Nani seen as Palace sacrificial lamb

I am intrigued by the motive of Malacañang for allowing Nani Perez to be charged for the $2 million he received from mark Jimenez. I’ll write about that later. Here’s Malaya’s update on the $2 million man.

Malacañang will apparently turn former Justice Secretary Hernando “Nani” Perez into a “sacrificial lamb” to show the Arroyo administration is running after corrupt officials, Senate minority leader Aquilino Pimentel Jr. said yesterday.

“They want to create the impression that they are not tolerating corruption,” Pimentel said.

Sen. Jinggoy Estrada agreed with Pimentel but expressed doubts Malacañang would push the case against Perez.

The Ombudsman on Monday recommended the filing of extortion, graft and falsification charges against Perez, Arroyo’s first justice secretary, based on the $2 million extortion charge of former Manila Rep. Mark Jimenez.

Jimenez said he gave Perez the $2 million to stop the latter from forcing him to execute affidavits damaging to persons connected with the ousted administration of President Joseph Estrada.

Sen. Estrada and the United Opposition (UNO) asked the Ombudsman to upgrade the charges to plunder.

Sen. Estrada said Perez should be charged with plunder and not merely extortion and graft charge because the amount involved is above the P50 million floor for plunder which is a non-bailable offense.

“Masyadong hilaw ang kaso. Extortion. Magkano ba ang bail ng extortion?” he said.

He reiterated his call for Perez’ immediate arrest. He noted that in the plunder charge filed by the Arroyo administration against him, his father, and lawyer Ed Serapio, investigation took only four months, after which they were arrested.

“It took the Ombudsman four years to decide (on the Perez case). Samantalang sa amin, we were removed January 2001. Hinuli na kami April (after) four months… At ikunulong na agad kami.”

“They have to do the same with Nani Perez. They have to arrest him right away and put him behind bars,” he added.

Pressing plunder charges against a “big fish” like Perez, UNO said, will be a test of the administration’s vaunted effort to battle corruption.

“Ombudsman (Merceditas) Gutierrez has finally managed to gain some measure of credibility but it still suffers with her continued failure to file the necessary charges against former agriculture undersecretary Jocelyn Bolante,” said former senator Ernesto Maceda, UNO spokesman.

Maceda also criticized Malacañang for the statement of Executive Secretary Eduardo Ermita that he believed Perez is innocent.

“It is despicable that no less than Executive Secretary Eduardo Ermita would come to his defense. It only shows how serious the Arroyo administration is when it comes to charges of corruption of its ally,” he said.

Maceda also took to task Ermita for saying the complaint of Jimenez was a private case.

“He appears to be confused when he said it is a private case. How can the approval of the IMPSA contract be considered a private matter? That’s the problem of the present administration, it is treating public funds as a private matter,” he said.

There are allegations that the $2 million was part of a bigger sum paid by IMPSA, the Argentine company which rehabilitated the Caliraya-Botocan-Kalayaan hydroelectric plant complex, to secure a government guarantee for its loans.

Smokescreen

Former Solicitor General Frank Chavez also called for upgrading the charges to plunder, saying the case showed a “consistent, clear and repeated” pattern of efforts to hide the money.

Chavez said the graft and extortion charges could be a “smokescreen” to make it appear that the administration is indeed serious in its campaign against corruption in the government.

Pimentel said that while the indictment of Perez was a “pleasant surprise,” he said Gutierrez failed to look beyond Perez’ liabilities.

He said Ombudsman investigators should have also “investigated deeper the allegation that Perez conspired with other administration personalities in the extortion-bribery case and that the amount involved was much bigger than $2 million.”

Lacson on Tuesday said the actual amount involved in the extortion case was $14 million.

Pimentel urged Gutierrez, who served as undersecretary to Perez, to also finally make a ruling on the graft complaints against Bolante in connection with the alleged illegal diversion of fertilizer funds to the campaign kitty of President Arroyo during the 2004 presidential elections.

The complaints against Bolante are still in the preliminary investigation stage because Ombudsman investigators claim they have yet to get documentary evidence.

Vindication

Sen. Luisa Ejercito-Estrada said the Ombudsman’s decision is another vindication “not only for President Erap but the entire Estrada clan as well.”

“For too long, the government and the prosecutors in President Erap’s plunder trial have been trying to link this anomalous deal to him in a vain attempt to divert the public’s attention from the real culprits % former DOJ Secretary Hernando Perez and other ranking Palace officials,” she said.

“But the records are very clear. Not a single IPP (independent power producer) deal was approved during President Erap’s term and this IMPSA (power generation) deal was in fact consummated in an indecent and hasty manner when Mrs. Arroyo grabbed the presidency from him in 2001,” she added.

She also said it was “illogical” for the Ombudsman to claim the extortion case filed by Jimenez was not related to the IMPSA deal.

“Up to the last days of President Erap in Malacañang, Mr. Jimenez had been badgering him to approve the contract, even hinting that funds were available for projects of the Office of the President so no way could this probe be limited only to the former justice secretary,” she said.

“We now dare Ombudsman Gutierrez to show her mettle and crack the whip on all those involved up to Malacañang and not just Mr. Perez. For the sake of truth and justice, I will talk to President Erap and ask him if he would be willing to share his knowledge of this deal like what he did when he testified in the Senate on the same issue,” she added.

Hands off

Former President Estrada asked Malacañang to keep a hands-off policy in Perez’ case.

“Let justice take its course, let the chips fall where they may,” the former president said in a statement. “This is a case of corruption and extortion, and it is most unseemly and unethical for the Executive Secretary to pronounce a verdict even before the case is brought before the anti-graft.”

His spokesman, Rufus Rodriguez, belied Jimenez’ allegation that the former president was involved in the IMPSA bribery issue, pointing out that it was Jimenez who brokered the contract and gave the $2 million to Perez.

Estrada said the negotiations for the IMPSA power project began during the Ramos administration.

During his 1999 state visit to Argentina, Estrada said he was advised by senior officials of his host country that they remained interested in the project.

Estrada cancelled the negotiations after IMPSA officials, through Jimenez, tried to bribe him with $14 million in exchange for his approval of a “sovereign guarantee” to be attached to the project.

“President Estrada would not hear of any sovereign guarantee that would only bring additional hardships on the people, and that is the reason this project was shelved under his administration,” Rodriguez said.

A sovereign guarantee automatically requires the national government to assume the liabilities of a private company should it be unable to pay its debts.

Rodriguez asked Jimenez to say where the balance of $12 million went.

No sacrificial lamb

Ermita said Malacañang is not making a sacrificial lamb out of Perez. He said he sees no reason why there should be any.

He added the statement is expected from Pimentel, the latter being in the opposition.

Ermita also said he has no knowledge on whether the alleged pay-off reached anyone in Malacañang.

“I would just say that let’s just leave it to the courts to decide,” he said, adding that he does not want to be cited in contempt of court for commenting on the case.

He also said that under the law, a person is deemed innocent until proven guilty. – With Ashzel Hachero and Jocelyn Montemayor

    No sir, Mr. sescretary, it is not up to the courts to decide, But it is Up for the Investigators, the prosecutors investigators, under the office of Anti-graft agencies, whatever you call them, and then have the evidence file with the Court, before the Courts could Decide, that is if you know the Process. But if the so called prosecutors don’t even dare investigate the “malacanang” then the courts would have nothing to decide. Now Secretary Ermita can we start all over again…

    This thing about Nani Perez being charged in court is just a charade, a moro-moro, a gimmick. Don’t you believe it. This administration is charging him only to get him acquitted, just so that they could say later on that he was officially exonerated by the court. And of course, it’s all cooked up from the beginning. Mark my word.

    Yes, the Edralins are from Ilocos. Ang pangalan ng mother ni Marcos ay Josefa Edralin. You must be related to the mother side of the late dictator Marcos.     Remember the story about the trojan horse, Greek bearing gift. Here is a prime example, mutineer Gloria using Perez as a pawn, as rumor floating around or assumed by others. I won’t trust Gloria the Rapist for all the tea in China. Mutineer Gloria got something off her butt, and Perez is no sacrificial lamb. My guess, Perez is an old man and has only so many months to live and will die before it gets to court with the $2 million he’ll take with him, or somebody will do him in. Crook perez upon his death will stop at Switzerland to make a $2 million withdrawal so he can use to bribe the gate keeper so he doesn’t have to burn.

    Once again, mutineer Gloria is trying to out smart everyone. Goody! Goody! Way ahead of Gloria the Rapist. Mutineer Gloria didn’t come this far, over six years and only to let Perez squeal on mutineer Gloria or betray Gloria the Rapist. Mutineer Gloria got billions (in dollar) to lose and Perez only $2 million that don’t even belong to him. Hence, Perez is not going to do anything to jeopardize Gloria’s enchanted kingdom. Mutineer Gloria won’t let it happen, ever.

    This is another story that will fade away like good old soldier of mutineer Gloria. e.g. Hello Garci, Josie Joc Joc Bolate, those mutineers that cooperated with mutineer Gloria herself, and among others.

    I’m not falling in to it! What else could it be but mutineer Gloria’s another of her immoral scam.

    Kabayang Apoy, you mentioned Chua and Lacson. I’m intrigued by this. What do the two got to do with Donya Josefa and Imelda? Well, ang alam ko po ang tunay na ama ni Marcos isang Chinese na ang last name ay Chua. Pero ang Lacson ewan ko lang.

    I still stand by what I said regading this Nani brouhaha. In a previous thread I said that I smell a game a foot on this “graft and extortion charges..filed by the Ombudsman against former Justice Secretary Hernando Perez.” It has politics spelled all over it !

    Malacañan is making it APPEAR that Nani is the ““sacrificial lamb”.” Malacañan is up to something. Watch them pull out a rabbit from a magician’s hat ! Isn;t it strange that this issue is comig out during an election period ?

    Can’t help being amused by this new gimmick of the crooks! But they have not fooled anybody—not a lot of us here anyway as long as the crooks are still roaming around, and acting like they alone have the right determine the fate of the country and the people of the Philippines. They should be arrested and prosecuted together with Nani Perez, et al.

    ‘What is the signal the Palace is sending in expressing support for Perez?’

    The highest officials of the land have apparently grown accustomed to the culture of corruption in government that they would even publicly defend former Justice Secretary Hernando Perez over the alleged $2 million he extorted from former Rep. Mark Jimenez.

    That $2 million was exacted from Jimenez so he would not be included in the plunder charges against President Joseph Estrada is no longer coffee shop talk or idle gossip. The Ombudsman has already found prima facie evidence against Perez. In days past when those serving in government adhered or appeared to adhere to higher moral standards, officials would be tripping at each other’s feet in seeking to distance themselves from the purported perpetrator of the alleged crime.

    But what did we hear from the Palace? Executive Secretary Eduardo Ermita, while saying that Perez is on his own because he is no longer in government, said the Malacañang remains supportive of Perez. Why? Because he said Perez is an administration ally and, in fact, an official of the Lakas party in his home province in Batangas.

    It was not clear what Ermita meant by the Palace being supportive of Perez. Perhaps he was referring to moral support for a former colleague. This much was indicated when he said, “Alam naman ni Secretary Perez in spirit, lahat ng kasamahan niya are behind him.”

    Granted that Perez enjoys the presumption of innocence, what is the signal the Palace is sending in expressing support for Perez? That no social stigma attaches to one who is facing trial for graft, extortion and falsification of public documents?

    Justice Secretary Raul Gonzalez went even further than Ermita by offering to provide legal assistance to Perez.

    “He is entitled to a valid, credible defense. He is entitled to every legal defense possible if there is a legal technicality… There can be some explanation (for the paper trail),” he said.

    Strange words for one who supervises the prosecution service which is responsible for the determination of probable cause on all criminal charges, except corruption in government which is the exclusive jurisdiction of the Ombudsman.

    After prosecutors have found prima facie evidence and filed charges, they are sworn to do their best to put the accused in jail. Proving the innocence of the accused is not their business. But here now comes their boss offering to help an accused put up a credible defense.

    Gonzalez’ warped sense of justice, however, is consistent with his handling of the Perez case.

    The original smoking gun was provided by Swiss authorities who sought the assistance of the government in determining who is the Hernando Perez who was found to have transferred substantial sums from Singapore to Switzerland and then to Guernsey offshore banks.

    Gonzalez sat on a request to Hong Kong authorities for documents on the bank accounts under the mutual legal assistance treaty.

    He is only running true to form as protector and coddler of offenders close to the administration.

    Interesting. But here’s a Philippine Star article (a pro-Arroyo paper) on the Mark Jimenez Impsa deal last Sept. 5, 2003 by Jose Rodel Clapano:

    Jimenez, in his privileged speech at the House last year, claimed actually releasing $14 million in kickbacks in exchange for the approval of the IMPSA power deal. The Manila lawmaker was later extradited to the United States to face charges of mail fraud and illegal campaign contribution.

    The IMPSA contract was approved four days after President Arroyo assumed the presidency in January 2001.

    Of the $14-million bribe, Jimenez claimed $2 million went to Perez, $1 million “for the boys” and $4 million to Malacañang “residents.” The remaining $7 million remains unaccounted for.

    Unaccounted for raw… wink, wink…

    But why in the first place did Perez approve IMPSA’s request just four days after the Arroyo government took over and despite the issues raised against it by NPC and other agencies? The “bombshell” was finally dropped when Congressman Jimenez testified before the Senate Blue Ribbon Committee late last year that the justice secretary received $2 million in return for the favorable DoJ ruling on IMPSA. Jimenez and a House colleage, Rep. Willie Villarama, also said the money was part of a $14-million bribe offered to officials of the Arroyo administration.     Classifying people based on ethnic background and regions is like profiling. Para sa akin, ano man tulong naibibigay ito sa pulisya, hindi pa din maganda. Ang tao ay may kanya-kanyang katangian.     After reading your post about Chavit, I could only utter, WOW Philippines! I thought what I read at Newsbreak before are all there. Mas marami pa palang additional info.

    And so, I think Chavit will not run for Senator even if he’s promised by the 82 governors. Not even once his name has been mentioned in the senatoriable under the aegis of GMA meaning, even GMA is not too keen in endorsing him.
    The perception about Chavit is like that of JDV. They are unbeatable in the local arena but not that strong in the national elections.

    For Chavit, being in the senate is another kind of ballgame than as a provincial governor where he is the political kingpin and all that. We know why he is the kingpin and the Newsbreak tells us more.

    It’s true that El Chavit has no followers outside his turf. He is the governor for life in Ilocos Sur. Jose De Venecia is not a political kingpin in Pangasinan. The west of Pangasinan are Pangalatok while eastern Pangasinan are Ilocanos. Jose De Venecia may be strong in Pangalatok area only. Maybe Fidel Ramos controls the other half of Pangasinan.

    About ten years ago, one of my employees chartered a Partas bus for our company excursion in La Union. Nagulat ako, first-class ang bus. Airplane-like reclineable seats/beds, carpeted flooring, upholstered sidings, mirror ceiling, crystal chandeliers, clean toilet, “in-flight” movies, snacks, etc. Heyup, daig pa yung mga eroplano. Tinanong ko yung driver, “Ganda ng bus nyo, sinong may-ari?”. “Si Chavit Singson po”, sagot ng driver. The rental cost, though, was very competitive. Siguro pang-maintenance lang kulang pa.

    Kaya naman pala di umaasenso ang yung probinsiya ng tatay ko, pati bus ng Gobernador, malamang yung probinsiya ang gumagastos. Narinig ko later sa testimony ni Atong Ang sa Senado na kay Chavit nga ang bus company.

    Di pa rin inaamin na kanya kahit alam na ng lahat. Wala ring nag-iimbestiga. Sino kaya ang katapat ni Chavit?
