Libel suits pile up as presidential spouse ‘defends rights’

Presidential spouse Jose Miguel Arroyo is a natty dresser and a man of many suits. But his critics are finding out his favourite is the libel suit.

Mr Arroyo has sued or is suing six politicians, two publishers, and 12 editors and writers. Two weeks ago, he threatened to sue three more journalists and, this weekend, another congressman.

His critics say he uses the courts as a political tool. But Mr Arroyo, who could not be reached for comment, has claimed his critics have maliciously and falsely accused him of corruption. The claims include vote-buying for his wife President Gloria Macapagal-Arroyo’s 2004 poll victory, money laundering, demanding illegal gambling payoffs and influence peddling.

He has also said they called him fat.

In an 11 million peso (HK$1.68 million) damages suit against Lito Banayo, a columnist and spokesman for opposition senator Panfilo Lacson, Mr Arroyo complained Mr Banayo had described him as el esposo gordo (the fat spouse). This description was “obviously meant to denigrate me for my rotundity”, Mr Arroyo complained.

Two weeks ago, Mr Arroyo showed Mr Banayo he was serious. Appearing in court for a pretrial hearing, Mr Arroyo brought along bomb-sniffing dogs and presidential palace guards, who barred the media from the proceedings. The judge, Concepcion Alarcon-Vergara, ordered Mr Banayo’s lawyer to cross-examine Mr Arroyo without being given time to study Mr Arroyo’s 102-page testimony.

“I want to dispose of this case immediately because the complainant [Mr Arroyo] is a very busy man,” the judge said.

Last week, eight policemen entered the legislature trying to arrest Senator Jinggoy Estrada, son of jailed president Joseph Estrada, over a 10 million peso criminal libel suit filed by Mr Arroyo five months ago.

The young Estrada had linked him to alleged smugglers in a privileged speech inside the legislature.

The arrest was thwarted only by the intervention of Senate president Manuel Villar, who reminded authorities that lawmakers were constitutionally immune from arrest if the crime – like libel – was punishable with less than six years in jail.

Last week, Malaya newspaper publisher Jake Macasaet, along with his editors and reporters, were compelled to attend a pretrial conference after being arraigned on Mr Arroyo’s libel charges. All have pleaded not guilty to maliciously publishing a May 2004 article in which former opposition senator Francisco Tatad named Mr Arroyo as “chief cheating operator”.

Mr Tatad, however, was dropped from the charge sheet after he claimed he was misquoted.

Ellen Tordesillas, Malaya’s chief of reporters, was originally among those accused, but she was dropped from the case for unknown reasons.

The cancer-stricken journalist said the case had shown her first-hand how such suits were “really expensive” in terms of time, money and effort.

“I had to go to court even if I had just finished chemotherapy,” she complained. “Law suits are one way to pressure the media into silence by intimidation.”

Mr Arroyo believes law suits defend his rights.

Shortly after the May 2004 polls, he said: “Enough is enough. I think I could exercise my rights after the elections, and one of these rights is to sue people who malign me.”

I have a feeling that this guy is making filing libel suits his profession, and he intends to make millions out of these lawsuits by making sure that they will be handled by people connected to them with a promise of making them also rich in the process. Yuck! Hindi na nahiya! Palibhasa makapal! Mas makapal pa sa semento! Pwe! ‘Kakasuka! 😡

  2. On the other hand, these libel suits are nothing but threats and attempts to silence people those who can spill the beans! Let him file the suits and in the process prove the crimes that he and his wife have been committing against the people of the Republic of the Philippines. After all, crime in fact does not pay!

  3. I know Spanish, but I did not know that Banayo is being sued only for saying the truth that the Fat Guy is fat! Why, what does he want Banayo to describe him? That he is thin? That will be more libelous, I guess!

    para naman palang bata itong si mr gma. paulit ulit na libel suits ito. problema diyan kung hindi siya manalo ang conclusion ay totoo. kung hindi naman siya magdemanda ang conclusion din ay totoo. sila rin ang nagpapahirap sa sarili nila. kung umisplit na lang sila, tapos. lahat maligaya.

    Although the prosecutor dropped me and former sen. tatad from the list of accused, Arroyo’s lawyer filed a motion for reconsideration to have us re-instated in the case.

  7. Condolence, Ellen. Now, I am more confident that our courts in Japan are better than the courts in the Philippines. Over here, libel suits in the nature of the libel suits filed by the Fat Guy will not even make it to the sala of any judge. It will automatically be junked especially when it is about some anomalies activities allegedly and reportedly being committed by the Pandak, her husband, kin, friends and cronies. Instead, the court may issue warrants to search for evidences more than the Garci tapes for example, and make sure that no one is trying to be above the law!!!

    Poor, poor Philippines and Filipinos, who are being saddled with no class leaders and pretenders to the throne!

    On the other hand, Ellen, a libel suit may prove a blessing in disguise. At least, you are still alive, and not shot by a hired killer!

    Your country needs you. So, hang on there, dear girl! Malapit na ang day of reckoning ng Dambuhalang at asawa niyang punggok!

    Golly, lahat kinukurakot! Pati iyong clinic sa Malacanang, kinurakot na rin! Under military rule pa! With Romulo talking to the Burmese, there is a possibility that the Philippines will one of these days be under a SLORC and a killing field ala-Burma and Cambodia under Pol Pot.

    Wala na bang katapusan? How long do Filipinos have to suffer under these pretenders and squatters at the palace by the murky river.

    Oo nga ano, ilang araw nang luma ang column ni Mang Lito sa Malaya. Siguro pinagbawalan siya ng korte na magsusulat ng anti-Arroyo column. Pero buhay pa naman at may abogado din siya. Tungkol naman sa taba, mataba din si Lito Banayo pero may kaunting muscle…di tulad nitong baboy sa Malacanang…tabang lamig.

    Ang mga mayayaman na kriminal ginagamit ang pera at influence para takutin ang mga kaaway. Di ba iyan din ang ugali at style nitong kriminal sa Ilocos Sur? Sa dami ng ipinagpatay niya tulad doon sa auditor na si Chan, ni isang kaso walang nangyari. Iyan din ang style nitong matabang kriminal sa Palasyo.

  10. Vergara should be disbarred. She should show the public that justice is blind and fair. So what if the fatso is a busy man, aren’t we all? He was the one doing all the filing, let him stand in line like the rest of us. This only shows how rotten our justice system is. The powerful can get a quick response while the poor have to sit it out and wait for justice to notice him.

In the first place, the libel suits of this guy is getting too high for the court to be suspicious and would be better off starting an investigation on the charges filed by the public through other means like the media, etc. that this crook is now filing libel suits for. They should realize by now that this is already abuse of power as it is an attempt to suppress freedom of the press, even the freedom to freely investigate on the activities of these crooks connected with the Pandak, who is doing down the history of the country as the most corrupt and inept president the Philippines has ever had especially considering the fact that she got the said position by devious means in cooperation with the gangsters in Philippine politics!!!

    Looks like the fat guy is running wild and out of control just like an amok-para bang isang asong nau-ulol. His suing spree serves as to strike fear, to harass, to silence and to warn critics and would be detractors to keep off their backs. Meaning: manahimik na lang kayo at hayaan ninyong ubusin na naming ang lahat ng yaman ng bansa.
    His critics say he use the court as a political tool, and if I may add, he makes a fool, not only of the court, but together with the judges who can not withstand his pressures for them to act in accordance with his whims and it doesn’t matter whether their act is illegal or in violation with the rules of court. It’s not justice and compensation that he seeks, because, in the first place, and by the looks of it, his cases don’t hold water in any court of law and he always had his way and very resourceful in his financial transactions. If you notice the amounts involved in his suits-barya-barya lang sa kaniya yon. He just wants to send out the message to one and all that he is the big boss, the capo, and the law that even courts have to bow before him.
    Imagine suing for libel because somebody called him a fat guy. That’s the funniest and weirdest thing that I ever heard in my whole life. Maybe we can follow the fat guy’s lead that anybody who criticize your looks or appearance-sue them for libel. And maybe too, one of these days, the fake pres will sue because somebody called her Pandak. Now we know that the fat guy resents being called a fat guy. No problem, go on diet. But as for the fake, I can not offer any solution for her being a Pandak except to suggest that go and have a pair of limb and legs transplant.
    As for Congressman Cayetano, be steadfast sir. Eyes are on you. Don’t fall into their trap being laid by Santos the lawyer of the FG. “Nanginginig na raw kayo sa takot” at gusto pa kayong papuntahin sa Germany. What can you do in Germany without the signed waiver? Ginagawa pa kayong tanga. Ang sabihin mo sila ang nanginginig na sa takot dahil mabubulgar na ang katotohanan at hindi nila malaman kung paano sila makapagdepensa. I pray and I hope to see the end of what you started.     Is this Concepcion Azarcon-Vergara related to Penny Azarcon-de la Cruz? Ano bang klaseng judge siya para sabihing bilisan ang pag-cross exam dahil busy si fatso man? Aba!! kahit maghapong umupo si fatso sa loob ng court room hindi iyan magugutom sa dami ng pera niya. Bakit kung mahirap ang nag-akusa o inaakusahan hindi naman pinagmamadali?   21. For all the claim of being rich, etc., the Pandak and the Fat Guy only show what kind of upbringing they have had. If they have been brought up right by good parents, how come they do not know that when they break the law of the land and of God for that matter, they should know that they lose all rights under the very law that they break. It is called forfeiture of right as a matter of fact unless of course such matter is not in the written laws of the Philippines, written and unwritten. Accordingly, what is this right that the Fat Guy is talking about. All the right that he, as a criminal suspect, is the right to have an attorney to defend him in a court that will hear his case, that is, is the Department of Justice Minister can have the balls to have him prosecuted sans the utang na loob for having him appointed to abuse the people of the Philippines, especially those they label as communists for criticizing them.

    It is actually just a matter of common sense for the ordinary people to understand that something is not right, and the culprits have to be caught and sent to jail!

    I showed the picture of the Fat Guy to my Japanese friends in the NGO networking with groups in the Philippines, and asked them if they think the Fat Guy is thin. Napataas ang kanilang mga kilay! “Nani? Debu ja nai no?!” was what they said. Literally,”debu” is the word used for someone obese.

    I told them don’t say that to the Fat Guy or they might get charged with libel! Lalong tumaas ang kanilang kilay! “Baka ja nai no!” ang sabi nila, meaning, “Isn’t that being stupid?”

Parang katulad noong kapitbahay namin noong maliit pa ako na mambabato tapos siya ang may ganang magsumbong sa nanay niyang panot when you retaliate and box him on the face.

    Libel suit from Mike

    The city prosecutor of Manila has recommended the filing of a libel case against me and Rosario T. Galang, our business editor.

    The prosecutor said the publication of the article on July 9, 2004 “caused the complainant physical suffering , mental anguish, fright, serious anxiety, besmirched reputation, wounded feelings, moral shock, social humiliation and similar injury.

    “Respondent (Macasaet) should therefore be made to pay moral damages of P10 million and attorney’s fees of P1 million.

    The “Business Insight” column I wrote on Mike carried the title of “First Couple’s idea of charity,” which said, among other things:

    “Weeks after the elections a kind-hearted man tried to get in touch with Mike Arroyo in the hope of getting assistance for Rowena Juno, sister of a member of the Presidential Security Guard.

    “Juno has been in excruciating pain at the V. Luna Medical Center, suffering from brain cancer.

    “The executive assistant of Mike Arroyo promised P100,000 but the money never came. In the end, the matter was referred to the Philippine Charity Sweepstakes Office.

    “Before that, another person called up somebody, presumed to handle money in the office of President Arroyo, he was told that ‘we have no money.’

    “The request was also referred to the PCSO.

    “Ms. Juno spends an estimated P50,000 a day in the faint hope of getting well. But she has run out of money.

    “The story here is that Mike Arroyo is trying to build a name for charity.

    “Now that the election is over, he would not even part with any amount for the sister of a PSG member. Neither would the President draw some money from her Special Fund which is not subject to audit.

    “Politicians are the most charitable people on this planet while they are campaigning. After they win, they become tight-fisted. And the money may not even be theirs.”

    ‘Thank you, Atty. Arroyo’

    On July 13, 2004 I wrote another item titled “Thank you, Atty. Arroyo”. Following is what I said:

    “Our small effort to get the attention of First Gentleman Mike Arroyo paid off handsomely. We said that there is this Rowena Juno, sister of a member of the Presidential Security Group who is confined at the V. Luna Hospital suffering from brain cancer.

    “A friend of hers called up the Office of the President for help but she was turned down although the request was referred to the Philippine Charity Sweepstakes Office.

    “A similar attempt was made with a top assistant of the First Gentleman. The assistant promised P100,000 but the money never came. It turned out that the request was also referred by the assistant to the PCSO.

    “That got us to saying that since the First Gentleman promised to stay away from the powers of his wife and that he will devote his time to charity and sports, it should not be difficult for him to provide assistance to a sister of the person who helps secure the lives of the First Family.

    “Quite promptly, the First Gentleman sent somebody to V. Luna to inquire what “Ms. Juno needs. Money, of course. But there could be other things that the patient might need. I suppose the First Gentleman’s charitable heart will take care of that, too.

    “Only problem is — if we have to set modesty aside — Attorney Arroyo moved only after he was told that we wrote about the poor girl’s pitiful situation. Suppose we had not reported it, would he have sent somebody to V. Luna to inquire about Ms. Juno’s needs?

    “I guess not. But I am personally grateful to the First Gentleman for his quick response. There are hundreds of cases reasonably similar to that of Ms. Juno. We hope we would not have to report them.”

    Another libel case

    The First Gentleman filed another complaint for libel against me, former Sen. Kit Tatad, and a few of my senior editors.

    Atty. Mike Arroyo and his lawyer found cause for libel when our Senate reporter Jun Lopez quoted a statement of Tatad alleging election fraud in Mindanao where the First Gentleman was allegedly involved.

    The complaint is still under investigation by one of the city prosecutors of Manila.

    Tatad is the principal respondent in the case.

    We would not be surprised if an information, similar to the first one, is recommended for filing with the Court.

    We are prepared for whatever the prosecutor will recommend. Libel has always been a hazard of our occupation.

    We live by the philosophy that if we can dish it out, we should be able to take some ourselves. That is precisely what we are doing.

    We do our job in our best lights.

    It does always happen that our best lights sit well with other people, including the First Gentleman.

    We will face him in court in the belief that we did not offend him or his sensibilities.

    The judge in the Lito Banayo case said that the fat guy is a busy man. How right is she. The fat guy is busy thinking and planning where and how he can increase his income; busy in counting and doing the accounting of his daily takes; busy in planning how he will allocate his eggs into different financial institution their in the Philippines and abroad; busy in thinking how he will conceal from anybody, maybe including his conjugal partner, his enormous hidden wealth; busy in planning again and again where in the world will he spend some good times with his girlfriends; and very busy thinking on how he will get back at his detractors, critics and perceived enemies.
    That’s how busy he is. He is not working, but his income is so enormous, incredible and unbelievable. Where in this planet earth can you find such a man-only in this part of the world-in the Philippines.

    Of course naman, a European rendezvous is in the books. Ano kayo sinusuwerte, sasayangin ba naman ang pagkakataong matagal at pinagkaabalahang iplano at pinagisipan. Sabi ko nga sa bandang itaas, he is busy in planning where in the world will he spend some good times with his girlfriend. Siguro nga ang laki ng pasasalamat niya kay Cayetano dahil biglang nagkaroon ng dahilan para pumunta ng Germany. An not only that, maybe the fat guy’s trip to Germany is to clear the accounts.

Tawa ko lang kung pumalpak siya dahil ang akala ng mga ungas na ito kapareho sa Pilipinas ang ibang bansa. Si Lagayman nga ang akala puede niya takutin ang mga hapon sa kagaguhan niyang bugaw din pala! Anong klaseng mambababatas ito na kasabwat din sa pagbubugaw ng mga pilipino sa ibang bansa?   39. Nagalit na ang mga German. I have a friend who is a member of our church who works for the German bank that revealed that the Pidal son has an account there for 500M dollars. Matanong nga ang kaibigan ko!

    Wow! Papaanong nagkaroon ng 500M iyong anak? Kaya pala maraming mga nagugutom sa Pilipinas at hindi makapag-aral kasi ang mga pera kinurakot na. Ang daming utang ng Pilipinas, lalong hindi makakabayad ang mga pilipino sa mga inuutang ni Pandak!

    Tatay din niyan utangero sa totoo lang. Siya ang may pinakamalaking inutang bago pa naging presidente si Marcos. Sabi nga ng professor ko noon sa history na hindi makakabayad ng utang ang henerasyon ng mga pilipino mula noon hanggang sa matapos ang mundo!     No wonder, maraming pilipino ang gusto nang umalis ng Pilipinas para hindi na dumanas pa ng mas lalong pasakit, dusa at hirap!

    Basta ako ang tawag ko kay Arroyo…tiyanak. Tungkol sa pera ni Mickey, hindi ba siya ang kasangkot sa malawakang jueteng payola noon? May “cut” siya sa lahat ng jueteng lords sa buong bansa. Kaya hindi kataka-taka kung may 500M siya. Isa pa, smuggler siya ng imported horse mula sa Australia. Hindi nagbabayad ng tax at ibinebenta ang mga kabayo. Tungkol naman sa pagmarka sa mga bahay ng kaaway ni tiyanak, lumang style na iyan. Panahon pa ng Hapon ginawa na iyan.

  43. Now, what the Fatso did is show his guilt even before he is accused of anything since he is not the one Cayetano in fact is referring to. “Nagigisa sa sariling langis,” so they say!

    Who knows but it must have been himself who deposited the said account on behalf of his son, and the trip to Germany was to see if he could have it withdrawn and have the bank issue a certificate proving that he does not have an account there although when requested the said bank may issue a certificate proving that the son instead has deposits in millions there!

    All they have to do in fact is show where they have been getting those millions. But as the say in Pilipino, “nahuli sa sariling bibig!”

    Pero bilib ka rin, nakakalusot pa rin! Pag sa kalokohan, ang galing! Pero pag sa katotohanan at kabutihan, walang sinabi! Hanggang declaration lang ng national emergency magaling!

    Mike Arroyo left for Germany last night. My info is that “E” also left for London last week. Is there a European rendezvous?

    Ate Ellen, baka naman itong “E” na may alam sa foreign banking ang nag-launder at nag-transfer ng kanyang pera? Hindi ba nasa Lugano sila pagkatapos umalis si Gloria sa Spain? Ang Lugano ay Mafia’s Swiss banking center.

    As a bona fide journalist in the mainstream press, you might be able to catch the attention of OECD financial brigade in France if you ask them (OECD) for information on how you could go about verifying facts pertaining to the money laundering suspicions against First Fat Guy as well as his purported dubious bank accounts with the German bank with copies of newspaper clippings on the subject.

    That should get the ball rolling.
