Press freedom, not technicality, is the issue

Last Monday, Jose Miguel Arroyo, through his lawyer, asked the Makati Trial Court to dismiss the class suit we (more than 35 journalists he charged with libel plus more than 30 co-petitioners) filed against him describing it as as “plain political harassment”.

Arroyo’s lead counsel Ruy Alberto Rondain said the suit “is not even a class suit and is only a move by the plaintiffs to vindicate personal and individual interests, albeit imagined.”

Arroyo’s spokesman Jesus Santos said the case is defective in nature and should be dismissed.

Rondain said the suit is not a class suit because of the following points: the lack of common interest among the plaintiffs, notably the lack of a common definition for the juridical entity “The Philippine Press” which was used by the plaintiffs in describing themselves in the suit; 26 of the journalists earlier sued by Arroyo for libel did not join or sign the complaint while those not sued like Miriam Grace Go, Gemma Bagayaua, Jose Pavia and Sweet May Cawicaan did; and the plaintiffs asking for monetary damages against his client has effectively torpedoed their argument for common interest since plaintiffs in a class suit would normally demand relief and not damages.

Rondain also said, “”There are 39 plaintiffs claiming damages totaling P487, 500,000. The docket fees for that claim exceeds P9 million but the records do not indicate that the docket fees paid are anywhere near the amount,” he said, adding that there was a “deliberate attempt on the part on the part of the plaintiffs to mislead the court and to avoid the payment of the proper docket fees.”

Through our lawyer, Harry Roque, we say that Arroyo’s motion to dismiss is based on technicalities and on a wrong interpretation of the rules and is thus devoid of merit.

We maintain that the suit, the first of its kind in the world, is meant to defend press freedom and democracy against Mr. Arroyo’s efforts to undermine both.

Roque said, “He claims the journalists did not pay the correct docket fees, and yet it is very clear from the Prayer of the complaint that all that they are collectively praying for from the the court is it grant them from the First Gentleman a total sum of 12.5 Million Pesos in damages.

“It is correct that the 12.5 million is not sufficient money to compensate the journalists for the damage the Arroyo libel suits have caused them, free expression, and the country’s democracy in general. However, because they were able to raise only enough funds to pay for docket fees only for damage claims amounting to 12.5 million pesos, the journalists settled for that symbolic amount,” Roque said.

“It is the view in fact of my clients that the amount of damage caused by Mr. Arroyo is unquantifiable, given the normative value of freedom of the press as indispensable for arriving at the truth, and in shaping the informed public opinion necessary to check an abusive government,” Roque continued.

“Arroyo’s Motion to Dismiss also alleged that those not sued by the First Gentleman have no cause of action. The journalists’ complaint, however, states that because of the filing of these baseless libel suits, the first gentleman is “chilling” the exercise of freedom of the press by abusing his right to sue for libel,, and is thus in violation of articles 19, 20, 21 and 32 of the New Civil Code.”

The chilling effect of his libel suits is being felt by all media practitioners and not just by those sued by Mr. Arroyo. Mr. Arroyo is fully aware of the adverse effect of his libel suits on press freedom in general. Here, the journalists explained, it is the law itself that gives them the cause of action precisely because what is in dispute is not whether he has the legal right to file these suits, but whether he is abusing his right to do so in a deliberate and systematic effort to curtail press freedom, and thus further weaken Philippine democracy.

Roque elcomes Arroyo’s Motion to Dismiss and his Answer to the journalists’ complaint as a virtual admission that the First gentleman is guilty of abuse of right:

“There is not a single denial that Mr. Arroyo abused his right to file these cases. He only claimed that he had a right to file these cases, which my clients do not dispute. In the absence of such a denial, the effect is an admission”.

Roque said it is likewise preposterous to say that only human beings, not media outfits, are protected by the free speech and free press clause of the constitution.

“He forgets that the leading cases on libel in the US and in the Philippines involved juridical entities such as the Manila times, the Philippines star and The Manila Bulletin. The claim that media outfits such as PCIJ, CFMR and other journalists groups cannot sue Mr. Arroyo for undermining the freedom of the press is grossly ignorant of the law,” Roque said..

On the so-called ground that the venue for the journalists’ suit was improperly laid in Makati, Roque stressed that it is alleged in the Complaint that journalist Vergel Santos, one of the Plaintiffs, is a resident of Palanan, Makati. A case may be filed in the locality where either the plaintiff or the defendant resides.

Likewise, all the so-called technical defects of the suit, such as lack of certification of non-forum shopping, are without merit since the record will bear that these certificates are found in the records of the court.

“Even assuming that these defects are true, the fact is that the case will still proceed since Mr. Arroyo did not allege a complete absence of these certificates”, Roque explained.

“Mr. Arroyo probably confuses our courts of law with a political body such as the House of Representatives. He will not get the same results that he got from the House from a competent tribunal such as the Regional Trial Court of Makati with competent and morally upright judges,” Roque added.

“My clients are not suing for themselves as individuals alone, but for the entire Philippine press and in defense of democracy,” Roque concluded.

    This thread and the group of journalists’ lawsuit against Mike Arroyo now reminds me to ask where is Mike right now? Nasaan siya at bakit tahimik? Does he really have serious health issue since his hospital confinement or is he again planning some stupid things? Delikado ang mga tahimik na tao. Maaaring may ginagawang mga milagro. Let’s beware of silent operator. Ang mga maiingay walang laman pero ang mga tahimik mapanganib. Let’s better check on this Mike Arroyo and see what’s he’s doing and what’s he’s up to these days. Baka nasa Hongkong na iyan ngayon at gumagawa ng paraan sa pera ni Nani Perez.

    The presiding judge on the case could have told Mike Arroyo’s lawyer that the docket pay to be suffecient, he can even reduce the amount of the suit to $1 and just make up the rest as punitive damages. That way Mr. Arroyo has only to pay a dollar or peso and then pay millions on punitive to emphasize the violation of the rights of the plaintiffs. That is if the defendant’s lawyer still insist on Technicalities as basis for dismissal.

    As for Mike’s wherabout, my suspicion is, he is in solitary confinement as a strick diet regimen, otherwise, he’ll be up for another procedure in no time if Misis will let him loose..

    Kabayang Vic, we hope the reason for Mike Arroyo’s silence is due to dieting. Baka umiikot na iyan sa bansa para sa pondo sa election. O baka nasa abroad iyan at inaaayos ang mga pera nila in anticipation of his wife’s inevitable ouster. I can’t help but speculate. His being both a private and public figure requires that we be informed of his condition and whereabout. This man is dangerous. Leave him a minute and he causes harm and damage to the people.

    WWNL, I like the way you describe Mike Arroyo’s voice as that of a frog, a crying frog. Kung ano ang laki ng katawan, ganyan naman ka liit ang boses. Boses palaka ba? He reminds me of the late Doroy Valencia, a popular journalist closely identified with Imelda Marcos. I’m sure kilala ni Ms. Ellen Tordesillas.

    If the court there is of the same caliber as the courts in more civilized societies, you can bet your bottom dollar justice will be on your side, never on this one who takes advantage of the position of his wife even when everyone knows how they have managed to have her sit there. Hopefully, the sitting judge will have more sense even just to insist his/her independence as he/she should insist he/she enjoys as his/her privilege, honor and responsibility.

    We’ll see how press freedom works there.

Making up our mind what to call Mike Arroyo (mouse or frog) is one of the things some focused recently. Pinag-uusapan lang naman kung anong bagay sa boses ni Mike Arroyo: Palaka o daga.
