Takot sa katotohanan

Binigyan ng MTRCB (Movie and Television Review and Classification Board) ng X rating and pelikula ni dating Pangulong Estrada ng X rating. Ibig sabihin noon hindi mapanood ng publiko.

Ngunit hindi sinabi ng MTRCB na bawal panoorin sa loob ng bahay mo.

Mas matindi pala ang interpretasyon ng military dahil ipamigay mo lang ang CD ni Erap, kulong ka na.

Ganoon ang nangyari kay 1Lt. Artemio A. Raymundo na ngayon ay mag-isang buwan ng nakakulong sa Philippine Marine Corps Brig dahil namigay raw siya ng CD ng “Para Mabuhay sa Masa” at “At All Cost”.

Ang “Mabuhay sa Masa” ay tungkol sa buhay ni Estrada at ang kanyang pagpasok sa pulitika, mula ng siya ay mayor ng san Juan hanggang siya ay naging pangulo. Kasama rin doon ang pagpatalsik sa kanya sa Malacañang.

Ang “At All Cost” naman ay tungkol sa dayaan noong 2004 elections at ipinakita kung ano talaga dapat ang resulta ng eleksyon kung hindi minadyik nina Gloria Arroyo, katulong si Comelec Commissioner Virgilio Garcillano, ang resulta ng eleksyon. Ang panalo dapat ay si Fernando Poe, Jr.

Ang “At All Cost” ay base sa statistics at hindi lang haka-haka. Klarong hindi binoto si Arroyo ng taumbayan na pangulo.

Sa sinumpaan na salaysay ni Raymundo, sinabi niya na nakuha niya ang anim na CD mga dalawang buwan na ang nakaraan nang siya ay sumakay sa LRT. Nakita raw niyang nagdamputan ang mga tao ng CD, kaya kumuha rin siya .

Dahil anim naman ang nakuha niya, pinamigay na rin niya sa iba. Aba, hinuli siya ni Maj. Danilo Luna noong Sept. 25 at sinabing nasa 16th Marine Company headquarters lang siya.

Noong hapon, sinabi ni Raymundo na pupunta siya sa kapwa opisyal na nasa loob rin ng 16th Marine headquarters at nagsagutan sila ni Luna. Inis raw si Luna dahil hindi man lamang nag-sorry si Raymundo sa kanyang ginawang pag-distribute ng CD. Kaya nilipat sa Philippine Marines Brig kung saan nakakulong siya hanggang ngayon.

Noong bagyong Milenyo nga raw ay basing- basa ang higaan ni Raymundo dahil tumutulo ang kanyang kwarto.

Nag-file ng petisyon para habeas corpus si Raymundo at ang kanyang asawang si Ma. Salome sa Court of Appeals para siya ay palayain dahil sabi ng kanyang mga abogado wala namang batas na nagsasabing bawal magmigay ng CD.

Wala ring order na nagsabing bawal manood or mamigay ng “Ang Mabuhay para sa Masa” at “At All Cost”

Ang linagay ngayon ni Luna na kasalanan ni Raymundo ay “Disrespect to superior officer”.

Paano mo naman respetuhin ang ganoong opisyal?

    Lieutenant faces court martial for distributing Erap video

    A MARINE lieutenant is facing investigation, preparatory to possible court martial, for distributing to fellow soldiers copies of a video documentary on the life of President Joseph Estrada, which government has given a “triple x” rating.
    Marines spokesman Lt. Col. Ariel Caculitan said 1st Lt. Artemio Raymundo, detailed with the Marine Field Artillery Battalion, was ordered confined to barracks as early as last month for the infraction.
    Caculitan said Maj. Danilo Luna, Raymundo’s commanding officer, ordered Raymundo to stop distributing copies of “Ang Mabuhay para sa Masa (To Live for the Masses).”
    “There was an order not to distribute the Erap video and he was defiant,” Caculitan said.
    Raymundo ignored the order, prompting Luna to order his confinement to barracks, Caculitan said.
    Caculitan said Raymundo’s battalion conducted an initial investigation and the conclusion of the probe was a recommendation to try him in a court martial for “insubordination.”
    Caculitan said the office of the Judge Advocate General at the Marines is conducting further investigation on Raymundo.
    “What we are looking at is insubordination. There was an order and he disobeyed it,” he said.
    Asked what office ordered the banning of the documentary in the military, Caculitan said: “I don’t know, maybe GHQ (general headquarters). You better ask Colonel Bacarro why it’s banned.”
    He was referring to AFP public information officer Lt. Col. Bartolome Bacarro.
    Bacarro, in a press briefing, said there was no directive coming from Camp Aguinaldo banning the documentary video. But he said military leaders agree that there is a “political color” to the documentary.
    “As far as I’m concerned, there is no directive (by GHQ to ban the video),” said Bacarro even as he justified Luna’s order to confine Raymundo.
    “We all know that the CD has a political color and it is the inherent job of every commander to ensure that his men are isolated from partisan politics. So it was the judgment of the commander to ask initially Lt. Raymundo to stop distributing this CD,” he said.
    Bacarro said Luna initially summoned and warned Raymundo against distributing the copies of the CD after some officers who received copies reported Raymundo’s activities to Luna.
    “But despite the warning, instruction given by his battalion commander, he still continued to distribute these CDs,” Bacarro said.
    Bacarro said Luna again summoned Raymundo for possible restriction to quarters. “When he was informed that he is being confined to quarters, he turned unruly and he talked back to his battalion commander and this constitute a violation of Article of War 64, disrespect to a senior officer,” he said.
    Apart from violation of the Article of War 64, Bacarro said Raymundo could also face a charge of violation of the Article of War 65 or insubordination for failing to comply with the specific instruction of his superior or disobeying a superior officer.
    “When he was told to stop it, that was a legal order. He disobeyed it. Then when he was being placed under confinement he talked back to his senior officer, which has the authority to confine him. That again constitutes another violation of Articles of War, that is disrespect to a superior officer,” he said. – Victor Reyes

    Deposed President Joseph Estrada yesterday cruticized the Armed Forces of the Philippines for detaining 1LT Artemio Raymundo for distributing copies of his documentary “Ang Mabuhay Para sa Masa” to his fellow Marines.

    “I denounce in the strongest possible terms the ill treatment according to First Lieutenant Raymundo,” Estrada said in a statement released by his lawyer Rufus Rodriguez.

  7. I have always reminded everybody to stick to issues. The purpose of this blog is to encourage discussion so that we can learn from each other even from those whose opinions are different from ours.

    I have been deleting comments that cast doubts on other visitor’s motives or personal background. I find those kind of comments counter-productive. It wastes everybody’s time and efforts.

    I will continue to delete such comments.

    I think the issue here could be ‘is it right for military personnels to distribute political materials’?

    Or, did the military overreacted on the matter?

    We might not like the fact that President Erap was duly elected President of the Philippines, but the undeniable truth is he was, in accordance to the constitution of the Philippines. He was still in Malacanang when bogus Gloria and Hilario Davide conspired to swore fake Gloria under the constructive resignation. Do you recall that event at Edsa?

    President Estrada were never legally impeached in accordance to the law. If you also recall on tapes that both Husband and Wife, Miguel and Gloria plotted and planned the overthrowing of President Estrada, bloodshed matter not. Do you also recall that admissable by the couple?

    Reality is, not what I want, but what would satisfy justice, the rule of law? As far as I know bogus Gloria is illegitimate head and has no moral authority to govern the country. And if I’ve my way President Estrada will be reinstated to his rightful position in office. Again, is not what my desire, but justice requires it as civilized nation and if we strongly believe in democracy. And I do!

Furthermore, do you think Chavit Singson is telling the truth when he testified against President Estrada?

    Injustice has been done by bogus Gloria not only to President Estrada but the Philippines as a whole. The Pilipinos are the victims, like you and I.

Bakit nangyayari ito? It is because of our country’s current “political crisis and instability”…na kagagawan ni gloria. Bakit sumusulpot ang mga grupo na tulad ng SIGnAW ng BAYAN? Nakakalap ng mga pirma mula sa mga taong “naninirahan” sa mga “depressed areas” kapalit ng bigas, noodles, sardinas, at kaunting “barya”. Kaya kung ang “laman” ng DVD ni ERAP ay tungkol o “bumabanggit” sa mga kaganapang ito, mahirap “lunukin” ng numero unong IPOKRITO na ale sa Malakanyang ang ganitong KATOTOHANAN. Dahil sa kaniyang isipan ay mayroon pa siyang humigit-kumulang na apat pang taon sa kaniyang “kinalu-luklukan”.

    Arroyo says pope meeting inspired her to seek administration change

    MANILA, April 8 Kyodo
    Philippine President Gloria Macapagal-Arroyo, in Rome for Pope John Paul II’s burial, said Friday that a meeting with the pontiff in October 2000 gave her the courage to join the movement seeking a change in administration that led to her assumption of the presidency in 2001.

  38. Based on the above news, Major Luna gave an order to 1Lt Raymundo to “stop distributing the DVDs” but Raymundo disobeyed, was thus confined to barracks and now will be facing a court martial.

    I am flabbergasted Ellen.

    It doesn’t make sense that a junior officer should be facing a court martial because he disobeyed his superior’s order to stop distributing the Erap DVD.

    First of all, we are not talking here of foot soldiers but of a junior officer. There is clearly a wanton disregard for proper procedures. The offense, if we may call that an offense is not a serious one that warrants a court martial.

    Secondly, the unit commander could easily address the offender with a summation brief first saying that if he continued to disobey his superior’s order, he would be called in, along with the superior who issued the order, to explain what happened.

    Thirdly, The young officer should be able to explain, outside a court martial, why he disobeyed the verbal order; during the ‘interrogation’, it is up to his superior too to explain why he gave a verbal order for the junior officer to desist from further distributing the DVD.

    To show that there was indeed a violation of an article of war, there should have been a written order from the start.

    Any military order that does not entail security risk or put the lives of elements of the military at risk or is outside military operations may be questioned by the receiver of the order who is entitled under military rules to be provided with an answer.

    (The DVD in question could easily be equated with the porn or adult rated films proliferating in military camps and do not necessarily contravene or violate military rules unless otherwise stipulated in a military guideline.)

    The process by which the military is punishing the junior soldier is going out of hand. What do this people think they are doing? By elevating this issue to a court martial offense, the AFP has managed stupidly and idiotically to lend more political color to what could have been a forgettable affair.

    Major Luna went over the limit and boundaries expected of a good military commander. Clearly, he is a poor commander.

    Military officers are also bound by this code: NEVER ISSUE AN ORDER THAT CANNOT BE OBEYED. No ifs, no buts.

    As for Erap returning to the presidency, I doubt, for I understand that there will be in interim administration just in case the Midget steps down, and the Senate President has to take over since when the bogus president admits that she has cheated in the last election, then there is the possibility too that Loren Legarda’s contention that she has been cheated herself to be true, and presto, both the bogus president and the still to be declared bogus VP shall be stripped off of their present titles, bogus though they are, then the Senate President shall take over, and within 60 or 90 days (?) has to declare a snap election. One suggestion is that none of the officials to serve in the interim election should run in the snap election para less dayaan.

    As far as I am concerned, I would opt for the abolition of the useless agency called “COMELEC”! They should not in fact have appointees serving there as a matter of fact. The truth is we don’t have such useless agency in Japan, and yet, we can still have a clean election over here. Less cheating especially when we have conscientious policemen looking all the time for the cheats and catch them on tips of concerned citizens, even those who serve as volunteers for parties concerned. Bakit hindi iyan magawa sa Pilipinas?

    Why can Filipinos not realize that if they want their government to change, these cheatings should be stopped by all means, once and for all? Pero golly, pati police and militar kasama sa dayaan. No wonder wala na ngang pag-asa! But my gosh, do other nations have to take the burden of all these anomalies by being made to accept Filipinos who are driven out of their country to escape hunger and poverty?

    In short, Erap is also now history. However, so far, he has not been proven to have stolen as much as the incumbent has stolen money from the treasury, for the truth is his case is more or less a case of bribery as far as the Ilocano Singson is concerned (I am ashamed of this crook as a matter of fact. Kababayan ng lola ko. Nakakahiya!). Ang hina naman ng mga prosecutor sa Pilipinas not to know that what Singson did was try to bribe Estrada for special favor and treatment. Walang makitang ebidensiya. So, walang kaso! Sino bang niloloko nila?

    If we are to base our judgement on the news that the young officer’s superior gave a verbal order to stop distributing but did not issue a written order to that effect points to an ‘offense’ that does not warrant a court martial hearing even if there had been an ‘exchange of words’ between the two protagonists.

    The stupidity is that MajGen Allaga has allowed this to get to a point of no return. One of his underlings, the deputy marine commandant for instance, could easily have summoned both officers, Raymundo and Luna, to explain their sides. There was no risk to life involved here.

    I’m afraid the theory that the AFP is not quite a professional military is becoming less and less that of a mere theory.

    Good grief, if that is true, there must be a provision in the Constitution for an enabling budget; the law stipulates a number of slots for officers, from the rank of lieutenant colonel to 4-star. Each major service has a number of these officers and cannot be increased at whim. Any increase in the slot is subject to the law.

    AFP troops -120,000 or so of officers and men – to be increased almost three-fold? There are already CAGFUS (official para-military militias)in operation, although I gathered they were re-named…

    But even if these ‘troops’ whom you say are being recruited, do not get absorbed into the official AFP military, still, a private army of 180 thousand is beyond any rich man’s wildest dreams! Keeping a private army of say, a hundred or two hundred men is one thing but to have a private army of 180,000 is NOT DOABLE not even in the Philippines where Gloria can steal from national coffers at will or with impunity!

    Think of the expense.

    There must be a misunderstanding of the figure somewhere.

There is no law that implicitly states that they cannot be copied, distributed, etc. If Bunye says otherwise, then we know for a fact that he is he guilty one; a proof that he has tried to trick the Filipinos that the Ale Boba has never committed a crime against the people of the Republic of the Philippines.

    Cheating, electioneering, tampering of votes, etc. are not misdemeanors in the calibre of a traffic ticket. it is a crime that should have been prosecuted in a criminal court.

    The Garci tapes are still available for downloading in the PCIJ site as a matter of fact.

    As for the jueteng bribe to Malacanang, I am told that it has been in fact a political tradition that was never exposed nor talked about until the Singson fiasco. At least, nabisto o ibinisto nila ang mga sarili nila a paghahanap ng baho ni Estradang bayani ng masa!

    Don’t bet me wrong. Wala akong kinikilingan. In fact, I never endorsed the candidacy of Estrada for the presidency. I thought Filipinos should boycott the election in 1998 for being presented with no real good choice for the presidency.

    You see, I, for one, believe that God does not bless a country headed by people who are fornicators, liars, cheats, etc. The Bible and even perhaps the Koran are explicit about abiding by God’s rules to be blessed by Him.

    Now, the difference between Estrada and the Bansot is the adulation and love of the small people for the incarcerated president versus the bogus one.

    I keep getting astounded by the blatant disregard for the bill of rights in a nation that purports to be democratic although I shouldn’t be because I am aware of how things work in the Philippines.

    It’s just that the Philippines has the distinction of possessing a strong educated class but why can’t those who can make the difference see that if they continue to have disdain for the elementary notion that the bill of rights are there for the good of society overall, which includes everyone from all walks of life, in the long term, they, the ones who can make the difference will not enjoy the fruits of their labor?

    What good can all the education, the wealth, the status serve if you live in the midst of a miserable value-less, disrespectful society?

    Part of democracy is acting in good faith, never mind the legalese and its intricate gobbledygooks but acting in good faith and respect for the bill of rights are the unwritten rules of a civilized nation.

    We keep regressing in the Philippines instead of progressing. The more we go forward, the worse the actions in bad faith become and the less respect there is for the bill of rights.

    You said the things I’ve wanted to say. Nagtataka nga ako kung bakit hindi naipasunod ang mga batas sa Pilipinas the way the Americans had made sure the laws drafted and passed under their tutelage, guidance and supervision are abided by over here like the law on Child Welfare and Protection. I understand that such had been one of those drafted for the new Republic even prior to the granting of Philippine independence, bakit hindi sinunod. And then, kundi pa makalabas ng bansa hindi mo malalaman ng ginugunggong pala ang mga mamamayan ng mga binoboto nila. Mga bata nagkalat sa kalye, hindi nag-aaral kundi pinagtitinda ng kung anu-ano.

    Bill of rights? I doubt that they know there is such a thing!

    Bills of Rights!!! good for you Anna to Mention It, because just remind me, the whole constitution of Canada, “the Constitution Act of l982” is simply a Bill Of Rights. We call it Charter of Rights and Freedom and all the legislations and by-laws, criminal and civil popping out of all our legislative bodies are tested and studied around that piece of Work, before they are enacted laws, otherwise the court, starting from the Municipal Court will just declare a law unconstitutional the first case brought before it. Yes, the Bill of rights and Freedoms..

    You are absolutely correct! That’s why I pounced on it the moment Yuko mentioned it because anywhere in the civilized world, the basis of laws are enshrined in the Bill of Rights. It is omnipresent in the French Constitution and even in the centuries and centuries old Magna Carta of Great Britain.

    It is based on respect of a citizen and common sense in the absolute.

  80. Over here, Anna, Vic, we always say when we protest, “According to the Constitution, I have this and that right!” Hindi na makakaimik ang kahit sino! It is actually a matter of knowing both rights and duties as guaranteed and prescribed by the Constitution, the highest law of the land. Sayang ang mga pilipino. Hindi nila alam na may mga rights and privileges sila na hindi puedeng saklawan lalo na ng hind naman naboto ng majority ng mga mamamayan. Palusot pa kasi sila when they do something wrong themselves na hindi nila alam ang tungkulin nila sa batas! As usual, it takes two to tango! Ang masama pa kasi sa Pilipinas, ginagawa talagang bobo ang mga tao.
