Nagsampa kahapon sa Supreme Court ang labin-isang personnel ng ABS-CBN ng kaso laban sa mga opisyal ng pamahalaan na sangkot sa pag-aresto at pagposas sa mga mamamahayag noong Nov. 29 na insidente sa Manila Peninsula.

Humingi sila ng writ of amparo or pagbabawal sa mga kapulisan at sino mang opisyal ng pamahalaan na kasuhan sila tungkol sa nangyari noong Nov. 29 at ulitin ang kanilang ginawa na panggigipit sa media sa mga coverages na mangyari balang-araw.

Ang mga nagsampa ay sina Ces Drilon, senior correspondent; Mayjay Cabalit, researcher; Melanie Masecampo, segment producer; Ruperto Ambil II, field producer; Mark Cadampog, field producer; Emelito Hao, cameraman; Norbert Calupitan, cameraman; Alexis Acuin, Engineering van technical crew; Bernie Lito Mallari, cameraman; Ransy Villan, microwave technician; at Noel Alamar, DZMM Radyo patrol correspondent.

Ang kinasuhan ay sina Interior Ronaldo Puno, Raul Gonzalez, PNP Chief Avelino Razon, NCR Police Chief Geary Barias Police Supt. Asher Dolina, at ilang opisyal pa ng DILG at DOJ.

Sa kanyang pahayag sinabi ni Ces Drilon, “Noong nasa Peninsula Manila ako ang aking sampung kasamahan sa ABS-CBN ang tangi naming pakay ay maghatid ng balita sa aming mga manonood. Sa bandang huli, sa hindi namin inaasahang pagkakataon at kagustuhan ay kami na ang naging balita, dahil sa ginawang paghuli ng awtoridad.

“Ngayon kami ay nasa harap ninyo dahil sa pagdulog namin sa mataas na hukuman upang ihayag na hindi maaaring isawalang bahala ang pag-aresto sa amin ang ang mga sumu­nod na banta ng mga katungkulan. Hindi po ito tungkol sa amin kundi po para sa lahat ng mga mamamahayag — upang galangin ang malayang pamamahayag na napakahalaga sa isang demokratikong lipunan.”

Sa kanilang demanda, isiniwalat nila ang pahirap na ginawa sa kanila ng mga pulis.

Si Ambil na siyang unang-unang lumabas sa Rizal room kung saan nandoon sina Sen. Antonio Trillanes, Brig. Gen. Danilo Lim at iba pang opisyal ng Magdalo. Sabi ni Ambil, pinaluhod siya at hinablot ng Special Action Force na pulis ang kanyang ID.

Si Acuin naman ay pinadapa sa sahig na maraming bubog mula sa salamin na binasag ng tangke. Nasugatan pa nga ang kanyang kamay ng bubog. Pinaluhod din sina Calupitan at Hao hapang tinututukan sila ng baril.

Si Melanie Masecampo, hindi pinayagan pumunta sa restroom kahit na i­hing-ihi na. Kaya napilitan kaming sumama na sa mga pulis sa Bicutan dahil nag­­­ma­kaawa si Melanie, “Sige na pumayag na tayo kung saan tayo dalhin para makaalis na tayo dito at nang makaihi na tayo.”

Sa sobra talagang hirap ni Melai, nang huminto ang bus sa Camp Bagong Diwa, tumakbo pababa kahit hinaharang siya ng guwardiya sa bus. Doon siya umihi sa likod ng isang kotse.

Ang isinampa ng ABS-CBN kahapon ay simula lang ng aksyon ng taga-media para protektahan ang malayang pamamahayag na mahalaga upang mapanatili natin ang ating demokrasya. Sa loob din ng linggo na ito, mas maraming journalists pa ang magsasampa ng kaso laban sa mapanupil na admi­nistrasyong Arroyo.

Apostol: ‘amparo’ on Nov. 29 is moot

Several members of the media have sought the intervention of the Supreme Court over the arrests that were made against them following their coverage of the siege at a hotel in Makati City last November.

In a 35-page petition for a writ of amparo and/or a writ of prohibition, the journalists, all from television network ABS-CBN, also sought the high court’s protection from similar actions in the future by the government.

“We are asking the high court from effecting and making threats of, future warrantless arrests and acts of harassment of petitioners and other journalists, in the course or in consequence of the legal performance of their work, such as in the live coverage of breaking news events similar to the Manila Peninsula stand off,” the journalists said.

Petitioners said their arrest last November 29 when rebel civilians and soldiers, led by Senator Antonio Trillanes IV, took over the Manila Peninsula Hotel to dramatize their demand for President Gloria Macapagal-Arroyo to resign not only violated their rights to liberty and security but also their right to free speech, free press and right to information.

“This is not only a fight involving journalists but this is also a fight of the people,” the group’s lawyer Mario Bautista said.

“Their constitutional rights to liberty and security were violated when they were illegally arrested. But worse, there continue to be very real threats that such rights will again soon be disregarded and infringed upon. No less than some of the most powerful officials in the government have warned that petitioners, and other journalists, may once more be illegally arrested, harassed, and prosecuted for such past and future, coverage of news breaking events,” their petition read in part.

They said illegal arrests, acts of harassments, were intended to intimidate, scare, cow, and bully them and other practicing journalists in the country.

Defending their assertion that their arrests were illegal, the petitioners stressed that there was no ground for their warrantless arrests because “they were not committing, were not attempting to commit, nor had they just committed an offense in the presence of an arresting officer.”

The petitioners added that warrantless arrests required not only probable cause but also good faith on the part of the arresting officers.

“Here there was no probable cause. Worse the arrests were tainted with bad faith and malice and were intended to harass, intimidate, cow and scare journalists in the legitimate performance of their duties. This is evident from the palpable arbitrariness and heavy-handedness attending the arrests,” they said.

Named respondents in the petition were Interior and Local Government Secretary Ronaldo Puno, Justice Secretary Raul Gonzalez, National Police chief Avelino Razon, PNP-National Capital Region chief Geary Barias, Chief Superintendent Asher Dolina, and several John Does.

The petitioners are Ces Orena-Drilon, Mayjay Cabalit, Melanie Masecampo, Ruperto Ambil II, Mark Cadampog, Emelito Hao, Norberto Calupitan, Alexis Acuin, Bernie Lito Mallari, Randy Villan, and Noel Alamar.

    It was reported that there were about 40 journalists present in that Manila Pen incident. Why only 11 petitioners? Famous journalists like our very own Ellen and Herman Tiu Laurel did not sign the petition. Why? During the Press Conference, ABS-CBN legal counsel Atty. Bautista said it’s understandable many journalists did not sign the petition out of fear. No one wants to go against the big guys. Their family members might be harassed in the street, at the airport making the lives of these journalists and their families difficult. I’m sure Ellen, Herman and the others are not afraid. However, may we know why they did not join the petitioners? Or are they still thinking about it? What’s making them hesitant? Inasmuch as the topic is about this Writ of Amparo, I think we here deserve some answers not only to satisfy our curiosity but for our information and guidance. Thank you.

    Thanks a lot, Ellen. Please update us on this matter. I now remember that your group is filing a class suit. Maybe it might affect this Writ of Amparo that ABS-CBN initiated. Well, tambakan natin sila ng mga kaso at tignan natin kung saan sila dadamputin. Ang hirap sa mga iyan akala nila sila lang ang marunong magdemanda. As far as I know, never has the media been so determined in fighting against the government. Kung noon, kadalasan ang media ang nadedemanda…ngayon nagkakaisa ang media regardless of their network affiliation in their fight against the government’s abuses and violation of press freedom. Anong say mo FG Mike Arroyo? Bakit tameme ka ngayon?

    “Forum shopping is considered a serious offense which can be made by a complainant. The law in the Philippines explicitly prohibits the filing of more than one case for the same cause of action in any forum or court of law. The prohibition is done so that the courts will not be clogged by complaints of people who may file more than one complaint in an effort to gain a favorable decision in any of the numerous cases filed.” – wikipedia

    A good strategy is for the complainant to affix his/her signature in one complaint alone, kaya siguro hinati-hati ang mga journalist(media)into groups.

  9. The more the merrier. The first class suit is the one submitted by TV people. Next will be the photojournalists, I suppose, and the other one will be for news reporters and columnists.

    Kailangan mag-ingay to be heard around the world para mapahiya iyong magnanakaw when foreign media bombard her with questions when interviewed during her official and unofficial foreign trips that the media in the Philippines should in fact verify as to their nature para hindi sila madaling madenggoy ni Dorobo.

    Try your best Maám to file the necessary action against these gov’t officials who suppressed our media journalists during the PEN standoff.

    This is a fight between people of the Philippines AGAINST GMA regime. I do believe na susuportahan kayo ng mga magigiting nating abogado at ng sambayanang Pinoy sa labang ito. Para maparusahan kung sino ang nagkamali, para di na maulit uli ang ganitong scenario sa pagyurak ng mga awtoridad sa kalayaan sa pamamahayag.

    That’s what I thought, Ellen…why you didn’t join the petition. I didn’t get to see the content of that Writ of Amparo as well as the class suit your group is preparing. Kapag pareho ang laman ng demanda, baka ma-technical pa di ba?
    Natatawa ako kina Ces Drilon na binubuyo ka sumali, Ellen. Of course it’s a big plus for them if you join them.

    Bakit ka mo, kasi nga eh nangodiko pa sa taga-Latin America para lang maipatupad sa Pinas ang writ of Amparo (legally means protection). Hay naku, ito ang ginaya nila, “Mexico’s amparo is found in Articles 103 and 107 of the Mexican Constitution, It consists of the judicial review of governmental action and empowers state courts to protect individuals against state abuses.

    Eto ang napulot ko & it says, “The writ of amparo shall hold public authorities, those who took their oath to defend the constitution and enforce our laws, to a high standard of official conduct and hold them accountable to our people.

    Hay naku itong Supreme Court natin eh walang K, ano ba ang ginagawa ng Art.III, section 4 (source: Constitution) and Chapter 2, Art. 26 & 32 (source: Civil Code of the Phil.) at bakit wala bang ngipin ang mga batas sa Pinas?

    Look, Chief Justice Reynato Puno officially announced on September 25, 2007 that the Supreme Court of the Philippines had promulgated the Writ of Amparo.

    Nakapanggigigil talaga itong Korte Suprema natin, mga boba pala pag ipatutupad na ang batas?

    Gusto mo eh batuhin mo yan ng Article 32 ng Civil Code para matauhan. Tingnan mo ang linaw ng sinasaad dito, it says, “Any public officer or employee, or any private individual, who directly or indirectly obstructs, defeats, violates or in any manner impedes or impairs any of the following rights and liberties of another person shall be liable to the latter for damages:

    …..2) Freedom of speech. 3) Freedom to write for the press or to maintain a periodical publication; 4) Freedom from arbitrary or illegal detention; 8) The right to the equal protection of the laws; 11) The privacy of communication and correspondence; 13) The right to take part in a peaceable assembly to petition the gov’t for redress of grievances etc. etc.

    Dapat sunugin na ang mga batas na ito kung wala rin lang ngipin at kapangyarihan to prosecute whoever guilty on the above issue.

    ..narinig ko kanina ang isang opinion regarding Supreme Court justices dito sa US- sa Bloomberg news..all the justices were appointed by a President and their term is for life…they were appointed to protect the constitution..sa ngayon 4 ang conservative, 4 liberals and si Justice Kennedy ang swing vote..and the main reason of the Supreme Court is to protect the constitution..and the rights of the people..I suppose kanoon din sa atin..Lady Justice when equal scales she holds is blind…Supreme Court Justice when nominated goes through a very thorough investigation..before appointed by the Committee of Appointment…nakita ko dito ang ganyan…noong araw mukhang kanyan din sa atin..pero sa ngayon the wind blows differently…at mukhang sunod sunoran lang sa Death of Justice Secretary at hawak sa leeg ni Goria..ang lagay ay iba ngayon..it is not only tragic, it is pathetic…

    Forum-shopping. Namimili (there are no interpretations of the Tagalog word – choosing, or buying) ng “friendly judge”. A litigant files a case before a court, then when the raffle lands him with a judge not of his liking, he withdraws, then files again, to get a chance at being raffled to a “friendly judge”.

    Or, if there are several litigants, they file separate cases, so they have more chances for a friendly judge. Once one of them gets raffled to a friendly judge, then they move to consolidate the case of the unlucky party who is before another judge, so that it is tried by the friendly judge.

    The big law firms do not need to do this. They just fix the raffling.

    That maneuver is not the monopoly of the crooks. It is also employed by the government, including the Feds in the US.

    In the case of Padilla, the Latino accused of being a member of the Al Qaeda, a petition for habeas corpus was filed by his lawyer in New York, where Padilla was initially incarcerated. New York has the reputation of being liberal, so the government moves Padilla to a South Carolina military camp, because those States are conservative.

    The Supreme Court of the United States held that one has to sue whoever is holding the prisoner, for which reason, New York had no jurisdiction. This is an obvious case of forum shopping of the Federal government, under the all-purpose guise of “security concerns”.

    A woman journalist was caught on video by a TV news team helping fugitive Marine Capt. Nicanor Faeldon escape when troops stormed the Peninsula Manila hotel in Makati last year, according to a police source.

    The source said the journalist is neither Ces Oreña-Drilon of ABS-CBN nor Ellen Tordesillas of Malaya newspaper.

    atty: ang ibig bang sabihin ng “raffle” as you used here..parang sa lottery? akala ko kung saan ang venue ng crime doon ang pag file..as in the case of Nov. 29 walk out it happened in Makati kaya doon..I remembered reading a case here in NYC and they doubted the possibility of finding jurors that would be fair or unbiased the lawyers asked for another trial venue..pero sa Phil. hindi naman jury system.. I dread to be called for jury duty..kaya lang nakakalusot ako kasi kung criminal case..and I would be asked if I know or knew of someone in the police force. My late sister used to work as a forensic chemist at the NYPD for more that 20 years..and kung civil case naman like as in landlord tenant..I have a sad experience of naloko ng tenant..hindi na nga nagbayad for a couple of months..na awa ako at hindi ko pinalayas nag bakasyon ako-pagbalik ko umalis sila…kaya hindi ako naka serve as juror..

  32. OK lang sa US, Rose, kahit may papaano dumaan sa election ang choice ng mga kano. In other words, well-consented ng kalaban. Sa Pilipinas, nakakatakot dahil alam ng lahat na lumabag ng batas si Gloria Dorobo when she cheated, stole votes, and worse plundered the treasury when she ran for president in 2004. Huwag na natin i-consider ang pagyurak ng Constitution noong 2001. Kasabwat doon iyong mga appointees ni Cory at FVR.

    Imagine a Supreme Court na ang nagpapalakad mga appointees ng isang kriminal. Dios mahabagin!

    Iyan ang napala nilang gaya-gaya sa mga kano hindi naman pareho ang kultura, etc.!

    When a case is filed, may raffle, as to which among the judges will hear the case, o sa Tagalog/Spanish, kaninong sala mapupunta ang kaso.

    Basically, parehong batas ng Pilipinas except for that clause on the rearmament of Japan and the status of the Emperor sa Constitution ang in-impose ng mga kano sa mga Japanese, but unlike the Filipinos, hindi nilulunok ng mga Japanese ang utos ng mga kano ng walang laban.

    Nelbar, I understand how you feel about Villar. Pero kung hindi patatawarin ni Erap ang lahat na nagtaksil sa kanya, baka siya na lang ang mag-isa. Talagang ganyan sa politics. At sa tutoong buhay, maawain at mapagpatawad si Erap. Hindi lang ako papayag na patawarin niya si Chavit Singson. Here are some of the names who helped in his ouster: Guinggona, Cory, Pimentel, Legarda, Villar, Civil Society, media, religious groups like JIL, militant groups, Angie Reyes, etc. Marami sa mga nabanggit ang kampi kay Erap ngayon. I personally think a Villar-Erap team is a very good one. Mas okay naman kesa kay Legarda, Roxas at kung sino pa. Of course ang first choice ko si Ping Lacson. But I don’t think Ping is in the best relationship with Erap at present.
    Ma-pride din kasi itong si Ping.
