My concerns were addressed – Gutierrez

Golez asks if the Philippines is getting correct information from Chinese group.

Former President of the Philippine National Oil Corporation Eduardo Mañalac, the signatory in the controversial Joint Marine Seismic Undertaking with China and Vietnam admitted that the seismic survey being undertaken in the South China Sea and in the territorial waters of the Philippines can be considered exploration.

“If you ask me as a geologist it (seismic survey) is one part of the overall exploration,” Mañalac said in his press conference Monday even as he insisted that the tripartite agreement is aboveboard. He said he signed the agreement after he was told that the agreement was legal.

Mañalac’s admission is significant because the Constitution states that “The exploration,development,and utilization of natural resources shall be under the full control and supervision of the State.”

Mañalac confirmed earlier reports that Ombudsman Merceditas Gutierrez,then the acting justice secretary, was very concerned about the agreement prior to its signing with China on Sept. 1, 2004 because of the word “exploration.”

He said Gutierrez concern was eventually resolved when it was decided to “limit it to just seismic work.”

The danger of allowing foreigners access to the country’s natural resources is now manifesting with the news item in China’s People’s Daily dated Nov. 20, 2005.

Rep. Roilo Golez (Parañaque), who is initiating a probe of the JMSU in the House of Representatives, said the People’s Daily reported,

“Energy companies of China, the Philippines and Vietnam onSaturday celebrated the completion of seismic data acquisition in the South China Sea, witnessing the first milestone of itnernational joint efforts to uncover teh energy resources in the region.

“The seismic data acquisition was conducted by China Oilfield Services Limited (COSL) with its exploration ship codenamed Nanshai 502.

“The ship accomplished the mission with only 75 days, instead of eight months, acording to Li Xunke, vice president of COSL.

“There were 11,000 kms of sensor cable deployed on the seabed in this mission, covering an area of around 140,000 square kilometers. The data were collected smoothly and are ready to be processed and analyzed.

“The announcement was made by Zhu Welin, vice president of China national Oil Corporation (CNOOC), the parent company of COSL.

“COSL won the contract for data acquisition with a competitive bid in August, thereafter Vietnamese and Philippine companies got the contracts fro data processing and interpretation respectively.”

Golez said the report proves that basic data acquisition was handled by the subsidiary of CNOOC, the China signatory to the JMSU. “It appears that the survey ahs been completed and these talks from Malacañang about extension or termination may be moot and academic.”

“I reiterate my question on whether the PNOC is getting complete data on very strategic infromation on our natural resources, with CNOOC subsidiary, not an independent survey group, handling the survey. I cannot understand why PNOC and the Philippine government did not demand an independent survey group,” he said.

    Whatever this son of a gun Mañalac is telling to the public thru media, he is one of the culprits. Being one of the signatories, he violated Article I – The National Territory of our constitution. He had signed the agreement as he was told that this is legal? How stupid he was! He doesn’t know how to read and don’t have the capacity to understand then what the heck he took the president post? Centido comun. If he was told by someone to kill his family will he do it as he was told that this is not a crime. Damn. He’s a moron.

    From a cooperating witness, this Leo San Miguel turned out to be a hostile witness that surprised many senators most especially Ping Lacson. What went wrong? Lacson could only say one word…”He was told to shut up.” I watched the hearing mostly in the first half. Before the hearing started, I saw San Miguel using his cell phone talking to someone. It was even shown in full view by the TV camera. Who was he speaking to? Was he threatened? He also had a lawyer accompanying him who turned out to be the same lawyer for convicted US soldier rapist Smith.

    As usual, two of Malacanang’s old duet attempted to use their old antics. At the heat of the questions and answers, Joker Arroyo raised an issue about proper procedure in calling witnesses. He together with Enrile tried to interrupt the hearing as if thinking viewers didn’t know their intention. Thanks God the other old Malacanang dog Miriam Santiago was not present. She only showed up the first hearing never to return. She attended the first hearing with only one purpose: To discredit Jun Lozada by bringing a bunch of documents that led to Lozada’s investigation today. Gringo Honasan, the very reliable side-kick of Enrile, has long become a different Honasan after being let go by Malacanang. He was there at the hearing to defend Malacanang too.

    Finally, whatever happens to Senate President Manny Villar’s warning that those who failed to appear at the hearing would be ordered arrested? It would also show the sincerity of Malacanang in scrapping the EO 464. But, only Sec. Favila appeared. Meldy Poblador, Malacanang’s money distributor and Cardinal Rosales’ niece, even arrogantly reasoned that it was irrelevant for her to attend the hearing. The ball is now on the Senate to make good its threat to punish these witnesses who continue to refuse to attend despite being issued subpoenas.

    We have a madame president who is eager to peddle our national patrimony through its lead agency the PNOC for Chineses commission.

    Under the constitution, exploration and use of natural resources are placed under full control of the philippine state, and can only be undertaken through private companies owned by Filipinos.

    Ombudsman Merceditas Gutierrez then acting justice secretary knew by heart about national patrimony and was not likely to approve of such agreement. However, the unlucky Merceditas Gutierrez serving at the pleasure of the madame peddler can only do so much without getting kicked out of the office. So, she did what she knew best, skirt the patrimony issue through language change to “seismic” from “exploration”.

    This gives PNOC president Eduardo Manalac the needed confidence of engaging a foreign company (COSL, a division of China National Oil Corp), though contrary to constitution is armed by legality of contract language. The PNOC president himself knew that the work done by COSL is exploration and had admitted seismic survey is indeed exploration.

    In substance, the vice president of CNOC himself through press announcement define the scope of the exploration laying 11,000 kms of sensors on the seabed with 142,000 square kms including the 24,000 square kms inside Philippine territory.

    We had a justice secretary Merceditas Gutierrez and PNOC president Eduardo Manalac who both towed the line of the madame peddler president Gloria Macapal Arroyo in selling our national patrimony for Chinese commission.

    There is nothing clearer of treason than for the highest government official who willfully violated the national patrimony under the constitution.

  16. I heard a portion of the hearing Tuesday where the other three witnesses aside from San Miguel who was the major witness of the day.

    As one who has met and investigated a lot many criminals, I thought the guy was trying real hard to be evasive, and main reason I guess Lacson tried equally hard to keep his witness a secret—para hindi ma-abduct ng Malacanang and briefed to tell a lie!

    With three witnesses sharing the same testimony about the lagay that Abalos tried to fleece from the Chinese, how can the testimony of one lying witness have more weight in weighing the truth so that justice can prevail?

    San Miguel is one brilliant Filipino who at early age at 29 became an account manager for the 1st American commercial computer company. Despite successes, this is a guy who prefers to do business in the Philippines knowing the under-the-table-commission scheme in his own country and enriches himself and his family to satisfy his expensive indulgences like range rover.

    He is not afraid to lie under oath on the $41 million advances from ZTE. He knew that China ZTE and its records are beyond reach from Philippine senate. Chinese government already threatened diplomatic row over senate investigation.

    This reminds us that once we had a brilliant Ferdinand Marcos who can only think of himself and enrich himself at the expense of Filipino people. Another person like San Miguel is too familiar.

    LIE ONE -Leo San Miguel has displayed his arrogance in declaring that commission is very common in all Philippine business deals and yet time denied any commission has taken place in his deals.

    LIE TWO -As president of his company, he claimed he does technical work and cannot answer questions beyond technical aspects. This is a proven lie when Engr Madriaga who works for Leo San Miguel said his boss did not do technical work at all (Madriaga does technical work) but do the negotiation phase (how much commission).

  23. One thing wrong with the hearing ata the Senate is that the Senators should all have been speaking for the people who voted for them, not for the Malacanang dorobos. However, how many of the seating Senators, Congressmen, et al, except the members of the Doboro Cabinet,can honestly say they have been elected honestly by the people and not by the vote rigging manipulated by the Pidals.

    In short, it is obvious that there has been a lot many beatings around the bush instead of going through the root cause of the problem so much that the hearing seems to drag on and on. Di bale sana kung matiyaga naman ang mga piipino na magmartsa linggo-linggo hanggang sa mapatunayan kung sino ang mastermind at kung sino ang inuutusan lang sa mga garapalang gaya ng NBN/ZTE scam na ito.

    Iyong pagtatanong na lang ni Honasan, ang dami pang palikpik, isa lang naman ang gusto niyang ipalabas—trying hard talaga ang mokong na magmukhang tanga si Lacson.

    But God must have moved Lozada to be much bolder now to stand by the truth. God bless his soul, for the more the Pidals, et al goad him, I see him getting stronger and more valiant in protecting truth and right.

    To Mr. Lozada, I say, “Mabuhay ka, Mr. Lozada! God bless and protect you! Para sa katotohanan, let God be your constant guide!”

Ibang-iba talaga ang mga parliamentarians namin (I have yet to hear of vote riggings here as a matter of fact) when they investigate anomalies like the Lockheed scandal that ended the political career of ex-Premier Kakuei Tanaka or the recent bribery scandal involving a bureacrat at the Ministry of Defence resulting in the embarrassing defeat of the ruling political party, LDP, in the last election and the resignation of Abe.

    Over here, such hearings is also televised but nary will anyone hear any of our partliamentarians making excuses for the suspected criminals the way the Administration Senator, et al try their dumbest to protect the suspected masterminds at the palace by the murky river. Takot kasi ang mga opisyal namin dito sa mga tao (taxpayers). Dito kasi nag-i-snake dancing pa kapag nagde-demonstrate. At saka ang pulis hindi nagsisinungaling ng bilang ng tao. Taragis sa Pilipinas, iyong mga pulis sinungaling din!!! Pwe!

  26. Kung ako sa inyo, I will support Congressman Roilo Golez in pushing for finding the truth in his turf, the lower house. Together with the partylist congressmen (not those created to help increase the no. of supporters, rather bribe-takers, of the Dorobo Pygmy, he should work hard for a conviction and removal of the pests in the Philippine government now.

    Good luck, Congressman Golez! Hindi ka nag-iisa!

    There is a pattern here. So far the two big hanchos (Manalac and San Miguel)who both got involved directly with China are both saying that the projects they worked on are above board! Hmmm, I wonder how much “retainer fees” these two are given to protect China!

    For the supposedly responsible officials to side with China rather than protect their country are simply ROTTEN. I wonder if these two have children and grandchildren who will end up paying the debts in the future. They should be shaken to awaken them to the truth that these big “kickbacks”, exploitations and foreign explorations are NOT REALLY FOR THE COUNTRY but to enrich the few “greedy plus plus”. WAKE UP BEFORE IT IS TOO LATE!

    Leo San Miguel must have lied in his testimony. As a consultant for ZTE, he knows fully well that the Chinese corporation is teeming with experts right in its own ranks. They don’t need another San Miguel to bolster their proven capability. Everybody knows that China is very much advanced in science and technology, including computers and geology. San Miguel’s role as ZTE consultant is for him to “fix” and “facilitate” the transaction with the Philippine govt., given his “inside” contacts with those pinoys whose decisions matter in making projects take off.

    Gutierrez:

    The original JMSU as worded could not be pursued because the project involves a geophysical survey and that would amount to exploration .

    And that cannot be pursued because this would violate the Constitution.

    The problem of Constitutionality has been addressed and we agreed to the seismic undertaking- and that is not unconstitutional.. So why the concern.?

    Golez:

    Looks like the Ombudsman herself is saying the JMSU is unconstitutional and just got lost in the technical jargon of geophysical surveys which she stated are unconstitutional.

    Technical books define geophysical survey as “the systematic collection of physical data for spatial studies.

    “Exploration geophysics is the practical application of physical methods (such as seismic, gravitational, magnetic, electrical and electromagnetic) to remotely sense underground anomalies. The conventional application to this science is searching for mineral and petroleum deposits.”

    Thus, by her very own language, the Ombudsman is saying that seismic, which is one of the ways to conduct geophysical surveys, is unconstitutional. Too bad the Ombudsman may not have sought technical advice on the meaning of seismic surveys.
