquiry..meaning the Taxpayers..including counsels to the witnesses. accommodation and allowances for lost income…

    joe, say again? where did you get your figures certifying what you said was doing well for us? how many filipino families do you think are starving because of that good economy being flaunted by the aquino administration? read the news. see the mushrooming number of homeless scattered all over metro manila. see the refugees from natural and man-made calamities who are packed like corned beef (not sardines) in evacuation centers, without food, medicine not to mention the basic needs for their everyday living. moreover, see the number of those in power whose bank accounts are bloating like buteteng laot the sources of which are the ghost projects, the overpriced deals they entered at the expense of the poor people who are always hoping for the tuwid na daan of aquino to reach their doorsteps.

    Hindi kelangan na mag ‘Ay Am Sori’ si Pnoy. He just have to admit his responsibility and account for what happened in Mamasapano. “The buck stops here”, di ba niya alam bilang pangulo?!

    I don’ want him to step down o palitan kasi mas lalo napupulitika ang isyu. I want to see how he survives (if he could) this Mamasapano kapalpakan. Lahat ng presidente may extreme challenge, gusto ko makita ending ng kanyang presidency regarding this very hot issue and corruption. Let him suffer the consequences of his decisions and actions after his term.

    Lalo lang nabubuko si Pnoy dahil sa kanyang mga tangang spinners!

    @MPRivera #9, there are two ways to look at it. You use a comparative looking at the Philippines versus, say, the United States or maybe Taiwan. I’m not sure what your standard is.

    I use a “progress” comparison, that the Philippines is better off today than it was five years ago. Steady growth, second best in Asia. Rapid infrastructure development going on to try to catch up to past neglect (airports). Improved financials (S&P/Moodys). Rise in global standings. I mean, read the global press reports on the Philippines. All upward and praise.

    So the only thing we really have to argue about is the pace of development. Poverty is deeply entrenched. Millions and millions. The economic base is thin. You simply can’t correct it in five years. Maybe you can in 20.

    But if you always look at the empty part of the glass, you wake up each day feeling lousy about your country. Me, I wake up proud of the Philippines.

    One of the questions the BOI going into the tasked IPad to find the answer if the Chaim of command was Indeed broken or violated in Mamasapon Mission and details how did it happen and. recommend MEASURES That it will Never be Repeapet if it did happen.. But at the outset the BOI was not very successful to get the “Facts” from many Sources that were privy to the incidents mostly because they will get blamed if the testify and reveal the “truth” as they witnessed and seen them. That is main reason why Inquiry Fails.

    and in case you still don’t understand WHY i felt this way right after the 180 days period i gave for noynoy to prove his sincerity in referring to ordinary filipinos his boss – IT’S because i spent more than half of my life serving my country fighting separatist rebels and communist terrorists that are not babied by the previous and present administration. i even supported the candidacy of this president believing he was the better alternative than his bar topnotcher cousin during the 2010 election.

    it is also the same reason (being a former soldier formerly assigned in combat areas in different parts of mindanao during the 70’s and 80’s) WHY i hurt so much for the useless death of the fallen 44 knowing HOW napenas FAILED to consider SOME MOST important factors that could have contributed in the successful outcome of the OPLAN EXODUS most particularly the rolling flat terrain of mamasapano and the coordination with the AFP units for the aerial, artillery and manpower support.

    That he was fooled is beyond comprehension. It is beyond belief, if his previous pronouncements
    were to be taken into serious and utmost considerations in reference to what he claims now… THAT HE WAS FOOLED! That he was a fool? Oh no, I doubt if he is. He knows.

    He perfectly knew that time what was going on. He was sane enough to be in Zamboanga that fateful
    day! But he will not admit the many truths. He will insist that he was fooled.

    So as not to be harsh to him, this is what we call dialetheia in para-consistent logics. And I think he is
    an expert at it!
