Update on Satur

Early this morning, before 5 a.m., PNP officers forcibly took out Bayan Muna Partylist Rep. Satur Ocampo from the Manila Police District and brought to the Manila Domestic Airport. They want to bring him to Hilongos, Leyte.

ABS-CBN reported that Satur refused to take a military helicopter to Leyte as originally planned by the PNP.

Satur missed the 6 a.m. flight to Tacloban and is now at the airport waiting for the 10 a.m. flight.

Neri Colmenares, Ocampo’s lawyer, is already in Hilongos, Leyte to petition the court to keep Ocampo in Manila because the Supreme Court has scheduled oral arguments ofr his petition for certiorari on Friday, March 23.

Colmenares texted that Hilongos is

“heavily militarized. Ang daming army. May umiikot with microphone tumitira kay Satur. And daming intel naka civilian clothes. Armed men sa paligid ng korte.”

Bayan Muna rep. Teddy Casiño lambasted the treatment of his fellow partlist representative:”If [police] can vioate the rights of an elected official like Ka Satur, how much more an ordinary citizen?” he told DZMM.

“There is no reason for the police to rush Ocampo’s transfer. Our lawyer is already there just waiting for government offices to open so he could file a motion before the Leyte court,” he added.

He said Bayan Muna representatives have asked the police to wait for the decision of the court on their petition. He said he and Ocampo’s wife, Prof. Carolina Malay, will accompany the lawmaker if the transfer pushes through.

Casiño also scored Speaker Jose de Venecia for failing to act quickly on a separate petition to place Ocampo under the custody of the House of Representatives.

“The key there is the speaker of the House and the leadership of Congress. The sad thing is Speaker de Venecia [and] top House leaders haven’t even visited Ka Satur. Even if they don’t show support, the least they could do is visit a fellow congressman whose rights are being violated,” he said.

The Supreme Court earlier scheduled oral arguments over the petition for certiorari and prohibition filed by Ocampo last Friday shortly before the lawmaker was arrested.

The high court ordered Hilongos, Leyte court Branch 18 judge Ephrem Abando, Prosecutor Rosulo Rivero and Justice Secretary Raul Gonzalez to comment on Ocampo’s petition within a “non-extendible period of five days.”

Ocampo, who once served as the spokesman for the National Democratic Front (NDF) of the Communist Party of the Philippines, was charged with 15 counts of murder allegedly committed during a purge of suspected “spies and counter-revolutionaries” within the ranks of the CPP and its armed wing the New People’s Army (NPA) between 1985 and 1991.

The charges stemmed from the discovery of a mass grave in Inopacan, Leyte last year and the testimonies made by former rebels who survived the purges and the relatives of the victims.

Satur had been granted amesy under declarations issued by former President Aquino and Ramos.

    Masyadong ma-drama itong Tianak. Again, in the dark of the night (midnight pala), Rep. Satur was dragged out of MPD for Leyte. Buti pa na hindi na lang nagpakita si Ocampo sa korte. Assperon has a despicable behaviour, hindi kayang lumaban ng patas! The supersekyu has totally lost his mind!

    The moves of the Tianak and Assperon led one to believe that the forced incidents are prelude to the declaration of martial law if Tianak will become ‘tagilid’ with the result of the election in May.

    Thousands were massacred and killed in the eighties in the communist purges. Amnesty and pardon require that the truth be told and guilt be admitted. You cannot be absolved for crimes you do not admit to having committed. It is better that these multiple murder charges be properly adjudicated in a Court of Law. Or do you really want pure anarchy because galit ka lang kay GMA?

    I commented recently that I thought that this administration have to be very careful of their next move but the problem was they didn’t know what move to make. It is my opinion that this move against Rep.Satur Ocampo and the Rule of Law this morning is reckless and for no apparent real reason.

    There is also now a repression on groups joining rallies against the bogus president with their groups being put on surveillance or blacklist.

    Hindi na bago kay Tianak at Assperon ang sumunod sa SC. Nagmamadali silang i-transfer si Ocampo sa Leyte away from the prying eyes of the media which is the only protection of Rep. Satur these days?!

Gosh, police there can even shoot anyone they would want to without getting reprimanded for it, and a lot of people are even framed up by the police and send to the gallows without proving their innocence! I should know. I have worked for the freedom of one Japanese who refused to be framed up and was given a death penalty for a crime he did not commit in the Philippines. Buti na lang nakasama sa mga na-pardon on instruction of FVR, who I requested for a retrial, which they would not even want to grant because there was in fact no evidence.

    Over in the Land of the Rising Sun, no one gets to be indicted if the police cannot find evidences to prove one’s guilt, for over here, guilt is imperative to be proven before a person can be indicted. We call it here as “the burden of proof.”

    The court is there not to determine whether a person is innocent or guilty, but only to see if an accused is corrigible or not. Otherwise, he is sentenced to death if he is incorrigible and will continue to be a threat and hazard to society. Dapat ganyan sa Pilipinas.

    You bet, I prefer our system better than the system in the Philippines copied from the Americans sans the jury system that on the whole Filipinos can hardly understand and comprehend.

    “Warrant vs Satur was issued by Leyte Regional Trial Court either (a) with jurisdiction; or (b) without jurisdiction. If (a) then Satur’s petition for certiorari before Supreme Court will be dismissed. If (b), the proper remedy would be a motion to quash the information before the Regional Trial Court, not certiorari before the Supreme Court. Also if (b), surrender is not proper because RTC acted without jurisdiction,. Temporary Restraining Order would be proper to restrain arrest. When Satur got himself arrested, his petition for TRo became moot and academic. There is nothing more to restrain. Therefore Satur’s counsels erred when they exposed him to arrest before obtaining a TRO.”

    Ang kaso nila Satur at Joma ay hinggil lamang sa mga krimeng umano’y kanilang ginawa noon pang nakaraan. Tama ka na maraming ibang krimen na dapat parusahan. Ngunit isa lang ang Batas, isa lang ang Konstitusyon, isa lang ang Hustisya. Kung hindi natin ipagtatanggol ang Batas sa bawat pangyayari, kahit na sino pa man ang masaktan o hindi, walang pagasang maparusahan ang mga nagkasala. Iyon ang anarkiya.

As for the sex slaves, the National Archives here have records pertaining to the Korean and Taiwanese “Ianfu” but none on the victims of rapes in the Philippines, etc. as being made into sex slaves that I will liken to the Filipino Japayukis recruited here illegally and therefore could not avail of proper help when they complained, and then just keep quiet when they are paid.

    The Koreans and Taiwanese were considered members of the defunct Japanese Imperial Army, more like some sex WACs with the authorities then recognizing that the soldiers needed some respite after a day or two of heavy fighting and prevent them going around raping the natives!!! But war is war, and even Filipinos then in fact did such rapings and blamed the Japanese for their own marauding and crimes against their own fellow countrymen.

    Now, this little brown American pretending to be smart and wise does not even know that Satur’s friends in the Diet are the ones who have rallied for these self-proclaimed sex slaves in the Philippines to claim for compensation if they can prove they are right. They are not privy to the denial of the Japanese government now that there is no proof that Filipino women were used as sex slaves! Rape victims, maybe, but not sex slaves.

    Kaya ano ang sinasabi nitong ignoramus na ito? Mahirap ang magkalat ng wrong information as a matter of fact.

    I don’t question Atty. Paguia’s legal analysis because I’m not a lawyer. My question is about the transfer of Rep. Ocampo being done in a hurry, madaling araw pa?! Anong rason at hindi makapaghintay ng may araw which was only a few hours away? Palaging misterio ang oras ng transfer ng mga akusadong sikat sa administrasyon ni Tianak!

    To play a fair in a game we need to flip the coin on both side, not to focus only on a monologue issue. As I notice here we are only applauding the criticism committed by Arroyo but, how about the atrocities being committed by Satur, Joma and Jalandoni,Since they started their left wing activities the numbers of victims of their cruelty has skyrocketed, they acted as a jury, a judge and an executioner in their so called a Kangaroo Court, those victims who were sentenced to death has no good representation on there defense, either they were sentenced by absentia or being forcibly dragged in there court and the chanced of being found innocent is zero. They were already found guilty until proven innocent. Maybe, to some of you it is okey because you never lost any friends, kin, or family members who suffered a brutality of death in their bloody hands. Or, you don’t have any family members that were afraid to be on the outside of the house when sunset come. Or, maybe some of you don’t have a farmland that need to be till and plant some crops, those farmers in the barrio are afraid to be there alone tilling his land and harvesting his crops. We have some uncultivated farmland because no one want to till it. It was been infested by them. The last tenant we had, the whole family was been massacred by them. If he is guilty let him do his time and if he is innocent let him be free. I am not defending the Arroyo government. I am just voicing my ill feelings towards them. They must be accounted for too, for the command of responsibility.

    ABS-CBN banner Judge stops Satur’s transfer on DILG’s orders

    A Leyte judge on Monday ordered police to stop the transfer of jailed Bayan Muna Rep. Satur Ocampo from Manila to Leyte province after receiving instructions from the Department of the Interior and Local Government.

    Judge Ephrem Abando of the Leyte Regional Trial Court Branch 18 in Hilongos said he issued the order after receiving assurance that the DILG would secure the lawmaker.

  40. I supported the impeachment of GMA in 2005 and 2006. But there was never enough public support for it after the Leftist in Congress and a bunch of hotheads tried to pull that Stalinist Kangaroo Court stunt with Guingona as head of a Presiduum. They are as much to blame for the failure to pursue the processes of the Law as the House Majority who might not have squashed the 2006 attempt at impeachment so easily without the opposition alienating the public with that stunt. I am becoming even more pessimistic now. I think most Filipinos just want to get to Daly City instead…

    The best friend of my uncle was butchered by NPAs in front of my grandpa when they were on their way to supevise the taniman in the farms.     I, too, am not a fan of NPAs. But I wish this Tianak and Assperon don’t just make Satur an exhibit for the US, to serve their selfish ends. At dahil sumuko si Satur ay irespeto nila ang karapatan noong tao ayon sa batas. Kung tuluyang mapatunayan without doubt na gawa lahat ni Ocampo ang ibinibintang nila, e di bigyan ng parusa.

    Ikaw na rin ang nagsabi na matagal na ang mga pangyayari buhat noong martial law ni Marcos. At nakuha na nila si Satur. Ang dapat ay huwag nilang madaliin, bagkus ay tiyakin nila kung ano ang mga pananagutan ni Ocampo base sa mga evidences na hindi gawa-gawa lamang ng militar para manatili sa pwesto si Tianak.

    Ang problema kasi ay walang credibility and pekeng pangulo kaya lahat ng hakbang ay pinagdududahan na puro pansariling interes lamang. Lahat ng ginagawa ay para meron lang maipagyabang kay Bush!

  71. Of course, it should be different, Jr. Lad. Korea and Taiwan were considered part of Japan before WWII, with the Taiwanese being considered different from the Chinese, which in fact the native of Taiwan are.

    The Philippines was a territory of the US and not Japan’s, and the Japanese pre-war government were making ties with freedom fighters in the Philippines, Indonesia, etc. with its Asia co-prosperity sphere under the banner of “Asia for the Asians slogans!”

    You should read your history. It’s all there. I do not have to tell you that as a matter of fact. The comfort women were on the payroll of the military as the equivalent of the US WACs as a matter of fact. With the military considered illegal after WWII, there was I suppose the question of compensation for lost wages, and the comfort women were affected with a law passed limiting the pensions only to Japanese nationals. The pension was more like backpays that the soldiers were not paid during the fighting, not something like war booties or rewards as what Filipino soldiers and guerrillas had expected from Uncle Sam to pay them.

    The Koreans and the Taiwanese were given the option to choose in fact to be Japanese nationals so they could claim their pensions as members of the Japanese Imperial Army. There were no Filipinos listed there. Otherwise, the Americans would have made sure to ask Japan to pay and include such in the reparations package for the Philippines, which got the highest reparations rewards!

Siguro naman “average” lang tayo sa mga bansang mahirap. Ngunit bakit napaka-espesyal natin na hindi isa kundi dalawa, tatlo or higit pa ang mga lumalaganap na rebelde. May komunista at may jihadist na mga nag-aalsang nangangako ng Paraiso o demokrasya sa taong-bayan sa pamamagitan ng marahas at madugong paraan. Maraming mga NGO at party list sa lahat ng mga bansang ito, ngunit parang tayo lang ang mga ganitong grupo na tila may tinatago and kinukubli at ipinagtatanggol ang karapatan kuno ng mga gumagamit sa karahasan upang lutasin ang mga suliranin. Ang yabang naman natin kung tatanggapin natin ito. Wala akong paki sa idolohiyang gustohin ng nino man, ngunit walang karapatang gumamit ng dahas or ipagtanggol ang mga gumagamit ng dahas.

    Sa palagay ang karamihan ng Pinoy ay naniniwala rito, kaya nga hindi manalonalo ang mga komunista.     But there were also Asian women, particularly from the Korean peninsula who were physically coerced into joining the Japanese brothel bandwagon; we cannot say for sure how many but the truth is not all those who were recruited were willing to serve as prostitutes for the Japanese Imperial Army.

Even though a lot of folks around here preface their comments with “I am no communist but…” they actually believe this form of Philippine exceptionalism. We are not any worse or any better than the average in the developing world, yet we think we deserve the armed struggle, because the communists have terrorized us into thinking that we are.     What the ignoramuses do not know, Anna, is that there is a big difference between the comfort women and those women who became victims of gang rapes. At least, now there are NGOs helping victims of such atrocities even by their own countrymen as in the case of those women raped in Kosovo and Serbia.

    The comfort women were drafted. My mother-in-law said that they voluntarily joined the army out of needs perhaps because those were hard times the same way that Filipino women of today allow themselves to be recruited for work in brothels overseas because of hard life.

    My own mother has never heard of those Filipino comfort women but she sure knew about those Japanese, Korean and Taiwanese women catering to their soldiers during the war.     Hundreds of such complaints have been filed against me by the Philippine military and police before government prosecutors and judges. These complaints amount to nothing but propaganda rubbish from the desperately isolated and brutal Arroyo regime.     Under the direction of National Security Adviser Nor­berto Gonzales, the Interagen­cy Legal Action Group is under orders to complete 1,500 false charges against me before the end of the May 2007 election. What a waste of public money for producing pro­paganda trash!

    The latest move of the Philippine National Police (PNP) is to propagandize its supposed request to the International Criminal Police Commission/Organization (Interpol) to issue “red notices” to seek the arrest of myself and the NDFP negotiating panel chairman Luis Jalandoni for the purpose of extradition to the Philippines on the basis of a valid judicial warrant. But there is no extradition treaty between the Netherlands and the Philippines!

    I am used to false charges that come and go. These are cheaply fabricated by the Manila government. Remember that the 1998 charge of subversion against me was nullified by the repeal of the Antisubversion Law in 1992 and that the 1991 charge of multiple murder against me was dismissed by the Manila prosecutors in 1994 as something based on sheer speculation. In 1998 the secretary of justice of the Ramos government certified that there was no pending criminal charge against me.     On my part, I am not at all worried by the false charges being made against me by the military and police minions of the Arroyo regime. I laugh off all of them. Below are the strong factual and legal grounds for my confidence.

    First, the charges are so patently false, malicious and politically motivated.

    Second, the whole world knows that the leadership of the Communist Party of the Philippines and the command of the NPA are in the Philippines and not in the Netherlands.

    Third, I am protected by Article 3 and entirety of the European Convention on Human Rights and Refugee Convention.

    Fourth, there is no extradition treaty between the Dutch and Philippine governments.

    Fifth, under Philippine law itself, I am outside of the custody and jurisdiction of the Philippine government and cannot be arraigned and tried on any charge.

    The Arroyo regime is trying to show off that it can put down its Filipino critics anywhere in the world. But it only succeeds in exposing its callous intolerance for my exercise of the freedom of speech and its contempt for fundamental democratic rights. It has ignored the findings and conclusions of fact-finding missions by human-rights organizations, international civic organizations, religious organizations and the UN special rapporteurs on various aspects of human rights.

    The Arroyo regime is intensifying its campaign of vilification against me in a futile attempt to counter the impending Permanent People’s Tribunal in The Hague, Netherlands, from March 21 to 25, which shall try the case of the Filipino people against the Arroyo regime and its imperialist accomplices headed by the US, on the three major charges of human-rights violations, economic plunder and transgression of Philippine national sovereignty. The case has been filed by families of the victims of human-rights violations, human-rights organizations, Ba­yan and the Ecumenical Bishops’ Forum, among others.

    I dont know what crime ka Satur was charged with. If its murder, 20 years ang prescription. The problem is, the case vs. Ka Satur is pending in court for 22 years.

    The real killers of Ninoy Aquino are now scot free. No case had been filed against the real killers for 20 years, starting from 21 August 1983. Even if they are arrested now for killing Ninoy, they cannot be prosecuted for it.

    For anything Filipino, don’t rely on a Japanese. Most especially a Japanese ex-Pinay.

    Actually, i don’t know. I’m also puzzled. In court, he would have to invoke the amnesties given to him by Cory and FVR.

    That 22-year old case is pending in court, so prescription does not run.

    Wala nang maisip siguro. Ang sipag nga nung naka-unearth nitong 22-year old case.
