Droga sa administrasyong Arroyo

Hindi ako nagulat sa balita na may mga opisyal si Gloria Arroyo na sangkot sa pagpalaya ng mga personalidad na dawit sa paglalako ng droga.

Ipinangalanan ni Maj. Ferdinand Marcelino, hepe ng Special Enforcement Service ng Philippine Drug Enforcement Agency, si Justice Undersecretary Ricardo Blancaflor na siyang tumawag sa kanya para i-release sina Richard Brodett, Jorge Joseph, at Joseph Tecson na nahulihan na may dalang marijuana, Ecstasy at cocaine noong Septiembre.

May resolusyon na kasi ang Department of Justice na napirmahan ni State Prosecutor John Resado na inirekomenda naman ni Senior State Prosecutor Philip I. Kimpo na aprubahan at inaprubahan naman ni Chief State Prosecutor Jovencito Zuño.

Sa DOJ resolusyon, dismissed ang kaso laban sa tatlo dahil ilegal daw ang pagkahuli sa kanila. Ibig sabihin,teknikal ang ginamit na rason. Hindi inisip nitong mga opisyal ang buhay na nasisira ng droga.

Sabi ng PDEA itong sina Brodett, Joseph at Tecson ay kasama sa sindikato na nasu-supply ng mga binawal na gamot sa mga clubs at bars sa Metro Manila.

Sinabi ng PDEA na nagkaroon ng bayaran na P50 milyon para sa DOJ resolusyon. Sila din mismo raw nakatanggap ng alok, tatlong beses at ang pinakamataas ay P20 milyon.

Inamin ng tatay ni Joseph na si Johnny “Midnight” Joseph na kinausap niya si Marcelino ngunit ang kanyang inalok daw ay tulong sa kampanya laban sa ilegal na droga sa kanyang programa sa TV. Pambihira naman. Patigilan na muna niya ang anak niya sa paglalako ng droga bago siya magkampanya sa iba.

Ito naman si Blancaflor, “public assistance” lang naman daw ang tawag niya kay Marcelino. Magaling talaga pumili ng dapat i-assist itong mga opisyal ni Arroyo, ano.

Ngunit ano ba naman ang inaasahan natin sa isang administrasyon na walang moralidad. Marami na akong narinig tungkol sa isang pulitiko na nagsa-shabu.

Ito lahat ay pinag-uusapan ngunit hindi maa-aring sulatin dahil mahirap maghanap ng ebidensya. Grabe ang organisasyun ng ilegal na droga. Alam kung napasok nila ang mga pulis, military, at mga korte. At kung sa patayan, walang kiyeme ang organisasyoin na ito pumatay.

Naala-ala nyo ang nangyari kay Ensign Philip Pestano, PMA Class ’93 na natagpuang patay sa isang navy ship galing Cavite. Pinalabas ng Navy na nag-suicide na hindi naman kapani-paniwala. Ang usa-usapan sa Navy ay nadiskubre ng batang opisyal na ang kanila palang tina-transport ay ilegal ng troso at droga. Hindi siya pumayag. Kaya siya pinatay. Dahil walang naparusahan, masasabi natin na buo pa ang sindikato sa Navy.

Meron din yung kaso ng dating mayor ng Panukulan, Quezon na si Ronnie Mitra na nahulihan na nagta-transport ng shabu gamit ang ambulansya noong 2001. Nasentensyahan siya ng habambuhay sa kulungan.

    E walang magagawa dahil iligal din ang presidente nila! Nagkalat ang drugs sa Pinas dahil nagkakalat din si Gloria! Sino ba ang susunod sa pinuno na peke na ang baboy pa?

    What Blancaflor did was “pocket assistance”, not public assistance. He admitted that a long time personal friend, Philip Brodett, father of one of the accused asked him (Blancaflor) for help. So, the more it proved that Blancaflor had a special interest in the case and release of the three Alabang Boys.

    DOJ has long been surrounded by crooks. There’s what they call “Ateneo Mafia” within the department since the time of Nani Perez who himself is an Atenean. Of course let’s not forget that FG Mike Pidal is another Atenean. We’re not pinning down on a reputable school like Ateneo, though the Jesuits have a long history of controversy. It just so happened that many of the crooks led by FG are in this Arroyo government.

    Many cases with hard evidences are dismissed due to technicality. And this is the argument of the Alabang Boys.
    DOJ Usec. Zuno argued why blame the prosecutors from dismissing the case for PDEA’s fault. Remember Nani Perez’s case. It was dismissed for the same reason…technical. There are many loopholes in law. The guilty sometimes becomes innocent and vice versa.

    The question is…who supplied that huge amount of drugs to these three rich Alabang Boys. We’ll never know. Possible involvement were the large drug syndicates, politicians, law enforcement agencies…and Malacanang.

    Yan ang malaking problema sa Pinas, kaya grabe ng kriminalidad dahil marami ang sugapa sa ipinagbabawal na gamot.

    Yan dapat ang asikasuhin ng mg vigilante, itumba lahat ng kaaway ng batas lalo na yang nagpapakalat ng droga at mga ilegal na gawain ng mga kawatan.

    Na maubos nayang mga peste sa ating lipunan.

    This evil administration has been surviving from the support of gambling and drug lords. Even the newly appointed Philippine Dangerous Drug Board Chairman Tito Sotto was once linked to a Chinese drug lord.

    Johnny Midnight, father of one of the accused, explained that his son was only a social drug user. First time I heard of a social user as if social drinker. Another parent explained that as parents, they could not possibly be watching their children 24 hours a day. They also argued that they could not afford to bribe such a huge amount of money.

    To them (parents) I say: BS ! What kind of parents are they? P50M is just a million dollar compared to billions of pesos drugs being transacted. They might not afford to pay such an amount; but what about the drug syndicates? These three Alabang Boys have been doing their trade for a long time now, and it’s only this time that the honest cops did not fall into temptation of accepting the bribe.

    I have my own conjectures, too, on this matter. But its foolish to put them out here. One thing that I want to point out though is the part of our legislators of old. They were/are equivocal always. They might have placed the improper words unwittingly or just plain unlettered.

    Usually the admisability of evidence is challenged by the accused in a pre-trial stage of the process and if the presiding JUDGE decided that the accused rights were violated in obtaining these evidence, then the State has no option but to withdraw the charges. In reality that is the most important stage of the process along with challenging the Law itself for its constitutionality during the pre-trial.

    Libreng-libre iyong mga matataba na mag-utos sa mga utusan nilang magbigay sa kanila ng mga kailangan nilang droga para pumayat at hindi maantok para doon sa mga midnight mass, handaan para sa loyalty check kuno, etc. na ginaganap sa hatinggabi, etc. Kaya nga nakakapagmalaking halos hindi na siya natutulog!

    Tanggalin na, ngayon nang 2009!!! Huwag nang hintayin ang 2010!!!

    And the most important responsibilities the State among others is to disclose all the evidence against the accused that are available to them and all other evidence that may come to their possession before and duration of trial. Doing these things, and prosecute to the best of their knowledge, they can rest assured that they have done their duties win or lose. These are very rare breed of public prosecutors and very rare perhaps in the country led by one GMA with a Justice Secretary of a puppet named Raul..

Si Limcaoco ay nakapuwesto na noong panahon pa ni Cory, na wala namang nagawa kundi hukayin yung compound ng PTV-4 kakahanap ng Yamashita treasure na ibinaon daw doon ni Makoy.

    Sa Senate investigation, dapat i-subpoena yung phone records nina Limcaoco at Blancaflor. Ipapaputol ko ang leeg ng kapitbahay ko, kung mali ang hinala ko!

    That is right grizzy, but those Canadians should know that if they are in Singapore or any other countries with strict anti-drug laws, they could be sorry. marijuana use is still not off the book, but it is tolerated as long as it is in small amount and not for the purpose of trafficking. and it is already prescribed as painkiller for those who are “addicts”. grow-ops is still illegal and cops are raiding hundreds of residences converted into hydroponics grow-ops. a few pots is ok.

    not for murder, BE, first degree murder is punishable by life with no chance of Parole for 25 years (minimum) and 2nd degree is punishable by Life with no chance of parole between 10 to 25 years depending on the impact on the surviving victims… violent serious crimes is taken very seriously, and the crown will not spare any expense and will never close the case no matter how long will it take and do not give regards as to the victim. they will be treated just the same. Drug trafficking is also dealt a big blow recently with the arrest and the mastermind and discovery of drugs worth $250 millions. It is ongoing battle between the Police and the organized Crimes, but because of the Demand it will be on ongoing problem.

    the only problem is life inside the jail is so comfortable that some would love to stay there the rest of their lives. many documented cases some will do some petty crimes just to get back to jail instead of living a miserable life outside.

    it is soo comfortable that Sir Conrad Black would like his Citizenship back after renouncing it so he can become the member of the Royal family so he can avail of the prisoner exchange from the U.S. (but he didn’t get it back) and by law they are also paid for the work they are doing. it so comfortable that so far the Ombubsman has not received any emails of complaints from the prisoners as they are also all have access to internet and porn.

    Two news articles caught my attention today:

    1. Chiz Escudero calling on all pinoys to buy Philippine made products – ala CPG style – Buy Philippine products. If I am not mistaked, this was the slogan of CPG when he was the president decades ago. In order to help up lift the Philippine economy, CPG encourages all pinoys to buy Philippine made products during his tenure as President.

    Chiz is making a noise for his political ambition to become the youngest Presidednt of the land. At a young age as politician, he is going to the dogs, he cannot say what is white and what is black, he is GRANDSTANDING!!! Infront of the Pinoys, he saying what the people wnat’s to hear, but if he is not infront of them, your guess is as good as mine.

    TURNING UP TO BE A POLITICAL CHAMELEON AND VERY GOOD AT GRANDSTANDING.

    If I may also recall, I also posted it in this blog. In order for us to survive the global crunch, the government should adopt the policy of the garcia administration’s Philippine First Policy, but nobody caught that interest.

    Education – What??? unscrupuolus text book printers are making maney out of the government coffers. They are printing defective books, and yet the DepEd has done nothing (so far) to address this issue.

    Social Services – There’s a lot to be done with the social services. But the HOODs are busy preoccupying themselves with Cha-Cha.

    Health – Most of the Pinoys cannot even buy a cheap medicine, that’s the health services in the Philippines. Can’t even afford a cheap hospitalization, even the PGH or other public hospitals are asking for a deposit first before they accept the patient.

    ANd the saddest part of it, most of our doctors want to become a nurse at any foreign land, instead of giving basic health serives to the poor.

    The Opposition and Presidential wannabes, thay are to busy with the fast approaching 2010 elections and are all making noises for the ambitions

    The evil Bitch’s hoods are praising the the evil bitch because of her economic fundamentals (???) and economic reforms (???) inititated by her majesty. They forgot that because of the high remittances of all Pinoys scatttered around the world, the RP economy is still floating. What will happen to us if there were no remittances???

    Dureza also mentioned about the divisiveness in RP. But he needs not look far, if the evil bitch is hell bent on helping the economy floats, then she should tell her HOOds to stop the Cha-cha and focused more on how to ease the economic meltdown and fopcus more on social services such as education, social services and health.

    If not, I think it’s about time that every elective and appointive officials to resign and have the election now.

    just a thought.

  39. Truth, Vic, is I just interpreted for a Canadian caught with his friend at Narita Airport for trying to smuggle 2.5 kgs. of shabu from Malaysia. He has admitted to the lawyer that he has used Marijuana that he said is tolerated in his country. Kunyari pa raw wala siyang alam doon sa shabu found inside the lining of his suitcase.

    He won’t admit to the shabu inside his bag but he has admitted to owning the Marijuana in his cosmetic case for his personal use (daw).

    He can get 15 years for his crime. Fortunately, there is no death penalty for drug offenses over in Japan yet. There is now a movement to impose the capital punishment for such crime, though.

    Too bad for him grizzy. it is true that users here are usually let go during raid as the cops are only after the traffickers, but that is a wrong strategy, because without the consumers there won’t be traffickers..more than half of 70 homicides of 2008 were drug related, (street level) and majority involved firearms..still very low by big city standard and lowest in Canada, but just to demostrate that drug culture is one hard problem to solve anywhere. just too much money in it..if the Alabang boys were alleged to afford to bribe their way out the slumber with that kind of money, it is also good business here worth shooting it out among the “criminals” only sometimes an innocent bystander got in the way.

    Kudos to you Major Marcelino! I hope this would jumpstart the realization by our men in uniform that this government has been pulling a fast one on the citizenry.
    Dolorfino can not be trusted by his men, he has left Major Marcelino. Leave No Men Behind…the Marines’ credo. But their leader has left a good marine in Major Marcelino behind. Left to be devoured by the evil syndicate masquerading as governmment.
    My prediction, is that Balncaflor, Zuno and the lawyer of the Alabang Boys would clear Gonzalez, who is actually part oft he scheme. Just a hunch.

    Kaya ko gustong makita, ay dahil mahirap maniwalang walang bisa ang aresto, dahil ito ay buy-bust.

    An arrest may only be made upon order of a judge (warrant of arrest). The exception is when the police officer catches a person in the act of committing a crime, or about to commit a crime. For instance, when a snatcher grabs a lady’s bag, what do you expect the police to do? Say, “Wait, I’ll go see the judge.” In that case, an arrest may be made without a warrant.

    If the operation were a buy-bust operation, then when the police-poseur was given the drug for the money, the accused was in the act of committing an offense. So, there is no need for a warrant. The police may move in, and arrest the seller. The usual operation is with a poseur buying, and a back-up unit waiting for a signal to arrest the seller.

    Hinala ko lang, ang palusot ng resolution would be that there was no back-up team, nagsumbong ang poseur so opisina, and therefore, time elapsed, and they should have gotten a warrant.

    But the legality of the arrest, or the evidence obtained is raised by the defense lawyer, not the prosecution. The suppression of the evidence is in fact made as a motion before the judge, at the trial. There must be millions of reasons for the resolution. So I want to see how those millions of reasons got distilled into a legal argument for the dismissal of the case.

    I watched the Congressional hearing on the drug case and was very turned off by those DOJ state prosecutors. Gosh, they could not even speak straight English.

    Major Marcelino like Gudani and other decent officers is all alone in his crusade. Let’s all support him like what we did to the others. Marcelino prefers to tell all at the Senate and not the Congress. He knows who tried to bribe him and other big people involved.

    atty 36252: in her speech before the Member of Law profession and government officials, Chief Justice Beverley McLachlin, urged the government to make access to Justice a Basic Right, just like education and health care, because as she said it is no longer affordable for dependants other than the very wealthy and the poor (who qualified for legal aid) without getting a second mortgage or losing their life savings. The reason she said is the time consuming Challenges by the Defense of the admissibility of evidence and the constitutionality of the Law for which the dependant is accused of during most of the part of the trial. Which the cases may quashed by the presiding judge or stayed or withdrawn by the Crown, but after the dependant had already incurred substantial expense. also the same in civil litigation where Experts witnesses are brought in at a “price” and also for the time consuming process of “discovery of evidence”.

    But never in her speech the Chief Justice mentioned any “Out of Court” settlement for Criminal matters just to avoid substantial expenses for the dependants, as i always believe that the only out of court settlement for criminal matters if their no case at all.

    My late sister was an Associate chemist in the drug enforcement of the NYPD for a number of years..and she testified in court a hundred times..ang sabi ko sa kanya..why do you do that? And her reply was..”manang you just don’t how the use of these drugs destroy people particularly the young…kaya ang dapat.. ikulong yong mga nagbibinta ng mga ito”. She later joined the Forensic Dept of the NYPD as an associate chemist..and died as one…If you ask me hindi kulong ang dapat sa kanila..firing squad!

To save the crooks inside DOJ which could go as high as the Secretary, the respondents’ lawyer admitted that he was the one who prepare the letter/draft and brought it to DOJ for signature. He said he found a DOJ stationery at his home and used it to write. Caught by camera !

    At the House hearing, the supposed ties among Resado, DOJ Undersecretary Ricardo Blancaflor and Felisberto Verano, one of the suspects’ lawyers, were revealed.

    Blancaflor is an Ateneo law classmate and a fraternity brother of Verano. Another justice undersecretary, Fidel Exconde, belongs to the same law class and fraternity.

    Resado, on the other hand, is a student of Verano at the Far Eastern University law school. He has been with the DOJ for three years.

    I don’t know about this, but government officials in our Federal and Provincial Government (especially Cabinet Ministers)can not in any way directly, indirectly, perceived or in any manner influence the carriage of Justice, thereby bringing it into Disrepute. it is as simple as that. Their job is to established policies, standard, enact laws and guidelines, but can not personally get involved or even be perceived to have been in any way involved in the conduct of judicial process or otherwise bye-bye..

    I just read Manuel Buencamino’s article on the drug-bribery bust case in which he opines that PDEA erred when its agents led by Maj Marcelino obatained evidence without proper search warrants, etc.

    Other reports say that that DoJ was clearly at fault, etc. Am still trying to make sense out of the few reports I’ve read but can’t help but think (I might be wrong) that the Alabang druggies must have some firm backing from powers that be to be recommended for release without so much as a tap on the hand.

    My thought is that General Dionisio Santiago, former CSAFP, and current PDEA chief may not be the most brilliant military operator that the AFP ever produced but he certainly is not stupid as to enforce a search without proper warrants, etc. He does not suffer from a greatly tainted reputation nor has he been openly accused of overt corruption unlike his successors. He actually is a humble person, quite unassuming and not one to raise his chair (my only beef about him is that he serves under Gloria). His wife is a nice, corteous and quite unassuming lady too.

    Santiago’s agent, Maj Marcelino should be commended too — I’m pretty sure he is made of the same stuff as Santiago. If it’s true that Marcelino refused the bribe, he should be praised. We need young officers of his caliber.

    If Santiago says that those druggies were guilty as hell, then I’ll believe him. I’ll take his word anytime against that of DoJ’s stupid SiRaulo Gonzales.

    But, evidence wise, how does one prove it? Babaligtad ang istorya, and the briber would say the Officer/Gentleman asked for grease money.

  71. The defense strategy is to disprove that the operation was a buy-bust. The other PDEA operatives were prevented by the gate guards of Ayala Alabang from entering thus they argue it could not have been a buy-bust since the poseur-buyer acted by his lonesome. Hence, the “decision” by the state prosecutors that it was illegal since there were no warrants applied for the search and arrest of the suspects as the operation does not constitute a buy-bust.

    If it were actually buy-bust then no warrants were needed because the suspects were caught in flagrante delicto (red-handed).

    But that defense is good only if it were Brodett that was arrested. The prosecutors would have considered it a “hot pursuit” operation since Joseph and the agent were already being tailed by PDEA even before they entered Ayala Alabang. Again, hot pursuit operations do not require either search or arrest warrant. In this case, Joseph is considered the runner and Brodett, the pusher.

  72. To be a PDEA lead agent, Marcelino must be one heck of a courageous fellow (these guys usually are) because drug lords are not straightforward enemies, mga pa-traydor.

    So, I won’t be surprised kung puwedeng makipag-barilan siya sa mistah niya. Anyway, as I said, tapos na ang pagkakaibigan nilang dalawa. (Marcelino must watch his back and must protect his family at all cost.)

Drug ring bosses, drug lords, drug cartel leaders etc., should not be arrested — this is one area where I believe that the best way to rid the society of these pests is simply to, well… make them disappear kind of. Engage them in a firefight and make sure these pests can’t shoot back.

    Just by looking at his face and the way he talks, we can say Marcelino is an upright man. On the other hand, notice the three young rich men after their arrest as shown on TV footage several times…they looked relax and was even smiling as if they knew their problem would be easily settled.

    To the credit of the defense lawyers, they were doing all they can for their clients, albeit somewhat unethical or at the worst, downright illegal. They have strong points, too, but these matters are judged at the trial phase, not at the inquest.

    For example, they argue that it was inconceivable that the pusher Brodett provided change (sukli) for the “budol” money (bond papers sandwiched by real money in a bundle) when he could only supply 70 Ecstasy tablets out of 100 ordered, without inspecting, and finding out, that the payment given was “budol”. The prosecutors also allege that the money was never recovered by PDEA.

    These defense arguments were taken hook, line, and sinker by the prosecutors. Again, the DOJ, instead of looking at the 2 determinants to approve the filing in court, i.e., that the crime was committed and that there was probable cause to believe that the suspects committed the crime, they arrogated unto themselves lawyering for the accused and judging on the evidence before it was even presented in court.
