Duterte’s tactics show truth is not on his side in conflict with Trillanes

If you have to resort to lies in a conflict, it only indicates that you are not on the side of truth.

It’s becoming obvious that the expose of Sen. Antonio Trillanes IV of Davao City Mayor Duterte’s bank transactions that can go up to as much as P2.4 billion has hit hard the frontrunner in the May 9 presidential elections, more than his infamous rape comment.

Although I seriously doubt if this latest controversy would bring him down from number one in the race, the issue would hound him even if he wins the presidency.

So far, his actions are that of a person twisting and digging himself in a quicksand.

When Trillanes IV first made his expose alleging that Davao City Mayor Rodrigo Duterte is not the poor and honest public servant that he presents himself to the public because he had more than P200 million in his BPI Julia Vargas branch account in 2014 which he did not include in his Statement of Assets, Liabilities and Networth (SALN), Duterte called the senator a “liar” and dismissed the bank account as a “fabrication.”

“You can check with the bank. You go there,” Duterte said in a forum with the Makati Business Club April 27, the day the first expose came out in the Philippine Daily Inquirer.

My friend took up Duterte’s challenge and went to BPI Alabang Town Center the next day, April 28, and deposited in the bank account number published by the Inquirer. It was accepted by the bank and she was given the receipt showing that the account is a joint account of Rodrigo Roa Duterte and Sara Duterte.

My friend sent me a photo copy of the deposit slip and I posted it in Facebook a little past 1:30 p.m. It immediately went viral shared by more than three thousand people in one hour.

Less than two hours after, Inquirer posted a breaking story, “Duterte admits existence of BPI accounts.”

Duterte said his account contained just a few thousands contrary to the more than P200 million that Trillanes exposed complete with the amounts and dates of the deposits. Eight of the ten deposits in 2014 totalling P197 million were made on the mayor’s birthday, March 28.

Trillanes dared Duterte to open his account so the public would know who is telling the truth.

Duterte accepted the challenge of Trillanes while revising the amount of his bank assets. It’s less than P200 million, he said. Now, he is talking of millions of pesos in the bank.

Duterte’s propaganda team released a bank balance of P17,000. But Trillanes said he will insist on the transaction history of the account.

Duterte then set a condition that he will only agree to the opening of his bank account records if Trillanes would reveal in an affidavit how he obtained the bank documents. That’s as good as not allowing the opening of his bank accounts.

Trillanes will be at the BPI Julia Vargas branch today, May 2 at 11 a.m. Duterte will not be there. He said he will in Davao but he will be represented by his lawyer, Salvador Panelo.

Facebook removes post if they receive several complaints about it. Who would complain about an article on Duterte’s bank account?

I have been a subject of cyberbullying. The memes are actually hilarious in their stupidity which is something to be sad about because they are symptoms of a deeper problem in our society.

The other day, I got this text:

“Mga DDS nais nyo ba maka txt message ang balasubas na super epal na senador antonio trillanes mayroon po ako personal cp no ng senator na epal na yan.kaya mga dds dumugin po natin sya at eh post ko sa lahat ng duterte pages ang personal nya cp no.”

It was followed the next day with another text, similar message.

    And DDS is sending their text to you not the ambisyosong Senador. Unless you’re a drug pusher or criminal to the hilt, sure you’re in the crosshairs. Hay, puro drama na ito, besides, post the actual text msg from your Iphone to make it legitimate to your readers.

    DDS could also mean Duterte Daily Service, a social-media outfit devoted to Duterte-Cayetano campaign and is staffed by unpaid volunteers.

    Anyone who understand basic English and basic rudiments of law would find Trillanes so-called affidavit’s wanting of substance and requirements to stand in any court, except perhaps in a kangaroo court.

    It boils down to this: that Trillanes was approached by a certain Joseph Demesa, last April 21, 2016, with an information coming from the latter’s unnamed close relative who works from an unnamed government agency said to be devoted to finding, investigating ill-gotten wealth of any government worker.

    Is Joseph Demesa referring to Ombudsman or AMLAC? The BSP and AMLAC denies the existence of any such record. The Ombudsman only acts if there is any compaint, and so far there is none officially lodged against Mayor Rody Duterte!

    The bank in question, BPI, denies any ownership nor authorship of Trillanes’ spreadsheets shown in PDI he calls as his basis of fact!

    Joseph Demesa per Trillanes own affidavit, is neither the author of those.

    To make himself look more unbelievable, without him knowing it, Trillanes did NOT bother to subject Demesa to a written disposition.

    So where did those spreadsheets come from? Long short of it: Trillanes was approached by a certain Joseph Demesa, last April 21, 2016, claiming that he’s got an unnamed relative working with an unnamed govt agency said to be investigating officials working in govt.

    Clearly, Trillanes doesn’t know Demesa personally, based on his own affidavit yet he took what was fed him hook, line and sinker. Totally irresponsible.

    Trillanes must be reminded that his being a Senator does not grant him any immunity from suits arising from his lies as he was not in the Senate floor.

    Verbatim, states wholly: ” To request for and receive, from Bank of the Philippine Islands, Julia Vargas Avenue, Pasig City Branch, bank certificates for BPI Savings Account No. 2433-0695-39(the “Bank Account”)to show the current balance as well as the fact that at NO(emphasis mine)time since the opening of the aforesaid Bank Account was there a deposit either singly or collectively of Two Hundred Eleven Million Pesos (PhP 211,000,000)”

    * Bank certificates should have read bank certifications, imho, as bank certificates in finance lingo could mean a form of a negotiable instrument.

    The Trillanes-Duterte face-off at BPI was like the Pacquiao-Mayweather fight: massive hype but the “fight” itself was a major disappointment.

    First, Duterte didn’t show up (he earlier said he’ll just send his lawyer, so no big surprise).

    Second, while Trillanes complied with Duterte’s request to produce an affidavit, my gut feel is that the De Mesa guy was made up (it was Trillanes who signed the affidavit, not De Mesa).

    But Trillanes really just wanted to protect his source (all he needed was a BPI employee to get the info, and if you were that employee, will you sign your own death sentence?).

    Third, the condition under which Duterte’s special power of attorney authorized BPI to “certify” that “at no time since the opening of the aforesaid Bank Account was there a deposit either singly or collectively of Two Hundred Eleven Million Pesos (P211,000,000.00)” is very insulting to people’s intelligence. There’s a huge difference between transactions (deposits) and ending balance.

    Even if all the deposits amounted to P211 million (as claimed by Trillanes), the bank is unlikely to certify a total deposit of P211 million simply because of withdrawals. Who’s going to believe that as a genuine concession to ferret out the truth (aside from Duterte supporters of course)?

    Quite clearly Duterte’s account received huge deposits in the millions (which could be dirty money and/or “gifts” from rich friends), and he’s trying to hide it. That’s the central issue that now casts serious doubt on his integrity.

    Duterte’s supporters were quick to label the revelations black propaganda, even if the confirmation of the allegations came from their candidate himself. In subsequent appearances, Duterte would try to fudge the issue by flashing before the throng a supposed statement from BPI certifying that the account’s current balance is only P17,000 or thereabouts. Which, of course, does not answer the original charge: Were there millions at one point in 2014, specifically around the time that he himself said unidentified rich friends of his gifted him with the money, deposited straight into the account?……

    Who won in that face-off? Duterte, it would seem. He bought time to keep the information to himself while the country votes on May 9, exactly seven days away. This man who only had contempt for legal stonewalling now seeks refuge in it, while the public to which he has vowed transparency at all times is effectively kept in the dark about a momentous question they suddenly have to grapple with before they cast their vote: Is the mayor as clean as he claims to be?

    The manner in which the Duterte camp and its followers on social media resort to personal attacks and straw man arguments instead of addressing the central issue directly only magnifies the latter in people’s minds.

    2.) Now, what they need is the bank account’s in question transaction history. May I again ask your attention to the SPA’s second paragraph?     But perhaps, given these explanations, some people have made up their minds not to seek out the truth, but rather muddle the issue beyond recognition so as to leave the truly undecided perplexed and confused. Talk of raising political discourses! ‘Tang In@!!

    Manila-based Duterte critics so used to the idea that ONLY they have the monopoly of truth and define narratives accordingly will have the biggest awakening in their lives comes May 9.

    Postscript: Rody Duterte’s stint in the govt includes being a Special Prosecutor. If anyone cares to know its meaning, he is the Ombudsman. There were two of them, and he is One of the only two, for the whole island of Mindanao prior to EDSA 1.

    Quoted from the ANCALERTS Twitter page. The avoidance of releasing the actual record of deposits and withdrawals is plain to see.

    Also the overly specific condition in the SPA, deposits in the exact amount of “P211,000,000.00.″ What of the 197 million allegedly deposited on Duterte’s birthday, would the language of the SPA compel BPI to omit this transaction? In the first place Trillanes’s affidavit mentions three accounts, not just the one at BPI Julia Vargas.

    The only reason I brought up in this discussion Duterte’s being a Special Prosecutor one time in his life, is NOT to wow nor awe the audience. But rather put emphasis that phrases or usage of terms in the course of time do change its meaning. Before 1986 Constitution, the role of what is known today (at least in Pinas) as Ombudsman, is filled by what 1973 Constitution terms a Special Prosecutor.

    The phrase ‘transaction history’ came into being during the introduction of bank’s ATM machines. Its now popular meaning is understood by everyone. But there’s no guarantee that it will still be understood 100 years from now, the way people understand it today.

    Legal terms and its definitions if one care to notice, purposely avoid popular terms in favor of time-tested unambiguous basic construction to maintain a balanced comprehension devoid of double-meanings. This is so, not only because usage of pop terms vary from one place to another. The users themselves could have at some point, different levels of understanding, and a non-uniform, varying degree of speech evolution and development.

    Kaya, ang ginagamit na terminolohiya hanggat maari ay hindi binabago para manatili itong angkop sa lahat ng antas ng pamumuhay, edukasyon at kakayahan ng pag-inog ng kaisipan.

    Isipin na lamang ang gulong maidudulot ng kada may bagong pop term siya na rin agad ang gawing kahulugan sa mga ligal na panulat.

    Re: “hearsay,” a signed and duly notarized affidavit is a demonstration of a person’s willingness to defend their assertions in a legal forum. The truth is for a court to decide, certainly not by a lawyer defending his client.

    This is separate from the “central issue.” A candidate for the presidency must be willing to subject himself to the strictest scrutiny, having demanded the absolute trust of the electorate. By his own words Duterte has confirmed Trillanes’s accusations on several points, by his own words he has given the people reason to demand a reckoning. Granting written permission to examine his deposits is a recourse expressly provided by law, a minor inconvenience for a person with nothing to hide.

  38. By the way, Ellen. I have classmate who works for Nickel Asia who is a Manager at Hinatuan Mines. I just got some very interesting info that 36th (or26th?) floor of Nickel Asia Corp.’s building is being used as HQ by Duterte’s internet trolling brigade. With fast servers and IT experts that any of the monitored hashtags will instantly generate a barrage of posts, mostly copy-paste with servers linked to China and Russia that explains why Rappler reported somebody was “gaming” their online polls. A Rappler poll registered about 10,000 votes for Duterte in couple of minutes. It was so glaring the other candidates merely had one or null votes. Most overseas votes came from China and Russia.

    We know that Nickel Asia is a generous “friend” to politicians, rebel groups, lumads, church pastors, etc. since it is the 2nd largest Nickel Mine in the world and wouldn’t want a repeat of the burning by the NPA of it’s earthmoving equipment few years ago. They followed Digong’s advice to pay revolutionary taxes. Maybe. Maybe it was coursed through the BPI account, who knows?

    I was laughing the other day because my friend said the project manager of the internet ops forgot to sign their checks for the month-end of April so they did not work the whole weekend. Kaya pala konti if walang trolls nung Sat-Sun. LOL.

  39. Some US-based cousins told me to watch “Our Brand is Crisis” starring Sandra Bollock (Jane Bodine) and Billy Bob Thornton (Pat Candy)shown last year. They say this is the template Donald Trump’s campaign is patterned after. But after watching, they realized that it was more appropriate for Duterte’s campaign.

    Jane, the campaign strategist, usually quotes Sun Tzu but my favorite is:

    “That’s the world, that’s politics. That’s how it works. It starts out with big promises and ends up with jackshit happening. But the like the man said: ‘If voting changed anything, they’d make it illegal.'”
