The Madriaga files on NBN/ZTE

The following document landed in my mailbox. It’s supposed to have been written by a certain Dante Madriaga. Read on for what it’s worth:

I am an electronic/electrical engineer by profession.I attended the University of the Philippines and Texas A&M University.I have been in the communications industry for over 30 years.

I was a part owner of a company in the LISP in Cabuyao, Laguna that exported microwave radio transmitters.I was involved in the original design of the ARESCOM proposal using a concept similar to what Joey De Venecia thought about .I have been involved in the preparation and design of the NBN ZTE proposal since the beginning.

I have been a technical consultant for the project involved not only in the design but as a liaison to NEDA, DOTC/TELOF/CICT. I was involved in all discussions regarding the project including the names of other people involved, margins and actual pricing details.

ZTE International signs an MOU with the government on March 14 on a National Broadband Network project.

The following is my account of the project from the start to the time when the negotiations were turned over to the finance group. With the exception of the China trips I was present in all the meetings. There may be some omissions and oversights some of it done on purpose

May 2006 -The project was brought to ZTE on May 5 by a person named Stephen Lai, who was originally with Arescom and is a personal friend of the Arescom president Cris Ching. ZTE approached Chairman Abalos whom they knew to help on the political side.

Chairman Abalos enlisted the help of Ruben Reyes a golfing buddy to come up with a team to expedite matters. Ruben Reyes contacted General Quirino de la Torre and Leo San Miguel. I was approached by Leo San Miguel whom I had known before to work on the project. I provided Leo inputs on the Arescom proposal which ZTE used as a basis to start their design.

June 2006
– Ruben Reyes, Leo San Miguel, Gen. de la Torre, Stephen Lai, Yu Yong, Fan Yang meet on June 16 at the Makati Shangri-La in a private environment to discuss the NBN project. They were later joined by Chairman Abalos who left first. We start the design work but are hindered by cost constrains. There is no possible way to achieve the $130M Arescom budget with the commissions that were needed. They decide to increase it to $190M and later added some more components to make it $262M.

Same group meet on June 18 with the addition of Secretary Mike Defensor and Abalos Chief Of Staff Paz and without Stephen Lai meet in Wack-Wack to discuss details on the commissions.

July 2006
-We make initial presentations to CICT and Telof at the CICT office. Chairman Sales was present together with then Telof Asec. Frank Perez the son of Sec Nani Perez, Commissioner Lorenzo Formoso, ZTE personnel and the DOTC/CICT technical staff.

Chairman Sales initial comment was that the NBN project was best left up to private but promised to review the proposal and make recommendations.We made similar presentations to the NEDA infrastructure group, present was the ZTE group including Fan Yang and the accounting personnel of ZTE. NEDA writes a letter to us citing objections to the initial design.

PGMA signs an MOU on July 12 designating Sec Favila to negotiate with ZTE on the government’s behalf. Group meets on July 25 in Wack-Wack to solve the problems.

August 2006
-Then DOTC Asec. Perez makes a presentation and objects to the cost and the design. I work with the NEDA group to smooth out their objections.
Asec Perez who openly discredits the project is promptly replaced by Comm. Formoso who vowed to help with the implementation.Asec Formoso is a better choice than Asec Perez because he is an engineer and a lawyer and can defend the project well.

Chairman Sales reviews the project but is still not convinced; thru back door channels he changes his tune at a later date.

Group on August 11 goes to China and demand an advance payment upon orders from the boss ostensibly to facilitate the approval and for PR. Chairman Abalos leaves first over the weekend. They get it after mentioning the name of the FG. Ruben Reyes is designated as the recipient.

Group comes back from China on August 15 and meets again with Chairman Abalos to tell of their success. US$ 1M was doled out , Ruben Reyes was designated as the recipient.

September 2006 -Group meets regularly at Wack-Wack every weekend at night to discuss ways to facilitate the approval of the project.

NEDA status is ok but all of a sudden meets a sudden resistance from Director General Neri.

Group meets at Wack-Wack on September 22 to address the problem.We meet Sec Mendoza at his office and make representations. Secretary does not hear the full presentation but endorses us to the then head of legal Atty Noel Cruz.

DOTC legal returns the endorsement of the NBN project to the CICT.
Design is changed again trying to fit the commitments. ZTE and group argue on the profit margins, they finally decide on September 28 that the increasing the project amount to $270M will give them a margin of $70M each.

October 2006
– The name Joey de Venecia suddenly comes into play and makes the group worried. He wants the same project but on a BOT scheme and is adamant about it, he had the idea long before Arescom and ZTE conceptualized it in fact the whole idea the Arescom proposal came from Joey

Leo San Miguel is tasked to fix the problem since he personally knows Joey. The negotiations do not progress because of Joey’s distrust for the group. Group meets at Wack-Wack on October 11 and decides to ask the FG for help on how to handle Joey.

Ruben Reyes, Chairman Abalos and General De La Torre fly to China on October 14 and discuss the problem with the ZTE officials about Joey. ZTE is alarmed but is reassured that everything will be taken care of with the intervention of the FG.

November 2006 -Group is notified on November 12 that the President does not want to borrow and instead wants a BOT scheme similar to the AHI proposal. Group decides to compete with Joey and brings an alternate solution by bringing out a competing BOT offer.

Joey is unfazed since he holds all the cards at NEDA with his father’s help and stonewalls the group’s effort. Group meets almost daily to discuss ways to resolve the issues. ZTE is furious at group for not controlling the situation.

Group decides that the only way that Secretary Neri would not object is to offer him a commission of US$ 4M at that time the exchange rate of 50-1. Chairman Abalos is designated to fix the problem.

December 2006
– Group submits a proposal to Chairman Sales changing strategy and hoping to revive the NBN proposal to a BOT similar to Joey’s proposal.

In a meeting in Wack-Wack in December 5, FG and Abalos try to convince Joey to just partner with them and quit his objection. In the meeting at Wack Wack FG threatens Joey by telling him to back off and stay out of the project.

ZTE tries to help out in the conflict and even designs the AHI network thereby exposing their pricing to Joey’s group.

Group goes to China on December 27 with Joey to fix the problem, they meet with ZTE officials at ZTE HQ but the negotiation fails. It was during these negotiations that Joey brought up the idea of ZTE partnering with Hwawei, another Chinese supplier. The suggestion is promptly dismissed by ZTE and negotiations break down. Group demand an advance and promptly got it from ZTE before the arrival of Joey De Venecia. Ruben Reyes is again designated as the recipient. US$5M was doled out.

January 2007 -Group abandons the BOT proposal and decides to meet Joey De Venecia’s AHI group head on with their own BOT proposal. Asec Formoso organizes a defense by creating a Technical Working Group (TWG) to evaluate the proposals of ZTE, AHI and Arescom.

It comes as no surprise that the TWG comes up with a report tilted in favor of ZTE because all of the members are either TELOF or DOTC personnel, they do not want the offer of AHI since it will be implemented by the private AHI group.

Group plots strategy and enlist Secretary Mendoza since Chairman Sales is a technocrat and Secretary Mendoza is a long time ally. Group decides to move Telof back to DOTC citing the reason that CICT is a commission and cannot implement a project of this magnitude. In the end Secretary Sales signs the endorsement of the project anyway.

February 2007
-TWG finishes the evaluation and hands it to the Technical Working Committee (TWC) who promptly endorses it to Secretary Mendoza.
ZTE is endorsed to NEDA by both Mendoza and Sales.

Joey is not impressed and files a complaint about the ZTE proposal to whoever would listen citing the disadvantages to the government. The project at NEDA is delayed and the much needed NEDA approval is stalled. Secretary Neri does not seem to be favoring the NBN and appears to be part of the problem because he likes the AHI proposal rather than the NBN which requires a government guarantee.

March 2007
-Help finally comes on March 8 in the person of Ricky Razon who helps them secure the approval of PGMA in order to meet the deadline for final NEDA approval by the executive.

Group meets on March 12 in Wack- Wack with Yu Yong and Fan Yang but could not agree on how to handle the compensation for Razon. They finally expand the proposed coverage to increase the amount to $329 thereby solving their problem.

Joey is furious when the NBN proposal is approved and threatens to expose all the dealings that stopped his much superior proposal. Group does not appear to be worried and thinks it is just sour griping. Upon approval by the NEDA group meets on March 28 in Wack Wack with ZTE and demand another cash advance which they got. Ruben Reyes is the designated recipient again.US$10M is again doled out.

April 2006
-Group meets again in Makati Shangri-La on April 4 with Yu Yong and Fan Yang of ZTE to discuss ways of getting upfront money to finance partly the elections and some personal needs. Ruben Reyes is again designated as the recipient.US$ 30M is again doled out.

Yu Yong agrees but on the condition that PGMA be present at the signing. PGMA promptly goes to China to witness the signing.
FG cannot participate since he is hospitalized and Abalos is busy with the elections. Ruben Reyes takes over all of the negotiations and transfer of funds.

Upon arrival from China on April 27, Secretary Mendoza and Secretary Favila visit the FG and inform him of the good news.

    Right you are, balweg. FVR’s silence is suspicious again. Kung hindi niya makuha ang gusto niya kay GMA, ano man iyon uli, magpla-plano uli iyan ng coup. For all the shits this FVR has and does, let’s not underestimate his influence and connection in the military. For one thing, Amboy iyan si FVR. FVR-JDV in an unholy alliance with the opposition, militant groups, civil society and some religious groups might be the one we’re all waiting for to finally bring down this GMA. Hindi na baleng ayaw natin kina FVR…gamitin din natin sila katulad ng paggamit nila sa iba noon. Once GMA is out, let’s then deal with the other bad guys…

    Arroyo crony Ruben Reyes received $46 M dole out based on Dante Madriaga’s narration of sequence of events that led to $329 M NBN-ZTE broadband scam. There’s no surprise why $200 M kickbacks was added to the original $129 M price.

    The Gloria Arroyo government is controlled by Mafia boss Jose Pidal and protected by rogue AFP chief and some scalawag PNP elements. Where is ZTE scam Senate witness Rodolfo Lozada? Is he still alive?

    while the narrative – at first reading is convincing – it
    will have to stand the test of being heard in court.
    the court of public opinion is just simply that – an OPINION. the courts will have to weed out the truth in this claim. if it cannot stand the test of being heard in the RIGHT FORUM.
    i am curious – with so much details – why doesnt anyone file a case with the ombudsman (for sitting officials) and the courts (for the civilians involved)? puro report report report.
    i agree important ang report – but anung resulta nito? di ba sa korte din mapupunta? bakit hindi i-file and tingnan natin kung anung maging resulta?
    or sasabihin nanaman ng ibang may utak sa tuhod na wala din silang tiwala sa mga korte? e saan tayo magtitiwala kung ganun?

    Interesting indeed and dapat the Senate look into this..nagpapatunay sa pangyayari..Dante, ingat ka lang..baka ipadampot ka nila for this exposure..can the senate call him as a witness? Let us hear his story in person sa investigation sa Senado..

    Dante Madriaga is the same as LOZADA. This only confirms that the young de Venicia is telling the truth! I wonder who the bag man is. The senate should check this out PRONTO! Whoever Madriaga is, I hope that this time the Senate should secure him very well! Happy Gilmore, OMBUDSMAN? Heh,heh,heh, this entity too is very much in the DOROBOS pockets. Why can’t Ombudsman not do anything to the litany of Sabit Swingson’s corruption. Ang kaya ni Merceditas(which by the way is in the Fatso’s league-golf buddies pa daw)ay yung kalaban ni DOROBO. Merceditas filed a case against Binay, against the Iloilo governor(complete with police drama-isang batallion ng swat team who stormed the governor’s office) and some other mayors of Metro Manila. Did they succeed? NOOO! Most if not all of these politicians they harassed won overwhelmingly in the 2007 elections!
    COURTS? Forget it, almost all the judges are eyeing to be a Supreme Court Justice and will not raise any finger to convict any of the DOROBOS’ or anyone in their gang caught of any wrongdoing! And the Supreme Court, worst!

    Great expose, I could not agree with you more, but lingering ingrained nonsensical feelings are hard to lose, however, I am not impress whatever the motive or the purpose.The reasons;
    1) Bakit ngayon ka lang lumabas
    2)Ano ang ginagawa mo sa mga meeting or conference na iyon if you are not part of it.
    3) Bakit hindi mo sinamahan si JDV III sa senate hearing and be on his side.
    4)Kung namaterialized ang contract lalabas kaya ang expose mo.

    If the Madriaga File is true and Dante Madriaga is a real person, I’m afraid we may not hear from him after today. He will be likened to Lozada who, after initially raring to spill the beans before the Senate suddenly left for abroad. Now that he’s supposed to be back, where is he now?

  14. My editors said they checked with UP and records show Dante Madriaga as earning a BSE from UP in 1966.

    Try googling his name, you’ll find more info about him.

    I learned he is going to testify in the Senate.

    Kaya nga duda ako sa Madriaga na ito.I goggle his name and Malaya has an article on him;But,hindi ko alam kung papano ilink.Ito ang bahagi na nakasulat.

    He styles himself as Dante Madriaga. He tells people that he is the secret witness of Sen. Panfilo Lacson who has full details of everything wrong in the ZTE deal.

    I discovered that Madriaga will part with the information for money, not really to help find the truth. The first person he approached was Lito Banayo, loyal ally of Senator Lacson, showing him the draft of an affidavit on the expose. Lito immediately noticed that there was nothing new in the draft that Joey De Venecia III has not already disclosed before the Senate Blue Ribbon committee.

    Madriaga, represented by an agent, wanted P10 million. Banayo immediately informed Senator Lacson about the affidavit, not exactly to suggest that he buy it for P10 million but to warn his friends that somebody, using the name of Madriaga, is looking for suckers to buy a rotten bill of goods.

    Ellen, I am afraid for Dante’s life at this point, whoever he is. This regime systematically liquidates people who can testify against them or put them in jail like our Men of Honor in Tanay! The senate should do a better job of securing them. There are so many factions now fighting for power struggle. Let us not discount the very strong JDV-Ramos faction. If this faction took Lozada, mas mabuti pa. They may be kinder to him. But if it is the DOROBOS’ faction who has him, God forbids what will happen next. It happened already so may times-liquidation is a way of life for these in power.
    So may edad na rin itong si Dante. At least his revelations found its way to you. Thanks for sharing it with us.
    There will be a lot of researches to be done. At least now we have Joey and this Dante. One more witness has to come out in the open to collaborate the true story on what really happened in this fiasco.

    Dante Madriaga could be a fictitious name. He could either be Joey De Venecia or Lozada. But at this point, the author of that message is not important. What is more important is the content.

    Ellen, if that’s what your sources told you, then who are we here to doubt it. I just hope this guy comes to the open and testify if at the proper time. Cocoy, Joey and Lozada actually met the night before Lozada left. Joey told friends that Lozada was in tears.

For the protection of this Madriaga, kung talagang tunay iyong mga gunggong sa Senate na tapusin ang kasong ito with the Dorobo and cahoots off to jail for their crime(s), puede naman nilang puntahan where he is safer. Hindi naman kailangan na papuntahin pa siya sa Pilipinas para i-display and/or ipapapatay dahil delikado ang buhay niya if we believe the statistics that 1 out of 10 Filipinos becomes a victim of violence (frequency not specified though). Puede naman siyang mag-issue ng affidavit duly notarized by a lawyer there and the Philippine Embassy/Consulate in the US if he is there.

    Ako nga was advised not to go to Manila. Sabi ng isang kakilala ko, “Stay where you are. Kung pupunta ka dito, don’t get a visa from the Philippine Embassy kasi baka itimbre sa Pilipinas. Puede ka namang pumasok on a waiver.”

    Marami na kasi sa mga kasama ko sa advocacy namin on extrajudicial killings for instance ang either na A to A o inipit pagpasok sa Pilipinas. Kahit nga iyong pilipina na nagpatingin doon dahil may cancer siya, inipit pagpasok at paglabas niya ng Pilipinas even when she is a Philippine passport holder. Lalo pa siguro kung foreign passport holder. Karamihan pa nga gusto pang kikilan ng mga garapal.

    In short, not safe. An affidavit containing statements as those passed on to Ellen will suffice to establish a case. Kaya lang talaga, ito namang mga binoto ng mga pilipino, puro wala ring kuwenta. Naghihintay din ng lagay, I bet.

    Cocoy: So let’s join him to pray a lot of Hail Mary and Our Father…more than 2000 Hail Marys..With all of us praying for his safety I am sure the Blessed Mother will cover him with her mantle and I am sure Our Father will not abandon him..Let’s do it! United in prayers we can all help him and his family.. That goes too for the 28 detained officers and their family..

    Contemporary ko pala si Madriaga kaya matapang. Ganoon kasi kami hinubog noon. You bet, we were idealistic once upon a time over at UP, the supposed “citadel of truth” kasi maipagmamalaki.

    Sayang nasira dahil kay Gloria Dorobo. You bet, bumaba ang category ng UP for granting a mediocre like her an undeserving doctorate degree with a thesis I heard that was a doctored version of her father’s undergrad term paper!

    grizzy: You are right..that is why I am asking for each of us to say an extra prayer and collectively we will be united as one nation praying..individual commitment for an extra prayer..and that is why I am suggesting to people I know to spend an hour and pray wherever the Blessed Sacrament is exposed (for us Catholics)..because that reminds me of the time when Jesus prayed at Gethsamane and found the three disciples sleeping..and He said..”can you not watch with me for an hour”?..

    I have no reason to doubt the Broadband file of Dante Madriaga. The sequence of events complete with dates and names of persons involved made me believe that it is for real. When you tell a story and named persons who are the most powerful in this country and who are very much alive and can confront you and even eliminate you from the face of the earth anytime, then you must be telling the truth. He even confirmed the “back-off” incident between Joey and the Fatso and the 200m to be offered to Neri. By doing so he knew that he is risking his life and his family, He must be a very brave man to have the courage to come forward though it’s a little late, but it’s better than never. I suggest however that to formalize the existence of this file detailing the NBN deal, he should offer himself as a witness and submit his file in the Senate without any financial considerations. In that way he is clean, untainted and credible resource person.
    But considering that he is real and can’t do what he has to do, then he is nothing but a fake who just out there to confuse and muddle the issue.

Also, Rose, let’s not forget to pray that it will be God’s Will that should prevail, not the will of the devil via his possessed followers squatting at the palace by the murky river who are BTW reciting the rosary, too, as shown in a recent picture of feign holiness of the dorobo. May it be the Will of God that the Dorobo and her cahoots be removed soon even by Divine Intervention like a tsunami along the murky river!!!

  31. Sending Ellen a letter is already offering himself as a witness, Florry. What he should do is formalize it through through some lawyer or notary public. He does not have to go to the police, etc. considering the sad fact that the police in the Philippines is in cahoot with the criminals or better still, the police there together with the Department of Justice is now run by criminals and wannabe criminals. He is safer to send his affidavits/statements via some legal counsels. Kung hindi nga corrupt din ang bar association sa Pilipinas, puede din na ipadala ang affidavit niya through the bar association, and it can still be binding. But then, of course, I am thinking of how we do it in Japan, where things are made simpler to send the criminals to jail and make them be legally responsible for their actions. Taragis, isa pang dahilan kung bakit takot ang mga witnesses and not encouraged to tell the truth kasi iyong witness pa ang nakukulong for telling the truth kundi siya kayang ipapapatay! Tapos kunyari playing angel si Dorobo by granting them some “pardon” sabay takot kundi operan ng posisyon sa tabi niya para tumahimik sila!!! Galing talaga ng demonya! Puede ba, sipain na iyan?

    Yuko, the divine intervention we are praying for may now be just around the corner. I can smell it! The landscape has changed. From hereon there will be real FIREWORKS! Let us just watch as it unravels. Hindi lahat ay natatapalan ng pera. Some can settle for a position in the next administration which may be better than the money because they can instill worthwhile changes. Let us see amongst these players who will have the guts to oust these DOROBOS!

    Joey might be “high” on drugs, but the Arroyos must be “under medications” ….

    Very Good and Very Detailed accounts… but before we get too excited, let’s try to take a deep breath and look at the content of the letter on a wider and more scrutinizing perspective.. On my part, I have two points..

    1. We should be looking at the veracity and reliability of the email. Are the details, specially the dates, jiving with what have already been presented to the Senate committees? Kc pwedeng ‘kuryente’ lang ang email na ito to shoot down the more credible details given before.. bcoz remember, having conflicting info or date nullifies the validity of the information.

    2. Next is, look at the November 2006 entry saying “the President does not want to borrow and instead wants a BOT scheme similar to the AHI proposal.” It seems this line implies that MIDGET is actually favoring AHI of Joey DV. which conflicts to what Joey said before that FG & ZTE don’t want the BOT scheme kc mawawala ung “sa kanila”..

    I was able to watch “Strictly Politics” hosted by Pia Hontiveros with JDV and wife Gina as guests. Si Tanga medyo calm at controlled ang pagsasalita far from his fierce speech at the Congress. Pero si Gina matapang at palaban. “Hello Garci” and the famous “I Am Sorry” by GMA were discussed. Sabi ni Gina nandoon daw siya nang kunan iyong “I am sorry” speech.     In simpler language, it is a general principle given to affirm the two witness idea that is to govern all the civil and criminal courts. One witness is not enough to convict a man accused of any crime or offense he may have committed.
