Confined to brig for non-existent offense

A junior navy officer has been detained in the Philippine Marines Brig for almost a month for allegedly distributing compact discs of former President Estrada’s life story and about cheating in the 2004 elections.

Navy 1Lt Artemio Raymundo, Jr. was ordered confined by Navy Major Danilo Luna,commanding officer, last Sept. 25 in connection with his “alleged involvement on (sic) the distribution of CD’s containing Erap’s documentary.”

Last October 2, Raymundo’s lawyer, Juanito I. Velasco of the Lazaro Law firm, wrote the staff judge advocate of the Philippine Marine Corps that “Under Article 70 of the Articles of War, a person subject to military law, charged with minor offenses, ‘shall not be placed in confinement.’ “

He appealed that the office be released “since the offense for which Lt. Raymundo is charged had not yet been determined.”

The confinement order, however, stated”Disrespect to superior officer.”
Last Tuesday, Raymundo and his wife, Salome, filed a petition for habeas corpus to have the young officer brought to court at the soonest possible date and time and to show the cause of his arrest and detention.

Named respondents are Maj. Gen. Nelson Allaga, commandant of the Philippine Marines; Col. Jonathan Martir, brigade commander of Combat Service and Support Brigade (CSSB); Luna; Maj. Gregorio Hernandez, CSSB intelligence officer; and 1Lt. Rogelio Balderamos, Brig commander of the Philippine marines.

The petition also asked for discharge of Raymundo and for the respondents to permanently restrain from arresting and detaining Raymundo “for the same cause.”
In his sworn statement, Raymundo said he got the CDs “Ang Mabuhay para sa Masa” and “At All Costs” at LRT station where they were being distributed. He shared them with other officers without anybody ordering him to do so.

In the petition, Raymundo related that on Sept. 25, he was odered by Luna “confined within 16th Maine Company Headquarters.” That same afternoon, he informed Luna that he was going to visit another officer within the restricted area. They got into a verbal argument Luna prohibited the junior officer from making his intended visit.

The next day, Luna ordered the transfer of Raymundo to the PMC Brig. The petition said during the typhoon Milenyo, “Raymundo suffered in his room at the PMC Brig as rain waters leaked through the ceilings and drenched his bed.”

Margarejo, Rosas & Sanguyo Law offices, who filed the petition for habeas corpus in behalf of Raymundo argued that the “act of distributing CDs or DVDs is not defined, treated nor penalized by the Articles of War.”

“Moreover, they said, “there has been no command or order to Lt. Raymundo, prior to his restrictions and confinements, prohibiting the distribution of the subject CDs or DVDs.”
The petition also noted that “even the investigation itself does not charge Lt. Raymundo with any offense. It has not even determined whether or not Lt. Raymundo had committed any violation.”

Estrada’s “Ang Mabuhay para sa Masa” has been classified “X”, not for public viewing, by the Move and Television Review and Classification Board.

    When all this such ridiculous raping of the deceny of the Pilipino nation is going to end? This dwarf in Malacanang got to go! Enough of this putrefaction stuffs, same shit only different days. Are there any alligator or stingray in murky Pasig River? Throw that illegal dwarf in the river for bait. It ain’t in Pasig River, dump them in china sea.

    Philippines military and PNP are nothing but keystone cops, such laughable group of people. Of course, not all of them, also recognized that there are some good people in the group, but the bads giving bad name to the military in which I’m directing my remarks. But, bogus Gloria called herself the Commander-in-Cheap, so what can you expect from little dwarf performing a job for mature honest person. Ain’t possible.

  7. This situation is crazy. Gloria’s continuing stay in Malacanang is provoking the good elements of the AFP, junior officers to boot to undo the military institution.

    If the root cause of this new “act of insubordination” is Erap’s life on tape, Gloria’s soldiers are approaching it wrongly. For a junior officer to have a verbal argument with his superior takes the cake. The Philippine military is a small one and the grumbling will creep into the ranks.

    Very, very bad take.

    Soldiers, officers and men alike are a reflection of the person at the helm. These men in uniform know but one game, the oldest one in the world: FOLLOW THE LEADER.

  10. There is no law that prohibits the downloading of the Erap movies especially with permission for free distribution given by the producers. Everybody is free to download and distribute it. For those who want to download the movie, please go to http://www.erap.ph.

  11. The Erap movie is available also in all the bittorrents download sites. You will need a bittorrent client if you are downloading the file from http://www.mininova.org

    The files at Erap’s site are easier to download but if you do not have a DVD producer, you may watch the files only on your PC. The one at mininova is ready for burning in DVDs.

    Apparently, the bogus president does not want Filipinos to watch it because she knows they will hate her when they know the truth that she is a dye in the wool a crook. And they definitely would not want to be led by such a crook!

Bogus Gloria in reality is most jealous of President Estrada, if we’ve to make some comparison of the two. Bogus Gloria will never qualify to carry President Estrada’s jockies or briefs. Counterfeit Gloria’s achievements or to show for are what she stole and cheated the people. Bogus Gloria has no real achievement of her own, it’s all handed to her in a fake silver platter.

    I just read this statement by Lieutenant Colonel Bartolome Bacarro, AFP public information office chief.

    According to the Inquirer, “Bacarro said there was no directive from the AFP leadership prohibiting soldiers from watching the Estrada video.

    “He, however, said Major Danilo Luna, Raymundo’s commanding officer, was right in banning the video.

    ““(The video) has political color. It’s the inherent job of a commander to insulate his men from partisan politics. If I were a commander, I would not let my people watch it,” Bacarro said.”

    This is the most stupid military inanity I’ve ever heard a military officer ever said.

    He wouldn’t let his people watch it? And pray, how does he hope to do that? By making them face a firing squad?

    This officer does not know the boundaries and limits of a commander.

    He should be sacked for even saying it! Dismissed without pay!

This is what I meant by saying that “From the info I gather, who Gloria does NOT HAVE on her side are A LOT of the junior officers. Let’s stay tuned on that one. Sooner than later, Gloria will “see”.     I thought your and Chabeli’s messages re npongco’s ‘this blog going to the dogs’ were imparted with great dignity. It is indeed quite disconcerting when a fellow commenter feels so aggrieved whether rightly or wrongly, one cannot help but see the extreme pain and anguish of the said commenter through his many messages.

    Soleil’s admonition not to be naive and just to ignore comments that are not to our liking is the best course of action in a highly popular blog such as Ellen’s.

    This blog is almost like a public forum and there are people who are bound to dislike the comments by others who are human beings like us so it isn’t abnormal to find one or two who feel really aggrieved and who take it very personally.

    Having said that, I find it is uncalled for to vent one’s frustrations on Ellen.

    Just the same, I would like to join Chabeli in wishing npongco good luck in another blog.

    No one said that life is fair! As an individual, we deal with it the best we know how and at the end of the day, be proud that you did your best. It’s kinda sad that you take it quite personal and unfortunate that you feel you do about Ms Ellen. I don’t know Ms Ellen, but I’ve my greatest respect toward Ms Ellen for standing alone on her quest against bogus Gloria’s machine. I only knew her a very short time when I joined this wonderful blog and thanks to Ms Ellen for her generosity. I can honestly say that Ms Ellen is the most honest, gracious, un-assuming, greatful of a human being can be. Bogus Gloria don’t even come close.

    As for the preferential treatment to others that you’ve mentioned, I will describe it as cyberspace comraderie, that is they’ve something perhaps in common. Women talks, if you can relate to it. It shouldn’t bother you the least, instead you should approved of it, that they’ve this closenest to each other.

    Where else in the Philippines you can open up and speak your mind very freely. You can in this blog most of the time. All Ms, Ellen have asked of us were to be civilized and to stop name calling, if I recall and also to stick on issues. I don’t think it’s too much to ask on everyone by our host Ms Ellen. What do you think?

Toney is right in saying that a deep “friendship” has blossomed between your preceived irritants and Ellen. They have known each other for quite sometime. You have crossed the line of civility time and again but you were never banned. Isn’t that a good example of being fair?

    My son had Asthma, too, but he has outgrown it. Still, he suffers from some skin allergy. The doctor told us that his Asthma could be aggravated by stress. Don’t be stressed, Sweetheart, by untoward comments here, or the lamentable situation over there. It is not worth losing your life on these crooks trying to lord it over anyone. They do not own the Philippines nor this blog.

    This blog is Ellen’s and right you are, Toney, to say that we should know at least some decorum, and give the owner of this blog some respect. Frankly, I hate saying bad words, but saying … in reference to the Bansot is indeed a great reliever.

    At least, Ellen is being very liberal about it and does not censor/censure us. It shows that she is being true and honest to what she says. For that, she earns by great and esteem respect.

    I can only agree with Schumey when he says you’ve had your share of inappropriate comments, and that’s putting it mildly, isn’t that enough reason we can peacefully coexist when all it takes is to iggy one or two blogger you don’t feel reading instead of trashing the whole blog because the owner doesn’t ban some bloggers you’ve requested her to?

    I admit I’m not clean myself and at times “stray” in that direction, too. But this is the web and all the while I thought we unanimously agree that censorship has no place in a decent democracy, much less in an open virtual democratic society. We even hate Gloria for assaulting media and stuff ‘cuz it encroaches on free speech and all that chuva. And no one can or should impose on Ellen, no, accuse Ellen of corruption, if only for respecting her hosting of this forum.

Takot kasi ang mga unprofessional sip-sip senior officers ng AFP na lumakas ang loob ng mga junior officers at magkaisa na hindi na sundin ang kanilang mga orders at pataubin si Gloria. Dahil pag nawala si Gloria tapos na ang ‘masaganang buhay’ nila. Hawak nila sa leeg si Gloria dahil magkakasama sila sa pandaraya nuong 2004 election.   35. Differences in opinion is as natural as living in a community. No two individuals are alike. Even may pamangkin twins are at odd at times. Agreement and dissensions are expected in any other blog, or fora…or any ordinary community, for that matter.

    It is saddening to hear such words coming from a blogger I perceived as a man. You see, I was raised in a society where ‘TRUE MEN’ don’t whine; where women do!

    I learned in school that an act can garner several reactions. Much as we react to the gross violation of human rights in our country. Had there been no violation or abuse, we wouldn’t have blogged and reacted to the news that such greedy bogus leaders do. Had you not said those racial slurs against my father, I wouldn’t have minded your posts. When someone here hurled ‘dugong aso’, you went wild.     Parang Martial Law!
    I remember hearing those bawal during Martial Law.
    There was that book:Conjugal Dictatorship which went around the campus phto-copied by all. Bawal kasi ang libro. So the rest of the studentry were allowed by the Porfessors to borrow the book for photo-copying. Everyone did!

    The idea is: it became more popular becoz the ban garnered curiousity among the people. Mas ipagbawal, mas lalong mag-iisip ang tao at matatakaw lamang ang kagustuhang makita o mabasa ang banned material.

    Nakakatulong ang pagba-banned ng Erap movie. Mas nagiging hot commodity ito. Kita nyo, mas marami ngayon ang nag-uusap tungkol dito, kahit na pabulong. YUN ang nakakatakot! Yun ang dapat inisip ng nagpapigil nun.

    Kahit na banned, nakakuha ako ng kopya [thanks to that kind spirit who sent me one!]….And I’m gonna share it with others who want to see the movie hereabouts.

    We are all visitors in this blog site and Ms. Ellen, being the owner/moderator got all the rights in this world to censor/delete all offending remarks to maintain civility.

    I admit – I really salute and appreciate her strong convictions, inspite of her fragile health, for providing us with one forum where we can pour out our sentiments and shout, if necessary to release our anger against the conjugal devil by the murky Pasig River. Where else in the world can you find such forum and hosted a brave lady?

    Npongco’s comment is really uncalled for and this should not pass. He owe Ms. Ellen an apology, either he do it in public or through her private e-mail.

  44. There are some comments here in reaction to Npongco’s comments which I deleted. The reasons I didn’t delete the reactions because they contain sensible messages which others can learn from.

    I have always reminded everybody to stick to issues. The purpose of this blog is to encourage discussion so that we can learn from each other even from those whose opinions are different from ours.

    I have been deleting comments that cast doubts on other visitor’s motives or personal background. I find that kind of comments counter-productive. It wastes everybody’s time and efforts.

    I will continue to delete such comments.

    Ellen, being the owner and moderator of this blog makes you a powerful person. It’s like this GMA who’s so powerful that she can suspend and oust a local official. You deleted my comments not because they were too personal; but because most of what I mentioned were true. Truth hurts. I appreciate the fact that many here managed to share a few good words and I must thank them for that. To Emilio, to apologize is easy but if it doesn’t come from the heart, it’s meaningless. I honestly believe I have nothing to apologize. Ellen has the tendency to post those that are favorable to her and a privileged few; but would delete those that are damaging to the very purpose of why this blog was created. What we’re experiencing here is not different from the kind of media we have today. And Ellen knows what I mean. I thought this blog would make a difference; but it’s not. Those who oppose the heavy hitters here are promptly ganged up upon. I posted the previous message when a reader accused you of being corrupt and you reacted strongly. I also defended you because at that time, I had the highest respect for you. I’m not sure if I feel the same way now. You allowed this blog to get out of control for so long despite my repeated reminders. You allowed profanities and insults to go on. It’s only now that you’re putting things in order. I can see some improvement; but your favorite heavy hitters continue to display their arrogance as if they have complete control over you. Many like me don’t know you personally. We all don’t even have to know one another intimately. What matters most is what we’re all fighting for; that is, to oust this illegitimate president ASAP. But just like the political opposition; if we can’t even unite here and some are behaving as if their comments and opinions are the ones that count most, then we’re no better than these politicians who claim to be with the opposition. The ball is on you Ellen. If these members respect you, they should also speak their minds like what I did…even if it’s against your monitoring style. Your being a journalist is due to your occupation. And you’re wittingly or unwittingly applying that approach here in this blog.

    When we join a blog, we also have to abide by the owner, in this case, Ms. Ellen. She is not being dictatorial by doing what she wants to do in moderating people’s comments. While it is Ms. Ellen’s option to create her OWN blog in her own terms, our option, on the other hand, is to join this blog or not. But to say that some people get their karma “health or otherwise” is rather below the belt. If I may add to my 2 cents worth, it may be worth exploring the option of having your own blog where the rules will be under YOUR own terms. Hopefully, this will alleviate your anger. Happiness, after all, is a choice.

    Thanks for deleting parts of my comment. I wrote them in haste and was overwhelmed with emotion at the time.

    This administration has time and again abused its discretion. The midget and her minions obviously know how she grabbed power from a legitimately elected president. Anna and I have posted months back how they plotted and did succeed in kicking Erap out. The ghost of their actions have haunted them and they are too scared that it will be done to them too. But karma has ways to get back at them. I’m hoping it will catch up with them soon.

I don’t know if you knew of the beatings of Erap’s supporters while the Midget was being sworn in by Davide by men in uniform calling themselves policemen but I now realize were actually members of the AFP on orders of their leaders then, Angie Reyes and maybe, Orly Mercado although I would have more trust and confidence that Orly would not do that knowing him to be what he used to be at least.

    He was in fact a childhood friend and classmate, and I doubt if he would be that evil, for deep within his heart, I know there indeed was the idealist that many of us in our class were.

    I saw the unedited footages of EDSA 2 as a matter of fact that had to be clipped for the breaking news of the day on several Japanese TVs and some documentary on what the Japanese, Americans and other foreigners were becoming “a very bad habit” of Filipinos after the failure of the first EDSA to really effect a change would not ironically make Marcos a saint!

    Now, what is really repudiating is how money borrowed from overseas are being squandered to insure that the image of the “Small but terrible ‘ojosan’ (maiden, princess whatever)” is not damaged by any “rebellion,” big and small by making the rallies and protests look nothing but petty grumblings by the opposition.

    What I cannot understand though is how Filipinos in general can excuse the Midget even when she has practically admitted that she cheated in the last election when she said sorry for calling up the Master Election Rigger. It’s utterly atrocious!

    This is where we differ. Orly is one opportunist of the lowest category and not just because he doesn’t know how to hold his liquor. I’ve dealt with him on defence issues and know that he is as scalawag as some of the guys in Malacanang today. I know some of the things that he did when he was still a senator (private commercial transactions) and what he did during his term as defence chief.

    In fairness, I cannot however judge him on purely friendship basis because I didn’t know him before he entered the political or government arena.

    I don’t know how much Orly was corrupted by the system, but I knew him from grade school, and at one time belonged to the same church with Lino Brocka, who was the first Filipino Mormon missionary. He had since left the fold, however, but I’ve kept contact with him although I was not interested in his political career, not even depended on him when we were fighting for the preservation of the Philippine patrimonies in Japan.

    He is presently in Japan teaching at a university in Kobe together with the wife, who is a doctor with the WHO office in Japan. I get email from him from time to time, but for some reason he avoids talking politics with me.

    Orly once did something terrible to Tito Guingona’s daughter and received a punch from the former Vice-President. Erap trusted Orly and appointed him to juicy position; but the guy was among the first to betray Erap. His defeat during the last election reflected how people were disgusted with his turn around and character. He digged his own grave. As for him being a former Mormon, I didn’t have a clue he was; not even the late director Lino Brocka. I didn’t know that Mormon accepts certified gays. Lino was with his boy friend, the former actor Willian Lorenzo, when he died in a car accident.
