The gall of Navera

The temerity of Juan Pedro Navera,senior state prosecutor, to complain about the decision of President Aquino to grant amnesty to some 300 military officers and soldiers that stood up against Gloria Arroyo show that Justice Secretary Leila de Lima is presiding over an organization, many of whose personnel have still a mindset of impunity that characterized the Arroyo administration.

This is a serious challenge to President Aquino’s reform agenda especially in the area of anti-corruption. This is as problematic as the issue with an Arroyo loyalists-dominated Supreme Court.

A newspaper report quoted Navera as saying that his seven years of hard work to convict the Magdalo officers and soldiers have come to nought with the issuance of the President of Proclamation 50 giving amnesty to military officers who were allegedly involved the July 2003 Oakwood mutiny, the reported plan to withdraw support from Arroyo following the “Hello Garci” expose in February 2006 and the Manila Peninsula seige.

The amnesty proclamation renders moot and academic whatever decision of Judge Oscar Pimentel of the Makati Regional Trial Court trying the coup d’etat case against Sen.Antonio Trillanes IV and core leaders of the Magdalo.

The Inquirer report quoted Navera as saying, “If we want to respect the rule of law, if we want to bow to the court, we should wait for the court decision,”he said.

Since when did public prosecutors,reporting to an alter ego of the President, the Secretary of Justice, earn the right to tell the President what he can do and cannot do and when he should do it?

I ask Navera: Is there anything illegal in the President’s issuance of Proclamation 50.

If he can’t cite anything illegal about it, he better shut up. If he can’t shut up, he better resign. That would be one less unenlightened personnel at the Department of Justice.

Navera took pains to say that he was airing his personnel opinion and not necessarily that of his colleagues led by Assistant Chief Prosecutor Richard Anthony Fadullon.

Lokohin niya lelong niya.
It is known in the justice department that the reason Fadullon is doing his sabotaging of Aquino’s reforms in the Department of Justice through Navera is because he (Fadullon) is eyeing the post of Quezon City prosecutor.

I’d like to borrow lawyer Harry Roque’s Facebook shoutout to remind Navera of his complicity against the Filipino people: “To those ranting against the amnesty, where were you during the darkest days of our democracy? Bet you were with the evil one.”

Trillanes and company never stole a single centavo from the government. How about the person you defended? Think of the military establishment that allowed Maj. Gen. Carlos Garcia and his cohorts to steal millions of pesos from funds that should have been spent buying boots, helmets, and medical equipment for the soldiers risking their lives in the field.Think of those who sold bullets and guns to the insurgents as well as the Abusayaf bandit group, that the Magdalo pointed out “bullets that are used to kill us.”

Think of the officers including former AFP Chief Hermogenes Esperon who participated in subverting the will of the people in the 2004 elections.

It was seven years of injustice against the Filipino people. And Navera is proud of that?

    So what if he spent 7 useless years trying to outwit these military officers; that he didn’t suceed is a measure of his stupidity, i.e., his charges perhaps had no leg to stand on.

    Sec. de Lima shoud do something drastic to Navera and Fadullon, ipatapon sa snake island! Winarak ng todo ni Gloria ang justice system at itinutuloy pa nila, mga anay ni Gloria!

    Kahit mas maayos sana kung sa hukom maresolba ang kaso, sa tagal ng panahon, maaring sabihin na walang mararating ang kaso na hindi mabubulgar ang mga taong nasa mataas na posisyon na sangkot sa daing ng magdalo group.

    Sa ganoon kailangan magsalita si penoy na buo ang loob niya sa amnesty – na maituturing ng whistleblowing ang ginawa ng magdalo group at sa ngalan ng katarungan ay dapat ng ihinto sa madaling panahon ang isyung ito. Ifa-fast track daw sa senado ang Congress ang amnesty – dapat magsalita si penoy dito, at sabihin at pangakatawanan na iimbistagahan sa lalong madaling panahon ang akusadong kurakot na binubulgar ng magdalo, oo pati na mga tao sa prosecutor office, kung may pansarili silang(kung sino man) layunin sa kaso.

    Dapat din baguhin ang mga salitang “Oakwood Mutiny” o ano pa mang salita na nag-iimply ng guilt samantalang wala pa namang disisyon sa hukom, at tanungin kung bakit kay tagal dumating ng hustisya.

    Ang mahirap dito e mabilis si penoy ang mga review-review kapag mga bata niya ang sangkot pero itong kasong nabulok na sa lamesa ni Navera e hanggang ngayon e palpak pa rin.

    Paano na yung mga dinukot na mga istudiyante ng UPD, yung journalists, yung mga tunay activists na binaril ng sakay motor ng assassins? Paano na sila?

    Marami ngang problema na dapat iresulba, pero kung mahusay kang magdelegate ng trabaho, magagawa yan.

    Very well said. I couldn’t agree with you more. This person is either trying hard to create controversy to make waves to build up his name or is paid by Arroyo to confuse people or much worse, is extremely stupid without even knowing it.

    I expected Aquino to grant amnesty to Sen. Trillanes and other Magdalo members much earlier. When Malacanang knew that a decision would be handed down sometime October, they beat them to the punch.

    I’m very happy that the much deserved amnesty is at hand.

    Kudos to Sen. Trillanes and the remaining Magdalo soldiers who were granted amnesty. I just hope that the amnesty would be revised and allow those who would like to continue their service in the military to do so.

  25. Update:Court grants Trillanes plea to defer trial for rebellion

    A Makati court yesterday granted the appeal of detained Sen. Antonio Trillanes IV and the other military officers belonging to the Magdalo group for a deferment of yesterday’s hearing of the rebellion case in connection with the 2007 Manila Peninsula Hotel stand-off.

    The case is being heard by Judge Elmo Alameda of the Makati Regional Trial Court Branch 150.

    Trillanes on Tuesday asked for the deferment in view of the amnesty proclamation issued by President Aquino last week for soldiers involved in uprisings against the past administration. He said Proclamation No. 50, once concurred in by Congress, will render the rebellion case moot and academic.

    The Senate and the House have said they are prioritizing the approval of the concurring resolutions when Congress resumes session on November 8 after a three-week break.

    Another court is hearing a coup d’état case against Trillanes and other Magdalo officers for the 2003 Oakwood mutiny, the Makati RTC Branch 148 of Judge Oscar Pimentel who is scheduled to issue a ruling on October 28.

    Aside from Trillanes and former Brig. Gen. Danilo Lim, also facing rebellion charges are Captains Gary Alejano and Segundino Orfiano Jr.; Lieutenants (s.g.) Eugene Gonzalez, Andy Torrato, Arturo Pascua Jr., James Layug, and Manuel G. Cabochan; 1Lt. Billy Pascua; 2Lt. 2Lt. Jonnell P. Sangalang; Cpl. Clecarte Dahan; Privates First Class Juanito S. Jilbury, Emmanuel C. Tirador, German M. Linde, Julius J. Mesa, and Cesari Yasser Gonzales; and Ens. Armand Pontejos.

    Marine Capt. Nicanor Faeldon, who also participated in the walkout, has yet to be tried in the case as he escaped at the height of the standoff at the hotel. He recently surrendered and is now detained.

    The court earlier dismissed for lack of merit similar charges against 18 civilian personalities led by former Vice President Teofisto Guingona Jr., former UP President Francisco Nemenzo, Infanta Bishop Julio Labayen and actress Bibeth Orteza. – Ashzel Hachero

    Gloria and her cabal of generals headed by that corrupt and arrogant sonovabitch Angie Reyes (yes, he was very corrupt — talk about the JCPV class and what he did in London if you please) and his three major command stooges (lesser sin though for former LtGen Benjie Defensor PAF because he did try to stop Angie but could not prevail) went all out in violating the sacrosanct Constitution with the complicity of another pig head, Davide, committing not only rebellion but goddamn coup d’état and yet justice went not only blind and shy but goddamn dead where they were concerned…

I would support him [yes, support him] if he would first prosecute the 2001 violators of the Constitution. If he can’t do that, he should stop complaining and if he can’t get it into his thick head that justice should know no person (high or low), he should hang himself from the highest lamppost and be done with it.

    No matter how one tries to deodorize a stinking sh*t. The smell will linger still. Now comes the allege cover-up of the Glorietta “bombing” according to Ret. Col. Allan Sollano, he “was the leader of the Army Explosive and Ordinance Disposal Unit in 1 of 4 teams that investigated the Glorietta blast in October 2007.”

    According to Sollano, then Gen. Ricardo David, now AFP-CS instructed him to lie about the incident by saying it’s methane gas explosion and not caused by a bomb.

    Now the question is, will PNoy ask for the reinvestigation of the case assuming that further proofs points to a cover-up by GMA’s administration? Since Sollano directly accused David will the AFP-CS’ head roll or will he be “protected” by the president?

    Don’t get carried away with statement like this. Odds are quite high Trillianes will be a rich man if he gets reelected again in the senate (god forbids), and Gluerilla to him will be a blurr in the past.

    Narvasa, Fortun…all these well paid lawyers are the protectors of big time criminals. While they are free to defend anyone even if he’s guilty of a crime, dapat man lang sana may conscience sila. Kung alam nila na may kasalanan ang kanilang client, bitawan na lang nila at hindi puro pera lang ang habol.
